The ADA Amendments Act of 2008 – Implications for Workers’<br />

When the Americans with Disabilities Act (ADA) was passed in 1990 it represented a significant change in the way employers recruited,<br />

interviewed, evaluated, hired and promoted persons with disabilities. The law had an unexpected and significant impact on workers’<br />

compensation and disability management return-to-work programs. From pre-offer medical examinations to wrongful termination and failure to<br />

accommodate disabled workers, the ADA changed the way that employers conducted disability management with their injured employees.<br />

The ADA has now been amended and the updated version creates new compliance challenges for workers’ compensation self-insurers. The<br />

top industry expert on this topic will provide an overview of key ADA changes with a specific focus on return-to-work programs.<br />
