Form 36 must be given to the purchaser prior to signing the contract or tenant be<strong>for</strong>e entering into<br />

an accommodation agreement.<br />

3.6 What is the <strong>pool</strong> safety st<strong>and</strong>ard<br />

The <strong>pool</strong> safety st<strong>and</strong>ard is the minimum requirements that a swimming <strong>pool</strong> barrier must meet to<br />

comply with Queensl<strong>and</strong>’s <strong>pool</strong> safety laws. In Queensl<strong>and</strong> the <strong>pool</strong> safety st<strong>and</strong>ard is the<br />

QDC 3.4 <strong>and</strong> the Australian St<strong>and</strong>ard (AS) 1926–2007 Parts 1 <strong>and</strong> 2 as modified by the QDC.<br />

Please note that later versions <strong>of</strong> the Australian St<strong>and</strong>ard do not apply in Queensl<strong>and</strong> unless they<br />

are adopted by a new version <strong>of</strong> the QDC.<br />

A <strong>pool</strong> owner’s <strong>pool</strong> fence must comply with the <strong>pool</strong> safety st<strong>and</strong>ard by 30 November 2015 or<br />

earlier if they sell or lease their <strong>property</strong>. The current <strong>pool</strong> safety st<strong>and</strong>ard replaces all the <strong>pool</strong><br />

safety st<strong>and</strong>ards that previously applied to swimming <strong>pool</strong>s.<br />

Appendix A <strong>of</strong> these guidelines provides some basic in<strong>for</strong>mation about the <strong>pool</strong> safety st<strong>and</strong>ard.<br />

3.7 Legislation<br />

The principal legislation regulating swimming <strong>pool</strong> safety in Queensl<strong>and</strong> is the BA. The BA<br />

contains provisions about when a barrier is required <strong>and</strong> refers to subordinate legislation <strong>for</strong> more<br />

technical requirements.<br />

These guidelines should be read in conjunction with the BA, BR, QDC 3.4, AS 1926−2007 Parts 1<br />

<strong>and</strong> 2 <strong>and</strong> other relevant legislation <strong>and</strong> guidelines.<br />

4 Sale <strong>and</strong> lease compliance system<br />

Under the <strong>pool</strong> safety laws, <strong>pool</strong> <strong>owners</strong> have until 30 November 2015 to meet the <strong>pool</strong> safety<br />

st<strong>and</strong>ard unless they sell or lease their <strong>property</strong>. Where a <strong>property</strong> is sold or leased the <strong>pool</strong> barrier<br />

will need to comply with the requirements as explained in sections 4.1–4.4 below.<br />

4.1 Sale <strong>of</strong> a <strong>property</strong> with a non-shared <strong>pool</strong><br />

Since 1 December 2010 the <strong>pool</strong> safety laws have required that a valid <strong>pool</strong> safety certificate be<br />

obtained if a <strong>property</strong> with a regulated <strong>pool</strong> is sold. To ensure this occurs the following obligations<br />

have been placed on the seller <strong>of</strong> the <strong>property</strong>.<br />

Be<strong>for</strong>e entering into a contract<br />

A seller must either:<br />

• give the purchaser a <strong>pool</strong> safety certificate or<br />

• give the purchaser a Form 36. Form 36 advises that the <strong>pool</strong> may not comply with the <strong>pool</strong><br />

safety st<strong>and</strong>ard <strong>and</strong> the steps that must be taken to comply. Form 36 is intended to help<br />

prospective buyers make a more in<strong>for</strong>med decision about purchasing the <strong>property</strong>.<br />
