Project Document The GWA has a board chaired by the Chairman of the CGWB. With the exception of one member of Joint Secretary Rank to be appointed by the central government, all other board members are drawn from the CGWB. The Authority was established provisionally for a year with the following powers and functions: · to issue direction and take measures pertaining to Sub-section 2 of Section 3 of the Environment (Protection) Act; · to resort to the penal provisions contained in Sections 15-21 of Environment (Protection) Act; · to regulate discriminate drilling and withdrawal of groundwater in the country and issue necessary regulations with a view to preserving and protecting groundwater. The Supreme Court has recently mandated government action to address groundwater overdraft problems and establish the CGWB as a GWA, with a complementary authority in each state. Various states have passed legislation intended to enable groundwater regulation, which include: the Maharashtra Water Act, Madras mini-act, Gujarat amendments to the irrigation act and the model bill circulated by CGWB. The Supreme Court ruling, while mandating regulation of groundwater extraction, does not specify how that should be implemented. Although some approaches, such as the mini- Act of Madras, have had some success, in most cases legislation has yet to prove effective. Although the proposed legislation could not be revised rapidly, it might be more productive to use the SC mandate and existing administrative authorities to initiate pilot management projects. A 2b State level Andhra Pradesh State has been formed in 1956 by the merger of the Telangana area of old Hyderabad State with Andhra, the erstwhile Madras State. The legal systems of both the former States have come into application in the respective areas after the formation of Andhra Pradesh. This Act confers powers on irrigation officers for regulation of water, localization, operation of canal system, for proper maintenance of water courses and for stoppage of water for certain specified reasons, powers to impose penalties and collection of water taxes. · Andhra Pradesh Irrigation (Construction and Maintenance of water courses) Act, 1965 covers the construction of water courses up to a block of 10 ha and cost recovery · Andhra Pradesh (Andhra area) Irrigation Cess Act, 1865. Amended in 1900. To enable the Government to levy a separate Cess for the use of water supplied for irrigation purposes. · Andhra Pradesh Farmer Management of Irrigation Systems Act, 1997, by which the maintenance of irrigation systems and management of irrigation water have been transferred to farmers through establishing Water Users Associations, Distributary Committees and Project Committees. This Act is under review. · Andhra Pradesh Water, Land and Trees Act, 2002, to promote water conservation and tree cover and to regulate the exploitation of surface and groundwater Localization means allocation of land proposed to be served by an irrigation project to different types of irrigation, that is, perennial, wet, garden, irrigated dry and light. Uncommendable areas and anti-malarial zones are also demarcated. While there is plethora of legislation available for water management in Andhra Pradesh, the challenge is to coordinate the implementation of this legislation. A further challenge is to ensure that implementation of legislation takes place. This can be done by strengthening the organizations responsible for implementation. The Governor of Andhra Pradesh promulgated Andhra Pradesh Ordinance No. 15 of 200 on 15 December 2000, under the article 348 (3) of the Constitution of India. Under this Ordinance, the Government should constitute an authority called Andhra Pradesh Water, Land and Trees Authority. Groundwater protection measures forms the third chapter of the Ordinance, salient features of which is listed below. · All wells have to be registered · Designated officer can prohibit water pumping in certain areas · Permission to be obtained from the GWA for sinking a well for any purpose by any individual or agency 16
