ESTABLISHING<strong>BHRAC</strong> & SELECTINGBHRAO The <strong>BHRAC</strong> shall be established in the barangay through a Resolution approved by the Sangguniang Barangay. The <strong>BHRAC</strong> shall be manned by a Barangay Human Rights Action Officer (BHRAO). The two-mode selection process for the BHRAO is as follows: 1. In barangays where the barangay council has no Human Rights Committee, the following procedure shall be observed: A barangay assembly meeting shall be convened for the purpose of nominating candidates and finally designating the person who shall serve as the BHRAO; and The BHRAO shall be chosen through viva voce by a majority of those present in the barangay assembly meeting. The meeting shall be jointly supervised by the City/Municipal Planning and Development and City/Municipal Local Government Operations Officer. 2. In barangays, municipalities, cities where the barangay, municipal, and city councils has a Human Rights Committee, the chairman automatically becomes the BHRAO. In the first case, the following qualifications are prescribed: • At least a high school graduate; • Not less than 21 years old; • Must not be an elective appointive official of the government; • Once elected, s/he must not engage in partisan political activities; • Committed to the cause of human rights; and • Willing to undergo BHRAO Training. In both cases, after the BHRAO had undergone the required training, a resolution shall be issued by the Barangay/Municipal council, formally conferring the BHRAO’s authority as such. The <strong>Commission</strong> shall then issue a Deputation Certificate and a BHRAO Identification Card for this purpose. 14 <strong>BHRAC</strong> Legal Bases
TERM OF OFFICE OF AN ELECTED BHRAO An elected BHRAO shall have a term of five (5) years without re-election. REMOVAL FROM OFFICE The following are the grounds for removing a BHRAO from office: 1. Violation of human rights 2. Loss of Confidence 3. Non performance of functions FREQUENTLY ASKED QUESTIONS FAQs What are the functions/services of the <strong>BHRAC</strong>? The <strong>BHRAC</strong> has two functions/services: 1. Complaints Referral The BHRAO is primarily (at the very least) tasked to receive complaints of “alleged” human rights violations and refer the same to the nearest CHRP regional or sub-office for investigation. 2. Awareness-Raising on Human Rights The BHRAO is tasked to coordinate with the CHRP Regional offices in conducting for seminars, training, symposia and other human rights information and education activities.
