Adoptions and Safe Families Act (ASFA) • ASFA was passed into law by Congress in 1997. • Congress was concerned over the length of time children were living in foster care • ASFA requires that the courts begin the process to terminate the parental rights of parents who have had children in foster care for 15 months out of the last 22 months. • If a parent is in treatment for alcohol or drug abuse, they might not lose their parental rights if they stay in treatment, attend all court dates and show a desire/capcity to be reunited with their children.
