Most provisions of AB 109, the so-called “realignment” bill, became effective on<br />

October 1, 2011. <strong>One</strong> result of this shift of responsibility for punishment and supervision of<br />

most non-violent, non-serious and non-sex felons from state to county government was to<br />

create new categories of punishments. We now have at least the following nine categories:<br />

1. Infractions—fines up to $250. (PC § 19.8)<br />

2. “Wobblettes”—misdemeanors/infractions. Ex: PC § 415 (PC § 19.8)<br />

3. Fine-only misdemeanors. Ex: HS § 11360(b)<br />

4. Fine/jail misdemeanors—$500/6 months, up to $1000/1 year. (PC § 19)<br />

5. <strong>County</strong> jail “wobblers”—misdemeanors/county jail felonies. Ex: PC § 422<br />

6. State prison “wobblers”—misdemeanors/state prison felonies. Ex: VC § 2800.2(a)<br />

7. <strong>County</strong> jail felonies—16/2/3 non-non-nons, plus others. Ex: PC § 192(b)<br />

8. State prison felonies—serious, violent, sex, strikers, mental.<br />

9. Capital crimes—treason and special-circumstances murder.<br />

During the 2010 legislative session, SB 1080 and SB 1115 were enacted, to take<br />

effect on January 1, 2012. Between them, these two bills renumber about 1000 sections of<br />

10 codes, relating to firearms and dangerous weapons. Some of the renumbered sections are<br />

also affected by the sentencing changes from AB 109, meaning double changes in some<br />

cases. Listed on page 2 are selected provisions, showing old and new (2012) section<br />

numbers, <strong>brief</strong> descriptions and classifications. M=Misdemeanor. SPF=State Prison Felony.<br />

SPW=State Prison Wobbler. CJW=<strong>County</strong> Jail Wobbler. DOC=Depending on Circumstances<br />

(priors, injuries, gang activity, etc.). The full text of the 2012 statutes should be consulted<br />

for elements, exceptions, defenses and terms of punishments.
