138 For animal carcasses, discharge shall occur as far from<br />

the nearest l<strong>and</strong> as possible, taking into account the<br />

2012 guidelines for the Implementation of MARPOL<br />

Annex V, adopted by Resolution MEPC.219(63) <strong>and</strong><br />

amended by Resolution MEPC.239(65).<br />

139 Cleaning agents or additives contained in cargo hold, deck<br />

<strong>and</strong> external surfaces wash water may be discharged into<br />

the sea, but these substances must not be harmful to the<br />

marine environment, taking into account the 2012 guidelines<br />

for the Implementation of MARPOL Annex V, adopted by<br />

Resolution MEPC.219(63) <strong>and</strong> amended by Resolution<br />

MEPC.239(65).<br />

Within special areas (i.e. Mediterranean Sea, Baltic Sea,<br />

Black Sea, Red Sea, Gulfs, North Sea, Antarctic <strong>and</strong> Wider<br />

Caribbean Region), discharge of the following garbage into<br />

the sea shall only be permitted while the ship is en route <strong>and</strong><br />

as follows:<br />

discharge into the sea of food wastes as far as<br />

practicable from the nearest l<strong>and</strong>, but not less than 12<br />

nautical miles from the nearest l<strong>and</strong> or the nearest ice<br />

shelf. Food waste shall be comminuted or ground <strong>and</strong><br />

shall be capable of passing through a screen with<br />

openings no greater than 25 mm;<br />

discharge of cargo residues that cannot be recovered<br />

using commonly available methods for unloading,<br />

where all the conditions given in Regulation 6.1.2 are<br />

satisfied, taking into account also the 2012 guidelines<br />

for the Implementation of MARPOL Annex V, adopted<br />

by Resolution MEPC.219(63) <strong>and</strong> amended by<br />

Resolution MEPC.239(65).<br />

2. Requirements for MARPOL Annex V Parties in relation to<br />

reception facilities within special areas. Each Party, the coastline<br />

of which borders a special area, undertakes to ensure that, as<br />

soon as possible, in all ports <strong>and</strong> terminals within the special<br />

area, adequate reception facilities are provided. All taken<br />

measures shall by notified to <strong>IMO</strong> by the Parties <strong>and</strong>, upon receipt<br />

sufficient notifications, <strong>IMO</strong> shall establish a date from which the<br />

garbage discharge requirements in respect of the area in question<br />

take effect.<br />

140 Until the date so established, ships that are navigating in such<br />

special area shall comply with the garbage discharge<br />

requirements outside special areas.<br />
