This Card is your quick reference to your Allotment <strong>Rules</strong>.<br />

For full rules please refer to your signed copy of your Tenancy<br />

Agreement<br />

MEMBERS<br />

Every Member shall be aware of the terms of their Tenancy Agreement<br />

with the <strong>Council</strong> <strong>and</strong> will observe all the conditions laid down in the<br />

tenancy agreement.<br />

Members will be held responsible for the due observance of these rules<br />

by their visitors.<br />

USE OF LAND<br />

The l<strong>and</strong> shall only be used for horticultural purposes. The l<strong>and</strong> shall not<br />

be used for:-<br />

a) Any commercial purpose<br />

b) Keeping pigeons except where notified to the <strong>Council</strong> in the<br />

tenancy agreement<br />

c) Keeping horses or other animals except where notified to the<br />

<strong>Council</strong> in the tenancy agreement<br />

d) Keeping ducks or geese except where notified to the <strong>Council</strong> in the<br />

tenancy agreement<br />

e) Keeping Cockerels<br />

f) Storage of vehicles of any description including caravan, mobile<br />

home or trailer (of any size).<br />

RESPONSIBILITIES<br />

Plots shall be kept weed free <strong>and</strong> at least two thirds will be cultivated.<br />

In the interests of safety, plot holders, shall act in a manner so as not to<br />

cause danger or injury to themselves or others.<br />

Plot holders must act in such a manner so as not to cause a nuisance or<br />

annoyance to the local community, occupants of adjoining properties or<br />

any other plot holders.<br />

Dogs must be kept on a lead <strong>and</strong> under control at all times <strong>and</strong> faeces<br />

are to be collected <strong>and</strong> disposed of in a proper manner. Any <strong>allotment</strong><br />

holder not complying will face eviction <strong>and</strong> Members of the public will be<br />

issued with a fine.


THE SITE SECRETARY WILL<br />

a) Maintain a list of all members names <strong>and</strong> addresses. Such lists<br />

are to be made available to the <strong>Town</strong> <strong>Council</strong> annually after the<br />

site AGM.<br />

b) Maintain a waiting list of prospective tenants <strong>and</strong> vacant plots will<br />

be allocated in strict rotation by date of application. Application to<br />

be put on<br />

the waiting list must be made in writing, to the Site Secretary.<br />

c) Ensure that an up to date waiting list is displayed on the<br />

site/noticeboard including the date on which it was displayed<br />

signed by the Steward/Secretary.<br />

ERECTION OF SHEDS, GREEN HOUSES, POLY TUNNELS OR<br />

OTHER STRUCTURES<br />

Applications to erect a shed, greenhouse, poly tunnel or other<br />

permanent structure must be made in writing together with a sketch plan<br />

showing the proposed dimensions to the Site Secretary who will seek<br />

the approval or otherwise of the <strong>Town</strong> <strong>Council</strong>’s Allotment Committee.<br />

Any buildings or structures erected without the <strong>Council</strong>’s permission will<br />

amount to a breach of this tenancy agreement <strong>and</strong> notice to quit may be<br />

issued.<br />

An application for a swap must be made in writing to the site steward<br />

who will seek the approval or otherwise of the <strong>Town</strong> <strong>Council</strong>’s Allotment<br />

Committee.<br />

If an <strong>allotment</strong> tenancy is terminated, then the outgoing tenant can offer<br />

any structure to the incoming tenant taken from the waiting list in strict<br />

date of application. If the new tenant does not wish to retain the structure<br />

then the outgoing tenant is required to remove the structure at their own<br />

expense within 28 days of vacating their tenancy. Failure to comply will<br />

result in a charge being made to the retiring tenant by Spennymoor<br />

<strong>Town</strong> <strong>Council</strong> for the removal/clearing of the plot. UNDER NO<br />

CIRCUMSTANCES can the outgoing tenant make the purchase of any<br />

structure a condition of tenancy to the incoming tenant.
