On-Going Inspection and Maintenance<br />

A permanent maintenance plan for each permanent storm water management facility shall be included in<br />

the Final Site Development Plan. Requirements for on-going inspection and maintenance of permanent<br />

storm water management facilities are as follows:<br />

Storm water management facilities and practices, included in a site development plan, which are<br />

subject to an inspection and maintenance agreement, must undergo ongoing inspections to document<br />

maintenance and repair needs and ensure that maintenance is completed in compliance with the<br />

SWPPP, any agreements and the <strong>County</strong>’s Storm Water Management Ordinance. For<br />

developments, which establish a POA or HOA, provisions for long term maintenance, as outlined in<br />

SWPPP, must be defined in a maintenance agreement. The provisions of this agreement must also<br />

identify a source of funding to support future required maintenance and upkeep activities, and a<br />

responsible party. The maintenance agreement shall be recorded in the <strong>Greenville</strong> <strong>County</strong> Register<br />

of Deed’s Office and shall constitute a covenant running with the land to all heirs, successors, and<br />

assigns. The Director must be notified of changes in status and personnel or contract information for<br />

record keeping and inventory purposes in accordance with its MS4 permit requirements.<br />

Subdivision site runoff storage areas, and storm water facilities not located in dedicated rights-ofway<br />

or easement, shall be granted or dedicated to and accepted by a public entity, or shall be<br />

conveyed by plat as undivided equal interests to each lot in the subdivision or to dedicated entities<br />

approved by the Director . Included in the dedication shall be a plan for continued management,<br />

operation, and maintenance of the storm water facility, including designation of the person or<br />

persons responsible for long-term operational management and dedicated funding sources. If title to<br />

the land underlying site runoff storage areas and storm water facilities is conveyed by agreement to<br />

each of the lots in the subdivision, then:<br />

A covenant on the face of the plat shall be provided; and<br />

Subdivision property owners shall establish a property owner’s association to provide for the<br />

maintenance of site runoff storage areas and storm water facilities. The association shall be duly<br />

incorporated and the property owners’ association agreement shall be recorded for all the lots in<br />

that subdivision; and<br />

The proposed property owners’ association by-laws and declaration shall provide for a long term<br />

maintenance agreement.<br />

A storm water management facility or practice shall be inspected on a periodic basis by the<br />

responsible person in accordance with the approved inspection and maintenance agreement. In the<br />

event that the storm water management facility has not been maintained and/or becomes a danger to<br />

public safety or public health, the <strong>County</strong> shall notify the person responsible for carrying out the<br />

maintenance plan by registered or certified mail to the person specified in the inspection and<br />

maintenance agreement. The notice shall specify the measures needed to comply with the agreement<br />

and the plan and shall specify the time within which such measures shall be completed.<br />

Inspection programs by the <strong>County</strong> may be established on any reasonable basis, including but not<br />

limited to: routine inspections; random inspections; inspections based upon complaints or other<br />

notice of possible violations; and joint inspections with other agencies inspecting under<br />

environmental or safety laws. Inspections may include, but are not limited to: reviewing<br />

maintenance and repair records; sampling discharges, surface water, groundwater, and material or<br />

<strong>Greenville</strong> <strong>County</strong>, South Carolina<br />
