RECYCLING HAZARDOUS OR INDUSTRIAL WASTE<br />

The Texas Solid Waste Disposal Act Authorized the Texas Commission on Environmental Quality (<strong>TCEQ</strong>) to<br />

regulate all industrial solid waste <strong>and</strong> municipal hazardous waste activities in Texas. Use this <strong><strong>for</strong>m</strong> to notify the<br />

<strong>TCEQ</strong> of wastes which are to be received <strong>for</strong> <strong>recycling</strong> by your facility. This <strong><strong>for</strong>m</strong> is not appropriate <strong>for</strong><br />

generators of materials to be recycled. Generators should use Form #<strong>TCEQ</strong>-0525.<br />

All in<strong><strong>for</strong>m</strong>ation is required <strong>for</strong> a complete <strong>notification</strong>, unless otherwise indicated.<br />

Storage of material prior to <strong>recycling</strong> may require a permit as described in Title 30 Texas Administrative<br />

Code (TAC) Section (§)335.2 For more in<strong><strong>for</strong>m</strong>ation on permitting requirements you may contact the<br />

Industrial <strong>and</strong> Hazardous Waste Permits Section at (512) 239-6595.<br />

Any waste generated from <strong>recycling</strong> processes which involve industrial <strong>and</strong>/or hazardous waste is subject to<br />

all applicable requirements of 30 TAC Chapter 335. For in<strong><strong>for</strong>m</strong>ation on waste <strong>notification</strong> <strong><strong>for</strong>m</strong>s, you may<br />

contact the Industrial <strong>and</strong> Hazardous Waste Permits Section at (512) 239-6412.<br />

Please note that deed recordation as outlined in 30 TAC 335.5 is not required <strong>for</strong> the legitimate<br />

reuse/<strong>recycling</strong> of nonhazardous materials, even if l<strong>and</strong> applied.<br />

For additional in<strong><strong>for</strong>m</strong>ation on <strong>recycling</strong>, please refer to 30 TAC 335.24 <strong>and</strong>/or Subchapter H.<br />

Materials which are recycled remain subject to the General Prohibitions of 30 TAC 335.4. As described in<br />

this Section, recyclable materials may not<br />

1) threaten the waters of the state, or<br />

2) cause a nuisance, or<br />

3) endanger human health <strong>and</strong>/or welfare.<br />
