A semi-permanently flooded wetland is designated as having surface waters that persist throughout the growing season, in most years; when surface water is absent, the water table is usually at or near the land’s surface. The NYSDEC also delineated freshwater wetlands. In accordance with Article 23 of the New York State Environmental Conservation Law (NYS, 1075), freshwater wetlands are defined as those lands and waters that meet the following criteria: • Contain marshes, swamps, bogs, wetland trees, wetland shrubs, emergent vegetation, free-floating vegetation, rooted floating vegetation, or submergent vegetation. • Are substantially enclosed by aquatic or semi-aquatic vegetation. • Are shown on the NYS Freshwater Wetlands Maps. Freshwater wetlands associated with Mill Creek are located on Brook Road, on both sides of the roadway (including Mill Pond, located on the east side of the roadway discussed earlier in this section). An area of NYSDEC-designated freshwater wetland on the west side of Brook Road has been filled and a residence now occupies the site. Freshwater seeps from this site are collected into drainage structures and piped through a catch basin system into the creek on the east side of Brook Road. These wetlands have a NYSDEC designation of PJ-3. The NYSDEC wetland is noted on the in Habitat Assessment on Map 7. Tidal Wetlands Tidal wetlands are ecologically important environmentally productive and support a diversity of species. Tidal wetlands provide a number of valuable stormwater mitigation functions such as flood control, shore protection, sediment reduction, and pollution mitigation. The tidal wetlands were inventoried and mapped by the NYSDEC in 1979. While Mill Creek does not appear on NYSDEC tidal wetlands maps, the eastern segment November 2010 2 ND Draft 2-15
