Appeals court upholds Fla. gay adoption ban<br />

Plaintiffs ‘surprised by hostility’ of ruling; Trantalis assails ‘hypocrisy’<br />

After deliberating for almost a year, a<br />

three-judge panel of the 11th Circuit Court of<br />

Appeals ruled unanimously Jan. 28 that the<br />

state of Florida can legally bar sexually active<br />

gay men and lesbians from adopting children.<br />

In a case brought by three gay families,<br />

the Atlanta-based federal appeals court held<br />

that adoption is a privilege granted by a state,<br />

invalidating the plaintiffs’ claims that their<br />

constitutional rights to equal protection and<br />

due process <strong>were</strong> violated.<br />

“<strong>The</strong> state of Florida has made the<br />

determination that it is not in the best interests<br />

of its displaced children to be adopted by<br />

individuals who ‘engage in current,<br />

voluntary homosexual activity’ and we have<br />

found nothing in the Constitution that<br />

forbids this policy judgment,” Judge Stanley<br />

Birch wrote in the panel’s decision.<br />

Birch was joined in his opinion by Judge<br />

Edward Carnes of Alabama; both men <strong>were</strong><br />

appointed to the 11th Circuit by President<br />

George H.W. Bush. A third judge on the panel,<br />

Proctor Hug, Jr., was appointed to the 9th<br />

Circuit Appeals Court in 1977 by President<br />

Jimmy Carter.<br />

Local gay man says he was falsely accused<br />

of indecent exposure in Kendall restroom raid<br />

It started as a simple trip to the mall to<br />

buy a tie. It ended after five hours in a<br />

sweltering police paddy wagon and seven<br />

hours at the Miami-Dade County jail. That’s<br />

how Claudio Guadagno, a local gay man,<br />

described his ordeal, which started early in<br />

the afternoon of Jan. 22 at the Town &<br />

Country Mall in Kendall. He was one of 21<br />

men arrested Jan. 22-23 in a Miami-Dade<br />

police undercover operation in the mall’s<br />

restroom.<br />

He has been charged with “exposure<br />

of sexual organs.” But Guadagno said he<br />

did nothing in the restroom except use the<br />

toilet to relieve himself. He insisted that he<br />

was falsely accused and arrested simply<br />

because he happened to be in the restroom<br />

that day. An angry Guadagno has hired a<br />

lawyer, plans to plead not guilty and will<br />

settle for “nothing less than complete<br />

dismissal of the charges.”<br />

Guadagno said he went to the Town &<br />

Country Mall, which is about a half mile<br />

“deeply disappointing.”<br />

“We think the court is wrong in<br />

believing that government can continue to<br />

discriminate on the basis of sexual orientation<br />

after the Supreme Court’s decision in<br />

Lawrence v. Texas last summer,” Matt Coles,<br />

director of the ACLU’s Lesbian & <strong>Gay</strong> Rights<br />

Project, said in a written statement.<br />

“We think the court is wrong in thinking<br />

that the Constitution lets the government<br />

assume that sexual orientation has anything<br />

to do with good parenting,” Coles said.<br />

<strong>The</strong> reaction from state and local gay<br />

rights advocates was swift and very critical<br />

of the ruling. Equality Florida, a statewide<br />

gay rights organization, issued a statement<br />

saying it was “outraged over the ruling” and<br />

calling on the Florida legislature to repeal<br />

the anti-gay adoption law, which Equality<br />

Florida described as “state-sanctioned<br />

bigotry.”<br />

Noting that the Florida law allows gay<br />

men and lesbians to serve as foster parents<br />

but prohibits them from solidifying their<br />

relationships with their children through<br />

adoption, local attorney and Fort Lauderdale<br />

City Commissioner Dean Trantalis criticized<br />

“the hypocrisy of their sense of family.” “<strong>The</strong><br />

idea of family is to maintain a long-term<br />

cohesive environment for children, and this<br />

decision undermines that,” Trantalis said.<br />

from his home in Kendall, on Jan. 22 to buy<br />

a tie for a job interview. While shopping at<br />

Sears, he started having stomach cramps,<br />

so he went to the restroom.<br />

According to Guadagno, he entered<br />

the restroom at about 12:20 p.m., went into<br />

a stall and closed the door. While inside<br />

the stall, Guadagno said he noticed<br />

someone outside the stall peering at him<br />

through the crack in the door. “I noticed<br />

two feet standing in front of the door,” he<br />

said. “I hit the door and said, ‘Hey, it’s<br />

occupied.’”<br />

After he exited the stall, Guadagno said<br />

he noticed that there <strong>were</strong> two empty stalls,<br />

making him wonder why someone would<br />

be trying to get into his stall. He also<br />

noticed two Hispanic individuals, both of<br />

whom he had seen when he first entered<br />

the restroom. He said one of them was<br />

wearing a red shirt and kept going in and<br />

out of the restroom. “I never spoke to<br />

anyone and I never acknowledged<br />

anyone,” Guadagno said. “When I was in<br />

“Again, prejudice and bigotry win out, and<br />

children are denied a better way of life.”<br />

Trantalis said he expects the case to<br />

“make it’s way up to the Supreme Court.”<br />

But he said there was no guarantee that the<br />

high court would hear the case or would rule<br />

differently than the lower courts.<br />

Officials with the state of Florida could<br />

not immediately be reached for comment on<br />

the case, known as Lofton v. Kearney, while<br />

conservative groups quickly lauded the<br />

decision.<br />

Author and South Florida-based activist Wayne Besen<br />

took time out from his 55-city book tour last week to denounce<br />

the inclusion of an “ex-gay” leader on a panel that testified<br />

Jan. 23 at a House subcommittee hearing on President Bush’s<br />

faith-based initiative.<br />

Besides the subcommittee hearing — which included<br />

five witnesses from the conservative religious group Focus<br />

on the Family — Besen also pointed to the recent opening<br />

of a faith-based prison in Florida as another example of an<br />

intensifying assault on the separation of church and state,<br />

which Besen believes threatens the civil rights of gay men<br />

and lesbians.<br />

“<strong>The</strong> only thing that protects us is the separation of<br />

church and state. That’s the only thing that keeps us from<br />

becoming Iran,” said Besen, who is the author of “Anything<br />

But Straight,” which argues that “ex-gay” ministries do<br />

psychological harm to gay people. “If we lose that, [gay<br />

people] will be the big losers, more than any other group in<br />

the country. We’re the ones that they’re going to justify not<br />

role and allow the people to set family policy,”<br />

Mathew Staver, president of Liberty Counsel,<br />

an Orlando-based group that filed a brief<br />

supporting the ban, told the Associated Press.<br />

Sodomy ruling not<br />

persuasive<br />

In Lawrence v. Texas, the U.S. Supreme<br />

court overturned state sodomy laws, holding<br />

that states “cannot demean [gay citizens’]<br />

existence or control their destiny by making<br />

their private sexual conduct a crime.”<br />

<strong>The</strong> 11th Circuit heard arguments in the Florida adoption<br />

case on March 4, but the ACLU asked the court to withhold<br />

a ruling until a decision was reached in Lawrence vs. Texas.<br />

After the Supreme Court’s June 26 ruling, the Florida<br />

plaintiffs <strong>were</strong> “obviously optimistic,” ACLU spokesperson<br />

Paul Cates said Wednesday.<br />

“But I think we <strong>were</strong> really surprised by the hostility of<br />

the [11th Circuit] opinion,” Cates said.<br />

Birch, appointed to the appeals court in 1990, gave the<br />

keynote speech at the October 1997 annual dinner of the<br />

Stonewall Bar Association of Georgia, a gay lawyers group,<br />

just months after he surprised some legal experts with his<br />

powerful dissent to the 11th Circuit’s decision upholding<br />

Georgia Attorney General Michael Bowers’ right to fire a<br />

lesbian attorney.<br />

“We’ve all witnessed, in the last couple of years, a sea<br />

change in the way the law looks upon the gay and lesbian<br />

community,” Birch said then, calling the group for gay<br />

attorneys and other similar organizations “vital to the<br />

continued vitality of our nation.”<br />

But in the Florida ruling, Birch was willing to accept the<br />

justifications behind Florida’s blanket decision to exclude<br />

sexually active homosexuals from adopting children, despite<br />

the “exemplary” role he said the gay plaintiffs in the case had<br />

played in foster parenting HIV-positive children they now<br />

wished to adopt.<br />

Birch dismissed the plaintiffs’ arguments that Florida’s<br />

policy discriminates against gays, keeps thousands of<br />

children from possible homes and is not supported by social<br />

science research or major child welfare organizations.<br />

“<strong>The</strong> best interests of children … are not automatically<br />

served by adoption into any available home merely because<br />

it is permanent,” the panel ruled.<br />

<strong>The</strong> panel also disagreed with the ACLU’s contention that<br />

Florida’s argument that it bans gays from adopting in order to<br />

promote homes with a father and a mother is undermined by its<br />

willingness to allow single heterosexuals to adopt.<br />

“It is not irrational to think that heterosexual singles<br />

have a markedly greater probability of eventually establishing<br />

a married household and, thus, providing their adopted<br />

children with a stable, dual-gender parenting environment,”<br />

Birch wrote.<br />

It is up to the state legislature — not the court — to<br />

determine if Florida’s adoption policy needs to be changed,<br />

the judges ruled.<br />

But Greg Nevins, a senior staff attorney with the Lambda<br />

Legal Defense & Education Fund, said the judges abandoned<br />

their duty to strike down unconstitutional laws.<br />

“<strong>The</strong>y talked about being deferential to the legislature,<br />

but the court has the responsibility to strike down<br />

discriminatory laws passed by the legislature, and this court<br />

abdicated that responsibility,” Nevins said.<br />

<strong>The</strong> ACLU can either ask the three-judge panel to<br />

reconsider the case, ask the entire 11th Circuit Court of Appeals<br />

to rehear the case or appeal the decision directly to the U.S.<br />

Supreme Court.<br />

<strong>The</strong> ACLU has yet to decide which option it will pursue,<br />

but Cates said he believes the ruling will eventually be<br />

overturned.<br />

“One of our major arguments is that after the Supreme<br />

Court ruled in Lawrence vs. Texas, they basically said these<br />

kinds of laws will no longer be valid,” Cates said.<br />

Broad impact feared<br />

<strong>The</strong> 11th Circuit Court has jurisdiction over Florida,<br />

Georgia and Alabama, and it is unclear what impact<br />

Wednesday’s ruling will have on gay adoptions in those<br />

states.<br />

Neither Alabama nor Georgia currently bans gay men<br />

and lesbians from adopting children, but Lambda’s Nevins<br />

said he fears the court ruling may open the door for similar<br />

measures in those states.<br />

Florida enacted its gay adoption ban in 1977, as part of a<br />

nationally publicized anti-gay crusade by singer and former<br />

beauty queen Anita Bryant.<br />

While Utah and Mississippi also ban adoptions by gay<br />

couples, Florida’s policy — which applies to single gays as<br />

well — is the most stringent in the country.<br />

“Florida has a right to legislate its moral disapproval of<br />

homosexuality,” Casey Walker, one of the lawyers for the<br />

state, has argued. “And children need a married mother and<br />

father to develop into healthy adults.”<br />

But the ACLU’s Coles and other gay rights activists<br />

said children would be hurt by Wednesday’s ruling.<br />

“We are distressed that the court’s decision will leave<br />

thousands of children without the homes and the parents<br />

they deserve,” Coles said.<br />

<strong>The</strong> ACLU will vigorously oppose any efforts by the<br />

state to take away children currently living with gay families<br />

involved in the lawsuit, officials said.<br />

the restroom, there was no activity going on except people<br />

relieving themselves.”<br />

As he was leaving the mall and returning to his car,<br />

Guadagno said he was grabbed roughly by two police<br />

officers and arrested. “I was terrified,” he said. “<strong>The</strong>y never<br />

even told me what I was being arrested for.”<br />

<strong>The</strong> police photographed him, and an officer took a DNA<br />

sample. “I asked why she was taking a DNA sample, and she<br />

said, ‘It’s required now because of the Patriot Act,’” Guadagno<br />

said. <strong>The</strong> officer told him if he didn’t agree to the DNA test, he<br />

would have to spend 21 days in jail, Guadagno said.<br />

Guadagno said he and several other prisoners <strong>were</strong> held<br />

for 5½ hours in a police paddy wagon in the mall parking lot.<br />

According to Guadagno, for at least three of those hours<br />

there was no air conditioning in the vehicle and the windows<br />

<strong>were</strong> closed. “It was hot in there,” he said. <strong>The</strong> prisoners<br />

<strong>were</strong> never given any water, Guadagno said. He said the<br />

plastic handcuffs around his wrists <strong>were</strong> so tight that they<br />

bruised his wrists. “We <strong>were</strong> tortured,” he said.<br />

Meanwhile, the officers ate pizza outside the paddy<br />

wagon, never offered the prisoners any food and taunted<br />

them with anti-gay insults, Guadagno said.<br />

Guadagno recalled that one officer said, “You bunch of<br />

faggots, you deserve what you get.” He said the same officer<br />

threw mock kisses at him and said, “Come here Sweetheart.<br />

You got what you deserved.”<br />

He said one man pleaded with the police to let him go<br />

because his children <strong>were</strong> in day care and there was no one<br />

to pick them up. <strong>The</strong> police woudn’t even let the man make a<br />

phone call, Guadagno said. <strong>The</strong> man told Guadagno that he<br />

wasn’t gay and was arrested for simply unzipping his pants<br />

at a urinal in the restroom.<br />

According to the arrest report provided by the Miami-<br />

Dade police, Guadagno was arrested by Officer A. Zabaleta,<br />

who was “working a plain clothes detail.” <strong>The</strong> police report<br />

says Guadagno “came out of a stall in the men’s room and<br />

approached this officer and exposed himself. <strong>The</strong> defendant<br />

then began to masturbate in front of this officer.”<br />

Guadagno vehemently denies the charge against him. “I<br />

didn’t do anything except use the bathroom,” he said. “To<br />

whom did I expose myself except the man who was peeking<br />

through the crack in the door?”<br />

Guadagno said he was released from jail at 1:40 a.m. on<br />

Jan. 23 after posting a $500 bond. He was released without<br />

his wallet or ID.<br />

He said he got a case of bronchitis from the ordeal and also<br />

missed his job interview. He plans to “fight to the end.” “This<br />

is just wrong what they’re doing; It’s just bigotry.” he said.<br />

Robert Williams, public information officer for the Miami-<br />

Dade Police Department, said he could not comment on an<br />

active case. But he confirmed that 21 men <strong>were</strong> arrested during<br />

the period of Jan. 22-23 at the Town & Country Mall restroom.<br />

Julio Estorino, a Cuban radio personality and news anchor<br />

on the Archdiocese of Miami’s station, was arrested in the<br />

mall’s restroom on the same day that Guadagno was booked.<br />

Like Guadagno, he was charged with “exposure of sexual<br />

organs.” Like Guadagno, Estorino denies any wrongdoing and<br />

plans to contest the charge in court.<br />

In a press statement, Estorino said, “I used the restroom in<br />

the same way any man would use the restroom. I have turned<br />

this matter to my attorney for appropriate action. I have faith in<br />

God and in our legal system. I trust that I will be exonerated.”<br />

Money rolls in from AIDS ride<br />

Bike It & B.E.A.R. It presents checks to six service organizations<br />

<strong>The</strong> results are in. <strong>The</strong> Bike It & B.E.A.R<br />

It for AIDS ride presented a total of $169,304<br />

to six different Florida AIDS service<br />

organizations. On Friday, Jan. 23,<br />

representatives from all six organizations<br />

gathered at the Schubert Resort in Fort<br />

Lauderdale. <strong>The</strong> committee that produced the<br />

event gave a check for $40,148 to AIDS Help,<br />

Inc. in Key West; $27,959 to Broward House<br />

in Fort Lauderdale; $25,661 to Florida AIDS<br />

Action Foundation, Inc. in Tampa; $29,084<br />

to Hug Me in Orlando; $22,237 to Sarasota<br />

CCC in Sarasota; and $24,214 to South Beach<br />

AIDS Project in South Beach.<br />

<strong>The</strong> bike ride took place on the weekend<br />

of Nov. 6-9. Riders <strong>were</strong> required to collect a<br />

little over a $1,000 each to participate in the<br />

event. Fifty percent of the money they<br />

collected went to a general fund to be split<br />

among the agencies. Riders can then distribute<br />

the remaining half of the donations among the<br />

benefiting organizations as they see fit.<br />

“It was a really great event,” said Dr.<br />

Keith Riddle of Broward House, who was a<br />

volunteer for the event. “<strong>The</strong>re <strong>were</strong> stops<br />

along the way where representatives from<br />

different agencies talked to the riders about<br />

the services they provide.”<br />

On the first night, the riders gathered in<br />

South Miami and had a kick-off at Gameworks,<br />

leisure venue with restaurants and bars. <strong>The</strong><br />

next morning, the race got started and went<br />

to Marathon, where riders spent the night.<br />

<strong>The</strong> following day, riders pedaled down to<br />

Key West where the race finished.<br />

“<strong>The</strong> organizations knew the<br />

total amount of funds raised but did<br />

not know how much each one of them<br />

would receive individually,” said Glen<br />

Weinzimer, director of public relations<br />

for the ride. “This event was different<br />

in that the riders <strong>were</strong> allowed to<br />

distribute half the money they raised<br />

as they saw fit. But the other half was<br />

evenly split, so each agency was<br />

guaranteed $14,108.”<br />

Weinzimer says that each<br />

agency approached the race<br />

differently. Key West, though it is a<br />

smaller community, did really well<br />

because it had such a tight-knit group<br />

of riders. <strong>The</strong>y worked closely with<br />

the media and ran training programs.<br />

All their riders wore a team shirt while<br />

training, and they did joint<br />

fundraising. <strong>The</strong>y also rented a van<br />

collectively to help their group.<br />

“I would say 95 percent of Key<br />

West’s riders gave 100 percent of their<br />

money to AIDS Help,” Weinzimer said.<br />

“Orlando did really well, but it is a pediatric<br />

AIDS charity. And there are some people that<br />

just wanted to see that the kids are taken<br />

care of, so they geared their money just to<br />

them. Which is nice because it shows a cross<br />

section of riders.”<br />

By working as a grass roots effort<br />

entirely supported by non-paid volunteers,<br />

the ride proved it could get funds to the<br />

selected organizations. It was quite a<br />

different story with the last ride, which took<br />

place a year and a half ago. That ride actually<br />

lost money and the organizations did not<br />

receive a dime. <strong>The</strong> organizers had<br />

anticipated 500 riders attending, but only 78<br />

showed up. With expenses going towards<br />

advertising, paid employees, and food and<br />

supplies purchased for 500 riders, there <strong>were</strong><br />

no funds left. Other previous rides had made<br />

money but <strong>were</strong> produced by special events<br />

companies that took a large fee, leaving less<br />

than $10,000 for each charity.<br />

This past year 100 percent of the money<br />

went to the charities.<br />

<strong>The</strong> ride will take place again in<br />

November 2004, but under the name <strong>The</strong><br />

Southernmost AIDS Bike Ride. Weinzimer<br />

says the name change promotes the<br />

destination a little more, and he believes it<br />

will help attract more out-of-state riders. <strong>The</strong><br />

tagline for the event will be “Ride to<br />

Paradise.”<br />

raised at this event will be used to provide<br />

services for people living with HIV/AIDS in<br />

South Florida.<br />

This year marks the first time that<br />

“Dining Out for Life” will be held in South<br />

Florida. <strong>The</strong> fund-raiser was founded in 1991<br />

in Philadelphia. Since its inception, the event<br />

has grown into an international fund-raiser<br />

with more than 25 AIDS Service Organizations<br />

around the nation collaborating with<br />

restaurants and sponsors to raise much<br />

needed funds for HIV/AIDS care. Major cities<br />

like Los Angeles, San Francisco, Seattle,<br />

Minneapolis, Buffalo and Dallas host the<br />

event.<br />

Attendees simply eat out at their favorite<br />

lunch or dinner location. <strong>The</strong> participating<br />

restaurants donate 25 percent of the day’s<br />

proceeds to the AIDS service organizations.<br />

Ambassadors will be on hand at each<br />

restaurant to answer any questions patrons<br />

might have regarding the<br />

benefiting agencies and<br />

the services they offer. <strong>The</strong><br />

participating restaurants<br />

are located in Palm Beach,<br />

Boca Raton, Fort<br />

Lauderdale, Hollywood<br />

and Miami.<br />

“<strong>The</strong> restaurants<br />

<strong>were</strong> very willing and very<br />

eager to join,” said Debi<br />

Dance of AIDS Project<br />

Florida. “Eighty-three<br />

restaurants for the first<br />

year is phenomenal.”<br />

“When I was approached to participate<br />

in the event, I said yes right away,” said Per<br />

Jacobson, owner of Vienna Café & Wine Bar<br />

in Fort Lauderdale. “It is a good cause, and<br />

because it is the first year, it as an exciting<br />

event to be a part of.”<br />

“We <strong>were</strong> approached by <strong>The</strong> New<br />

Times,” said Chuck Smith, owner of <strong>The</strong> Hi-<br />

Life Café in Fort Lauderdale. “I heard about<br />

this event being done in other cities, and I<br />

think it is a terrific idea because it is a winwin<br />

situation for everybody. It’s a painless<br />

way to give cash, and it gives us nice<br />

marketing and advertising while at the same<br />

time it’s an opportunity to give back to the<br />

community. I’ve gotten a lot of reservations<br />

from it because customers feel like they are<br />

able to donate money without spending extra<br />

cash.”<br />

Besides proceeds from meal sales, the<br />

event will also raise money from a raffle.<br />

When restaurant patrons are presented with<br />

their bill, they will receive a raffle envelope<br />

to fill out. Donations aren’t required to<br />

participate in the raffle, but they are<br />

encouraged. <strong>The</strong> prize for the raffle is a<br />

Marriot Harbor Beach weekend package.<br />

Participating restaurants run the gamut<br />

of South Florida dining experiences. “One of<br />

the exciting things about ‘Dining Out for Life’<br />

is that we have a wide variety of restaurants<br />

as far as prices are concerned,” Dance said.<br />

“So it allows our client base to also<br />

participate, which is wonderful.”<br />

Divas dazzle ‘big wigs’ of West Palm gay scene<br />

Performance at new 2730 club raises money for Compass community center<br />

Travel to Hollywood and you are likely<br />

to see some star-studded performances.<br />

Whitney, Mariah and Aretha are true crowd<br />

pleasers always guaranteed to give a great<br />

— if not unpredictable — performance. <strong>The</strong><br />

good news is that you don’t have to travel<br />

to the Hollywood Bowl or for that matter to<br />

tinsel town to see the performance of a diva.<br />

On Friday, Jan. 23, the Divas came to a<br />

local stage for a memorable performance. <strong>The</strong><br />

venue was the newly opened 2730 club in<br />

West Palm Beach. <strong>The</strong> Divas — Miss Peg,<br />

Madame Rose, Edie, Evie, Nickie Norton and<br />

Savannah — came prepared to give a show<br />

that none will soon forget. Replete with handmade<br />

costumes, these “ladies of the stage”<br />

<strong>were</strong> ready to do what they do best — raise<br />

money.<br />

Long before the curtain opened at 2730,<br />

these performers — all business<br />

professionals in the local community — <strong>were</strong><br />

prepping and primping to raise money for<br />

yet another gay and lesbian organization. It<br />

had been several months since anyone had<br />

viewed their Tea Dance Performance at Club<br />

Kashmir. <strong>The</strong>ir last event was to support the<br />

local AIDS Walk. <strong>The</strong> Jan. 23 event benefited<br />

Compass, Palm Beach County’s gay and<br />

lesbian community center.<br />

Carlos Garcia, one of the club’s owners,<br />

wanted to support Compass’s PrideFest. He<br />

also heard of the talented Divas and wanted<br />

them to perform at his club. With a few calls<br />

to the community center and the “girls”<br />

<strong>The</strong> Divas pictured with Scott Fox, development coordinator for Compass; Clarence<br />

Brooks, president of Compass’s board of trustees; and Betsy Becker<br />

network of friends and fans, the deal was<br />

done. <strong>The</strong> Divas <strong>were</strong> booked for the “Big<br />

Wig Dress Up Party.”<br />

In their previous performances, this<br />

highly talented group have collaborated on<br />

both ensemble and individual numbers to<br />

meet the needs of their demanding fans.<br />

While they have traveled throughout South<br />

Florida raising money, the Compass event<br />

was the first time they performed at 2730 club.<br />

Formerly the “El Cid Bar” and also referred<br />

to as “Le Cabaret Martini Video Bar,” 2730<br />

has years of history and is uniquely located<br />

in the heart of West Palm Beach’s historic<br />

district. <strong>The</strong> owners have carefully decorated<br />

the club to reflect its affluent surroundings.<br />

From crushed velvet curtains and comfortable<br />

seating arrangements to tasteful works of art<br />

and sculptures that adorn the walls, 2730’s<br />

spacious layout provides a welcome<br />

alternative to the raucous downtown club<br />

district. <strong>The</strong> term “bar” is perhaps deceiving;<br />

this entertainment venue is divided into four<br />

different meeting areas: the main bar, the<br />

dance floor, a movie room and a rear seating<br />

area.<br />

In the second of a series of fund-raising<br />

events held at 2730, the Divas took control<br />

of the movie room stage shortly after 10 p.m.<br />

<strong>The</strong> opening number, a classic from the<br />

Divinyls, brought the crowd to its feet.<br />

Shortly into the performance, Savannah<br />

showed the true range and talent of the Divas.<br />

Her performance of Cher’s “Turn Back Time”<br />

moved everyone from the main room and<br />

onto the dance floor.<br />

<strong>The</strong>re would be no cat fights backstage.<br />

After all, this was a benefit; every diva would<br />

get her time on stage. To prove their<br />

solidarity, several of the Divas paired up for<br />

both duets (including the show tune<br />

“Sisters”) and group performances. Perhaps<br />

the most popular number was from the movie<br />

“Grease.” “You’re the One That I Want”<br />

served as a theme to the night’s event.<br />

A backstage interview revealed that it<br />

won’t be long before this talented group<br />

next takes the stage. A third fund-raising<br />

event to commemorate Mardi Gras has<br />

been scheduled for Friday, Feb. 20. 2730 is<br />

located at 2730 South Dixie Hwy. (a quarter<br />

mile south of Belvedere Road directly<br />

across from the Palm Beach Post building).<br />

A memorable memorial service<br />

Friends gather at Jade Lounge in honor of Pagan “Sexilia” Rivera<br />

On Sunday, Jan. 25, a large crowd<br />

gathered at Jade Lounge in Miami Beach to<br />

raise funds to pay for the funeral expenses<br />

of Reynaldo Pagan “Sexilia” Rivera. Any<br />

leftover money will be donated to AIDS<br />

charities.<br />

Rivera passed away on Jan. 14 from<br />

AIDS-related complications. <strong>The</strong> popular<br />

drag queen had entertained crowds since the<br />

early days of South Beach’s gay scene until<br />

his death.<br />

Volunteers set up a shrine of glossy<br />

pictures that captured Rivera’s theatrical flair<br />

inside the club, which was aglow with 300<br />

candles. A number of South Florida’s bestknown<br />

drag queens performed on stage in<br />

front of a large portrait of their contemporary.<br />

Donations <strong>were</strong> taken at the door, and a gift<br />

basket valued at $1,000 was raffled off. At<br />

the end of the evening, everyone in the crowd<br />

held a candle and led a procession to the<br />

wharf a few blocks away from the club, where<br />

Rivera’s ashes <strong>were</strong> scattered in the waters<br />

off the city that he loved and came to know<br />

as home. Sobs could be heard, and a brief<br />

fireworks display brought the memorial to a<br />

close.<br />

As his drag persona Sexilia, Rivera was<br />

known for his razor sharp wit and great comic<br />

timing. For over a year he hosted karaoke<br />

nights at Twist, and was also a host at the<br />

club Liquid during its heyday.<br />

“She was charged up, over the top and<br />

full of energy, but very specific,” said Richard<br />

Jay-Alexander, the well-known South Beach<br />

producer who has just finished directing<br />

Bette Midler’s current tour.<br />

Jay-Alexander directed Rivera and some<br />

fellow drag queens in a rendition of “Hey<br />

Big Spender” from the Broadway show<br />

“Sweet Charity.” <strong>The</strong> gig was for the Bulgari<br />

spring jewelry show, and the press went crazy<br />

for it. “Of all the drag queens and performers,<br />

Sexilia was very unique. I mean they are all<br />

unique, but she was so ’60s and emanated<br />

the ’60s. And she looked real.”<br />

Dixon Miller was a neighbor and close<br />

friend of Riviera. <strong>The</strong> two had known each<br />

other since 1999, and lived right down the<br />

street from each other on Jefferson Avenue.<br />

He describes Rivera as very generous, and<br />

never expecting anything back in return.<br />

When Miller had a back injury and couldn’t<br />

move, Rivera did his shopping, laundry and<br />

prepared his meals. Little did Miller know that<br />

he would be caring for Rivera one year later.<br />

“Would he be surprised at tonight?<br />

Yes.” Miller said. “Would he be pleased?<br />

Extremely. <strong>The</strong> fact we are going to raise<br />

money to go beyond the expenses related to<br />

his funeral so that money can go on to help<br />

the people that are in his shoes in the future<br />

makes all of this essential and acceptable.”<br />

As an intensive care nurse, Miller was<br />

working at the same hospital Rivera spent<br />

his final days at, Mount Sinai.<br />

“He was in no pain in his final moments,”<br />

Miller said. “I had him on a diprivan drip. I<br />

never cared for him directly, because that<br />

would be ethically incorrect. But I made it<br />

known to the nurses on his floor that if he<br />

ever so much as sneezes you give me a call.”<br />

South Beach events planner Mark<br />

Stevens put together the enormous gift<br />

basket raffled off to help bring in funds. CDs<br />

from the Pride Factory, T-shirts from Zoo-14<br />

and expensive liquor filled the large mound<br />

of cellophane. Ian Schrager, the one-time coowner<br />

of legendary New York nightclub<br />

Studio 54, also leant a hand.<br />

“I put it together in one day,” Stevens<br />

said. “A lot of local businesses I work with<br />

on a regular basis contributed. Eden Roc gave<br />

us a weekend for two worth $700. I donated a<br />

lot of liquor, and Ian Schrager gave us some<br />

Dom Perignon.”<br />

“She would have had a great time being<br />

here,” said Miss Amy Rivers, one of Rivera’s<br />

fellow drag performers who collected<br />

donations at the front door. “Spiritually, she<br />

is here with us. What she would have wanted<br />

is for us to be happy for her. She is in a better<br />

place in heaven, and would be very happy<br />

having us celebrating her life. That is the<br />

way she would have wanted it.”<br />

Friends of Rivera turned to promoter<br />

Edison Farrow to help raise funds to cover<br />

funeral costs. Farrow, who puts on the Friday<br />

night Euphoria parties at Jade Lounge, was<br />

the mastermind behind the fund-raiser.<br />

Farrow fronted $795 for funeral costs, and<br />

then put out word of the memorial on his<br />

expansive e-mail database. Within no time<br />

members of the community came together to<br />

lend a hand. Jojo Infinity volunteered to play<br />

music for the evening. Pistols and Petals<br />

flower shop on Alton Road donated four<br />

enormous arrangements of white roses, which<br />

<strong>were</strong> Rivera’s favorite, and the flower petals<br />

that attendees tossed into the water at the<br />

end of the evening. A slew of drag queens<br />

performed, including Ebonee Excell, China<br />

Girl and Tiffany Arieagus. Adora had the large<br />

duty of emceeing the night, and led the<br />

procession to the harbor where the ashes<br />

<strong>were</strong> scattered.<br />

<strong>The</strong> fund-raiser brought in a total of<br />

$5,793. One thousand dollars each will go to<br />

Care Resource, South Beach AIDS project,<br />

United Foundation for AIDS and Prideline<br />

Youth Services. <strong>The</strong> remaining money will<br />

hiring. We’re the ones who will be kicked<br />

out of the soup kitchen.”<br />

Bush’s faith-based initiative would allow<br />

federal funding of religious groups that offer<br />

community services if they meet certain legal<br />

requirements. Mike Haley, who heads Focus<br />

on the Family’s “ex-gay” ministry, was one<br />

of the witnesses who testified at a<br />

subcommittee hearing on faith-based<br />

programs in Colorado Springs. Five of the 10<br />

Republican witnesses on the panel <strong>were</strong> from<br />

Focus on the Family, whose president, James<br />

Dobson, has been very outspoken in<br />

opposing gay rights efforts.<br />

“If the subcommittee wants to see a true<br />

portrait of Focus on the Family’s failed ex-gay<br />

program, I will be glad to provide a picture of<br />

ex-gay leader John Paulk running away from a<br />

gay bar,” Besen said. “Double lives and ruined<br />

lives are the real picture of these groups that<br />

Focus on the Family won’t show the<br />

subcommittee.”<br />

Haley, who was involved in Focus on the<br />

Family’s ex-gay conference “Love Won Out,”<br />

said Congressman Mark Souder (R-Ind.) asked<br />

him and other members of his group to<br />

participate in the subcommittee panel. “We<br />

<strong>were</strong> asked to talk about faith-based programs,”<br />

Haley said. “He asked us because we are one<br />

of the largest Christian ministries in the world.<br />

We testified about what Focus on the Family<br />

offers the community.”<br />

Haley insisted that Focus on the Family<br />

is not interested in receiving federal funds for<br />

its ex-gay ministry nor for any of its other<br />

programs. “Focus on the Family has never<br />

taken federal funds, nor do we wish to do so<br />

because with federal funds there are always<br />

strings attached,” Haley said. “We would never<br />

be able to maintain our Christian standards.<br />

I’m on the board of Exodus, and we would<br />

never take federal funding. I can’t name any<br />

ex-gay group that would want to take federal<br />

funding.”<br />

But Besen questioned why Haley and the<br />

other Focus on the Family members <strong>were</strong><br />

invited to testify at a hearing on a federally<br />

funded program. He described Bush’s faithbased<br />

initiative as a “scam” and suggested<br />

that the country may be headed down a<br />

slippery slope toward “having taxpayers,<br />

including gay people, pay for ex-gay therapy.”<br />

Besen doesn’t think taxpayers should<br />

have to foot the bill for a faith-based prison<br />

either. <strong>The</strong> nation’s first faith-based prison,<br />

the Lawtey Correctional Institution, opened<br />

Dec. 24 in Bradford County, Fla. <strong>The</strong> facility<br />

offers Bible studies, choir practice and<br />

religious counseling. Participation in the<br />

activities is voluntary, and inmates are free<br />

to transfer out of the prison.<br />

According to the Associated Press, at<br />

the opening ceremony, Florida Gov. Jeb Bush<br />

told inmates, “I can’t think of a better place<br />

to reflect on the awesome love of our Lord<br />

Jesus than to be here at Lawtey Correctional.<br />

God bless you.”<br />

Besen suggested that the governor’s<br />

remarks make it clear which faith the prison is<br />

based upon. “<strong>The</strong>y say it represents 26 faiths,<br />

but the vast majority of the people are going<br />

to be fundamentalist Christians,” Besen said.<br />

“And imagine being a gay prisoner in this new<br />

faith-based prison. If you transfer out, it will<br />

be frowned upon. It’s a recipe for a lot of<br />

intimidation. It also brings up the question of<br />

parole boards. I think people are going to<br />

spend more time in jail because they don’t<br />

subscribe to the state religion.”<br />

<strong>The</strong> <strong>Express</strong> contacted the White House<br />

Office of Faith-Based and Community<br />

Initiatives and asked if ex-gay ministries<br />

could be considered for federal funding<br />

under the president’s program. Katherine<br />

Ryan, media spokesperson for the faithbased<br />

office, promised to call back with an<br />

answer to the question, but as of press time<br />

she had not called back, even though she<br />

had two full days to respond.<br />

In a statement posted on the White House<br />

Web site, Jim Towey, director of the White<br />

House Office of Faith-Based and Community<br />

Initiatives, writes, “[<strong>The</strong> president] firmly<br />

believes that these organizations have an<br />

essential role to play in combating poverty<br />

and lessening suffering…. <strong>The</strong>y improve<br />

communities.” But the statement does not<br />

address the separation of church and state<br />

issue. In fact, the phrase “church and state”<br />

never appears in the 450-word message, which<br />

reads like a mission statement. <strong>The</strong> issue is<br />

also not mentioned in a link that provides an<br />

overview of the program. Towey does<br />

mentioned that there are “do’s and don’ts” of<br />

applying for a federal grant under the program.<br />

He also refers to “complicated rules and<br />

regulations that hinder these groups from<br />

competing for federal funds on an equal footing<br />

with other, larger charities.”<br />

Besen thinks the mainstream media has<br />

not focused enough attention on Bush’s<br />

faith-based program and other attempts to<br />

chip away at the wall separating church and<br />

state. “<strong>The</strong>y don’t grasp what these people<br />

are trying to do,” Besen said. “<strong>The</strong>se people<br />

want to destroy the separation of church and<br />

state. This faith-based initiative is the first<br />

step at sliding through the back door to do<br />

that. If we don’t stop it now and make these<br />

things a priority, the next thing you know<br />

these things will be funded.”<br />

Besen also criticized gay organizations<br />

for being complacent about the issue. “<strong>Gay</strong><br />

organizations are not speaking out strongly<br />

against faith-based initiatives because they<br />

don’t want to be labeled as anti-religious,”<br />

Besen said. “<strong>The</strong>y rationalize it by saying<br />

MCC can receive funds. But the people who<br />

control religion in America are anti-gay. <strong>Gay</strong><br />

organizations need to take the lead.”<br />

A president with a proud past<br />

New Stonewall Library head co-authored 1977 Dade Ordinance<br />

<strong>The</strong> election of Melodie Moorehead as<br />

president of the Stonewall Library &<br />

Archives brings a bit of living history to a<br />

facility that has become the cultural center<br />

of Fort Lauderdale. Twenty seven years ago,<br />

Moorehead co-authored the gay rights<br />

ordinance in Miami that Anita Bryant<br />

opposed.<br />

“I debated Anita Bryant back in 1978,”<br />

recalls Moorehead, who is now a licensed<br />

psychologist. “We had collected the 18,000<br />

signatures to put the issue of gay rights on<br />

the ballot for the first time back in Dade<br />

County.”<br />

Moorehead was studying psychology<br />

at the time, and says she participated in the<br />

ordinance effort as a preventative mental<br />

health measure. She was working with the<br />

gay and lesbian community and wanted to<br />

do something about the homophobia that<br />

she saw all around her.<br />

Pop singer and Christian conservative<br />

Bryant succeeded in repealing the civil rights<br />

ordinance for gays in Dade County. Bryant’s<br />

“Save the Children” campaign is largely<br />

credited for giving birth to the modern day<br />

religious right as well as spearheading the<br />

gay rights movement.<br />

<strong>The</strong> gay rights ordinance in Dade<br />

County was eventually reinstated in 1999.<br />

Bryant has long since faded into obscurity.<br />

After the ordinance was repealed, she lost<br />

her lucrative job as spokesperson for the<br />

Florida Citrus Commission when activists<br />

launched a successful boycott of Florida<br />

citrus products.<br />

“I had contact with Bryant on the night<br />

of the debate,” Moorehead said. “She was a<br />

very beautiful woman and had a lovely voice,<br />

but she was very limited with her prejudice<br />

and discrimination. <strong>The</strong>n I had contact with<br />

her again through the God and Country rally<br />

she did with Jerry Falwell in 1978. I had been<br />

invited to that rally with Doctor Alan<br />

Rockway, who is now deceased of AIDS, and<br />

Robert Kuntz.” Rockway and Kuntz <strong>were</strong> also<br />

co-authors of the 1977 gay rights ordinance.<br />

Moorehead says her history in the local<br />

gay rights movement was one reason why<br />

she was asked to head Stonewall Library. She<br />

says taking the position honors the memories<br />

of some of her activist friends of the past,<br />

like Dr. Rockway.<br />

As Stonewall president, she takes over<br />

the helm of an organization that has become<br />

a vibrant cultural force in the local community.<br />

“I am extremely proud and very much looking<br />

forward to working with the fine men and<br />

women that are on the board and interfacing<br />

with the community,” Moorehead says.<br />

Moorehead says that the primary<br />

mission of the library is to preserve the history<br />

of the gay community and make it accessible<br />

to the community. As for the sale of the <strong>Gay</strong><br />

& Lesbian Community Center, where the<br />

library currently rents space, Moorehead<br />

says it offers an opportunity for change.<br />

“<strong>The</strong>re are many things that are<br />

happening that are going to require the<br />

Stonewall Library & Achieves to be more<br />

independent and develop more of an<br />

identity,” Moorehead says. “We are hoping<br />

to do it as we make this relocation. We have<br />

a wonderful committee set up now that’s<br />

being shared by good people such as Vice<br />

President Jack Latona, who will be getting<br />

feedback to me from the committee as to what<br />

our options are going to be and what<br />

direction we should take.” She says the<br />

library’s membership will be included in<br />

planning for the future.<br />

Moorehead is also excited about the<br />

library expanding its vision by signing a<br />

contract with the U.S. Holocaust Museum.<br />

Stonewall will bring a traveling exhibition to<br />

South Florida in 2005 on the Nazi regime’s<br />

persecution of gay people. <strong>The</strong> exhibit will<br />

be housed at the Broward County Library.<br />

“We will be the only people in the state<br />

lesbians, and also to help people learn about<br />

the Stonewall Library.”<br />

go toward the funeral costs and to help out Rivera’s roommate, who was left with a<br />

handful of bills.<br />

Rivera originally hailed from Puerto Rico. He had been out of touch with his family<br />

for many years. <strong>The</strong> week he passed away, his brother Edgardo flew to Miami. A fax<br />

had to be sent to Rivera’s parents in Puerto Rico and signed in front of a notary and<br />

faxed back in order for Rivera to be cremated. According to Farrow, Rivera’s parents<br />

did not come to Miami themselves due to lack of funds. Though his brother was<br />

unable to attend the benefit, he was very appreciative that the community was coming<br />

together to take care of arrangements.<br />

In the end, the community that Rivera lived and worked in for so many years came<br />

together to pay homage to one of their own. <strong>The</strong> evening proved that someone with an<br />

unconventional life and offbeat path had a unique family and a support system of his<br />

own.<br />

Republicans should end military ban<br />

If they don’t, Bush could lose the 1 million gay votes he got in 2000<br />

Exit polling from the 2000 general election<br />

tells us 1 million gay men and lesbians voted<br />

for President Bush, and he still lost the<br />

popular vote by a half million. <strong>The</strong> 2004<br />

election may well be decided more by external<br />

factors, but the election will likely be<br />

agonizingly close.<br />

Three-plus years of the “Great Uniter”<br />

dividing people will do that for a nation.<br />

<strong>The</strong> Republican Party has an image<br />

problem with gays, which seems strange,<br />

since George W. Bush is the most gayfriendly<br />

Republican president ever. He has<br />

appointed a gay ambassador, and there are<br />

high-ranking gays in the White House and<br />

on his campaign staff. <strong>The</strong> president talks<br />

about tolerance even while he’s trying to<br />

deny rights and perpetuate the second-class<br />

citizenship that we experience today.<br />

<strong>The</strong> White House and Republicans in<br />

Congress should take the lead this year to<br />

end the ban against gay men and lesbians<br />

serving openly in the military. It would be a<br />

major political coup and the benefits of such<br />

leadership would more than make up for any<br />

backlash from their base supporters.<br />

Such a move would demonstrate that<br />

the Bush administration and Republicans are<br />

not waging their own private jihad against<br />

gay Americans, which would appeal to<br />

moderates who are uncomfortable with the<br />

current religious right rhetoric on marriage.<br />

Republicans can do this now because:<br />

• <strong>The</strong> Lawrence vs. Texas Supreme Court<br />

decision removed the last legal justification<br />

for denying gay men and lesbians the right<br />

to serve openly by stating our sexual<br />

orientation can no longer be deemed illegal.<br />

• A December 2003 CNN/USA Today/<br />

Gallup poll found that 79 percent of<br />

Americans believe gays should be able to<br />

serve openly. <strong>The</strong> American public is ready<br />

for the change.<br />

• Study after study of militaries where<br />

gays do serve openly shows there is no loss<br />

of effectiveness after the change in policy.<br />

<strong>The</strong>re are only two nations in NATO that do<br />

not allow gays to serve openly — the U.S.<br />

and Turkey. Do we want to be the last of our<br />

allies to make this change?<br />

• U.S. military forces have served in joint<br />

assignments with soldiers from other nations,<br />

where gays do serve openly, like Britain and<br />

Canada. <strong>The</strong>re have been no reported<br />

problems.<br />

• Republicans have the power. <strong>The</strong>y can<br />

steal another Democratic issue and make it<br />

their own. <strong>The</strong> ban will be lifted eventually.<br />

<strong>The</strong> only question is, who will get the credit<br />

for it?<br />

Think about that. <strong>The</strong> Democratic Party<br />

will be remembered for both “Don’t Ask,<br />

Don’t Tell” and the Defense of Marriage Act<br />

because President Clinton signed them into<br />

law, and many congressional Democrats<br />

couldn’t wait to jump into bed with<br />

Republicans on those issues.<br />

It would be President Bush and the<br />

Republicans who would be remembered for<br />

ending the military ban. <strong>The</strong>re hasn’t been a<br />

civil rights legacy like that in the Republican<br />

Party since the end of slavery.<br />

<strong>The</strong>re would be some cost, of course.<br />

Tony Perkins and Gary Bauer and other<br />

“family” activists will be screaming that they<br />

have been betrayed by the Republican Party.<br />

<strong>The</strong> social conservative base will make lots<br />

of noise about staying home on Election Day.<br />

Some might even follow through on that<br />

threat, but that is unlikely. <strong>Gay</strong> marriage will<br />

continue to be a hot-button issue all year<br />

and as long as Republicans in Congress are<br />

pushing for a constitutional amendment to<br />

discriminate against gay couples, the social<br />

conservative base will turn out to support<br />

Republicans. <strong>The</strong> threats will be empty.<br />

Hand someone a bandage while you’re<br />

bashing them over the head with a hammer.<br />

At one time, this was the fine art of<br />

compromise.<br />

And as Republicans prepare to end the<br />

ban, they can frame their argument for what<br />

it really is: A national security issue. It is in<br />

the vital interest of our national security that<br />

we allow gays to serve openly. In a time of<br />

war, can our military really afford to be without<br />

those 10,000 soldiers who have been<br />

discharged since “Don’t Ask, Don’t Tell”<br />

began?<br />

When we are struggling to win the hearts<br />

and minds of Iraqis and are in a desperate<br />

need of Arabic translators, can our nation<br />

afford to be without the more than 30 gay<br />

linguists who <strong>were</strong> discharged, many of<br />

whom spoke Arabic?<br />

<strong>The</strong> United States military is actually less<br />

effective because of this ban. That argument,<br />

and the ridiculous crusade for a<br />

constitutional amendment to discriminate<br />

against gay couples, should be enough to<br />

placate the “family” groups.<br />

With the political arguments for ending<br />

the ban behind me, I can return to my idealistic<br />

roots. Ending the military ban is simply the<br />

right thing to do. <strong>Gay</strong> men and lesbians have<br />

always served in our nation’s military, even<br />

at the highest levels, as the recent coming<br />

out of Brig. Gen. Keith Kerr, Brig. Gen. Virgil<br />

Richard and Rear Adm. Alan Steinman<br />

shows.<br />

How can we talk about honesty and<br />

serving proudly on one hand, and insist on<br />

dishonesty and shame on the other? <strong>The</strong><br />

policy forces our soldiers, sailors and pilots<br />

to be hypocrites. Is this how we honor those<br />

who would risk their lives for this country,<br />

by demanding they hide in the shadows?<br />

<strong>The</strong>re is no legitimate reason to deny<br />

gay service members the right to live openly<br />

as they serve the country they love. It makes<br />

sense politically. <strong>The</strong> nation is divided, and<br />

yet nearly eight of 10 people believe the time<br />

has come to end the ban. <strong>The</strong> other 20 percent<br />

will never alter their views.<br />

It is time for the White House and<br />

Republicans in Congress to show true<br />

leadership and compassion and give one<br />

Bush thinks he’s above accountability<br />

In light of the story in the Jan. 26 edition of <strong>The</strong> <strong>Express</strong>, I thought you would<br />

find the following quote from President Bush interesting: Bush to National Security<br />

Council: “I’m the commander, see — I do not need to explain why I say things.<br />

That’s the interesting thing about being the President — [I] don’t feel like I owe<br />

anybody an explanation.”<br />

Now if that doesn’t make you shudder. We have to get unBushed or we will<br />

continue to be Bush-wacked.<br />

GLCC sale is a bad deal for the community<br />

Many people will continue to debate the <strong>Gay</strong> & Lesbian Community Center<br />

(GLCC) sale on the issues of how the deal was done, etc. I want to address the deal<br />

itself. <strong>The</strong> picture in your article showed a really ugly structure that’s inappropriate<br />

for the location.<br />

Are we really expected to believe Tarragon Realty when they claim to have no<br />

interest in the surrounding properties? It’s more plausible that the gay bars there<br />

and their buildings will be gone as soon as they can make another secret agreement<br />

to bring in a Starbucks and other more “acceptable” businesses in Tarragon’s<br />

grand scheme of “improving the area.” And GLCC ought to get their lawyers ready<br />

for when Tarragon comes back to them and says they have to change the new<br />

GLCC because there is really not enough room on the site.<br />

It has always been my experience that developers are inherently dishonest.<br />

Deep down, was the confidentiality thing really plausible? I don’t think so. And<br />

who else finds Tarragon’s proposal to take over gay community centers all over<br />

the country and replace them with luxury condos really frightening? Is that what<br />

our community wants to stand for?<br />

Finally, as the sale price was obviously deflated, let’s hold out for a threestory<br />

new GLCC — more space. After all, how expensive can another truckload of<br />

cinder blocks be to a company that will be making $20 million off their sales.<br />

A gay dad is sent to jail<br />

Tenn. resident charged for answering son’s question about homosexuality<br />

Tennessee resident Joe Hogue thought<br />

he was being a good father by answering his<br />

9-year-old son’s questions about<br />

homosexuality, something his<br />

father knows about firsthand.<br />

But Hogue’s honesty with<br />

his son got him put in jail, then<br />

got him rebuked by an appeals<br />

court that essentially ordered him<br />

to act straight and not “subject”<br />

his son to the “gay lifestyle.”<br />

Hogue, a producer in the<br />

Christian music industry, and his<br />

wife, Cher, divorced in February<br />

2002, and Hogue went on to lead<br />

his life as a gay man. Though<br />

Hogue got partial custody rights to his son,<br />

part of the divorce decree prohibited Hogue<br />

from “taking the child around or otherwise<br />

exposing the child to his gay lover(s) and/or<br />

his gay lifestyle.”<br />

According to a complaint filed by his<br />

ex-wife, Hogue allowed his son to be with<br />

his lover in their home, and (ironically) at<br />

church.<br />

But what really got the ex-wife all riled<br />

was when Hogue apparently told his son<br />

outright that he is gay.<br />

“When someone is gay, they are born<br />

like that,” he told his little boy, as part of his<br />

explanation of being gay. <strong>The</strong> outraged<br />

mother complained about her ex-husband’s<br />

honesty, claiming that he was violating the<br />

court order to “shield” the little boy from the<br />

“homosexual lifestyle.”<br />

God forbid the little kid learn honesty<br />

and integrity and tolerance from his gay dad.<br />

Much better to follow the lead of the<br />

vindictive mother, and learn bigotry, denial,<br />

vengeance and homophobia.<br />

At least one court in<br />

Tennessee agreed. It found<br />

Hogue guilty of violating the<br />

divorce agreement, and sent him<br />

to jail for two days.<br />

Luckily, an appeals court<br />

disagreed at least with<br />

the part of the argument<br />

that landed Hogue in<br />

prison.<br />

“We do not read the<br />

restraining order to<br />

prohibit a statement by the father that<br />

he is gay,” an appeals court judge<br />

wrote. “Thus, [Mr. Hogue] did not<br />

have notice that he was prohibited<br />

from telling his son he was gay and<br />

therefore cannot be held in contempt<br />

for doing so.”<br />

Sadly, however, the appeals court found<br />

nothing wrong with the lower court order<br />

requiring that the little boy not be “exposed”<br />

to Mr. Hogue’s “gay lifestyle.”<br />

I always wonder what these kind of<br />

people mean when they say things like that.<br />

What — they don’t want the son to have<br />

good taste in clothes or be able to pick out<br />

nice antiques or to arrange flowers? Or maybe<br />

they don’t want the son to learn about selfrespect,<br />

or love, or civil rights? Hard to know<br />

which bothers them more.<br />

Hogue told his son he was gay because<br />

his son was asking questions — as kids that<br />

age are apt to do. Hogue became concerned<br />

when his son confided in him that others<br />

<strong>were</strong> gossiping. Worse, the child was being<br />

told that his father’s soul was going to be<br />

damned in hell for being gay.<br />

<strong>The</strong> rightfully alarmed gay dad wanted<br />

to clear it up with his son, to let his son know<br />

that he was a good Christian, and that he did<br />

not believe he was going to hell for being<br />

gay.<br />

A Tennessee judge<br />

threw Joe Hogue in jail<br />

for telling his son that<br />

being gay didn’t mean<br />

he’d be damned to hell.<br />

I often hear critics — even gay and<br />

lesbian parents — say that kids shouldn’t<br />

be told about homosexuality when they are<br />

“too young.”<br />

But unlike homosexuality, homophobia<br />

and prejudice and bigotry are not inherent<br />

traits and characteristics with which people<br />

are born. Those ugly attributes are totally<br />

man-made and learned.<br />

People who say we shouldn’t talk to kids<br />

about homosexuality until they are “old<br />

enough to know about it,” are really saying<br />

we should just wait until kids are already<br />

brainwashed by society to hate gay people,<br />

and then, when damage is already well set in,<br />

we should try to do a meager job of reversing<br />

it.<br />

To most kids, being gay or lesbian is<br />

initially a neutral point. It becomes an issue<br />

when they pick up on societal clues around<br />

them that this is somehow bad or wrong or<br />

dirty.<br />

Anyone who thinks that pre-teen kids<br />

are “too young” to know about gay people<br />

has never been to a local playground<br />

or in a contemporary school, where the<br />

words “fag” and “gay” are used<br />

incessantly. And not in a good way.<br />

<strong>The</strong> question isn’t whether or not<br />

kids should learn about what it means<br />

to be gay. <strong>The</strong>y’re going to get<br />

information about it one way or the<br />

other.<br />

<strong>The</strong> question is what they hear,<br />

how they hear it, and who they hear it<br />

from.<br />

For Hogue, the issue was being honest<br />

with his son, letting his son know who he<br />

really is, and trying to educate his son<br />

differently from the intolerant viewpoints he<br />

was otherwise getting — the only<br />

viewpoints the little boy apparently was<br />

getting.<br />

Hogue did a brave and courageous thing<br />

as a gay man. More importantly, he did the<br />

right thing as a good father.<br />

Treating HIV as a crime<br />

In Florida, failing to disclose status before having sex is felony<br />

HIV Disclosure is the silent volcano<br />

among gay men. Hardly anybody hears<br />

rumbling debates about the issue, but fiery<br />

emotions brew just below the<br />

surface.<br />

A reader’s recent e-mail<br />

reflects a common viewpoint: “I<br />

am completely appalled by the<br />

lack of respect for human life of<br />

some HIV-positive people. I know<br />

that it is my responsibility to<br />

protect myself. But I also feel<br />

very strongly that if you have<br />

HIV, you have a moral obligation<br />

to inform anyone who stands the<br />

risk of contracting the virus from<br />

you. … I believe that if you<br />

knowingly infect someone with the HIV virus,<br />

it’s murder.”<br />

Another writer challenged that<br />

expectation, recommending guys adopt a<br />

“buyer beware” attitude: “You say that<br />

‘disclosure should be the expected norm.’<br />

Ha! Do you always believe what someone<br />

tells you?”<br />

What keeps us from descending into that<br />

sort of cynicism, always suspecting our lovers<br />

are liars?<br />

Many gay men look to the law to protect<br />

them. <strong>The</strong>y assume that the threat of<br />

punishment will motivate any HIV-infected<br />

sex partners to answer honestly when asked<br />

their status.<br />

But the law is a clumsy instrument to<br />

regulate romantic affairs. I always point out<br />

that “no court has ever overturned an HIV<br />

infection.” Winning a judgment against a<br />

person who infected you may be small solace<br />

for the person who faces a lifetime of<br />

treatment anxiety, and possibly<br />

acquired treatment resistance.<br />

<strong>The</strong> justice system<br />

may not be well equipped<br />

to negotiate our<br />

community’s conflicted<br />

beliefs about HIV status<br />

disclosure. Still, threedozen<br />

states have passed<br />

some sort of laws, and not<br />

all are codicils of rationale<br />

legislation.<br />

Just last month in<br />

California, San Francisco<br />

Superior Court Judge Kay Tsenin<br />

tossed out the case against Ronald<br />

Gene Hill, accused of repeatedly<br />

denying his HIV infection to sex<br />

partners, at least two of whom he<br />

subsequently infected.<br />

<strong>The</strong> charges against Hill <strong>were</strong> not<br />

dropped because these claims <strong>were</strong> proven<br />

untrue. <strong>The</strong>y <strong>were</strong> dropped because<br />

California’s ludicrous law does not criminalize<br />

willfully deceiving sex partners about HIV<br />

status.<br />

<strong>The</strong> standard for criminal behavior<br />

under the California HIV disclosure law<br />

requires that the positive defendant must<br />

have acted with the “specific intent” of<br />

infecting the other person. Merely lying to<br />

get your rocks off, with willful disregard of<br />

the risks to your partner, is not considered a<br />

criminal act in California. Seriously.<br />

If California’s law is overly narrow and<br />

lenient, Florida’s law is overly broad and<br />

punitive. A person diagnosed with HIV in<br />

Florida is guilty of a felony if he or she ever<br />

has sex with another person without first<br />

disclosing HIV status. Using condoms<br />

doesn’t excuse someone legally from not<br />

disclosing.<br />

In a long-term relationship, we may<br />

question the morality of hiding HIV infection<br />

whether condoms are used or not. But early<br />

in a relationship, or in a casual sex encounter,<br />

a person who uses condoms has certainly<br />

fulfilled a reasonable obligation to protect a<br />

partner.<br />

Some may say that allowing condoms<br />

to replace disclosure is too permissive. Why<br />

shouldn’t HIV-positive people always be<br />

“forced” to disclose their status? Because<br />

that requirement makes it less likely that<br />

people will take an HIV test in the first place.<br />

Many who suspect they are<br />

infected will choose not to confirm<br />

their suspicions, as this knowledge<br />

would make them vulnerable to<br />

prosecution if they ever blundered<br />

into impulsive sex with a stranger to<br />

whom they didn’t want to disclose<br />

their status. Protection without<br />

disclosure is preferable to denial and<br />

possible non-protection.<br />

HIV-positive gay men may also<br />

doubt that the legal punishment will<br />

follow non-disclosure, whereas the<br />

risk of social excommunication<br />

following disclosure is very real.<br />

Even today, I see gay men point<br />

out other men they believe to be<br />

infected, and warn their friends to<br />

“be careful, he’s not clean.” That<br />

discriminatory language creates a hostile<br />

environment for any who do want to protect<br />

their partners through honest disclosure.<br />

Legislators may not be able to manage<br />

fair language, but we should be able to speak<br />

to each other about HIV status honestly and<br />

empathetically.<br />
