There are over 500 species of wild bird<br />
found in Britain but the Schedules only<br />
list a small number of these. Please<br />
remember that, as a default, birds have<br />
full protection all year round unless<br />
subject to a General Licence. The<br />
Schedules only list species whose<br />
protection is greater or less than normal.<br />
Extent of protection given to<br />
birds<br />
All birds, their nests and eggs are<br />
protected by law and it is an offence,<br />
with certain exceptions, to:<br />
• intentionally or recklessly kill,<br />
injure or take any wild bird<br />
• intentionally or recklessly take,<br />
damage or destroy or otherwise<br />
interfere with the nest of any wild<br />
bird while it is in use or being built<br />
• intentionally or recklessly take,<br />
damage, destroy or otherwise<br />
interfere with any nest habitually<br />
used by any wild bird included in<br />
Schedule A1 when it is not in use<br />
or being built.<br />
• intentionally or recklessly obstruct<br />
or prevent any wild bird from<br />
using its nest<br />
• intentionally or recklessly kill take<br />
or destroy the egg of any wild bird<br />
• have in one’s possession or control<br />
any wild bird (dead or alive), or<br />
part of a wild bird, obtained in<br />
contravention of the Wildlife and<br />
Countryside Act 1981 or the<br />
Protection of Birds Act 1954<br />
• have in one’s possession or control<br />
an egg, or part of an egg, obtained<br />
in contravention of the Wildlife<br />
and Countryside Act 1981 or the<br />
Protection of Birds Act 1954<br />
• have in one’s possession or control<br />
any bird in Schedule 4 of the<br />
Wildlife and Countryside Act<br />
unless it is registered and ringed in<br />
accordance with the Minister's<br />
regulations.<br />
• intentionally or recklessly disturb<br />
any wild bird listed in Schedule 1<br />
while it is nest-building or is at or<br />
near a nest with eggs or young; or<br />
disturb the dependent young of<br />
such a bird.<br />
• intentionally or recklessly disturb<br />
any wild bird in Schedule 1 which<br />
leks while the bird is lekking<br />
• intentionally or recklessly harass<br />
any wild bird included in Schedule<br />
1A.<br />
Sale of live wild birds and<br />
birds' eggs<br />
It is an offence to sell, offer or expose for<br />
sale, possesss for sale or transport for<br />
sale, any wild bird unless it is:<br />
• a species listed on Schedule 3 Part I<br />
and<br />
• captive-bred and<br />
• fitted with an approved close-ring<br />
as defined by the regulations<br />
issued by the Scottish Executive or<br />
