Ronald D. Schenck (hereinafter the Accused) and the <strong>Oregon</strong> <strong>State</strong> <strong>Bar</strong><br />

(hereinafter the <strong>Bar</strong>) hereby stipulate to the following matters pursuant to Rule of<br />
.4<br />
Procedure 3.6k).<br />
The <strong>Oregon</strong> <strong>State</strong> <strong>Bar</strong> was created and exists by virtue of the laws of the<br />
<strong>State</strong> of <strong>Oregon</strong> and is, and at all times mentioned herein was, authorized to carry<br />
out the provisions of ORS Chapter 9 relating to the discipline of attorneys.<br />
2.<br />
The Accused, Ronald D. Schenck, is, and at all times mentioned herein,<br />
was an attorney at law, duly admitted by the <strong>Oregon</strong> Supreme Court to the<br />
practice of law in <strong>Oregon</strong> on May 1, 1979, and has been a member of the<br />
<strong>Oregon</strong> <strong>State</strong> <strong>Bar</strong> since that time.<br />
3.<br />
The Accused enters into this Stipulation for Discipline freely and voluntarily.<br />
4.<br />
On September 22, 1990, the <strong>State</strong> Professional Responsibility Board (SPRB)<br />
authorized the filing of a formal complaint alleging that the Accused committed<br />
conflict of interest violations contrary to former DR 5-105(A) [current DR 5-<br />
105(C) and (E)] of the Code of Professional Responsibility. A formal complaint<br />
(no. 89-75) was subsequently filed by the <strong>Oregon</strong> <strong>State</strong> <strong>Bar</strong> on February 18,
