For many years, PLIAN<br />

has been fortunate to<br />

receive core funding<br />

support (including in-kind<br />

support) from Justice<br />

Canada, the Law<br />

Foundation <strong>of</strong><br />

Newfoundland and<br />

Labrador and the<br />

Newfoundland and<br />

Labrador Department <strong>of</strong><br />

Justice. PLIAN has been<br />

equally fortunate to<br />

receive project funding.<br />

We are the <strong>NL</strong><br />

component <strong>of</strong> <strong>Public</strong><br />

<strong>Legal</strong> Education<br />

<strong>Association</strong> <strong>of</strong> Canada<br />

(PLEAC). In October,<br />

PLIAN attended PLEAC’s<br />

annual conference in<br />

Ontario, which provided<br />

an opportunity to share<br />

best practices and see<br />

the innovative work our<br />

colleagues are<br />

participating in all over<br />

the country. We look<br />

forward to next year’s<br />

conference in Vancouver.<br />

As President <strong>of</strong> PLIAN’s Board <strong>of</strong><br />

Directors I am pleased to report that<br />

PLIAN is in our 29 th year <strong>of</strong><br />

operation, and is continuing its<br />

efforts to provide public legal<br />

education and information services<br />

with the intent <strong>of</strong> increasing access<br />

to justice. We <strong>of</strong>fer services to the<br />

people <strong>of</strong> Newfoundland and<br />

Labrador to increase their<br />

understanding <strong>of</strong> the law. These<br />

services include the Lawyer Referral<br />

Service (LRS), the <strong>Legal</strong> <strong>Information</strong><br />

Line (LIL), school presentations,<br />

community information sessions,<br />

publications on legal issues and a<br />

website. Over 20,000 people use<br />

our services every year. We raise<br />

awareness among the general public<br />

and service providers about the<br />

importance <strong>of</strong> the law in everyday<br />

life.<br />

I would like to take this opportunity<br />

to sincerely thank the members <strong>of</strong><br />

PLIAN’s Board <strong>of</strong> Directors, as well<br />

as PLIAN’s staff and volunteers. Your<br />

time, effort, guidance and dedication<br />

have helped PLIAN be where it is<br />

today. I would like to extend a very<br />

special thank you to Kristen O’Keefe<br />

for her dedication to PLIAN. Ms.<br />

O’Keefe has proven to be an<br />

invaluable asset to PLIAN and we are<br />

so happy to report that we have<br />

been able to add her back to the<br />

PLIAN team in late September and<br />

her presence has certainly been<br />

noticed.<br />

I would be remiss to not<br />

acknowledge the efforts, dedication<br />

and loyalty <strong>of</strong> staff members Kelly<br />

Brockerville and Sarah McHugh. We<br />

are so fortunate to have such<br />

amazing, hard working women on<br />

our staff. Kelly, who has been on<br />

staff since 2001, has stepped into<br />

the role <strong>of</strong> Acting Executive Director<br />

with enthusiasm, deep knowledge <strong>of</strong><br />

the organization and tremendous<br />

grace. She is <strong>of</strong>ten referred to as<br />

the “heart <strong>of</strong> PLIAN” and I would<br />

like to like to echo that sentiment.<br />

Sarah started with us as a<br />

volunteer and is now a project<br />

coordinator. She’s been in this role<br />

for over 4 years. Sarah is a skilled<br />

researcher, writer, and a very gifted<br />

public speaker. Her dedication to<br />

PLIAN is evident in every job she<br />

takes on, whether it be writing a<br />

publication or presenting to the<br />

public.<br />

I would like to thank Ms. Leanne<br />

O’Leary <strong>of</strong> the law firm Cox and<br />

Palmer who retired from PLIAN’s<br />

Board after serving as an active<br />

and dedicated Board Member for<br />

over 12 years. She will be greatly<br />

missed. At this time I would also<br />

like to welcome John Hartery <strong>of</strong><br />

Pendergast & Hartery, as well as<br />

Alexandria Hollett <strong>of</strong> O’Dea Earle to<br />

our Board <strong>of</strong> Directors.<br />

I, along with the staff, volunteers<br />

and Board <strong>of</strong> Directors welcome<br />

you to read about the exciting<br />

endeavors and initiatives we have<br />

been involved in over the past year.<br />

Kelly Brockerville entered<br />

into the role <strong>of</strong> Executive<br />

Director (Acting) in April<br />

<strong>2012</strong>. She had previously<br />

been PLIAN’s Office Manager<br />

and has been a part <strong>of</strong> the<br />

PLIAN team since 2001.<br />

Sarah McHugh continues in<br />

her role as Project<br />

Coordinator. She has been<br />

an integral part <strong>of</strong> PLIAN<br />

since 2008. Sarah has been<br />

extremely busy juggling<br />

several <strong>of</strong> our projects and<br />

delivering presentations,<br />

webinars and focus groups in<br />

the community.<br />

We are so excited to report<br />

that in September <strong>of</strong> <strong>2012</strong><br />

after a leave <strong>of</strong> absence<br />

31, <strong>2013</strong> PLIAN was very busy<br />

reaching out to the people <strong>of</strong><br />

Newfoundland and Labrador.<br />

We are delighted to report that<br />

through our Lawyer Referral<br />

Service and <strong>Legal</strong> <strong>Information</strong><br />

Line (which operates during<br />

weekdays from 9 am-12 pm)<br />

we helped assist 1,858 people.<br />

also distributed over 9,383<br />

publications to clients and<br />

PLIAN is in the process <strong>of</strong><br />

researching and writing a<br />

publication especially for<br />

Newfoundland and<br />

important later in life.<br />

The publication will<br />

address topics such as<br />

entering long term care<br />

facilities, joint bank<br />

accounts, financial<br />

abuse, consumer<br />

protection, etc.<br />

The publication will also<br />

address what happens<br />

when a person can no<br />

longer manage their<br />

affairs.<br />

PLIAN has received<br />

funding from United<br />

Way - Newfoundland<br />

and Labrador to print<br />

the publication when it<br />

is completed. It will also<br />

be posted on our<br />

website.<br />

In March <strong>of</strong> <strong>2013</strong>, PLIAN<br />

hosted a series <strong>of</strong><br />

seminars on different<br />

types <strong>of</strong> elder abuse.<br />

These seniors safety<br />

sessions were made<br />

possible through<br />

funding from the<br />

Government <strong>of</strong><br />

Canada’s New Horizons<br />

for Seniors Program.<br />

PLIAN <strong>of</strong>fered five<br />

sessions each covering<br />

a different topic—<br />

physical abuse,<br />

emotional abuse,<br />

financial abuse, fraud<br />

and neglect.<br />

Participants had the<br />

opportunity to<br />

participate in as many<br />

sessions as they<br />

wished to, at no cost.<br />

Topics covered<br />

included signs,<br />

symptoms and<br />

examples <strong>of</strong> abuse and<br />

neglect, how to protect<br />

oneself or a loved one,<br />

available resources,<br />

and more. The sessions<br />

were kept interactive<br />

by using case studies,<br />

videos, discussion, and<br />

guest speakers.<br />

These sessions were<br />

incredibly well received<br />

by participants, and<br />

even received media<br />

attention.<br />

PLIAN’s website, and hard copies <strong>of</strong> CDs can<br />

PLIAN received funding<br />

in <strong>2012</strong> from the<br />

Federal Department <strong>of</strong><br />

Justice’s Victims Fund<br />

to deliver a project<br />

called ‘Reaching Out to<br />

Victims <strong>of</strong> Violence’.<br />

PLIAN used webinar<br />

technology for the first<br />

time to deliver<br />

presentations to<br />

service providers who<br />

work with victims <strong>of</strong><br />

violence. The goal with<br />

using webinars was to<br />

remove barriers—<br />

geography (lack <strong>of</strong><br />

access to information<br />

based on location) and<br />

cost (associated with<br />

travel).<br />

The project included<br />

the delivery <strong>of</strong> 10<br />

webinars to specific<br />

groups <strong>of</strong> service<br />

providers based on the<br />

clients they work with<br />

(some examples<br />

include women,<br />

Aboriginal people, and<br />

seniors).<br />

Topics included<br />

information on the<br />

legal responses to<br />

violence (Emergency<br />

Protection Orders,<br />

Peace Bonds, and<br />

criminal charges), the<br />

court process for<br />

victims and witnesses,<br />

terminology, resources,<br />

and more.

PLIAN has developed an<br />

information booklet entitled “My<br />

Parents Live Apart” and<br />

accompanying six videos, for<br />

children and youth (aged 10 to 15<br />

years <strong>of</strong> age) living in<br />

Newfoundland and Labrador,<br />

dealing with parental separation<br />

and divorce.<br />

Adults <strong>of</strong>ten lack a basic<br />

understanding <strong>of</strong> their rights and<br />

responsibilities in relation to<br />

family law. The complexity <strong>of</strong> the<br />

law renders the processes <strong>of</strong><br />

separation and divorce even more<br />

confusing and alienating to<br />

children and youth. PLIAN<br />

received funding for this project<br />

from Canada’s Supporting<br />

Families Fund, <strong>Public</strong> <strong>Legal</strong><br />

Education and <strong>Information</strong> and<br />

Pr<strong>of</strong>essional Training<br />

Component.<br />

The project we undertook helps<br />

provide children and youth<br />

general information about<br />

family law, child rights, and<br />

what to expect. The guide and<br />

videos are also a helpful<br />

resource to parents and service<br />

providers to help explain family<br />

law matters to children and<br />

youth.<br />

The development <strong>of</strong> the<br />

booklet was the result <strong>of</strong> much<br />

collaboration. We would like to<br />

say a special thank you to the<br />

many people who reviewed<br />

earlier drafts to provide<br />

feedback and suggestions,<br />

including Family Justice<br />

Services, Berkley Reynolds, and<br />

PLIAN’s Board <strong>of</strong> Directors. We<br />

also want to thank the youth<br />

who participated in a focus<br />

group to provide feedback on<br />

the publication.<br />

PLIAN’s <strong>2012</strong> Youth Justice Camp<br />

was held at the Buckmaster’s<br />

Circle Community Centre in St.<br />

John’s. Funding for camp was<br />

provided by the Department <strong>of</strong><br />

Advanced Education and Skills,<br />

Government <strong>of</strong> Newfoundland and<br />

Labrador. This camp has 12<br />

participants, all <strong>of</strong> which were<br />

girls!<br />

Camp activities included a tour <strong>of</strong><br />

Provincial Court, a visit to the RNC<br />

Mounted Unit’s stables, and a<br />

mock trial with the Honourable<br />

Judge Smith, which saw the girls<br />

taking on the roles <strong>of</strong> lawyers,<br />

witnesses, accused, and jury. In<br />

addition to these field trips, the<br />

campers had presentations<br />

from a Crown Attorney, a<br />

private practice lawyer, the<br />

Office <strong>of</strong> the Child and Youth<br />

Advocate, and more. The youth<br />

also had time for arts and<br />

crafts.<br />

On October 23, <strong>2012</strong> changes to the Youth<br />

Criminal Justice Act came into effect as a result<br />

<strong>of</strong> the federal Safe Streets and Communities<br />

Act. PLIAN received funding from the<br />

Department <strong>of</strong> Justice (Canada), Youth Justice<br />

Policy, to update PLIAN’s existing youth justice<br />

materials, as well as create new material to<br />

help inform the public about the changes.<br />

As part <strong>of</strong> this project, we held a focus group<br />

with youth. The participating youth provided<br />

input to help us present the material in a youthfriendly<br />

manner and in plain language.<br />

We have created a new Youth Justice Fact<br />

Sheet that explains how the youth justice<br />

system has been impacted by the Safe Streets<br />

and Communities Act. Our existing<br />

publication “For the Record- The Youth Criminal<br />

Justice Act” has also been updated to reflect<br />

the recent changes, as well as the “Frequently<br />

Asked Questions” on the youth justice section <strong>of</strong><br />

PLIAN’s website. Our youth justice presentation<br />

has also been revised to reflect the changes.<br />

PLIAN participates in community activities and events. Through such participation, we build our<br />

reputation in the community, which allows for the exchange <strong>of</strong> ideas and views on effective measures <strong>of</strong><br />

disseminating information. PLIAN is also involved in various national, regional and local committees such<br />

as the Coalition Against Violence (Avalon East), Newfoundland and Labrador Network for the Prevention<br />

<strong>of</strong> Elder Abuse, Atlantic Coordinating Committee on Crime Prevention and Community Safety, <strong>Public</strong> <strong>Legal</strong><br />

Education <strong>Association</strong> <strong>of</strong> Canada, and more. We also rely heavily on the very important and long lasting<br />

relationships we have established with so many <strong>of</strong> our community partners. This is always such an<br />

exciting part <strong>of</strong> our work and we love getting out in the community!<br />

PLIAN would like to take this opportunity to sincerely thank the lawyers who enrolled in our Lawyer Referral Service (LRS) this<br />

past year. Lawyers voluntarily register to participate in this service, which in turn enables Newfoundlanders and Labradorians<br />

requiring legal assistance to consult with a lawyer for up to 30 minutes at a nominal fee.<br />

Although Newfoundland and Labrador does not have a formalized pro bono program, the Lawyer Referral Service is another<br />

avenue for lawyers to give back to their communities. Based on public response and constant demand for this service, it is<br />

clear that the LRS is extremely beneficial to the people <strong>of</strong> our province.<br />

PLIAN is governed by an extremely dedicated voluntary board <strong>of</strong> directors. Our board <strong>of</strong> directors is comprised <strong>of</strong> a range <strong>of</strong><br />

pr<strong>of</strong>essionals including lawyers, judges, police, retired teachers, and others. In <strong>2012</strong>-13, PLIAN welcomed two new Board<br />

members—Alexandria Hollett and John Hartery, both practicing lawyers in St. John’s. PLIAN also said farewell to longtime Board<br />

member, Leanne O’Leary. PLIAN would like to thank Leanne for her years <strong>of</strong> service, and welcome Alexandria and John.<br />

Over the years PLIAN has been fortunate to have amazing volunteers. This past year has<br />

been no exception. We are delighted to have Mike Schryver and Dana Martin work with us.<br />

We want to thank Dana and Mike who have taken the great cause <strong>of</strong> providing plain<br />

language legal information to heart. Without their valuable help, PLIAN could not fulfil its<br />

mandate. We would like you both to know how much your involvement and time is<br />

PLIAN was also fortunate to enjoy three short-term law student placements. Anne Barnes, <strong>of</strong><br />

the University <strong>of</strong> Ottawa, spent a month researching and writing on the new Safe Streets<br />

and Communities Act. Emma Adlakha and Gabrielle Chowne were part <strong>of</strong> the Pro-Bono<br />

Students Canada program at the University <strong>of</strong> New Brunswick, and contributed to the writing<br />

and research <strong>of</strong> the ‘My Parents Live Apart’ guide. Gabrielle also contributed to the research<br />

and writing for the NVCAW newsletter. PLIAN extends many thanks to all students for their<br />

valuable contributions, and wishes them the best as they continue their studies.<br />

‘Volunteering at PLIAN has been a great educational and also enjoyable experience.<br />

Doing research for pamphlets which will actually be published is a great motivator to work<br />

hard and diligently. It was very neat to see some <strong>of</strong> the work I did showing up in the final<br />

version <strong>of</strong> the child’s guide, “My Parents Live Apart”, and to be a part <strong>of</strong> the whole<br />

process from its birth to research to editing to its final publication and to writing up<br />

mailing labels and packaging the publications for delivery. Being involved in this made<br />

me feel like a part <strong>of</strong> the team and I wanted to see the pamphlet delivered and helping<br />

people.’
