f<strong>in</strong>ances before choos<strong>in</strong>g a <strong>care</strong> home<br />

Your right to <strong>in</strong>formation <strong>and</strong> an assessment<br />

If you are th<strong>in</strong>k<strong>in</strong>g of go<strong>in</strong>g <strong>in</strong>to a <strong>care</strong> home it is advisable to<br />

first speak to Kent County Council (Families <strong>and</strong> Social Care).<br />

We can provide <strong>in</strong>formation <strong>and</strong> advice on a range of services<br />

<strong>and</strong> if necessary a full assessment of your needs. This may<br />

help you to stay <strong>in</strong> your own home. Alternatively we can<br />

advise you on mov<strong>in</strong>g to more supported accommodation like<br />

sheltered hous<strong>in</strong>g.<br />

An assessment can also tell you whether we th<strong>in</strong>k you need<br />

to go <strong>in</strong>to a <strong>care</strong> home <strong>and</strong> whether we would fund the cost of<br />

the <strong>care</strong> home if/when your capital drops below the threshold<br />

for <strong>fund<strong>in</strong>g</strong>. You must not assume we will do this. Kent County<br />

Council will only fund <strong>residential</strong> <strong>care</strong> if we assess that you<br />

need this type of <strong>care</strong> <strong>and</strong> we will normally only fund up to<br />

certa<strong>in</strong> f<strong>in</strong>ancial limits.<br />

How do I f<strong>in</strong>d out the current capital threshold for local<br />

authority <strong>fund<strong>in</strong>g</strong>?<br />

In April each year the government sets out the levels that<br />

determ<strong>in</strong>e whether an <strong>in</strong>dividual may qualify for f<strong>in</strong>ancial help<br />

from their council’s social services department. There are three<br />

ways that you can f<strong>in</strong>d out the levels for this year:<br />

• If you are already <strong>in</strong> a <strong>care</strong> home ask the manager of<br />

your <strong>care</strong> home<br />

• Phone Kent County Council’s 24 hour helpl<strong>in</strong>e on<br />

08458 247 100<br />

• Visit the website at www.kent.gov.uk <strong>and</strong> look at the current<br />

‘Charg<strong>in</strong>g for Residential Care’ booklet.


Whether you are already <strong>in</strong> a <strong>care</strong> home <strong>fund<strong>in</strong>g</strong> yourself or<br />

th<strong>in</strong>k<strong>in</strong>g of go<strong>in</strong>g <strong>in</strong>to a <strong>care</strong> home, if your capital (sav<strong>in</strong>gs <strong>and</strong><br />

other assets) fall below the capital threshold you may qualify<br />

for f<strong>in</strong>ancial help from Kent County Council (or your local<br />

authority if you live elsewhere).<br />

As stated above we would first have to assess that you need<br />

to be <strong>in</strong> <strong>residential</strong> <strong>care</strong> <strong>and</strong> also that the cost is not more<br />

than we would normally expect to pay. Kent County Council<br />

usually only funds <strong>care</strong> <strong>homes</strong> that cost less than certa<strong>in</strong><br />

levels (depend<strong>in</strong>g on the area <strong>and</strong> the type of <strong>care</strong> needed). If<br />

you wanted to stay <strong>in</strong> a more expensive home someone would<br />

have to fund the difference, known as a top-up.<br />

Is the value of my home taken <strong>in</strong>to account when decid<strong>in</strong>g<br />

if my capital/sav<strong>in</strong>gs are above the threshold?<br />

Once you are <strong>in</strong> permanent <strong>residential</strong> <strong>care</strong> the value of your<br />

<strong>in</strong>terest <strong>in</strong> your former home will be <strong>in</strong>cluded unless it is still<br />

occupied by certa<strong>in</strong> people <strong>in</strong>clud<strong>in</strong>g your spouse, partner, a<br />

lone parent who is your former partner, a relative who is over<br />

60 or <strong>in</strong>capacitated, or your child under 18.<br />

When work<strong>in</strong>g out the value of your <strong>in</strong>terest we will deduct<br />

any mortgages etc still outst<strong>and</strong><strong>in</strong>g <strong>and</strong> 10% for the costs<br />

associated with sale.<br />

If it can’t be disregarded then the value of your <strong>in</strong>terest <strong>in</strong> your<br />

former home will be added to your other assets <strong>and</strong> sav<strong>in</strong>gs<br />

after a m<strong>and</strong>atory 12 weeks property disregard.<br />

How does the 12 Week Property Disregard work?<br />

If, apart from your former home, your other assets <strong>and</strong> sav<strong>in</strong>gs<br />

are less than the capital threshold, we may be able to help you


f<strong>in</strong>ancially for the first 12 weeks, as the value of your former<br />

home is disregarded dur<strong>in</strong>g this period. You will still, however,<br />

be expected to make a contribution to the cost of your <strong>care</strong><br />

home based on your weekly <strong>in</strong>come (like pensions <strong>and</strong><br />

benefits) <strong>and</strong> <strong>in</strong>come from any other capital you own.<br />

KCC has schemes that may <strong>in</strong> some circumstances be able<br />

to help you while you sell your property or if you decide not<br />

to sell it straight away. These are the Deferred Payments <strong>and</strong><br />

Temporary F<strong>in</strong>ancial Assistance schemes. Factsheets are<br />

available on these.<br />

I moved <strong>in</strong>to a <strong>care</strong> home without Social Services<br />

<strong>in</strong>volvement but my capital/sav<strong>in</strong>gs will soon fall below<br />

the upper capital limit. What should I do?<br />

If you know that your sav<strong>in</strong>gs will soon drop below the upper<br />

capital limit, then it is important that you let Kent County<br />

Council know <strong>in</strong> advance. We ask that you let us know three<br />

months <strong>in</strong> advance if possible. Contact Kent County Council’s<br />

24 hour helpl<strong>in</strong>e on 08458 247 100.<br />

We will then carry out a <strong>care</strong> assessment to see if you need<br />

to be <strong>in</strong> <strong>residential</strong> <strong>care</strong>. If we th<strong>in</strong>k you do, discussions will<br />

take place with your <strong>care</strong> home to see if they will accept Kent<br />

County Council’s maximum amount. If not you may be able to<br />

stay <strong>in</strong> the home if there is a relative or friend will<strong>in</strong>g to pay the<br />

extra cost (Third Party Top-Up). If neither of these options are<br />

available we will normally arrange for you to move to a <strong>care</strong><br />

home that is with<strong>in</strong> our maximum amount.<br />

I have heard that the NHS pay for some people to stay <strong>in</strong> a<br />

nurs<strong>in</strong>g home. Could this apply to me?<br />

Under NHS Cont<strong>in</strong>u<strong>in</strong>g Care rules, if you qualify, the NHS


does fund the full cost of a stay <strong>in</strong> a nurs<strong>in</strong>g home (<strong>and</strong> very<br />

occasionally <strong>in</strong> a <strong>residential</strong> home). When we assess your<br />

needs we will decide if it is worth you mak<strong>in</strong>g an application for<br />

this type of <strong>fund<strong>in</strong>g</strong> <strong>and</strong> assist you with this process.<br />

For everyone else the NHS pays what is called a Registered<br />

Nurs<strong>in</strong>g Care Contribution (RNCC) towards the cost of nurs<strong>in</strong>g<br />

home <strong>care</strong>. If you are currently self-<strong>fund<strong>in</strong>g</strong> <strong>in</strong> a nurs<strong>in</strong>g home<br />

the NHS will be pay<strong>in</strong>g this RNCC direct to your <strong>care</strong> home.<br />

Even if we (social services) take over <strong>fund<strong>in</strong>g</strong> the RNCC will<br />

cont<strong>in</strong>ue to be paid.<br />

Am I entitled to any benefits?<br />

Even if you have capital above the upper threshold for local<br />

authority help, you may still be entitled to Pension Credit<br />

(which even though it is means-tested, has no upper capital<br />

limit) <strong>and</strong> also non means-tested benefits like Attendance<br />

Allowance or Disability Liv<strong>in</strong>g Allowance. All these benefits<br />

are adm<strong>in</strong>istered by the Department for Work <strong>and</strong> Pensions<br />

(DWP).<br />

Can I give some of my capital away so I can qualify sooner<br />

for f<strong>in</strong>ancial help?<br />

If you give money or capital (e.g your house) away to avoid<br />

pay<strong>in</strong>g the full fees, then the assessment of how much you will<br />

have to pay will still <strong>in</strong>clude the value of the assets that have<br />

been given away. We can also, <strong>in</strong> some circumstances, legally<br />

ask the person who was given these assets to pay some or all<br />

of the costs of your <strong>care</strong> home.


Independent f<strong>in</strong>ancial advice<br />

In addition to the advice you receive from Kent County Council,<br />

it is very advisable to get <strong>in</strong>dependent f<strong>in</strong>ancial advice, ideally<br />

before you move <strong>in</strong>to a <strong>care</strong> home. This should help you to<br />

maximise your <strong>in</strong>come <strong>and</strong> safeguard your capital/sav<strong>in</strong>gs as<br />

far as possible.<br />
