The <strong>Physician</strong> <strong>Assistant</strong> <strong>Advisory</strong> <strong>Committee</strong> <strong>of</strong> the <strong>Board</strong> <strong>of</strong> Medical Licensure and<br />
Supervision met on April 29, 2010, in accordance with the Open Meeting Act. The meeting was<br />
held at the <strong>of</strong>fice <strong>of</strong> the <strong>Board</strong>, 101 NE 51 st Street, <strong>Oklahoma</strong> City, <strong>Oklahoma</strong>. Members present<br />
were:<br />

The meeting was called to order at 3:00 p.m. The minutes from January 7, 2010,<br />
<strong>Committee</strong> meeting were reviewed. Dr. McNeill moved to approve the minutes as presented.<br />
Ms. Gillispie seconded the motion and the vote was unanimous in the affirmative.<br />
LINDSEY MICHELLE SCHAEFER appeared in support <strong>of</strong> her application for <strong>Physician</strong><br />
<strong>Assistant</strong> licensure. Ms. Schaefer had been asked to appear in response to an arrest for driving<br />
under the influence. Ms. Schaefer testified regarding the incident that led to her arrest. She<br />
stated that it was completely out <strong>of</strong> character for her and would never happen again. A<br />
proposed Agreement for licensure was present that would allow the <strong>Board</strong> to monitor Ms.<br />
Schaefer. Dr. McNeill moved to recommend approval for licensure and warned Ms. Schaefer<br />
that if anything like this happens again, her license would be in serious jeopardy. Ms. Tudor<br />
suggested that, due to Dr. McNeill's connection with Ms. Schaefer through the PA Program that<br />
he abstain from voting. Dr. McNeill withdrew his motion. Dr. Wootan moved to recommend<br />
approval <strong>of</strong> the application under terms <strong>of</strong> the Agreement. Mr. Coody seconded the motion<br />
and all voted in favor <strong>of</strong> the motion with Dr. McNeill abstaining. (See attachment #1)<br />
Staff reported on pending disciplinary cases. The Complaint in the case <strong>of</strong> Betti Wymer,<br />
PA was reviewed. Allegations were that Ms. Wymer employed her supervising physician and
allowed unlicensed personnel to treat her patients when neither a physician nor PA was in the<br />
clinic. The <strong>Committee</strong> was deeply concerned that, if the allegations were true, that Ms. Wymer<br />
was still licensed to practice. Dr. Wootan moved to recommend that the <strong>Board</strong> curtail her<br />
practice until the case is heard. Ms. Gillispie and Mr. Coody seconded the motion and the vote<br />
was unanimous in the affirmative. (See attachment #2)<br />
Staff reported on the Complaint filed against Scott Gregory Bearden, PA for sexual<br />
misconduct. After review <strong>of</strong> the allegations, Dr. McNeill made a motion to recommend that the<br />
<strong>Board</strong> curtail Mr. Bearden's practice until the case is heard. Ms. Gillispie seconded the motion<br />
and the vote was unanimous in the affirmative. (See attachment #3)<br />
The case <strong>of</strong> Kathleen Mason-Morton, PA was reviewed. The allegations were that she<br />
employed her supervising physician in violation <strong>of</strong> <strong>Board</strong> rules. Mr. Kelsey reported that it was<br />
a difficult case because <strong>of</strong> variances in interpretations <strong>of</strong> the law. At staff’s recommendation,<br />
the <strong>Committee</strong> took no <strong>of</strong>ficial stand on the case. (See attachment #4)<br />
Applications for licensure, reinstatement <strong>of</strong> licensure, transfer applications, applications<br />
for additional positions and additional alternate supervisors were reviewed. Dr. McNeill moved<br />
to recommend approval <strong>of</strong> the following applications for <strong>Physician</strong> <strong>Assistant</strong> licensure:<br />

Chuck Stewart, MD with the <strong>Oklahoma</strong> Institute <strong>of</strong> Disaster and Emergency Medicine<br />
appeared with Leslie Ahlborn, PA to discuss <strong>Physician</strong> <strong>Assistant</strong> participation in disaster and<br />
emergency care. The <strong>Committee</strong> reviewed model language from the American Academy <strong>of</strong><br />
<strong>Physician</strong> <strong>Assistant</strong>s on PA participation in disaster and emergency care. Dr. Stewart said he<br />
would like to be Ms. Ahlborn's supervising physician in times <strong>of</strong> disaster but he was concerned<br />
that there was not language in the rules allowing a PA to practice during a disaster. Dr. McNeill<br />
said he had tried on two different occasions to get the AAPA language into law. On the first<br />
attempt, the bill never made it out <strong>of</strong> committee. The second time he was told by a senator<br />
that PAs would be covered by the Good Samaritan law and the law change was not needed. The<br />
<strong>Committee</strong> advised Dr. Stewart that, as Ms. Ahlborn's supervising physician, he could send her<br />
to another location without his presence. As alternate supervising physician, he could provide<br />
supervision at the site <strong>of</strong> a disaster. One thing not covered by the PA law would be out <strong>of</strong> state<br />
PAs who may want to come into the state to <strong>of</strong>fer aid during a disaster; however, they would<br />
be covered by the Good Samaritan law. The <strong>Committee</strong> discussed that the situation could get<br />
messy if a physician is on site and directing the PA in conflict with the PA's supervising<br />
physician. Getting the language into law would clean up a lot <strong>of</strong> the problems. Dr. McNeill<br />
suggested the <strong>Committee</strong> take the language to the state PA Academy who could seek the<br />
<strong>Board</strong>’s support in changing the law. He suggested adding to back <strong>of</strong> Form #5 under practice<br />
setting, any disaster setting. In the case <strong>of</strong> Ms. Ahlborn, she would need to add Dr. Stewart as<br />
an additional position to have him be her supervisor in the setting <strong>of</strong> his role at the University<br />
rather than at the clinic setting.<br />
An inquiry was received from Terry Arnold, PA regarding medications prescribed by the<br />
supervising physician and distributed by the PA when the supervising physician is outside <strong>of</strong> the<br />
<strong>of</strong>fice. The <strong>Committee</strong> discussed different scenarios <strong>of</strong> dispensing, including through selfservice<br />
machines. After discussion, the <strong>Committee</strong> asked Dr. McNeill to respond to Mr. Arnold<br />
that if the physician is not on-site to dispense, the <strong>Physician</strong> <strong>Assistant</strong> may not dispense the<br />
medications.
Mr. Kelsey reported on updates to the web site. PAs can see who is listed as their<br />
supervising physician(s) and soon physicians will be able to look at all the licensees they are<br />
listed as supervising.<br />
There being no further business, the meeting was adjourned. The time was 4:14 p.m.
