Over<strong>view</strong><br />
<strong>The</strong> Foreign-Trade Zone (<strong>FTZ</strong>) Program<br />
Federal legislation created the Foreign-Trade Zones (<strong>FTZ</strong>) Act <strong>of</strong> 1934 <strong>to</strong> facilitate international trade and increase<br />
the global competitiveness <strong>of</strong> U.S.-based companies. <strong>FTZ</strong>s are designated sites within the United States, where<br />
foreign and domestic merchandise are considered <strong>to</strong> be outside the U.S. Cus<strong>to</strong>ms terri<strong>to</strong>ry. <strong>The</strong> program is designed<br />
<strong>to</strong> lower the cost <strong>of</strong> doing business and stimulate economic growth and development in the U.S., by allowing<br />
companies <strong>to</strong> defer, reduce, or eliminate U.S. Cus<strong>to</strong>ms duties. Certain types <strong>of</strong> merchandise can be imported<br />
in<strong>to</strong> a Zone without going through formal Cus<strong>to</strong>ms entry procedures or paying import duties until the products are<br />
transferred from the <strong>FTZ</strong> sites for U.S. consumption. If merchandise never enters U.S. commerce or is re-exported<br />
<strong>to</strong> other countries, then no duties are paid on those items.<br />
<strong>FTZ</strong> <strong>202</strong> – <strong>The</strong> <strong>Port</strong> <strong>of</strong> <strong>Los</strong> <strong>Angeles</strong><br />
Foreign-Trade Zone <strong>202</strong> was established in 1994 and comprises approximately 2,700 acres <strong>of</strong> <strong>Port</strong> property plus<br />
General Purpose sites in <strong>Los</strong> <strong>Angeles</strong> and San Bernardino Counties <strong>to</strong>taling more than 4,000 acres. In addition,<br />
<strong>FTZ</strong> <strong>202</strong> comprises Subzones in the Southern California cities <strong>of</strong> El Segundo, Wilming<strong>to</strong>n, and Carson.<br />
Benefits<br />
Deferral <strong>of</strong> Duties<br />
Cus<strong>to</strong>ms duties are paid only when merchandise is shipped in<strong>to</strong> U.S. Cus<strong>to</strong>ms and Border Protection terri<strong>to</strong>ry.<br />
Inven<strong>to</strong>ry held in an <strong>FTZ</strong> is exempt from duty payment until shipped. This can <strong>of</strong>ten provide companies with<br />
significant operational cash flow relief.<br />
Inverted Tariff<br />
In an <strong>FTZ</strong>, users are allowed <strong>to</strong> elect a zone status on merchandise admitted <strong>to</strong> the zone. Importers may pay the<br />
duty rate applicable <strong>to</strong> either the parts or the finished product, whichever is lower.<br />
Elimination <strong>of</strong> Duties<br />
No duties are paid on merchandise exported from an <strong>FTZ</strong>, merchandise which is defective, damaged or obsolete, or<br />
waste or scrap.<br />
Elimination <strong>of</strong> Drawback<br />
<strong>The</strong> duties paid on exported merchandise may be refunded through a process called drawback. <strong>The</strong> drawback law<br />
has become complex and expensive <strong>to</strong> administer. Through the use <strong>of</strong> an <strong>FTZ</strong>, the need for drawback process and<br />
cost may be eliminated.<br />
Quotas<br />
U.S. quota restrictions do not apply <strong>to</strong> merchandise admitted <strong>to</strong> zones. Most merchandise subject <strong>to</strong> quota, may<br />
be held in an <strong>FTZ</strong>, even if it is subject <strong>to</strong> U.S. quota restrictions. When the quota opens, the merchandise may be<br />
immediately shipped in<strong>to</strong> U.S. Cus<strong>to</strong>ms and Border Protection terri<strong>to</strong>ry.<br />

Application Process<br />
<strong>The</strong> Foreign-Trade Zone application process is divided in<strong>to</strong> two steps:<br />
Step One:<br />
Application submission <strong>to</strong> the <strong>FTZ</strong> Board:<br />
<strong>The</strong>re are 6 different types <strong>of</strong> applications that can be made <strong>to</strong> the Foreign-Trade Zones Board. All applications for<br />
Foreign-Trade Zones are submitted <strong>to</strong> the Foreign-Trade Zones Board through the grantee such as the <strong>Port</strong> <strong>of</strong> <strong>Los</strong><br />
<strong>Angeles</strong> <strong>FTZ</strong> <strong>202</strong>.<br />
• General Purpose Zone<br />
• Boundary Modification<br />
• Subzone<br />
• Manufacturing Authority within a General Purpose Zone<br />
• Manufacturing Authority Expansion<br />
• Temporary Manufacturing Authority<br />

Step Two:<br />
Activation application submission <strong>to</strong> Cus<strong>to</strong>ms and Border Protection (CBP).<br />
Execute operating agreement with Grantee (<strong>Port</strong> <strong>of</strong> <strong>Los</strong> <strong>Angeles</strong>).<br />
Once the application has been approved by the <strong>FTZ</strong> Board, the opera<strong>to</strong>r must activate the site with CPB. <strong>The</strong>re are<br />
three areas that CBP will re<strong>view</strong> which are:<br />
• Procedures manual, describing the inven<strong>to</strong>ry control and record keeping systems.<br />
• Facility check and background checks on company <strong>of</strong>ficers.<br />
• Employees who have access <strong>to</strong> records, and the written concurrence <strong>of</strong> the Grantee in cases where the<br />
opera<strong>to</strong>r requests activation.<br />
<strong>FTZ</strong> regulations require the developer and opera<strong>to</strong>r <strong>to</strong> execute an agreement with Grantee (<strong>Port</strong> <strong>of</strong> <strong>Los</strong> <strong>Angeles</strong>).<br />
<strong>The</strong> <strong>FTZ</strong> Opera<strong>to</strong>r and developer submits an application <strong>to</strong> the grantee who re<strong>view</strong>s the application and executes an<br />
agreement with the grantee.<br />
<strong>The</strong> <strong>Port</strong> <strong>of</strong> <strong>Los</strong> <strong>Angeles</strong>, also known as America’s <strong>Port</strong> ® , Southern California’s gateway <strong>to</strong> international commerce,<br />
is located in San Pedro Bay, 20 miles south <strong>of</strong> down<strong>to</strong>wn <strong>Los</strong> <strong>Angeles</strong>. <strong>The</strong> nation’s number one port not only<br />
sustains its competitive edge with record-setting cargo operations, but also for its groundbreaking environmental<br />
initiatives, progressive security measures, and diverse recreational and educational facilities.<br />
<strong>The</strong> <strong>Port</strong> <strong>of</strong> <strong>Los</strong> <strong>Angeles</strong> is a department <strong>of</strong> the City <strong>of</strong> <strong>Los</strong> <strong>Angeles</strong> and is <strong>of</strong>ten referred <strong>to</strong> as the <strong>Los</strong> <strong>Angeles</strong><br />
Harbor Department. <strong>The</strong> <strong>Port</strong> is operated and managed under a State Tidelands Trust that grants local<br />
municipalities jurisdiction over ports and stipulates that activities must be related <strong>to</strong> commerce, navigation and<br />
fisheries. A five-member Board <strong>of</strong> Harbor Commissioners is, appointed by the Mayor and confirmed by the <strong>Los</strong><br />
<strong>Angeles</strong> City Council <strong>to</strong> provide direction and create policy for the <strong>Port</strong>.<br />
As a proprietary and self-supporting department, the <strong>Port</strong> is not supported by city taxes. Instead, revenue is<br />
derived from fees for shipping services such as dockage, wharfage, pilotage, s<strong>to</strong>rage, property rentals, royalties,<br />
and other <strong>Port</strong> services. Considered a landlord port, the <strong>Port</strong> <strong>of</strong> <strong>Los</strong> <strong>Angeles</strong> leases it property <strong>to</strong> tenants who then,<br />
in turn, operate their own facilities.<br />
<strong>The</strong> <strong>Port</strong> encompasses 7,500 acres, 43 miles <strong>of</strong> waterfront and features 27 cargo terminals, including dry and<br />
liquid bulk, container, breakbulk, au<strong>to</strong>mobile, and warehouse facilities.<br />
