immunity, it serves as an objective and convenient benchmark <strong>of</strong> tra<strong>in</strong><strong>in</strong>g<br />

and skill. Courts search for thresholds <strong>of</strong> expertise and may admit medical<br />

society guidel<strong>in</strong>es such as those published by ASGE, accreditation agency<br />

regulations, and similar consensus norms to determ<strong>in</strong>e the applicable standard<br />

<strong>of</strong> care. These regulations and guidel<strong>in</strong>es either embody certification<br />

requirements or reference certification criteria as m<strong>in</strong>imum necessary qualifications.<br />

Certification thus attests to a basel<strong>in</strong>e level <strong>of</strong> competence and<br />

helps protect aga<strong>in</strong>st liability.<br />

To best <strong>in</strong>sulate themselves from liability, therefore, hospitals should extend<br />

privileges only to board-certified physicians or to physicians with the degree<br />

<strong>of</strong> experience consistent with and comparable to the standards for board<br />

certification <strong>in</strong> a given, appropriate medical specialty. With respect to endoscopy<br />

<strong>in</strong> particular, this translates <strong>in</strong>to grant<strong>in</strong>g privileges only to ABIMcertified<br />

gastroenterologists, ABS-certified general surgeons, or non-certified<br />

physicians who have atta<strong>in</strong>ed (1) the cognitive and technical repertoire<br />

required to diagnose and treat gastro<strong>in</strong>test<strong>in</strong>al conditions, and (2) experience<br />

<strong>in</strong> specific procedures commensurate with (a) either ABIM prerequisites<br />

for board eligibility <strong>in</strong> gastroenterology or ABS prerequisites for<br />

general surgery, and (b) ASGE measures <strong>of</strong> expertise.<br />
