GENERAL TERMS AND CONDITIONS OF SALE<br />
4.3 - No-show at holiday venue<br />
If you do not turn up at your holiday venue, we will reta<strong>in</strong> the<br />
adm<strong>in</strong>istration charge <strong>in</strong>itially paid and the premiums for any<br />
<strong>in</strong>surance policies taken out plus the follow<strong>in</strong>g:<br />
4.3.1 - Accommodation<br />
a) Holiday <strong>in</strong> a Residence<br />
• 100% of the total value of the holiday.<br />
b) Holiday <strong>in</strong> a Hotel<br />
• Accommodation <strong>only</strong>:<br />
1 to 3 nights: payment for one night*,<br />
4 to 6 nights: payment for two nights*,<br />
7 nights or more = payment for two nights*,<br />
*the cost of the “night” corresponds to the total price of the<br />
holiday booked divided by its number of nights.<br />
• Half-board or full board holiday:<br />
The charges will be the same as above.<br />
4.3.2 – Optional services<br />
No refund is payable for any unused and <strong>in</strong>voiced services at<br />
the holiday venue. We advise you to take out one of the <strong>in</strong>surance<br />
deals with Europ Assistance (see Article 15 - Insurance).<br />
The premium must be paid <strong>in</strong> full at the time of book<strong>in</strong>g and<br />
is not refundable <strong>in</strong> any circumstances.<br />
ARTICLE 5 - ARRIVAL AND DEPARTURE<br />
The P&VCP group rem<strong>in</strong>ds you that <strong>in</strong> the event of full<br />
payment not be<strong>in</strong>g received (despite rem<strong>in</strong>ders be<strong>in</strong>g sent)<br />
that the accommodation keys will not be made available to<br />
you. If you <strong>cannot</strong> arrive at the specified time due to a major<br />
difficulty, it is essential that you <strong>in</strong>form the residence so<br />
that you can obta<strong>in</strong> the access codes. They will then make<br />
arrangements directly with you so that you can obta<strong>in</strong> the<br />
keys when you arrive.<br />
- For sites labelled «PIERRE & VACANCES» and «PIERRE &<br />
VACANCES RESORTS»:<br />
Keys are issued from 5PM on the day of the arrival provided<br />
the said payment has been made. These keys must be handed<br />
<strong>in</strong> by 10AM on the day of the departure (Saturday <strong>in</strong> most<br />
cases). For short stays, keys are available from 2pm and must<br />
be returned by 12 noon on the day of departure.<br />
- For sites labelled «PIERRE & VACANCES PREMIUM»:<br />
For any stay of a week (seven nights) or more, key handover<br />
takes place from 5PM on the day of arrival (Saturday <strong>in</strong> most<br />
cases) subject to payment of the said sum. Keys are to be<br />
returned before 10AM on the day of departure. After <strong>this</strong> time<br />
you will be charged for an extra night.<br />
For short stays, keys are available from 3PM subject to payment<br />
of the said sum and must be returned by 12 noon on the<br />
day of departure. After <strong>this</strong> time, you will be charged for an<br />
extra night.<br />
- For sites labelled «MAEVA»:<br />
The accommodation for your stay will be <strong>read</strong>y for you at 5pm:<br />
you may present yourself at reception prior to <strong>this</strong> time to<br />
carry out registration formalities. Keys are to be returned by<br />
10am on the day of departure. For short stays, keys are<br />
handed over from 11am subject to the aforementioned payment,<br />
and must be returned by 6pm on the date of departure,<br />
except for the follow<strong>in</strong>g «Partner» residences: «Anglet Mer &<br />
Golf» and «Arcachon Le Trianon» (arrival from 5pm and<br />
departure by 10am), as well as the residences «Biarritz<br />
Eugénie», «Bidart Llbarritz», «Urrugne Fort Socoa»,<br />
«Ciboure Soko Eder», «Hendaye Sokoburu» and «Argelèssur-Mer<br />
Port Argelès» (arrival from 3pm and departure by 12<br />
noon).<br />
ARTICLE 6 - DEPOSIT<br />
<strong>You</strong> will be asked for a deposit of €200 (€500 for Pierre &<br />
Vacances premium) per apartment, room, villa or house on<br />
arrival. This will be returned at the end of your holiday after<br />
you have paid for any additional services used on site<br />
(telephone, car park, etc.) With deductions made for any<br />
damages, unpaid services and loss of keys for apartments,<br />
rooms, villas, or houses issued on arrival. <strong>You</strong> will not be<br />
asked for a deposit for Adagio City Aparthotels.<br />
ARTICLE 7 - PETS<br />
Pets are allowed <strong>in</strong> most of our residences, on presentation<br />
of a rabies vacc<strong>in</strong>ation certificate, subject to payment on site<br />
of the follow<strong>in</strong>g charges:<br />
• Particular conditions for the label «PIERRE & VACANCES<br />
PREMIUM»:<br />
For stays <strong>in</strong> hotels, €11 per pet per night<br />
For Tourist Residences, the follow<strong>in</strong>g fixed sum amounts are<br />
due on site:<br />
for holidays of 7 nights or more, €49 per pet per holiday<br />
For holidays of less than 7 nights, €9 per pet per night<br />
• Particular conditions for the labels «PIERRE & VACANCES»<br />
and «PIERRE & VACANCES RESORTS»:<br />
For holidays of 7 nights or more, €49 per pet per holiday<br />
For holidays of less than 7 nights, €8 per pet per night<br />
For stays <strong>in</strong> hotels, €11 per pet per night<br />
Pets are not allowed <strong>in</strong> residences <strong>in</strong> Spa<strong>in</strong> or Italy.<br />
• Particular conditions for the label «MAEVA»:<br />
Fixed fee of €48 (depend<strong>in</strong>g on the Residences) per pet, per<br />
week or holiday, to be paid on book<strong>in</strong>g or on site on your<br />
arrival (the residences concerned are listed <strong>in</strong> <strong>this</strong> catalogue).<br />
They are permitted, on a lead, <strong>in</strong> the communal sections, <strong>but</strong><br />
are forbidden around swimm<strong>in</strong>g pools. We regret to <strong>in</strong>form<br />
you that animals are not accepted <strong>in</strong> our hotels, except <strong>in</strong><br />
exceptional circumstances (please ask us)<br />
ARTICLE 8 – ESTABLISHMENT REGULATIONS<br />
In order to facilitate the smooth runn<strong>in</strong>g of your holiday, establishment<br />
regulations are posted <strong>in</strong> each apartment, room<br />
and house; please acqua<strong>in</strong>t yourself with them and adhere to<br />
them. Certa<strong>in</strong> precautions can prevent possible problems:<br />
close your picture w<strong>in</strong>dows before leav<strong>in</strong>g your apartment,<br />
room or house and lock the door. We rem<strong>in</strong>d you that P&VCP<br />
<strong>cannot</strong> be held liable for the loss of personal belong<strong>in</strong>gs left<br />
<strong>in</strong> your apartment, room or house when you vacate them.<br />
ARTICLE 9 - FORMALITIES FOR TRAVEL AND HOLIDAYS<br />
ABROAD<br />
For these holidays <strong>in</strong>clud<strong>in</strong>g travel, each passenger must<br />
have a currently valid identity card or passport. We advise you<br />
to check the validity of the identity cards or passports of all<br />
members of the party (adults/children/<strong>in</strong>fants), your <strong>in</strong>surance,<br />
and for holidays abroad, currency exchange regulations<br />
and any necessary vacc<strong>in</strong>ations. We will not be held<br />
responsible for anyone not comply<strong>in</strong>g with the rules detailed<br />
<strong>in</strong> the brochure or the travel documents.<br />
- M<strong>in</strong>ors travell<strong>in</strong>g alone: <strong>in</strong> order to travel abroad, <strong>in</strong> addition<br />
to their valid identity card or passport, m<strong>in</strong>ors must have an<br />
official authorisation to leave the country signed by their<br />
parents or guardians.<br />
- Foreign nationals or holders of travel documents: you must<br />
enquire with the consulates of each country about any necessary<br />
visas. The occupancy of accommodation will depend on<br />
flight times serv<strong>in</strong>g airports close to our Residences.<br />
ARTICLE 10 - EARLY DEPARTURE / EARLY END TO SPORTS<br />
OR LEISURE ACTIVITIES<br />
Early departure or early end to sports or leisure activities<br />
booked with P&VCP does not give any entitlement to reimbursement<br />
from the latter. However, depend<strong>in</strong>g on the package<br />
available with the Europ Assistance policy (see article 15),<br />
depend<strong>in</strong>g on the reason for the departure from the site or<br />
term<strong>in</strong>ation of the activity be<strong>in</strong>g duly proven and fall<strong>in</strong>g with<strong>in</strong><br />
the terms of the policy, you may benefit from reimbursement<br />
on a pro rata basis, from the date of your departure from the<br />
site or the day of term<strong>in</strong>ation of the activity. With respect to<br />
early departure, you may benefit from pro rata reimbursement<br />
of the holiday <strong>only</strong> if you have fully vacated your apartment<br />
or room.<br />
ARTICLE 11 - CHANGES TO OUR PROGRAMMES<br />
If circumstances compel us, and <strong>only</strong> <strong>in</strong> circumstances of<br />
force majeure, outside our control, we may be obliged to<br />
change all or some of our programmes (total or partial closure<br />
of a site or a communal facility such as a swimm<strong>in</strong>g pool,<br />
restaurant, etc.).<br />
ARTICLE 12 - AFTER SALES SERVICE<br />
Our on-site teams are at your disposal dur<strong>in</strong>g your holiday to<br />
respond to your compla<strong>in</strong>ts, resolve any problems and enable<br />
you to enjoy your holiday to the full. Simply contact them with<br />
any requests you have. After your holiday, any claim should be<br />
made:<br />
- by registered letter with acknowledgement of receipt, sent<br />
to Groupe Pierre & Vacances Center Parcs - Service Relations<br />
Clientèle - 11, rue de Cambrai - 75947 Paris Cedex 19 France,<br />
or<br />
- by e-mail to: relations.client@pierre-vacances.fr<br />
with<strong>in</strong> two months of the end of your holiday so that we can<br />
deal with it as quickly as possible. We draw your attention to<br />
the fact that the longer you take to <strong>in</strong>form us of your claim, the<br />
more difficult it becomes to deal with it <strong>in</strong> your best <strong>in</strong>terests.<br />
In your letter, please specify the name of the person who booked<br />
the holiday, the book<strong>in</strong>g number, the place and dates of<br />
your holiday and the type of apartment or room booked <strong>in</strong> order<br />
to facilitate the process<strong>in</strong>g of your claim. Please also enclose<br />
all documentary evidence to enable us to process your claim as<br />
quickly as possible: certificate issued by the site and/or personal<br />
documents (certificate of non-use of services, certificate of<br />
premature departure, hospitalisation report, etc.).<br />
ARTICLE 13 - CATALOGUE<br />
Book<strong>in</strong>g one of our holidays implies acceptance of our particular<br />
terms and conditions of sale. General descriptions and<br />
photos of apartments are provided for <strong>in</strong>formational purposes<br />
<strong>only</strong>. Given the diversity of the P&VCP range, there are differences<br />
<strong>in</strong> the layout and decoration of certa<strong>in</strong> apartments and<br />
rooms. We present general descriptions of our apartments,<br />
sample layout plans, photographs and virtual visits <strong>in</strong> our<br />
catalogue and on our website: these are supplied for <strong>in</strong>formational<br />
purposes <strong>only</strong>. For further details, please do not hesitate<br />
to ask your travel agent. We would also rem<strong>in</strong>d you that<br />
any request for a specific apartment location or orientation is<br />
an additional service and does not constitute a contractual<br />
guarantee. All <strong>in</strong>formation on sport<strong>in</strong>g and leisure activities<br />
at the resorts and surround<strong>in</strong>g area is supplied to us by tourist<br />
offices and is passed on to you by way of <strong>in</strong>dication. We<br />
<strong>cannot</strong> be held liable if any of these facilities are no longer<br />
available at the time of your holiday. For further <strong>in</strong>formation<br />
on the facilities of the resorts, please contact their respective<br />
tourist offices directly. As our catalogue is pr<strong>in</strong>ted well <strong>in</strong><br />
advance, please ask your travel agent about open<strong>in</strong>g dates,<br />
sports facilities (type and quantity), activities and services<br />
offered by the site which determ<strong>in</strong>e your choice of site.<br />
Furthermore, we <strong>cannot</strong> be held responsible for works<br />
undertaken by <strong>in</strong>dividuals or local authorities which might<br />
<strong>in</strong>convenience our customers <strong>in</strong> the resorts or towns.<br />
ARTICLE 14 – RESPONSIBILITY - LIABILITY<br />
- We would draw to your attention the fact that rent<strong>in</strong>g a<br />
holiday apartment does not fall with<strong>in</strong> the framework of the<br />
hoteliers’ liability. Consequently, P&VCP <strong>cannot</strong> be held liable<br />
<strong>in</strong> the event of the loss or theft of or damage to personal<br />
effects <strong>in</strong> our Residences, apartments, car parks or communal<br />
areas (bicycle shed, etc.).<br />
- Please note that the liability of hotel operators for the rental<br />
of accommodation <strong>in</strong> the hotels is governed by the French<br />
Civil Code. The hotel operator can therefore be held liable<br />
<strong>only</strong> with<strong>in</strong> the legal limits <strong>in</strong> the event of loss, theft or<br />
damage to personal belong<strong>in</strong>gs <strong>in</strong> their rooms, car parks or<br />
communal facilities (ski sheds, cycle garages, etc).<br />
- Provision for amounts due to P&VCP is not <strong>in</strong>cluded <strong>in</strong> the<br />
field of application of the hotel statute (article 2272 of the Civil<br />
Code). In exception to Article 2244 of the Civil Code, the send<strong>in</strong>g<br />
of a registered letter by P&VCP to any client-debtor<br />
<strong>in</strong>terrupts the statute applicable <strong>in</strong> such a case.<br />
ARTICLE 15 – INSURANCE<br />
We have taken out a policy with Europ Assistance, no. 53 789<br />
536 789 536 M: <strong>this</strong> policy comprises a number of options.<br />
This <strong>in</strong>surance takes effect from the day of your reservation<br />
or the follow<strong>in</strong>g day at midday after payment of the premium<br />
if subscription takes place after reservation. It must be taken<br />
out before the beg<strong>in</strong>n<strong>in</strong>g of cancellation costs.<br />
N.B.: Under the terms of <strong>this</strong> contract, legal or tax residents<br />
of the European Union, Andorra, Gibraltar, Liechtenste<strong>in</strong>,<br />
Monaco, Norway, San Mar<strong>in</strong>o, and Switzerland are <strong>in</strong>sured.<br />
ARTICLE 16<br />
In order to improve the quality of our customer reception<br />
services, please note that your telephone calls with our<br />
employees may be recorded.<br />
Prices: the conversion from Euros to British Pounds is based on the exchange rate of £ 0,8185 for<br />
€1 given by the European Central Bank on the 24/06/10. Prices have been rounded to the nearest pound.<br />
