Compensation for Land Owners and Users<br />

<strong>The</strong> Government is committed, as part <strong>of</strong> the social<br />

partnership process, to the payment <strong>of</strong> a fair and<br />

proper level <strong>of</strong> compensation to landowners and<br />

users who have lands proposed for designation as a<br />

NHA, SAC or SPA.<br />

Rural Environmental Protection Scheme<br />

(REPS)<br />

Lands with<strong>in</strong> a candidate SAC, designated SPA,<br />

proposed NHA or Commonages are def<strong>in</strong>ed as<br />

‘Target Areas’ under this scheme. Farmers <strong>in</strong> the<br />

target areas who participate <strong>in</strong> the REPS scheme<br />

receive higher payments than those elsewhere.<br />

Farmers with small areas <strong>of</strong> land <strong>in</strong> a NHA, SAC or<br />

SPA can get REPS payments for that part <strong>of</strong> their<br />

farm. In either case, the farmer is subject to certa<strong>in</strong><br />

conditions regard<strong>in</strong>g farm<strong>in</strong>g and land use practices,<br />

set out <strong>in</strong> the REPS plan for the farm.<br />

Dúchas farm plans<br />

Where a farmer chooses not to participate <strong>in</strong> REPS,<br />

and Dúchas seeks to change the farm operation <strong>in</strong><br />

some way or to end a particular activity, Dúchas will<br />

pay for preparation <strong>of</strong> a farm plan. This will normally<br />

be conf<strong>in</strong>ed just to the designated lands, and will<br />

address the conservation requirements. <strong>The</strong> farm<br />

plan will list options for achiev<strong>in</strong>g these requirements<br />

and <strong>in</strong>dicate the actual costs to the farmer. Dúchas<br />

and the farmer will then negotiate an agreement on<br />

the plan and payment <strong>of</strong> the costs.<br />

Dúchas will tra<strong>in</strong> farm planners <strong>in</strong> preparation <strong>of</strong> farm<br />

plans for non-REPS farmers. A list <strong>of</strong> approved<br />

planners will be available to the farmer to choose<br />

from.<br />

Compensation for landowners who are not<br />

farm<strong>in</strong>g<br />

A landowner may seek compensation for actual<br />

losses <strong>in</strong>curred as a result <strong>of</strong> hav<strong>in</strong>g land <strong>in</strong>cluded <strong>in</strong><br />

a NHA, candidate SAC or SPA. Eligible landowners<br />

should submit to Dúchas, details <strong>of</strong> the losses<br />

<strong>in</strong>curred as a result <strong>of</strong> the <strong>in</strong>clusion <strong>of</strong> lands <strong>in</strong> a<br />

NHA, SAC or SPA, outl<strong>in</strong><strong>in</strong>g the basis for the<br />

calculations. Documentary evidence <strong>of</strong> past earn<strong>in</strong>gs<br />

and the activities that produced these should be<br />

<strong>in</strong>cluded with the claim. Should the applicant be<br />

dissatisfied with a compensation that is made, the<br />

case may be referred to an <strong>in</strong>dependent arbitrator<br />

who will review the matter and make a f<strong>in</strong>al decision.<br />

Where a proposed SAC/NHA/SPA prevents the<br />

landowner from carry<strong>in</strong>g out an activity or<br />

development on their land, the compensation due<br />

will exclude any payments that have been attracted<br />

under grant schemes (other than headage or premia<br />

payments).<br />

Aquaculture<br />

<strong>The</strong> compensatory arrangements outl<strong>in</strong>ed above<br />

apply also to aquaculture / foreshore licence<br />

holders, who may seek compensation for actual<br />

losses <strong>in</strong>curred as a result <strong>of</strong> hav<strong>in</strong>g their area <strong>of</strong><br />

operations <strong>in</strong>cluded <strong>in</strong> a candidate SAC / SPA.<br />

Eligible licence holders wish<strong>in</strong>g to use this option<br />

should submit to Dúchas, details <strong>of</strong> the losses<br />

<strong>in</strong>curred as a result <strong>of</strong> the <strong>in</strong>clusion <strong>of</strong> lands <strong>in</strong> a<br />

proposed candidate SAC or SPA, outl<strong>in</strong><strong>in</strong>g the basis<br />

for the calculations. Documentary evidence <strong>of</strong> past<br />

earn<strong>in</strong>gs, and the activities that produced these,<br />

should be <strong>in</strong>cluded with the claim.<br />

Dúchas will prepare conservation plans <strong>in</strong><br />

consultation with local <strong>in</strong>terest groups. <strong>The</strong>se plans<br />

will take account <strong>of</strong> aquaculture, fish<strong>in</strong>g and leisure<br />

activities. Compensation will be provided for actual<br />

<strong>in</strong>come loss due to the implementation <strong>of</strong> these<br />

plans.<br />
