County, parties of the first part, and Jesse <strong>Turner</strong>, Sr." of Breathitt<br />
County, party of the second part,<br />
Witnesseth: That said parties of the first part, for and in<br />
consideration of the sum of Forty Dollars (40) cash paid in hand,<br />
Three Hundred Dollars to be paid, the receipt of which is hereby<br />
acknowleged, we do hereby sell & convey to the party of the second<br />
part, his heirs and assigns four-fifths of the following described<br />
property, to wit:<br />
A certain tract or parcel of land lying in Breathitt County, on and<br />
being same land inherited by first parties from their deceased father,<br />
James <strong>Turner</strong>, containing 100 acres, more or less.<br />
Beginning at the mouth of the Canebrake; thence running up the<br />
point between the Canebrake to Pigeon Roost. Fork to the dividing<br />
ridge between <strong>Turner</strong>'s Creek and Lick Branch; thence running up<br />
said divide to the top of the point between the Pigeon Roost Fork and<br />
the Duff Fork; thence running down the point with Tolbert <strong>Turner</strong>'s<br />
line to the beginning -,<br />
Th have and to hold the same, together with all the appurtenances<br />
thereunto belonging unto the party of the second part, his heirs and<br />
assigns forever. And the said party of the first parts hereby covenants<br />
with the said party of the second part, that they will warrant the title<br />
to the property hereby conveyed unto the said party of the second part<br />
and his heirs and assigns forever.<br />
A lien is retained upon the property hereby conveyed as security for<br />
the payment of the said unpaid purchase money.<br />
IN TESTIMONY WHEREOF, the party of the first part has<br />
hereunto subscribed their names, the day, and year aforesaid.<br />
