C<strong>on</strong>sumer protecti<strong>on</strong><br />
and public health<br />
those expenses effectively incurred. The purchaser’s right of<br />
withdrawal may be exercised, with no costs, within three<br />
m<strong>on</strong>ths if <strong>the</strong> informati<strong>on</strong> required by <strong>the</strong> directive is not<br />
included in <strong>the</strong> c<strong>on</strong>tract.<br />
9. Air transport<br />
Regulati<strong>on</strong>s (EC) No 261/2004 and (EC) No 2027/97, as<br />
amended, establish comm<strong>on</strong> rules <strong>on</strong> compensati<strong>on</strong> and<br />
assistance to passengers in <strong>the</strong> event of denied boarding and<br />
cancellati<strong>on</strong> or l<strong>on</strong>g delay of flights and <strong>on</strong> air carrier liability<br />
(passenger and baggage), in case of accidents. Passengers<br />
now have <strong>the</strong> right to demand a cash compensati<strong>on</strong> payable<br />
within <strong>on</strong>e m<strong>on</strong>th under <strong>the</strong> rules displayed at airports.<br />
Regulati<strong>on</strong> (EEC) No 2299/89, as amended, <strong>on</strong> computerised<br />
reservati<strong>on</strong> systems (CRS) for air transport products establish<br />
obligati<strong>on</strong>s for <strong>the</strong> system vendor (to allow any carrier <strong>on</strong> an<br />
equal basis) and for <strong>the</strong> carriers (to communicate with equal<br />
care, and simultaneously, informati<strong>on</strong> to all systems).<br />
Regulati<strong>on</strong> (EEC) No 2409/92 introduces comm<strong>on</strong> criteria and<br />
procedures governing <strong>the</strong> establishment of <strong>the</strong> air fares and air<br />
cargo rates charged by air carriers <strong>on</strong> air services within <strong>the</strong><br />
Community.<br />
Regulati<strong>on</strong> (EC) No 2320/2002, as amended, introduces<br />
comm<strong>on</strong> rules in <strong>the</strong> field of civil aviati<strong>on</strong> security standards,<br />
following <strong>the</strong> criminal acts of 9/11 (11 September 2001).<br />
10. <strong>European</strong> c<strong>on</strong>sumer centres network (Euroguichets)<br />
In <strong>the</strong> <strong>European</strong> c<strong>on</strong>sumer centres network (ECC-Net),<br />
Euroguichets give informati<strong>on</strong> and assistance to c<strong>on</strong>sumers<br />
within <strong>the</strong> c<strong>on</strong>text of cross-border transacti<strong>on</strong>s. This network<br />
also works toge<strong>the</strong>r with o<strong>the</strong>r <strong>European</strong> networks, notably<br />
FIN-NET (financial), Solvit (internal market) and <strong>the</strong> <strong>European</strong><br />
judicial network in civil and commercial matters.<br />
C. Protecti<strong>on</strong> of c<strong>on</strong>sumers’ legal interests<br />
1. Alternative dispute resoluti<strong>on</strong> (ADR) procedures and<br />
injuncti<strong>on</strong>s<br />
Recommendati<strong>on</strong> 98/257/EC, Decisi<strong>on</strong> No 20/2004/EC and <strong>the</strong><br />
Council resoluti<strong>on</strong> of 25 May 2000 lay down <strong>the</strong> principles to<br />
be followed in ADR proceedings, aimed to guarantee <strong>the</strong><br />
single c<strong>on</strong>sumer with cheaper and faster intra-nati<strong>on</strong>al legal<br />
remedies.<br />
Directive 98/27/EC, as modified, harm<strong>on</strong>ises existing <strong>EU</strong> and<br />
nati<strong>on</strong>al law and, in order to protect <strong>the</strong> collective interests of<br />
c<strong>on</strong>sumers, introduces <strong>the</strong> ‘acti<strong>on</strong>s for injuncti<strong>on</strong>s’ which can<br />
be opened at <strong>the</strong> competent nati<strong>on</strong>al courts level, against<br />
infringements (misleading advertising, unfair commercial<br />
practices, c<strong>on</strong>tracts negotiated away from business premises,<br />
c<strong>on</strong>sumer credit, package travel, medicinal products for<br />
human use, unfair c<strong>on</strong>tractual terms, time-shares, distance<br />
c<strong>on</strong>tracts, sale of c<strong>on</strong>sumer goods and associated guarantees)<br />
made by commercial operators from o<strong>the</strong>r countries.<br />
C<strong>on</strong>sumers associati<strong>on</strong>s may seek to: stop or prohibit, under<br />
an urgent procedure, any illegal act; adopt <strong>the</strong> needed<br />
measures to eliminate <strong>the</strong> effects of <strong>the</strong> infringement; order<br />
<strong>the</strong> payment of a penalty in <strong>the</strong> event of failure to comply with<br />
<strong>the</strong> former decisi<strong>on</strong> within <strong>the</strong> specified time limit.<br />
2. <strong>European</strong> judicial network in civil and commercial<br />
matters and obligati<strong>on</strong> to cooperate for nati<strong>on</strong>al<br />
authorities<br />
Decisi<strong>on</strong> 2001/470/EC established such a network to simplify<br />
<strong>the</strong> life of citizens facing cross-border litigati<strong>on</strong> by improving<br />
<strong>the</strong> judicial cooperati<strong>on</strong> mechanisms between Member States<br />
in civil and commercial matters and by providing <strong>the</strong>m with<br />
practical informati<strong>on</strong> to facilitate <strong>the</strong>ir access to justice.<br />
Regulati<strong>on</strong> (EC) No 2006/2004 establishes a network of<br />
nati<strong>on</strong>al authorities resp<strong>on</strong>sible for <strong>the</strong> effective enforcement<br />
of EC c<strong>on</strong>sumer protecti<strong>on</strong> law and obliges <strong>the</strong>m, since<br />
29 December 2005, to cooperate to guarantee <strong>the</strong><br />
enforcement of EC law and to stop any infringement, using<br />
appropriate legal instruments as <strong>the</strong> injuncti<strong>on</strong>s, in <strong>the</strong> case of<br />
intra-Community infringements.<br />
Role of <strong>the</strong> <strong>European</strong> Parliament<br />
Parliament has been at <strong>the</strong> origin of most of <strong>the</strong> adopted<br />
measures (inter alia, <strong>European</strong> Food Safety Authority, <strong>European</strong><br />
Medicines Agency, GMOs, safety in <strong>the</strong> areas of cosmetics,<br />
tourism, unfair c<strong>on</strong>tract terms, distance selling, door-to-door<br />
sales, use of horm<strong>on</strong>es, exports of various dangerous<br />
substances as pesticides, greater protecti<strong>on</strong> to workers and<br />
c<strong>on</strong>sumers in <strong>the</strong> destinati<strong>on</strong> countries for <strong>EU</strong> exports, and<br />
Directive 76/768/EEC <strong>on</strong> animal experiments for cosmetic<br />
products).<br />
Parliament has also supported traditi<strong>on</strong>al food and producers<br />
located in isolated areas.<br />
