Rename the Middle College High School - Early College High School.<br />

There is no cost to the District.<br />

RATIONALE: To further assist the District and its partner, <strong>Tulsa</strong><br />

Community College, achieve mutual goals of providing an instructional<br />

program that leads to the completion of courses required to earn both a high<br />

school diploma and an associate’s degree upon graduation, and to motivate<br />

first generation college students in an effort to increase the likelihood of<br />

graduation and matriculation into higher education. Both partners have<br />

mutually agreed that a focus on grades nine through twelve will assist in the<br />

accomplishment of these goals.<br />

Approve the continuation of student uniforms at East Central High School<br />

which will now include sophomores for the 2010-2011 school year and each<br />

year thereafter until all students are in uniforms. The Board approved the<br />

uniforms for freshman May 4, 2009.<br />

There is no cost to the District.<br />

RATIONALE: Experts believe that by improving the school environment<br />

through mandatory standardized dress, both academic and behavioral<br />

outcomes improve.<br />

Renew the annual Memorandum of Understanding with <strong>Tulsa</strong> Technology<br />

Center (TTC) regarding approval of students earning high school credit in<br />

fulltime (three hours) technical training programs, courses taught<br />

contextually within selected TTC career majors/programs and mathematics<br />

courses taught before, during (as a pull out), or after regular school hours.<br />

There is no cost to the District.<br />

FURTHER RECOMMEND that the attorneys for the School District review<br />

and approve the appropriate memorandum and the proper officers of the<br />

Board of Education to be authorized to execute the memorandum on behalf<br />

of the District.<br />

RATIONALE: The Memorandum of Understanding is designed to identify<br />

alternative ways for students to earn high school credit so they will have the<br />

option to attend TTC to learn the skills that will prepare them for success as<br />

they enter higher education or the workforce.<br />

Renew the contract with American Education Solutions, Inc. (AES) to<br />

provide contracted services for the evaluation of the Magnet <strong>Schools</strong><br />

Assistance Program (MSAP) Grant during the 2010-2011 school year.<br />

Total cost not to exceed $55,000 will be paid from the General Fund Magnet<br />

Grant 1-11-7763-50-2544-3200-100-0000-000-05-093.<br />

FURTHER RECOMMEND that the attorneys for the School District review<br />

and approve the appropriate contract and the proper officers of the Board of<br />

Education be authorized to execute the contract on behalf of the District.<br />

RATIONALE: Evaluation services as required by the MSAP Grant for the<br />

four magnet schools: Central, Hale, McLain, and Webster. AES will provide<br />

detailed survey results reported by school with a District-level summary, the<br />

writing of a detailed annual performance reports (APR) based on grant<br />

documentation, school level NCLB test reports and other data as required by<br />

the grant. AES has been with the Magnet Grant for the past three years.<br />

Enter into a network services agreement with JAM Digital Media, <strong>Tulsa</strong>,<br />

Oklahoma, to provide technical services for the Apple MAC labs that support<br />

the Fine and Performing Arts Magnet Program at Central High School for the<br />

2010-2011 school year.<br />

Total cost/expenses not to exceed $8,700 will be charged to the General<br />

Fund Magnet <strong>Schools</strong> Project, 1-11-7763-50-1000-3200-100-0000-000-05-<br />

705.<br />

FURTHER RECOMMEND that the attorneys for the School District prepare<br />

the appropriate agreement and the proper officers of the Board of Education<br />

be authorized to execute the agreement on behalf of the District.<br />

RATIONALE: <strong>Tulsa</strong> <strong>Public</strong> <strong>Schools</strong> does not currently have personnel<br />

with the experience or training to appropriately configure or deploy the Apple<br />

iMacs and MacPros that are used to support the Fine and Performing Arts<br />

Magnet Programs at Central High School. This contract allows for the best<br />

method to provide adequate support and stability to these important<br />

resources.<br />

RATIONALE: These school-based services will include individual<br />

counseling, family counseling, referral services, classroom consultation, and<br />

team intervention and case management which support the academic goals<br />

by decreasing out-of-school suspensions, improving attendance, and<br />

increasing classroom academic learning time.<br />

Enter into a contract with NanoPac, Inc. to provide training, at $125 per hour,<br />

for visually impaired (VI) students and VI teachers during the 2010-2011<br />

RATIONALE: This test scoring service is required to participate in the<br />

GED testing program. The administration of the GED is provided through<br />

the Adult Education Program.<br />

Approve continued use of <strong>Tulsa</strong> Community College facilities at their<br />

Northeast campus for the Saturday classes of the High School PM<br />

Completion program at the amount of $1,450 per session, or $2,900 for the<br />

2010-2011 school year.<br />

Total cost not to exceed $2,900 will be paid from the General Fund Adult<br />

RATIONALE: Provisions of a quality learning experience is enhanced by<br />

(YWCA) under a 21st Century Community Learning Center grant during the<br />

2010-2011 school year. This provides extended day/year services at Skelly<br />

and McKinley elementary schools.<br />

RATIONALE: The YWCA of <strong>Tulsa</strong> was approved for a 21st Century grant<br />

by the Oklahoma Department of Education to provide after-school,<br />

intersession and summer activities at Skelly Elementary School and<br />

McKinley Elementary School. Activities will include tutoring, mentoring,<br />

accelerated instruction, service learning and integrated academic<br />

enrichment.<br />

RATIONALE: Due to unforeseen structural issues in the original design,<br />

The increase of $28,535 will be paid from the Facility Bond Fund, 1-36-1220-<br />

RATIONALE: The scope of the project was increased at the request of<br />

the site and was not part of the original contract. This contract was originally<br />

approved on the June 16, 2010, <strong>Agenda</strong>, item E-17, in the amount of<br />

$311,561.<br />

Increase the contract with SecureNet, Inc., for the security camera and<br />

access control systems at the high schools for the installation of systems at<br />

Webster High School, approved on the May 3, 2010, <strong>Agenda</strong>, item E-20.<br />

The increase in the amount of $44,858.08 will be paid from the Classroom<br />

Bond Fund, 1-34-3120-50-4700-7330-000-0000-000-12-037.<br />

RATIONALE: This increase will replace and expand the incompatible<br />

existing camera system at Webster High School and make it compatible<br />

with the new District-wide system.<br />

Enter into a contract with EMCS, Inc., the lowest responsible bidder, for the<br />

energy management system at Wright Elementary School.<br />

Total cost is $109,700 to be paid from Facilities Bond 134-1215-50-4700-<br />

4500-000-0000-000-12-444.<br />

RATIONALE:<br />

Energy management is part of the 2010 bond issuance.<br />

Enter into a contract with Standard Roofing, Inc., the lowest responsible<br />

bidder, for the roof replacement at Chouteau Elementary School.<br />

Total cost of $333,850 will be paid from Facilities Bond 136-1260-504700-<br />

4580-000-0000-000-12-155.<br />

RATIONALE:<br />

Replacing leaking roofs is part of the 2010 Bond Issuance.<br />

teachers in the District beginning with the 2010-2011 school year.<br />

The total cost not to exceed $3,000 per year per teacher to be paid to Teach<br />

For America from Title I ARRA stimulus account, 1-11-5160-50-2213-3200-<br />

494-0000-000-05-XXX.<br />

FURTHER RECOMMEND that the attorneys for the School District review<br />

and approve the appropriate contract and the proper officers of the Board be<br />

authorized to execute the contract on behalf of the District.<br />

RATIONALE: To impact the quality of teachers assigned to the District’s<br />

high poverty schools. Teach For America is the national corps of<br />

outstanding recent college graduates and professionals of all academic<br />

majors and career interests who commit two years to teach in urban and<br />

rural public schools and become leaders in the effort to expand educational<br />

opportunity.<br />

Enter into an agreement with <strong>Tulsa</strong> Community College (TCC) that will allow<br />

eligible <strong>Tulsa</strong> <strong>Public</strong> <strong>Schools</strong>’ students to receive TCC credit for specific<br />

courses taught by TCC faculty at Central, Hale, McLain, Webster, Memorial,<br />

Washington, East Central and Edison high schools. Tuition will be waived by<br />

TCC’s ACE Concurrent Tuition Waiver Scholarship. ACE Tuition Waiver<br />

Scholarships are awarded on a “first come-first served basis” as funds are<br />

available. TCC will waive all student activity fees. The library fee and<br />

student assessment totaling $12.75 is to be paid by the student.<br />

Total cost not to exceed $15,000 will be paid from the District textbook fund,<br />

111-3330-501000-6430-100-0000-000-16-077 for the purchase of textbooks.<br />

FURTHER RECOMMEND that the attorneys for the School District review<br />

and approve the appropriate agreement and the proper officers of the Board<br />

of Education be authorized to execute the agreement on behalf of the<br />

District.<br />

RATIONALE: The purpose is to continue a partnership between TCC and<br />

<strong>Tulsa</strong> <strong>Public</strong> <strong>Schools</strong> that will allow students who have demonstrated strong<br />

academic ability to complete a rigorous course of study while accelerating<br />

progress toward a college degree as established in Senate Bill 290 of 2009<br />

for endorsement of concurrent enrollment programs.<br />

operational practices. School Board policies are reviewed and revised by<br />

staff as necessary and/or required by State law and are further reviewed by<br />

the Board Policy Committee. The policies are then submitted for approval at<br />

a regular meeting of the Board.<br />

NOTE: These policies have not been submitted for information. It was necessary<br />

to submit for action because of implementation of a Resolution Commitment with<br />

the Office of Civil Rights of the United States Department of Education. The Board<br />

Policy Committee has reviewed the policies and recommends adoption.<br />

RATIONALE: During the Hazard Mitigation Grant process, one of the<br />

noted major hazards for the District is exposure to lightning strikes. The<br />

Hazard Mitigation committee researched all products and made site visits to<br />

schools and athletic facilities with the lightning prediction system. They<br />

concluded the only truly accurate lightning prediction system available is the<br />

Thor Guard system. Because of this, the Hazard Mitigation Committee<br />

recommended the Thor Guard system as a sole source vendor. The first<br />

unit has been successfully installed at East Central High School. This<br />

recommendation will install units at all other high schools and two other<br />

facilities to maximize the coverage area for the entire District. Future plans<br />

will complete a total District coverage in place once additional grant, Bond or<br />

other District funds become available.<br />

contract extension for the Superintendent to be employed through June 30, 2013.<br />

Each side is committed to reaching a final agreement on a three-year contract at the<br />

earliest possible date. The current contract provides that it may continue with the<br />

consent of the Board. This action is to formalize that consent pending a final<br />

agreement on a three-year contract.<br />

religion, color, national origin, sex, disability, genetic information, veteran status, marital<br />

status or age in its employment, programs and activities. Any student, parent/guardian,<br />

employee, patron or beneficiary having a complaint or grievance concerning discrimination,<br />

as referenced in the District’s policy of nondiscrimination, shall be entitled to file a grievance,<br />

orally or in writing, in accordance with this procedure.<br />

The student with a grievance alleging discrimination should present the grievance to the<br />

principal. The employee with a grievance alleging discrimination should present the<br />

grievance to his or her immediate supervisor. In the event the allegation of discrimination<br />

involves the student’s principal or the employee’s supervisor, the student or employee shall<br />

be permitted to present the grievance to the Human Capital Department’s Director of Support<br />

Talent. Should the grievance alleging discrimination involve the Director of Support Talent,<br />

the student or employee shall present the grievance to the Chief Human Capital Officer.<br />

Parents/guardians, patrons and beneficiaries shall likewise be permitted to file grievances<br />

alleging discrimination as defined in the District’s nondiscrimination policy. Grievances<br />

alleging discrimination should be submitted to the Director of Support Talent. If the<br />

parent/guardian, patron or beneficiary has a complaint of discrimination involving the actions<br />

or behavior of the Director of Support Talent, the individual may file the grievance directly<br />

with a member of the executive staff, which is comprised of the Chief of Staff; Chief Financial<br />

Officer; Assistant to the Superintendent for Accountability; Program Management Officer;<br />

Director of <strong>Public</strong> Information and Marketing; Associate Superintendent for Elementary<br />

<strong>Schools</strong>; Associate Superintendent for Secondary <strong>Schools</strong>; Assistant Superintendent for<br />

Curriculum and Instruction/Special Education and Student Services; Chief Human Capital<br />

Officer; Assistant Superintendent for Support Services; and the Executive Director of<br />

Teacher/Leadership Effectiveness Initiative.<br />

All grievances alleging discrimination whether from an employee, student, parent/guardian,<br />

or beneficiary shall be presented orally or in writing or in the case of an individual with a<br />

disability affecting the capacity to present an oral or written grievance, in an alternative form<br />

sufficient to identify for the District the nature of the grievance and the relevant facts<br />

explaining the grievance.<br />

The grievance shall be promptly investigated by appropriate representatives of the District.<br />

The individual filing the grievance shall be notified of the time in which the District expects to<br />

make a written response to the grievance. The District will conduct a timely, thorough,<br />

reliable, and impartial investigation of complaints of discrimination, harassment and<br />

retaliation, including the opportunity for the complainant or grievant to present witnesses and<br />

provide evidence. The District will evaluate all relevant information and documentation<br />

relating to a complaint of discrimination, harassment and retaliation. The District will make<br />

every effort to keep the response time period to fewer than 10 calendar days unless the<br />

grievance requires an extensive response which includes a recommendation for resolution or<br />

corrective action.<br />

Under no circumstances shall an individual accused of discrimination by a grievant be<br />

involved in the investigation of the grievance, nor shall any such individual have contact with<br />

the grievant regarding the subject matter while the grievance is pending. Similarly, no<br />

individual submitting a grievance to any District representative shall be subjected to<br />

retaliation because of the grievance. A claim of retaliation shall be made in the same<br />

manner and utilizing the same procedure as provided in this policy for complaints of<br />

discrimination.<br />

If a mutually acceptable settlement of the grievance is not reached as a result of the<br />

preliminary investigation and recommendation, the grievance shall be referred to an<br />

executive staff member of the District. The assigned executive staff member shall be an<br />

individual who is not the subject matter of the grievance and has not previously been<br />

involved in the investigation of the grievance. The executive staff member shall conduct any<br />

further investigation appropriate in light of the grievance and its specific charges and, if<br />

deemed necessary, may conduct a hearing with respect to the grievance.<br />

The executive staff member may adopt the recommendation made previously with respect to<br />

the grievance or may submit a new report of the investigation and recommendations. The<br />

decision of the executive staff member shall be issued within ten business days of receipt of<br />

the notice of appeal of the recommendation(s). A copy of the decision, any<br />

recommendations and an appeal rights notice shall be furnished to the grievant with a copy<br />

to the Superintendent.<br />

In cases where it is apparent the individual’s intent is to bring to the District’s attention a<br />

claim of discrimination, the employee’s written complaint shall be treated as a grievance<br />

arising under this procedure.<br />

The grievance procedure related to claims of discrimination does not and is not intended to<br />

displace rights arising under federal or state law related to claims of discrimination.<br />

<strong>Tulsa</strong> <strong>Public</strong> <strong>Schools</strong> prohibits retaliation against an individual because she or he has either<br />

filed a grievance, opposed an unlawful practice, or has made a charge, testified, assisted or<br />

participated in an investigation, proceeding or hearing regarding an alleged incident of illegal<br />

discrimination or harassment. The remedies, procedures, and rights set forth in Board<br />

Regulation 4901-R shall be available to any person aggrieved by any act or failure to act by<br />

any <strong>Tulsa</strong> <strong>Public</strong> <strong>Schools</strong> employee or official representative.<br />

No recipient or other person shall intimidate, threaten, coerce, or discriminate against any<br />

individual for the purpose of interfering with any right or privilege secured by section 601 of<br />

Receiving Federal Assistance through the Department of Education Effectuation of Title VI of<br />

the Civil Rights Act of 1964), or because he has made a complaint, testified, assisted, or<br />

participated in any manner in an investigation, proceeding or hearing under this part. The<br />

HARASSMENT, INTIMIDATION, AND BULLYING<br />

PURPOSE: To define the District’s position on harassment, intimidation, and bullying.<br />

Harassment, intimidation, and bullying include but are not limited to verbal or physical<br />

contact, epithets, slurs, gestures, or graffiti, even in jest, that are targeted toward an<br />

individual because of race, color, religion, sex, age, national origin, marital status, veteran<br />

status, or disability, or genetic information. Individuals bring different levels of sensitivity to<br />

interaction. What may seem harmless, trivial, or "all in good fun" to one person may be<br />

extremely offensive to the person to whom the comments or actions are directed.<br />

Harassment, intimidation, and bullying constitute unethical and unacceptable conduct that<br />

will not be tolerated at any level. All persons are strictly prohibited from engaging in any form<br />

of harassment of any employee, student, or applicant for employment. Anyone engaging in<br />

any form of harassment is subject to disciplinary action in accordance with District policy.<br />

Harassment also may constitute discrimination.<br />

Any applicant for employment, employee, or student to whom improper comments or actions<br />

are directed should utilize the <strong>Tulsa</strong> <strong>Public</strong> <strong>Schools</strong> Regulation 4901-R Affirmative<br />

Action/Nondiscrimination /Equal Employment Opportunity (Employee/Student/<br />

Parent/Guardian/Patron/Beneficiary Complaints and Grievance Procedure), or the <strong>Tulsa</strong><br />

Classroom Teachers Association/Administration Negotiations Grievance Procedure,<br />

whichever is appropriate. Violation of this policy by an employee may result in disciplinary<br />

action, including a recommendation for employment termination in the event of repeated<br />

incidents. Students violating this policy will be subject to appropriate disciplinary action at<br />

the school level by the principal or designee.<br />

When allegations of harassment, intimidation, or bullying, are filed, a thorough investigation<br />

will be conducted by the Superintendent or designee. The investigation will include<br />

interviews with all relevant persons. Such persons include, but are not limited to the<br />

complainant, the accused, student(s) and other potential witnesses. Employees and<br />

students are assured the privacy of the complainant and the persons accused of harassment<br />

will be protected to the extent possible.<br />

When complaints or allegations of harassment based on race, religion, color, national origin,<br />

PURPOSE:<br />

To require an annual audit of all site funds.<br />

The site funds at each school will be subject to an internal audit at least once during each<br />

school year. The internal audit report will be furnished to the principal of the audited site.<br />

The term “site funds” will include site school activity funds, as well as all other site-managed<br />

funds.<br />

The report will be evaluated by the Site Audit Committee, which will be chaired by the Chief<br />

Financial Officer. The committee will assign a rating of superior, excellent, good, or needs<br />

improvement to each audit. The evaluation results will be provided to the respective<br />

Principal and Superintendent or his/her designee.<br />

USE OF DISTRICT FACILITIES AS SCHOOL-BASED HEALTH CLINICS<br />

PURPOSE: To define the conditions under which outside health service providers may use<br />

District facilities to provide approved on-campus health services to District students and<br />

families.<br />

The School-Based Health Clinic Program<br />

The District may, if it identifies the need, contract with outside health service providers for the<br />

delivery of school-based health care programs for District students’ and/or family members<br />

through “school-based health clinics” funded by outside organizations and/or other<br />

governmental bodies. For the purpose of this policy, family members are those individuals<br />

who reside in <strong>Tulsa</strong> County or families who reside in the TPS District in Osage County. The<br />

goals of this program are to reduce student absenteeism, increase students’ ability to meet<br />

academic potential, and to provide services which may assist in improving and stabilizing<br />

students’ physical and emotional well-being.<br />

“School-based health clinics” are health centers on District property through which outside<br />

individuals or organizations provide certain health services directly to participating District<br />

students and families at a particular school pursuant to a written agreement with the District<br />

where appropriate. The health services which may be included in such an agreement with<br />

an outside provider include:<br />

• Preventive medical services<br />

• Diagnostic medical services, including Early Periodic Screening and Diagnostic Testing<br />

• Health education counseling and/or services<br />

• Mental health counseling and/or behavioral services<br />

• Immunizations<br />

• First aid<br />

• Dental services<br />

• Drug and alcohol abuse counseling<br />

• Prescription of medication<br />

• Other services as determined by the District<br />

However, in no event will school-based health clinics conduct pelvic examinations on female<br />

students or comparable examinations of male students, nor will a school-based health clinic<br />

dispense any form of contraceptive(s).<br />

The Special Education and Student Services Department, in cooperation with Health<br />

Services, will facilitate the District’s formal agreements with outside health providers wishing<br />

to operate a school-based clinic on District property through an application process as<br />

outlined in 2116-R.<br />
