DEVANT LA COUR DU BANC DE LA REINE<br />

QUESTIONS CONCERNANT L’HOMOLOGATION DES TESTAMENTS<br />

ET L’ADMINISTRATION DES SUCCESSIONS<br />

1 Pour l’application de la présente annexe, la valeur de la succession correspond à la totalité des éléments<br />

d’actif de la succession administrée. Les biens dont le représentant successoral ne s’occupe pas, tels que la<br />

propriété conjointe, l’assurance, les rentes et les pensions non payables à la succession, ne sont pas compris<br />

dans la valeur de la succession, et l’avocat facture séparément pour ses services à leur égard.<br />

2 Pour tous les services essentiels nécessaires, les honoraires de l’avocat sont comme suit :<br />

(a) 1 500 $, plus 1 % sur la première tranche de 500 000 $ de la valeur de la succession;<br />

(b) ¾ % sur la tranche suivante de 500 000 $ de la valeur de la succession;<br />

(c) ½ % sur le solde de la valeur de la succession.<br />

3 Pour les services non essentiels ou autres destinés à la succession et pour la reddition des comptes, les<br />

honoraires additionnels de l’avocat sont ceux prévus à la règle 745(3) ».<br />

EXTRACTS FROM THE RULES AND PROCEDURES OF THE<br />

LEGISLATIVE ASSEMBLY OF SASKATCHEWAN RELATING TO PRIVATE BILLS<br />

________________________<br />

Only a Private Member, not a Member <strong>of</strong> Cabinet, can present a petition for a Private Bill. <strong>The</strong> Clerk <strong>of</strong> the<br />

Legislative Assembly must be advised in writing <strong>of</strong> the name <strong>of</strong> the Private Member sponsoring the Private<br />

Bill.<br />

In cases where the proposed bill provides that the property to be used or occupied by the petitioner be exempt<br />

from taxation, either in whole or in part, the petitioner must file with the Clerk <strong>of</strong> the Assembly, along with the<br />

petition, a written statement from the local municipal authority in which the said property is situated approving<br />

the intent <strong>of</strong> the provisions <strong>of</strong> the proposed bill which provide for the exemption from taxation.<br />

91(1) All petitions for private bills shall be in duplicate and shall be filed with the Clerk <strong>of</strong> the Assembly not<br />

later than the fourth sitting day <strong>of</strong> the spring period <strong>of</strong> the parliamentary calendar.<br />

91(2) No petition for any private bill shall be received by the Assembly if presented after the first eight sitting<br />

days <strong>of</strong> the spring period <strong>of</strong> the parliamentary calendar.<br />

91(3) No private bill may be introduced in the Assembly after the first 15 sitting days <strong>of</strong> the spring period <strong>of</strong><br />

the parliamentary calendar.<br />

92(1) Every applicant for a private bill shall deposit with the Clerk <strong>of</strong> the Assembly, along with the petition<br />

for same, two copies <strong>of</strong> the bill with marginal notes inserted and an accepted cheque payable to the Minister <strong>of</strong><br />

Finance for the sum <strong>of</strong> two hundred and fifty dollars ($250) if the said bill does not exceed 10 pages, and fifteen<br />

dollars ($15) additional for each page over that number; 450 words shall be held to constitute a page.
