SAFETY REQUIREMENTS<br />

vehicles as well as pedestrians and animals <str<strong>on</strong>g>in</str<strong>on</strong>g>volved<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>, or associated with accidents.<br />

‣ Vulnerable <str<strong>on</strong>g>Road</str<strong>on</strong>g> Users (VRU) <str<strong>on</strong>g>in</str<strong>on</strong>g>clude pedestrians as well as<br />

riders of motorized two-wheelers, bicycle and other vehicles which<br />

Article 18 ‘<str<strong>on</strong>g>Safety</str<strong>on</strong>g> requirements’ (C<strong>on</strong>td.)<br />

‣ All costs and expenses aris<str<strong>on</strong>g>in</str<strong>on</strong>g>g out of or relat<str<strong>on</strong>g>in</str<strong>on</strong>g>g to <str<strong>on</strong>g>Safety</str<strong>on</strong>g><br />

Requirements shall be borne by the C<strong>on</strong>cessi<strong>on</strong>aire to the<br />

extent such costs and expenses form part of the works and<br />

‣ Even where safety works are <str<strong>on</strong>g>in</str<strong>on</strong>g>cluded as paid items the<br />

resp<strong>on</strong>se has been far from satisfactory.<br />

‣ Even <str<strong>on</strong>g>in</str<strong>on</strong>g> PPP projects <str<strong>on</strong>g>Safety</str<strong>on</strong>g> is c<strong>on</strong>sidered as the last<br />

priority; especially dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g c<strong>on</strong>structi<strong>on</strong> o period.<br />

‣ The C<strong>on</strong>cessi<strong>on</strong>aire often compla<str<strong>on</strong>g>in</str<strong>on</strong>g> of theft/vandalism as<br />

excuse for not <str<strong>on</strong>g>in</str<strong>on</strong>g>stall<str<strong>on</strong>g>in</str<strong>on</strong>g>g adequate safety devices<br />

‣ There is often dispute about the safety requirements<br />

dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g c<strong>on</strong>structi<strong>on</strong> period.<br />
