In January 1991, the former direc<str<strong>on</strong>g>to</str<strong>on</strong>g>r of the Divisi<strong>on</strong> of<br />
Occupati<strong>on</strong>al Licensing asked for our advice <strong>on</strong> two questi<strong>on</strong>s<br />
posed by the State Medical Board (board). Please excuse the<br />
delay in resp<strong>on</strong>ding <str<strong>on</strong>g>to</str<strong>on</strong>g> these requests. We understand that the<br />
first questi<strong>on</strong> c<strong>on</strong>cerns the scope of a hospital's <str<strong>on</strong>g>duty</str<strong>on</strong>g> <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>report</str<strong>on</strong>g><br />
a restricti<strong>on</strong> <strong>on</strong> a physician's hospital <strong>privileges</strong> as set out in<br />
AS 08.64.336(b). We understand that the sec<strong>on</strong>d questi<strong>on</strong> c<strong>on</strong>cerns<br />
the board's regula<str<strong>on</strong>g>to</str<strong>on</strong>g>ry authority over a pers<strong>on</strong> licensed as both a<br />
mobile intensive care paramedic and an emergency medical<br />
technician.<br />
DISCUSSION<br />
Questi<strong>on</strong> One<br />
The answer <str<strong>on</strong>g>to</str<strong>on</strong>g> questi<strong>on</strong> <strong>on</strong>e is ascertainable from the<br />
detailed text of AS 08.64.336(b). 1 The text of the statute<br />
1<br />
The current versi<strong>on</strong> of AS 08.64.336(b) was enacted in sec. 16,<br />
ch. 87, SLA 1987 (SCSCSHB 70 (Jud am S)); it provides:<br />
(b) A hospital that revokes, suspends,<br />
c<strong>on</strong>diti<strong>on</strong>s, restricts, or refuses <str<strong>on</strong>g>to</str<strong>on</strong>g> grant<br />
hospital <strong>privileges</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g>, or imposes a c<strong>on</strong>sultati<strong>on</strong><br />
requirement <strong>on</strong>, a pers<strong>on</strong> licensed <str<strong>on</strong>g>to</str<strong>on</strong>g> practice<br />
medicine or osteopathy in the state shall <str<strong>on</strong>g>report</str<strong>on</strong>g><br />
<str<strong>on</strong>g>to</str<strong>on</strong>g> the board the name and address of the pers<strong>on</strong><br />
and the reas<strong>on</strong>s for the acti<strong>on</strong> within seven<br />
working days after the acti<strong>on</strong> is taken. A<br />
hospital shall also <str<strong>on</strong>g>report</str<strong>on</strong>g> <str<strong>on</strong>g>to</str<strong>on</strong>g> the board the name<br />
and address of a pers<strong>on</strong> licensed <str<strong>on</strong>g>to</str<strong>on</strong>g> practice<br />
medicine or osteopathy in the state if the pers<strong>on</strong><br />
resigns hospital staff <strong>privileges</strong> while under<br />
investigati<strong>on</strong> by the hospital or a committee of<br />
the hospital and the investigati<strong>on</strong> could result in

imposes comprehensive requirements <strong>on</strong> hospitals <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>report</str<strong>on</strong>g><br />
<str<strong>on</strong>g>restricti<strong>on</strong>s</str<strong>on</strong>g> <strong>on</strong> <strong>physicians'</strong> <strong>privileges</strong>. In particular, the law<br />
provides:<br />
A <str<strong>on</strong>g>report</str<strong>on</strong>g> is not required if the sole reas<strong>on</strong> for<br />
the acti<strong>on</strong> is the pers<strong>on</strong>'s failure <str<strong>on</strong>g>to</str<strong>on</strong>g> complete<br />
hospital records in a timely manner or <str<strong>on</strong>g>to</str<strong>on</strong>g> attend<br />
staff or committee meetings.<br />
This passage sets out the <strong>on</strong>ly two excepti<strong>on</strong>s <str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />
hospital's obligati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>report</str<strong>on</strong>g> hospital-initiated <str<strong>on</strong>g>restricti<strong>on</strong>s</str<strong>on</strong>g><br />
<strong>on</strong> a physician's <strong>privileges</strong>. A hospital must <str<strong>on</strong>g>report</str<strong>on</strong>g> a hospitalinitiated<br />
restricti<strong>on</strong> unless the restricti<strong>on</strong> falls within the two<br />
specified excepti<strong>on</strong>s.<br />
You inquired whether a hospital must <str<strong>on</strong>g>report</str<strong>on</strong>g> a<br />
voluntary, agreed-up<strong>on</strong> restricti<strong>on</strong>. AS 08.64.336(b) provides<br />
that a hospital-initiated restricti<strong>on</strong> must be <str<strong>on</strong>g>report</str<strong>on</strong>g>ed even if<br />
the restricti<strong>on</strong> is voluntary and by agreement between the<br />
physician and the hospital. You also inquired whether<br />
<str<strong>on</strong>g>restricti<strong>on</strong>s</str<strong>on</strong>g> <strong>on</strong> procedural and admitting <strong>privileges</strong> should be<br />
treated differently. 2 There is no indicati<strong>on</strong> in the statute<br />

the revocati<strong>on</strong>, suspensi<strong>on</strong>, c<strong>on</strong>diti<strong>on</strong>ing, or<br />
restricting of, or the refusal <str<strong>on</strong>g>to</str<strong>on</strong>g> grant, hospital<br />
<strong>privileges</strong>, or in the impositi<strong>on</strong> of a c<strong>on</strong>sultati<strong>on</strong><br />
requirement. A <str<strong>on</strong>g>report</str<strong>on</strong>g> is required under this<br />
subsecti<strong>on</strong> regardless of whether the pers<strong>on</strong><br />
voluntarily agrees <str<strong>on</strong>g>to</str<strong>on</strong>g> the acti<strong>on</strong> taken by the<br />
hospital. A <str<strong>on</strong>g>report</str<strong>on</strong>g> is not required if the sole<br />
reas<strong>on</strong> for the acti<strong>on</strong> is the pers<strong>on</strong>'s failure <str<strong>on</strong>g>to</str<strong>on</strong>g><br />
complete hospital records in a timely manner or <str<strong>on</strong>g>to</str<strong>on</strong>g><br />
attend staff or committee meetings. In this<br />
subsecti<strong>on</strong> "c<strong>on</strong>sultati<strong>on</strong> requirement" means a<br />
restricti<strong>on</strong> placed <strong>on</strong> a pers<strong>on</strong>'s existing hospital<br />
<strong>privileges</strong> requiring c<strong>on</strong>sultati<strong>on</strong> with a<br />
designated physician or group of physicians in<br />
order <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>tinue <str<strong>on</strong>g>to</str<strong>on</strong>g> exercise the hospital<br />
<strong>privileges</strong>.<br />

We understand that "procedural" and "admitting" are medical<br />
terms of art in this c<strong>on</strong>text. "Procedural <strong>privileges</strong>" c<strong>on</strong>cern<br />
specific areas of practice such as obstetrics or surgery.<br />
"Admitting <strong>privileges</strong>" c<strong>on</strong>cern the physician's ability <str<strong>on</strong>g>to</str<strong>on</strong>g> admit

that these <str<strong>on</strong>g>restricti<strong>on</strong>s</str<strong>on</strong>g> should be treated differently; thus, we<br />
think a hospital is required <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>report</str<strong>on</strong>g> a hospital-initiated<br />
restricti<strong>on</strong> <strong>on</strong> either of these types of <strong>privileges</strong>.<br />
In additi<strong>on</strong>, AS 08.64.336(b) also requires a hospital<br />
<str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>report</str<strong>on</strong>g> a physician-initiated restricti<strong>on</strong> as follows:<br />
A hospital shall also <str<strong>on</strong>g>report</str<strong>on</strong>g> <str<strong>on</strong>g>to</str<strong>on</strong>g> the board . . . if<br />
the pers<strong>on</strong> resigns hospital staff <strong>privileges</strong> while<br />
under investigati<strong>on</strong> by the hospital . . . and the<br />
investigati<strong>on</strong> could result in the revocati<strong>on</strong>,<br />
suspensi<strong>on</strong>, c<strong>on</strong>diti<strong>on</strong>ing, or restricting of, or<br />
the refusal <str<strong>on</strong>g>to</str<strong>on</strong>g> grant, hospital <strong>privileges</strong>, or in<br />
the impositi<strong>on</strong> of a c<strong>on</strong>sultati<strong>on</strong> requirement.<br />
If a physician independently decides <str<strong>on</strong>g>to</str<strong>on</strong>g> relinquish a hospital<br />
staff privilege outside of the circumstances set forth above, the<br />
hospital is not required <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>report</str<strong>on</strong>g>.<br />
The applicable rule of statu<str<strong>on</strong>g>to</str<strong>on</strong>g>ry c<strong>on</strong>structi<strong>on</strong> followed<br />
in <strong>Alaska</strong> provides that where a statute is clear <strong>on</strong> its face the<br />
court will not go bey<strong>on</strong>d the text of the statute <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>sider<br />
legislative his<str<strong>on</strong>g>to</str<strong>on</strong>g>ry and determine the legislative intent. Lake<br />
v. C<strong>on</strong>structi<strong>on</strong> Machinery, Inc. 787 P.2d 1027, 1030 (<strong>Alaska</strong><br />
1990); State v. City of Anchorage, 513 P.2d 1104, 1109 (<strong>Alaska</strong><br />
1973). In any event, we have reviewed the legislative his<str<strong>on</strong>g>to</str<strong>on</strong>g>ry<br />
of AS 08.64.336(b), and this his<str<strong>on</strong>g>to</str<strong>on</strong>g>ry c<strong>on</strong>firms the language of the<br />
statute. 3 That the legislature intended <str<strong>on</strong>g>to</str<strong>on</strong>g> broaden hospitals'<br />
<str<strong>on</strong>g>report</str<strong>on</strong>g>ing obligati<strong>on</strong>s is further supported by the repeal and<br />
reenactment of AS 08.64.336(b) in 1987. That subsecti<strong>on</strong>, as it<br />
read before 1987, required hospitals <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>report</str<strong>on</strong>g> <strong>on</strong>ly in cases<br />
where the hospital restricted the physician because the physician<br />
posed a danger <str<strong>on</strong>g>to</str<strong>on</strong>g> the public. It was replaced in 1987 with the<br />
current language and the "danger <str<strong>on</strong>g>to</str<strong>on</strong>g> the public" limitati<strong>on</strong> was<br />

This his<str<strong>on</strong>g>to</str<strong>on</strong>g>ry dem<strong>on</strong>strates that the legislature intended that<br />

dropped. 4 We believe the legislature intended that hospitals<br />
<str<strong>on</strong>g>report</str<strong>on</strong>g> nearly all <str<strong>on</strong>g>restricti<strong>on</strong>s</str<strong>on</strong>g> and that the board screen these<br />
<str<strong>on</strong>g>report</str<strong>on</strong>g>s <str<strong>on</strong>g>to</str<strong>on</strong>g> determine if the restricti<strong>on</strong> warrants acti<strong>on</strong>, such as<br />
a disciplinary acti<strong>on</strong> against a physician.<br />
Questi<strong>on</strong> Two<br />
The board would also like <str<strong>on</strong>g>to</str<strong>on</strong>g> know which set of<br />
regulati<strong>on</strong>s would take precedence if a pers<strong>on</strong> is licensed as both<br />
a mobile intensive care paramedic (paramedic) and an emergency<br />
medical technician III (EMT III), in the event of a c<strong>on</strong>flict<br />
between the paramedic regulati<strong>on</strong>s and the EMT III regulati<strong>on</strong>s?<br />
The Department of Health and Social Services (DHSS) regulates<br />
EMTs. The board regulates paramedics. We believe that there is<br />
no c<strong>on</strong>flict in this situati<strong>on</strong> and that there is no need <str<strong>on</strong>g>to</str<strong>on</strong>g><br />
determine which set of regulati<strong>on</strong>s takes precedence over the<br />
other.<br />
A pers<strong>on</strong> licensed as both an EMT III and a paramedic<br />
(dual licensee) may act within the scope of authorized practice<br />
for both of these occupati<strong>on</strong>s. The primary goal of licensure in<br />
the health care professi<strong>on</strong>s is protecti<strong>on</strong> of the public health<br />
and safety. Clearly, this interest is served when a pers<strong>on</strong><br />
secures both licenses. Although the scope of the two licenses<br />
may sometimes overlap, the two licensing authorities, DHSS and<br />
the board, are each independently resp<strong>on</strong>sible for regulati<strong>on</strong> of a<br />
dual licensee. The board's and DHSS's authority do not overlap<br />
and each entity has independent disciplinary authority. There<br />
may be instances in which <strong>on</strong>e or both authorities could<br />
discipline a dual licensee. Although the board and DHSS have<br />
independent powers it is a good idea <str<strong>on</strong>g>to</str<strong>on</strong>g> communicate and cooperate<br />
<strong>on</strong> regulati<strong>on</strong> of dual licensees.<br />
