GENERAL TERMS AND CONDITIONS OF SALE<br />

depend<strong>in</strong>g on your reservation and may apply the cancellation<br />

conditions drawn up for <strong>this</strong> event and def<strong>in</strong>ed hereafter as a<br />

consequence. <strong>You</strong>r commitment therefore become f<strong>in</strong>al on<br />

payment of the balance before the 30th or 14th day of your<br />

stay or, <strong>in</strong> the event of non-payment of the balance and no use<br />

of the right to withdraw on your behalf, from the 30th or 14th<br />

day preced<strong>in</strong>g your stay. P&V’s commitment becomes f<strong>in</strong>al<br />

before the 30th or 14th day preced<strong>in</strong>g your stay, from the<br />

send<strong>in</strong>g of your reservation confirmation.<br />

1.4 - Methods of payment<br />

• For all book<strong>in</strong>gs up to 31 days before your holiday, payment<br />

of 100% of the cost of the holiday by any method of payment:<br />

credit card (*), cheque (**), or bank transfer (***)<br />

• For all book<strong>in</strong>gs between 30 and 15 days prior to the holiday,<br />

you may:<br />

- Pay 100% of the cost of your holiday by credit card (*)<br />

- Or pay 25% of the cost of the holiday as a deposit by credit<br />

card (*) and the balance with<strong>in</strong> 5 days by cheque (**) or bank<br />

transfer (***).<br />

For all book<strong>in</strong>gs between 14€ and 8 days prior to your holiday,<br />

you may:<br />

- Pay 100% of the cost of your holiday by credit card (*)<br />

- Or pay 50% of the cost of the holiday as a deposit by credit<br />

card (*) and the balance with<strong>in</strong> 5 days by cheque (**) or bank<br />

transfer (***).<br />

• For all book<strong>in</strong>gs made less than 7 days prior to the beg<strong>in</strong>n<strong>in</strong>g<br />

of the holiday, you must pay 100% of the cost of your<br />

holiday by credit card <strong>only</strong> (*).<br />

<strong>You</strong> may also pay by credit card (*) on our payment website<br />

https://paiement.pierreetvacances.com<br />

N.B.: Persons not resid<strong>in</strong>g <strong>in</strong> France may pay <strong>only</strong> by credit<br />

card, Eurocheques, bank cheque <strong>in</strong> Euros or bank transfer<br />

accompanied by the book<strong>in</strong>g voucher.<br />

<strong>You</strong>r travel documentation<br />

Sent 30 (or 14) days before the start of your holiday on condition<br />

of the settlement of the balance of your holiday, you will<br />

receive travel documentation conta<strong>in</strong><strong>in</strong>g: all the practical<br />

<strong>in</strong>formation required to help you get organised (it<strong>in</strong>erary,<br />

map, address) and the rental contract for your accommodation<br />

and the services booked.<br />

(*) Credit cards accepted: Visa, Eurocard / Mastercard,<br />

American Express, D<strong>in</strong>ers<br />

(**) Cheques and vouchers accepted: bank cheques, holiday<br />

vouchers, gift vouchers (subject to the terms and conditions<br />

to be validated by the salesperson)<br />

ARTICLE 2 - PRICES<br />

2.1 - Accommodation<br />

Our prices <strong>in</strong>clude all taxes and <strong>in</strong>clude the provision of the<br />

accommodation, <strong>in</strong>clud<strong>in</strong>g charges (water, electricity, heat<strong>in</strong>g)<br />

<strong>but</strong> exclud<strong>in</strong>g tourist tax, payable on site, pet supplements,<br />

optional <strong>in</strong>surance premiums and adm<strong>in</strong>istration<br />

charges, payable on book<strong>in</strong>g where applicable.<br />

Note that accommodation is provided for a specific number of<br />

occupants on book<strong>in</strong>g may not be occupied by a larger number<br />

of people.<br />

Note that young children are considered as occupants <strong>in</strong> their<br />

own right. Not all of our balconies, loggias, terraces and<br />

gardens are equipped with tables and chairs.<br />

2.2 - Optional services<br />

Our accommodation rates do not <strong>in</strong>clude optional extra services<br />

on offer <strong>in</strong> the catalogue, on our website or on site.<br />

<strong>You</strong> may be offered special rates depend<strong>in</strong>g on the terms and<br />

conditions and availabilities at the time of book<strong>in</strong>g and the<br />

economic situation at that time. Changes to the economic<br />

situation compared to that at the time of <strong>publication</strong> may<br />

<strong>in</strong>clude the follow<strong>in</strong>g:<br />

- changes <strong>in</strong> the fares themselves (due to fuel prices, extra<br />

costs <strong>in</strong>voiced, etc.);<br />

- the additional extras that P&VCP may <strong>in</strong>voice; <strong>in</strong> the case of<br />

additional commitments dur<strong>in</strong>g the season due to stock <strong>in</strong>itially<br />

offered before your registration runn<strong>in</strong>g out.<br />

2.3 – Snow Guarantee (Mounta<strong>in</strong> sites)<br />

2.3.1 – Eligibility conditions<br />

Our accommodation rates <strong>in</strong>clude a snow guarantee, valid<br />

<strong>only</strong> dur<strong>in</strong>g w<strong>in</strong>ter 2010/11, you can choose to cancel your<br />

holiday book<strong>in</strong>g if the follow<strong>in</strong>g conditions concur:<br />

1) The <strong>in</strong>itial book<strong>in</strong>g must have been made directly with<br />

P&VCP: on the website www.pv-holidays.com, <strong>in</strong> a PIERRE &<br />

VACANCES CENTER PARCS shop, directly at a P&VCP residence,<br />

or at the central book<strong>in</strong>g, and not <strong>in</strong>clud<strong>in</strong>g those not<br />

booked directly with P&VCP, particularly with Tour Operators;<br />

2) The book<strong>in</strong>g must concern a holiday tak<strong>in</strong>g place on a site<br />

with one of the follow<strong>in</strong>g brands: «PIERRE & VACANCES<br />

PREMIUM» or «PIERRE & VACANCES RESORT» or «PIERRE<br />

& VACANCES MONTAGNE» or «MAEVA» <strong>in</strong> the mounta<strong>in</strong>s,<br />

2.3.2 – What the guarantee <strong>in</strong>cludes<br />

Subject to compliance with the conditions set out <strong>in</strong> po<strong>in</strong>t<br />

2.3.1 above, you can send a request for the cancellation of a<br />

holiday <strong>in</strong> the event of lack or excess of snow, when the follow<strong>in</strong>g<br />

three conditions concur:<br />

1) The lack or excess of snow occurs <strong>in</strong> a ski area located<br />

above 1200 metres altitude; and<br />

2) The departure is between the 3rd Saturday <strong>in</strong> December<br />

and the 2nd Saturday <strong>in</strong> April; and<br />

3) The lack or excess of snow entails the closure of over 2/3<br />

of the ski lifts normally <strong>in</strong> service on your holiday site, for at<br />

least 2 consecutive days, with<strong>in</strong> the 5 days preced<strong>in</strong>g your<br />

departure.<br />

2.3.3 – How to make the claim<br />

<strong>You</strong> must <strong>in</strong>form P&VCP of your cancellation, then contact<br />

EUROP ASSISTANCE with<strong>in</strong> five work<strong>in</strong>g days of the event<br />

covered by the guarantee. To do so, you must send EUROP<br />

ASSISTANCE a cancellation declaration (<strong>in</strong>clud<strong>in</strong>g the <strong>in</strong>surance<br />

policy number: 63.112.088.V) by post to EUROP<br />

ASSISTANCE will send you a form to be completed and with<br />

documentary proof of the lack or excess of snow and the orig<strong>in</strong>al<br />

cancellation <strong>in</strong>voice drawn up by P&VCP.<br />

2.3.4 - Amount of refunds<br />

<strong>You</strong> will be refunded the deposit paid or any other sum reta<strong>in</strong>ed<br />

by P&VCP, exclud<strong>in</strong>g the adm<strong>in</strong>istration fees if such were<br />

<strong>in</strong>itially paid. The refund is paid m<strong>in</strong>us the specific deductibles<br />

shown <strong>in</strong> the follow<strong>in</strong>g Guarantee Amount Table. The<br />

guarantee is granted provided that the rental accommodation<br />

is fully vacated. All of the tourist services covered by the<br />

«Snow Guarantee» <strong>in</strong>surance, whether additional or successive,<br />

constitute a s<strong>in</strong>gle holiday for which <strong>only</strong> one date of<br />

departure is taken <strong>in</strong>to account: the date given by P&VCP for<br />

the beg<strong>in</strong>n<strong>in</strong>g of the services <strong>in</strong>sured.<br />

2.4 – Reduction<br />

The reductions mentioned <strong>in</strong> the brochure are <strong>only</strong> applicable<br />

on the accommodation section; any other services are<br />

excluded (restaurants, sport and leisure, etc).<br />

ARTICLE 3 - TOURIST TAX<br />

Tourist tax, collected on behalf of the local authorities, is not<br />

<strong>in</strong>cluded <strong>in</strong> our prices. It is approximately €1 per person per<br />

day and must be paid on site.<br />

ARTICLE 4 - CHANGE / CANCELLATION OF HOLIDAY BY THE<br />

CUSTOMER<br />

4.1 - Changes<br />

4.1.1 – Accommodation<br />

a) For hotels<br />

For any hotel stay of three nights or less, we will endeavour<br />

to accept your requests to change the date, type of accommodation<br />

or holiday venue as far as possible, subject to availability.<br />

These changes may be made at no additional cost. Any<br />

request to reduce the length of your holiday will be deemed<br />

by P&VCP to be a partial cancellation and will be subject to<br />

the cancellation terms referred to <strong>in</strong> 4.2 hereafter.<br />

For any hotel stay of three nights or less, we will also endeavour<br />

to accept your requests to change the date, type of<br />

accommodation or holiday venue as far as possible, subject to<br />

availability. If the value of your book<strong>in</strong>g (exclud<strong>in</strong>g optional<br />

services) after the change is lower than the value of the book<strong>in</strong>g<br />

before the change, we will reta<strong>in</strong> €10 as a charge for <strong>this</strong><br />

change. Any request to reduce the holiday length will be deemed<br />

by P&VCP to be a partial cancellation and will be subject<br />

to the cancellation terms referred to <strong>in</strong> 4.2 hereafter.<br />

b) For tourist residences<br />

• Change of type<br />

We will endeavour to accept requests to change the type of<br />

apartment as far as possible, subject to availability. If the<br />

value of the book<strong>in</strong>g (exclud<strong>in</strong>g optional services) after the<br />

change is lower than the value of the book<strong>in</strong>g before the<br />

change, we will reta<strong>in</strong> €10 as a charge for <strong>this</strong> change.<br />

• Change of holiday date or place<br />

We will endeavour to accept requests to change the date or<br />

holiday venue as far as possible, subject to availability.<br />

However, please note that <strong>this</strong> type of change causes variable<br />

costs for P&VCP depend<strong>in</strong>g on the date on which you make<br />

your request.<br />

Therefore for all changes of holiday date or place, we will<br />

apply the follow<strong>in</strong>g charges:<br />

- if your request for change is sent at least 30 days before<br />

your arrival and if the amount of the modified book<strong>in</strong>g is less<br />

than the amount of the <strong>in</strong>itial book<strong>in</strong>g: €10<br />

- if your request to change is made between 30 and 15 days<br />

prior to your arrival: 15% *<br />

- if your request to change is made between 14 and 8 days<br />

prior to your arrival: 30% *<br />

- if your request to change is made between 7 and 4 days prior<br />

to your arrival: 50% *<br />

* of the total cost of the accommodation.<br />

No request to change will be taken <strong>in</strong>to account if it is<br />

received by P&VCP three days or less prior to your arrival.<br />

N.B.:<br />

- Any request to extend the length of your holiday will be<br />

accepted by P&VCP without any additional charge<br />

- Any request to reduce the length of your holiday will be<br />

deemed by P&VCP to be a partial cancellation and will be<br />

subject to the cancellation terms referred to <strong>in</strong> 4.2 hereafter.<br />

4.1.2 – Optional services<br />

We will endeavour to accept requests to change the optional<br />

services as far as possible, subject to availability. If the value<br />

of the optional service after the change is lower than the<br />

value of the optional service before the change, we will reta<strong>in</strong><br />

€10 as a charge for <strong>this</strong> change.<br />

4.2 – Cancellation (total or partial)<br />

In the event of cancellation, please notify us either by post to<br />

the follow<strong>in</strong>g address PIERRE ET VACANCES CENTER PARCS<br />

service annulations BP291 75921 PARIS CEDEX 19, or by fax<br />

33 ( 01) 58 21 50 97 for the attention of «Service Annulations»,<br />

or by e-mail to the follow<strong>in</strong>g address: annulation.adv@pierrevacances.fr.<br />

The date of cancellation is determ<strong>in</strong>ed by the<br />

date of receipt of notification.<br />

4.2.1 - Accommodation<br />

a) Holiday <strong>in</strong> a Residence<br />

Whatever the date the book<strong>in</strong>g is cancelled, we will reta<strong>in</strong> the<br />

adm<strong>in</strong>istration charges, if applicable, <strong>in</strong>itially paid and any<br />

<strong>in</strong>surance premiums taken out.<br />

From the 30th day prior to the holiday, we will reta<strong>in</strong> the follow<strong>in</strong>g<br />

<strong>in</strong>demnities depend<strong>in</strong>g on your holiday package:<br />

- If the request to change is made between 30 and 15 days<br />

prior to your arrival: 25% *<br />

- If the request to change is made between 14 and 8 days prior<br />

to your arrival: 50% *<br />

- If the cancellation request is made seven days or less before<br />

your arrival: 100% *<br />

* of the total cost of the accommodation.<br />

b) Holiday <strong>in</strong> a hotel or apart-hotel<br />

Whatever the date of cancell<strong>in</strong>g the book<strong>in</strong>g, we will reta<strong>in</strong><br />

the amount of any <strong>in</strong>surance premiums taken out.<br />

Furthermore, for any stay greater than three nights, if you<br />

<strong>in</strong>form us after the 14th day preced<strong>in</strong>g your arrival and before<br />

6PM the day before your arrival, we will reta<strong>in</strong> the follow<strong>in</strong>g<br />

compensation depend<strong>in</strong>g on the terms of your holiday:<br />

4 to 6 nights, payment for one night*,<br />

7 nights or more, payment for two nights*,<br />

*the cost of the “night” corresponds to the total price of the<br />

holiday booked divided by its number of nights.<br />

Half-board or full board holiday:<br />

The charges will be the same as above.<br />

4.2.2 – Optional services<br />

For any additional services <strong>in</strong>voiced (activities, meals, etc.)<br />

cancelled after the 30th day (for a holiday <strong>in</strong> a residence) or<br />

14th day (for a holiday <strong>in</strong> a hotel or hotel apartment) preced<strong>in</strong>g<br />

your holiday, we will reta<strong>in</strong> €10 per cancelled service<br />

for cancellation costs.<br />

Special case (1): for any cancellation of an ESF ski lesson<br />

between four days before your arrival and the date of arrival,<br />

we will reta<strong>in</strong> 100% of the cost of the service.<br />

Special case (2): the entrance ticket for Parc Disneyland®<br />

and Parc Walt Disney Studios® is non-refundable.<br />
