1. INTRODUCTION<br />

“Wednesday was <str<strong>on</strong>g>the</str<strong>on</strong>g> worst day. The [broadcaster]<br />

was advising people to stay calm and he was<br />

collecting [bullet] shells to show as evidence. At<br />

about 6:30 am <str<strong>on</strong>g>the</str<strong>on</strong>g>y went to go arrest <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

[broadcaster] and <str<strong>on</strong>g>the</str<strong>on</strong>g> youths, women and children<br />

followed to resist <str<strong>on</strong>g>the</str<strong>on</strong>g> arrest. There was some<br />

firing but no causalities. The [police] came into<br />

my restaurant and took my drinks. They ate all <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

food. They emptied my freezer. They terrorized<br />

our neighbours. They verbally abused every<strong>on</strong>e,<br />

especially women. They were firing at people’s<br />

cooking pots. We were forced to stay indoors <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

rest <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> day. We were asking <str<strong>on</strong>g>the</str<strong>on</strong>g> youths to go<br />

inside so <str<strong>on</strong>g>the</str<strong>on</strong>g> women were preparing to go down<br />

[to <str<strong>on</strong>g>the</str<strong>on</strong>g> police stati<strong>on</strong>] - singing peace s<strong>on</strong>gs.”<br />

I.S., witness to events in Bumbuna, interviewed by Amnesty Internati<strong>on</strong>al <strong>on</strong> 12 May 2012<br />

Over a period <str<strong>on</strong>g>of</str<strong>on</strong>g> two days in April 2012 <str<strong>on</strong>g>the</str<strong>on</strong>g> police in <str<strong>on</strong>g>the</str<strong>on</strong>g> Sierra Le<strong>on</strong>ean town <str<strong>on</strong>g>of</str<strong>on</strong>g> Bumbuna<br />

fired live ammuniti<strong>on</strong> at unarmed community members, used chemical irritants described as<br />

teargas to dispel protests, raided homes and businesses and threatened numerous<br />

individuals. One woman was killed and at least 11 were injured, many as a result <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

gunshots.<br />

The events in Bumbuna occurred in <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>text <str<strong>on</strong>g>of</str<strong>on</strong>g> a dem<strong>on</strong>strati<strong>on</strong> by employees <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> ir<strong>on</strong>ore<br />

mining company, African Minerals Limited (AML), who had launched a public<br />

dem<strong>on</strong>strati<strong>on</strong> over working c<strong>on</strong>diti<strong>on</strong>s and pay.<br />

Amnesty Internati<strong>on</strong>al visited Bumbuna in May 2012 to investigate <str<strong>on</strong>g>the</str<strong>on</strong>g>se events. The<br />

organizati<strong>on</strong> interviewed numerous witnesses, as well as victims, police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers, health<br />

workers, local civil society and human rights organizati<strong>on</strong>s and community members. Some <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

those interviewed asked not to be identified and some names have been changed to protect<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>ir identity.<br />

Although <str<strong>on</strong>g>the</str<strong>on</strong>g> Amnesty Internati<strong>on</strong>al delegati<strong>on</strong> was able to speak to individual police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers,<br />

efforts to meet <str<strong>on</strong>g>of</str<strong>on</strong>g>ficially with a spokespers<strong>on</strong> for <str<strong>on</strong>g>the</str<strong>on</strong>g> Sierra Le<strong>on</strong>e Police (SLP) were<br />

unsuccessful. The organizati<strong>on</strong> also wrote to <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP and AML presenting its findings and<br />

requesting fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r informati<strong>on</strong>. The SLP did not resp<strong>on</strong>d to Amnesty Internati<strong>on</strong>al’s request.<br />

However, AML acknowledged receipt <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> letter and expressed willingness to engage with<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> organizati<strong>on</strong>. On 3 August 2012, Amnesty Internati<strong>on</strong>al received a two and half page<br />

resp<strong>on</strong>se from AML, which has been taken into account in this document. AML granted<br />

Amnesty Internati<strong>on</strong>al permissi<strong>on</strong> to make this letter publicly available, and it is included in<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> appendix <str<strong>on</strong>g>of</str<strong>on</strong>g> this document. 1 Representatives for AML also met with Amnesty<br />

Internati<strong>on</strong>al in L<strong>on</strong>d<strong>on</strong>, and AML followed up directly in a sec<strong>on</strong>d letter dated 17 September<br />

2012. The organizati<strong>on</strong> welcomes <str<strong>on</strong>g>the</str<strong>on</strong>g> fact that AML resp<strong>on</strong>ded. Recommendati<strong>on</strong>s to <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Sierra Le<strong>on</strong>e government and AML are included in <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>clusi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this document.<br />

Based <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> evidence ga<str<strong>on</strong>g>the</str<strong>on</strong>g>red at Bumbuna, Amnesty Internati<strong>on</strong>al believes that <str<strong>on</strong>g>the</str<strong>on</strong>g> police<br />

used arbitrary or abusive force, in breach <str<strong>on</strong>g>of</str<strong>on</strong>g> internati<strong>on</strong>al standards guiding <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> force<br />

and firearms by law enforcement <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers, and resulting in a violati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> right to life.<br />

Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>rmore, <str<strong>on</strong>g>the</str<strong>on</strong>g> organizati<strong>on</strong> is c<strong>on</strong>cerned that <str<strong>on</strong>g>the</str<strong>on</strong>g> close relati<strong>on</strong>ship between <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP and<br />

AML raises serious questi<strong>on</strong>s about <str<strong>on</strong>g>the</str<strong>on</strong>g> ability <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> police in Bumbuna to independently<br />

maintain public order and enforce <str<strong>on</strong>g>the</str<strong>on</strong>g> rule <str<strong>on</strong>g>of</str<strong>on</strong>g> law in an impartial manner.<br />

Amnesty Internati<strong>on</strong>al welcomes <str<strong>on</strong>g>the</str<strong>on</strong>g> Public Inquiry being undertaken by <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al <strong>Human</strong><br />

<strong>Rights</strong> Commissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Sierra Le<strong>on</strong>e (NHRC) into <str<strong>on</strong>g>the</str<strong>on</strong>g> events at Bumbuna. It urges <str<strong>on</strong>g>the</str<strong>on</strong>g> Sierra<br />

Le<strong>on</strong>e government to promptly implement <str<strong>on</strong>g>the</str<strong>on</strong>g> following recommendati<strong>on</strong>s:<br />

Ensure those suspected <str<strong>on</strong>g>of</str<strong>on</strong>g> arbitrary or abusive use <str<strong>on</strong>g>of</str<strong>on</strong>g> force in Bumbuna, including those<br />

with command resp<strong>on</strong>sibility, are investigated and prosecuted in proceedings which meet<br />

internati<strong>on</strong>al standards <str<strong>on</strong>g>of</str<strong>on</strong>g> fairness; <str<strong>on</strong>g>the</str<strong>on</strong>g> NHRC Public Inquiry should not be a substitute for<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> criminal investigati<strong>on</strong>s and prosecuti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> perpetrators; all <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers suspected <str<strong>on</strong>g>of</str<strong>on</strong>g> arbitrary<br />

or abusive use <str<strong>on</strong>g>of</str<strong>on</strong>g> force should be suspended from duty pending investigati<strong>on</strong>s;<br />

Ensure that victims and/or <str<strong>on</strong>g>the</str<strong>on</strong>g>ir families receive effective remedies, including<br />

compensati<strong>on</strong>, for <str<strong>on</strong>g>the</str<strong>on</strong>g> loss <str<strong>on</strong>g>of</str<strong>on</strong>g> life, injuries sustained and loss <str<strong>on</strong>g>of</str<strong>on</strong>g> livelihood as a result <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

police acti<strong>on</strong>s in Bumbuna in April 2012. Damage and loss <str<strong>on</strong>g>of</str<strong>on</strong>g> property should also be<br />

compensated;<br />

Publicly c<strong>on</strong>demn through newspapers, radio, televisi<strong>on</strong> and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r mediums all use <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

unnecessary or excessive force by <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP; and ensure this announcement is widely<br />

disseminated to police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers, as well as <str<strong>on</strong>g>the</str<strong>on</strong>g> public.

2. EVENTS IN BUMBUNA, 15-18<br />

APRIL<br />

The town <str<strong>on</strong>g>of</str<strong>on</strong>g> Bumbuna is located in <str<strong>on</strong>g>the</str<strong>on</strong>g> T<strong>on</strong>kolili District, Nor<str<strong>on</strong>g>the</str<strong>on</strong>g>rn Province <str<strong>on</strong>g>of</str<strong>on</strong>g> Sierra Le<strong>on</strong>e.<br />

This area is rich in natural resources, including ir<strong>on</strong> ore. It is also <str<strong>on</strong>g>the</str<strong>on</strong>g> home <str<strong>on</strong>g>of</str<strong>on</strong>g> a governmentowned<br />

hydropower dam, which provides electricity to Freetown and Makeni. Despite<br />

Bumbuna’s natural resource wealth, many community members complained <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

underdevelopment, including lack <str<strong>on</strong>g>of</str<strong>on</strong>g> paved roads, running water and electricity in homes.<br />

Levels <str<strong>on</strong>g>of</str<strong>on</strong>g> unemployment in <str<strong>on</strong>g>the</str<strong>on</strong>g> area are reported to be high, due to a large influx <str<strong>on</strong>g>of</str<strong>on</strong>g> migrants<br />

in search <str<strong>on</strong>g>of</str<strong>on</strong>g> employment.<br />

African Minerals Limited (AML) is a UK-based company with significant interests in Sierra<br />

Le<strong>on</strong>e. It has a license to mine in <str<strong>on</strong>g>the</str<strong>on</strong>g> T<strong>on</strong>kolili District. According to <str<strong>on</strong>g>the</str<strong>on</strong>g> company’s 2011<br />

annual report to its investors, AML is <str<strong>on</strong>g>the</str<strong>on</strong>g> largest private employer in Sierra Le<strong>on</strong>e, employing<br />

7,425 people - 82 per cent <str<strong>on</strong>g>of</str<strong>on</strong>g> whom are Sierra Le<strong>on</strong>ean nati<strong>on</strong>als. 2<br />

On 15 April 2012 local employees at <str<strong>on</strong>g>the</str<strong>on</strong>g> AML mine in Bumbuna initiated a public<br />

dem<strong>on</strong>strati<strong>on</strong> to protest <str<strong>on</strong>g>the</str<strong>on</strong>g>ir working c<strong>on</strong>diti<strong>on</strong>s and remunerati<strong>on</strong>. On <str<strong>on</strong>g>the</str<strong>on</strong>g> same day, <str<strong>on</strong>g>the</str<strong>on</strong>g>y<br />

provided notice to <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer in charge <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Bumbuna police and some workers placed<br />

barricades <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> main roads leading to <str<strong>on</strong>g>the</str<strong>on</strong>g> town.<br />

On 16 April <str<strong>on</strong>g>the</str<strong>on</strong>g> workers ga<str<strong>on</strong>g>the</str<strong>on</strong>g>red at <str<strong>on</strong>g>the</str<strong>on</strong>g> awning <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> local court house, a comm<strong>on</strong> ga<str<strong>on</strong>g>the</str<strong>on</strong>g>ring<br />

place for <str<strong>on</strong>g>the</str<strong>on</strong>g> community. The police in Bumbuna c<strong>on</strong>firmed <str<strong>on</strong>g>the</str<strong>on</strong>g> ga<str<strong>on</strong>g>the</str<strong>on</strong>g>ring <strong>on</strong> 16 April was<br />

peaceful. 3 N<strong>on</strong>e<str<strong>on</strong>g>the</str<strong>on</strong>g>less, <str<strong>on</strong>g>the</str<strong>on</strong>g>y called in reinforcements from Makeni, Magburaka and<br />

Freetown. Over <str<strong>on</strong>g>the</str<strong>on</strong>g> following two days several local government ministers also came to<br />

Bumbuna. The details <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> interacti<strong>on</strong>s between local government <str<strong>on</strong>g>of</str<strong>on</strong>g>ficials, AML and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

protesting workers during <str<strong>on</strong>g>the</str<strong>on</strong>g> 16 to 18 April are not clear, but as far as Amnesty Internati<strong>on</strong>al<br />

understands, protesters were told <str<strong>on</strong>g>the</str<strong>on</strong>g>ir c<strong>on</strong>cerns would be heard <strong>on</strong> 16 and 17 April.<br />

However, it was not until <str<strong>on</strong>g>the</str<strong>on</strong>g> evening <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> 18 April that a delegati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> local government<br />

ministers attempted to meet with <str<strong>on</strong>g>the</str<strong>on</strong>g> community, but this was unsuccessful.<br />

working c<strong>on</strong>diti<strong>on</strong>s and remunerati<strong>on</strong>.<br />

One local senior police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer, K.K., stated:<br />

“They [AML employees] placed barricades all over <str<strong>on</strong>g>the</str<strong>on</strong>g> place. The barricades were placed and<br />

o<str<strong>on</strong>g>the</str<strong>on</strong>g>rs were prevented from going to work. Five ministers came <strong>on</strong> Wednesday (18 April) but<br />

some delegates came <strong>on</strong> Tuesday (17 April) and urged <str<strong>on</strong>g>the</str<strong>on</strong>g> workers to stop <str<strong>on</strong>g>the</str<strong>on</strong>g> strike. The<br />

violence took place after two days. It was peaceful <str<strong>on</strong>g>the</str<strong>on</strong>g> first day but <str<strong>on</strong>g>the</str<strong>on</strong>g> strike was not<br />

unanimous.” 4<br />

Around 12:30 pm <strong>on</strong> 17 April, shots were heard near <str<strong>on</strong>g>the</str<strong>on</strong>g> AML fuel farm (a fuel depot), where<br />

some <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> protestors had moved to wait for a c<strong>on</strong>voy <str<strong>on</strong>g>of</str<strong>on</strong>g> local government ministers to drive<br />

by so <str<strong>on</strong>g>the</str<strong>on</strong>g>y could express <str<strong>on</strong>g>the</str<strong>on</strong>g>ir grievances against AML. 5 Shortly <str<strong>on</strong>g>the</str<strong>on</strong>g>reafter, around 1 pm, <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

police entered <str<strong>on</strong>g>the</str<strong>on</strong>g> main marketplace at Bumbuna - which was nowhere near <str<strong>on</strong>g>the</str<strong>on</strong>g> AML workers<br />

who were staging protests, and populated largely by women traders and <str<strong>on</strong>g>the</str<strong>on</strong>g>ir children – and<br />

fired tear gas and live ammuniti<strong>on</strong> into <str<strong>on</strong>g>the</str<strong>on</strong>g> air. Several women traders reported that <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

police also looted or destroyed <str<strong>on</strong>g>the</str<strong>on</strong>g>ir market stalls. 6<br />

One woman trader, told Amnesty Internati<strong>on</strong>al:<br />

“We saw five OSD (Operati<strong>on</strong> Support Divisi<strong>on</strong> police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers) 7 pers<strong>on</strong>nel entering <str<strong>on</strong>g>the</str<strong>on</strong>g> market<br />

place around 1 pm and <str<strong>on</strong>g>the</str<strong>on</strong>g>y fired tear gas, followed by live bullets in <str<strong>on</strong>g>the</str<strong>on</strong>g> air. They <str<strong>on</strong>g>the</str<strong>on</strong>g>n went<br />

<strong>on</strong> a rapid firing across <str<strong>on</strong>g>the</str<strong>on</strong>g> township. They were just roaming all over <str<strong>on</strong>g>the</str<strong>on</strong>g> town shooting tear<br />

gas and bullets through <str<strong>on</strong>g>the</str<strong>on</strong>g> day and anywhere <str<strong>on</strong>g>the</str<strong>on</strong>g>y saw smoke <str<strong>on</strong>g>the</str<strong>on</strong>g>y went <str<strong>on</strong>g>the</str<strong>on</strong>g>re and <str<strong>on</strong>g>the</str<strong>on</strong>g>y even<br />

shot at pots where people were preparing food and <str<strong>on</strong>g>the</str<strong>on</strong>g>y ate our own food and placed me at

gun point…<str<strong>on</strong>g>the</str<strong>on</strong>g> police used abusive language against <str<strong>on</strong>g>the</str<strong>on</strong>g> women and threatened <str<strong>on</strong>g>the</str<strong>on</strong>g>m. When<br />

I returned to <str<strong>on</strong>g>the</str<strong>on</strong>g> market, all <str<strong>on</strong>g>of</str<strong>on</strong>g> my bel<strong>on</strong>gings [were] missing. We are in total doubt as to<br />

what was our take into <str<strong>on</strong>g>the</str<strong>on</strong>g> whole situati<strong>on</strong>. We are not African Minerals workers, just market<br />

women.” 8<br />

The police have reportedly claimed that <str<strong>on</strong>g>the</str<strong>on</strong>g>y were chasing men who were trying to burn down<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> fuel farm and had allegedly fled into <str<strong>on</strong>g>the</str<strong>on</strong>g> marketplace. However, Amnesty Internati<strong>on</strong>al<br />

was not able to find any evidence to corroborate this. According to <str<strong>on</strong>g>the</str<strong>on</strong>g> market women and<br />

o<str<strong>on</strong>g>the</str<strong>on</strong>g>r eye witnesses, <str<strong>on</strong>g>the</str<strong>on</strong>g> police simply entered <str<strong>on</strong>g>the</str<strong>on</strong>g> market place and began shooting without<br />

There was no threat to <str<strong>on</strong>g>the</str<strong>on</strong>g>ir lives or <str<strong>on</strong>g>the</str<strong>on</strong>g> lives <str<strong>on</strong>g>of</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>rs and <str<strong>on</strong>g>the</str<strong>on</strong>g> police were not<br />

being shot at.<br />

Throughout <str<strong>on</strong>g>the</str<strong>on</strong>g> evening <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> 17 April and into <str<strong>on</strong>g>the</str<strong>on</strong>g> early hours <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> morning <strong>on</strong> 18 April, a<br />

local radio broadcaster was reporting <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> events, including <str<strong>on</strong>g>the</str<strong>on</strong>g> behaviour <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> police and<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> grievances <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> AML employees. He was hosting a live call-in radio show where people<br />

could express <str<strong>on</strong>g>the</str<strong>on</strong>g>ir opini<strong>on</strong>s and report <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> events. According to people listening to <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

show, and <str<strong>on</strong>g>the</str<strong>on</strong>g> broadcaster himself, he was urging every<strong>on</strong>e to maintain calm. 9<br />

The broadcaster told Amnesty Internati<strong>on</strong>al that at approximately 6:30 AM <strong>on</strong> 18 April, <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

SLP, in an AML vehicle, driven by an AML employee, arrived at <str<strong>on</strong>g>the</str<strong>on</strong>g> local radio stati<strong>on</strong> to<br />

questi<strong>on</strong> him, claiming that he was resorting to hate speech and inciting <str<strong>on</strong>g>the</str<strong>on</strong>g> local residents.<br />

According to <str<strong>on</strong>g>the</str<strong>on</strong>g> journalist, three people entered <str<strong>on</strong>g>the</str<strong>on</strong>g> radio stati<strong>on</strong> (a senior police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer, a<br />

photographer and an armed OSD <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer) and <str<strong>on</strong>g>the</str<strong>on</strong>g> police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer stated <str<strong>on</strong>g>the</str<strong>on</strong>g>y were questi<strong>on</strong>ing<br />

him because <str<strong>on</strong>g>of</str<strong>on</strong>g> “all that you are saying against us.” The journalist agreed to accompany <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

police to <str<strong>on</strong>g>the</str<strong>on</strong>g> police stati<strong>on</strong> to be questi<strong>on</strong>ed but was released after <str<strong>on</strong>g>the</str<strong>on</strong>g> community came to<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> radio stati<strong>on</strong> to prevent what <str<strong>on</strong>g>the</str<strong>on</strong>g>y believed was his arrest. 10<br />

Although events are not fully clear, it appears that <str<strong>on</strong>g>the</str<strong>on</strong>g> police may have used live ammuniti<strong>on</strong><br />

near <str<strong>on</strong>g>the</str<strong>on</strong>g> radio stati<strong>on</strong>. One young man who was injured by <str<strong>on</strong>g>the</str<strong>on</strong>g> firing told Amnesty<br />

Internati<strong>on</strong>al:<br />

“Early morning <strong>on</strong> Wednesday (18 April) we went to <str<strong>on</strong>g>the</str<strong>on</strong>g> radio stati<strong>on</strong> –about <str<strong>on</strong>g>the</str<strong>on</strong>g> same time<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>y went to arrest <str<strong>on</strong>g>the</str<strong>on</strong>g> [broadcaster]. I was moving over from <str<strong>on</strong>g>the</str<strong>on</strong>g> scene across <str<strong>on</strong>g>the</str<strong>on</strong>g> river to get<br />

to <str<strong>on</strong>g>the</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r side when I felt something <strong>on</strong> my foot like a st<strong>on</strong>e so I lifted my foot and I saw I<br />

had been shot. I felt dizzy and fell down. My friends came to rescue me and <str<strong>on</strong>g>the</str<strong>on</strong>g>y took me to<br />

community health <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer so in <str<strong>on</strong>g>the</str<strong>on</strong>g> hospital when <str<strong>on</strong>g>the</str<strong>on</strong>g> police came again <str<strong>on</strong>g>the</str<strong>on</strong>g>y arrest me. They<br />

also ran after o<str<strong>on</strong>g>the</str<strong>on</strong>g>r people in <str<strong>on</strong>g>the</str<strong>on</strong>g> hospital including my own bro<str<strong>on</strong>g>the</str<strong>on</strong>g>r.” 11<br />

Later <str<strong>on</strong>g>the</str<strong>on</strong>g> same morning, a group <str<strong>on</strong>g>of</str<strong>on</strong>g> protesters who were airing <str<strong>on</strong>g>the</str<strong>on</strong>g>ir grievances against <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

SLP’s use <str<strong>on</strong>g>of</str<strong>on</strong>g> force and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r misc<strong>on</strong>duct <str<strong>on</strong>g>the</str<strong>on</strong>g> previous day were fired at while <str<strong>on</strong>g>the</str<strong>on</strong>g>y marched to<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> town police stati<strong>on</strong>.<br />

According to eye witnesses, <str<strong>on</strong>g>the</str<strong>on</strong>g> police fired live ammuniti<strong>on</strong> directly into <str<strong>on</strong>g>the</str<strong>on</strong>g> crowd without<br />

giving prior warning. One woman, Musu C<strong>on</strong>teh, died after receiving a bullet wound to <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

right side <str<strong>on</strong>g>of</str<strong>on</strong>g> her chest. 12 A health worker, M.V., who treated <str<strong>on</strong>g>the</str<strong>on</strong>g> injured, reported that a total<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> 11 people sustained injuries, including a child who inhaled a chemical agent. 13 Amnesty<br />

Internati<strong>on</strong>al c<strong>on</strong>firmed through medial records and interviewing health pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>als at least<br />

six people who received gunshot wounds.<br />

Ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r health pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al, A.S., who treated some <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> wounded <strong>on</strong> 18 April described to<br />

Amnesty Internati<strong>on</strong>al what he saw. He told Amnesty Internati<strong>on</strong>al “<str<strong>on</strong>g>the</str<strong>on</strong>g> locati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

injuries that I treated is not c<strong>on</strong>sistent with <str<strong>on</strong>g>the</str<strong>on</strong>g> rules <str<strong>on</strong>g>of</str<strong>on</strong>g> engagement. The police were not<br />

firing in <str<strong>on</strong>g>the</str<strong>on</strong>g> air or below <str<strong>on</strong>g>the</str<strong>on</strong>g> knee. They were firing directly into crowds.” One woman he<br />

treated had suffered a gunshot wound to her right forearm and a sec<strong>on</strong>d gunshot wound to<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> right lower third thorax. He said:<br />

“I dug around for <str<strong>on</strong>g>the</str<strong>on</strong>g> bullet and removed some broken rib pieces. I felt that <str<strong>on</strong>g>the</str<strong>on</strong>g> plura <strong>on</strong> her<br />

lung was still intact and I brea<str<strong>on</strong>g>the</str<strong>on</strong>g>d a sigh <str<strong>on</strong>g>of</str<strong>on</strong>g> relief. She was still alive. I explored <str<strong>on</strong>g>the</str<strong>on</strong>g> wound<br />

and removed <str<strong>on</strong>g>the</str<strong>on</strong>g> projectile. It was a 9mm pistol bullet.”<br />

He described <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r man that he treated:<br />

“I treated a man who suffered a wound to <str<strong>on</strong>g>the</str<strong>on</strong>g> left shoulder. The bullet entered <str<strong>on</strong>g>the</str<strong>on</strong>g> left<br />

scapula and exited through <str<strong>on</strong>g>the</str<strong>on</strong>g> left clavicle. I did not take his name because <str<strong>on</strong>g>the</str<strong>on</strong>g>re was so<br />

much chaos. I stopped <str<strong>on</strong>g>the</str<strong>on</strong>g> bleeding and I called <str<strong>on</strong>g>the</str<strong>on</strong>g> LUC (lieutenant in command) and said<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>y needed to go to <str<strong>on</strong>g>the</str<strong>on</strong>g> bigger hospital.” 14<br />

According to <str<strong>on</strong>g>the</str<strong>on</strong>g> police in Makeni and Bumbuna, <str<strong>on</strong>g>the</str<strong>on</strong>g>ir use <str<strong>on</strong>g>of</str<strong>on</strong>g> force <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> 17 and 18 April<br />

was in resp<strong>on</strong>se to attempts by people in <str<strong>on</strong>g>the</str<strong>on</strong>g> community to burn down AML’s fuel depot, <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

paramount chief’s home and <str<strong>on</strong>g>the</str<strong>on</strong>g> police stati<strong>on</strong>. They claimed that members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

community were using violence, including by st<strong>on</strong>e throwing. 15 Some police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers told<br />

Amnesty Internati<strong>on</strong>al that <str<strong>on</strong>g>the</str<strong>on</strong>g>y had collected evidence, such as petrol bombs, knives and<br />

cutlasses. However, when Amnesty Internati<strong>on</strong>al requested to see this evidence <str<strong>on</strong>g>the</str<strong>on</strong>g>y said it<br />

had been taken to <str<strong>on</strong>g>the</str<strong>on</strong>g> headquarters for <str<strong>on</strong>g>the</str<strong>on</strong>g> Criminal Investigati<strong>on</strong> Department.

According to <str<strong>on</strong>g>the</str<strong>on</strong>g> paramount chief, <str<strong>on</strong>g>the</str<strong>on</strong>g> police informed him that he was under threat but he<br />

did not find this credible. He claims he has a good relati<strong>on</strong>ship with <str<strong>on</strong>g>the</str<strong>on</strong>g> community and <str<strong>on</strong>g>the</str<strong>on</strong>g>y<br />

would not want to harm him. He also stated that allegati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> police that protesters were<br />

armed were false as this community had been disarmed following <str<strong>on</strong>g>the</str<strong>on</strong>g> internal c<strong>on</strong>flict, which<br />

ended in 2002. 16<br />

While allegati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> st<strong>on</strong>e-throwing by some protestors in resp<strong>on</strong>se to <str<strong>on</strong>g>the</str<strong>on</strong>g> initial use <str<strong>on</strong>g>of</str<strong>on</strong>g> tear<br />

gas and live ammuniti<strong>on</strong> by <str<strong>on</strong>g>the</str<strong>on</strong>g> police is c<strong>on</strong>sistent with <str<strong>on</strong>g>the</str<strong>on</strong>g> informati<strong>on</strong> obtained by<br />

Amnesty Internati<strong>on</strong>al 17 , <str<strong>on</strong>g>the</str<strong>on</strong>g> organizati<strong>on</strong> has not found any evidence corroborating<br />

protestors’ use <str<strong>on</strong>g>of</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r items or weap<strong>on</strong>s as reported by <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP. In interviews with Amnesty<br />

Internati<strong>on</strong>al, <strong>on</strong>e police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer reported that at least eight <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers were injured by<br />

protesters. 18 When pressed fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers were unable to give details as to <str<strong>on</strong>g>the</str<strong>on</strong>g> identity<br />

or injuries <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers. They were also unable to indicate <str<strong>on</strong>g>the</str<strong>on</strong>g> rank or divisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g>ficers. Amnesty Internati<strong>on</strong>al visited <str<strong>on</strong>g>the</str<strong>on</strong>g> Bumbuna Primary Health Care Unit and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Makeni Hospital where <str<strong>on</strong>g>the</str<strong>on</strong>g> injured protesters were taken for treatment but no <strong>on</strong>e at <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

hospital could c<strong>on</strong>firm that <str<strong>on</strong>g>the</str<strong>on</strong>g>y received injured police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers. However, a police clinic in<br />

Makeni may have treated three injured <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers. 19 In July 2012 Amnesty Internati<strong>on</strong>al wrote<br />

to <str<strong>on</strong>g>the</str<strong>on</strong>g> police seeking fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r evidence <str<strong>on</strong>g>of</str<strong>on</strong>g> protester violence and injuries <str<strong>on</strong>g>of</str<strong>on</strong>g> police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers from<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> SLP in writing but did not receive a resp<strong>on</strong>se.<br />

During <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al <strong>Human</strong> <strong>Rights</strong> Commissi<strong>on</strong> Public Inquiry, which finished its public<br />

hearing in Bumbuna <strong>on</strong> 7 August 2012, police were unable to publicly produce any evidence<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> weap<strong>on</strong>ry allegedly used by protesters.<br />

Amnesty Internati<strong>on</strong>al has also received reports that some police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers engaged in looting<br />

and harassment <str<strong>on</strong>g>of</str<strong>on</strong>g> community members over <str<strong>on</strong>g>the</str<strong>on</strong>g> period from 17- 18 April. Several<br />

community members told Amnesty Internati<strong>on</strong>al that <str<strong>on</strong>g>the</str<strong>on</strong>g> police roamed through <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

community <strong>on</strong> 17 and 18 April breaking down doors to private homes to effect arrests <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

young men who <str<strong>on</strong>g>the</str<strong>on</strong>g>y suspected <str<strong>on</strong>g>of</str<strong>on</strong>g> involvement in <str<strong>on</strong>g>the</str<strong>on</strong>g> protest acti<strong>on</strong> by AML workers. 20 They<br />

reportedly harassed women cooking outside and shot live bullets into cooking pots;<br />

threatened and harassed community members; and looted m<strong>on</strong>ey, food and mobile ph<strong>on</strong>es<br />

from businesses and homes. Amnesty Internati<strong>on</strong>al was shown evidence <str<strong>on</strong>g>of</str<strong>on</strong>g> bullet holes in<br />

walls and ro<str<strong>on</strong>g>of</str<strong>on</strong>g>s, broken doors and cooking pots, bullet cartridges, large canisters referred to<br />

as tear gas canisters, photographs and videos and injuries.<br />

One man, whose bakery was looted by <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP, described how two <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers from <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Operati<strong>on</strong>al Support Divisi<strong>on</strong> entered his bakery <strong>on</strong> 18 April and shot at him.<br />

“They came to my house and asked me what am I doing here. I said we are baking bread.<br />

They tried to enter, but I put a box to <str<strong>on</strong>g>the</str<strong>on</strong>g> door to prevent <str<strong>on</strong>g>the</str<strong>on</strong>g>m. I told <str<strong>on</strong>g>the</str<strong>on</strong>g>m <str<strong>on</strong>g>the</str<strong>on</strong>g>re is bread,<br />

that it will get burned and I pleaded with <str<strong>on</strong>g>the</str<strong>on</strong>g>m. But <str<strong>on</strong>g>the</str<strong>on</strong>g>y wanted to take me by force but I<br />

pleaded and said <str<strong>on</strong>g>the</str<strong>on</strong>g>re is bread - please take it. When I said I was not going <str<strong>on</strong>g>the</str<strong>on</strong>g>y pointed<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>ir gun at me and I threw <str<strong>on</strong>g>the</str<strong>on</strong>g> bread at him and his gun fell down. When he reached for <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

gun I ran away. They shot at me, but I was already over <str<strong>on</strong>g>the</str<strong>on</strong>g> wall. They went around looking<br />

for me. I tried to enter <strong>on</strong>e house but <str<strong>on</strong>g>the</str<strong>on</strong>g>y wouldn’t let me because <str<strong>on</strong>g>the</str<strong>on</strong>g>y were afraid <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

police would enter. When I came [back] <str<strong>on</strong>g>the</str<strong>on</strong>g>y had stolen [about] 2,800,000 Le<strong>on</strong>es<br />

(approximately $650USD) cash and [about] 800,000 Le<strong>on</strong>es (approximately $185USD)<br />

worth in bread. I had three ph<strong>on</strong>es in <str<strong>on</strong>g>the</str<strong>on</strong>g>re because I have boys that work for me and if <str<strong>on</strong>g>the</str<strong>on</strong>g>y<br />

d<strong>on</strong>’t pay me back I take <str<strong>on</strong>g>the</str<strong>on</strong>g>ir ph<strong>on</strong>es until <str<strong>on</strong>g>the</str<strong>on</strong>g>y pay me back. The police took those ph<strong>on</strong>es.<br />

The OSD [Operati<strong>on</strong>al Support Divisi<strong>on</strong>] left and came back with colleagues and <str<strong>on</strong>g>the</str<strong>on</strong>g>y cleared<br />

all <str<strong>on</strong>g>of</str<strong>on</strong>g> my provisi<strong>on</strong>s: my yeast, butter, may<strong>on</strong>naise. My place was like a police post. They were<br />

stati<strong>on</strong>ed <str<strong>on</strong>g>the</str<strong>on</strong>g>re and were shooting from <str<strong>on</strong>g>the</str<strong>on</strong>g>re.” 21<br />

In <str<strong>on</strong>g>the</str<strong>on</strong>g> aftermath <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> events in Bumbuna, a delegati<strong>on</strong> comprising local government<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g>ficials came to <str<strong>on</strong>g>the</str<strong>on</strong>g> town to discuss <str<strong>on</strong>g>the</str<strong>on</strong>g> underlying causes <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> unrest. It was reported<br />

that, following a closed door meeting <strong>on</strong> 24 April attended by government <str<strong>on</strong>g>of</str<strong>on</strong>g>ficials, <str<strong>on</strong>g>the</str<strong>on</strong>g> local<br />

paramount chief and AML workers, AML’s General Manager publicly presented 40 milli<strong>on</strong><br />

Le<strong>on</strong>es (approximately $9,300USD) to <str<strong>on</strong>g>the</str<strong>on</strong>g> paramount chief to dispense to <str<strong>on</strong>g>the</str<strong>on</strong>g> market<br />

traders. In making this payment <str<strong>on</strong>g>the</str<strong>on</strong>g> General Manager is reported to have said that <str<strong>on</strong>g>the</str<strong>on</strong>g> m<strong>on</strong>ey<br />

THE RELATIONSHIP BETWEEN THE <str<strong>on</strong>g>SIERRA</str<strong>on</strong>g> <str<strong>on</strong>g>LEONE</str<strong>on</strong>g> POLICE AND AFRICAN<br />

MINERALS LTD<br />

Amnesty Internati<strong>on</strong>al’s understanding <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> events in Bumbuna gives rise to serious<br />

questi<strong>on</strong>s about <str<strong>on</strong>g>the</str<strong>on</strong>g> relati<strong>on</strong>ship between AML and <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP. Amnesty Internati<strong>on</strong>al<br />

understands <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP provide security to <str<strong>on</strong>g>the</str<strong>on</strong>g> AML mining operati<strong>on</strong> and a number <str<strong>on</strong>g>of</str<strong>on</strong>g> SLP<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g>ficers are stati<strong>on</strong>ed at <str<strong>on</strong>g>the</str<strong>on</strong>g> AML site in Bumbuna. 23<br />

AML c<strong>on</strong>firmed that due to <str<strong>on</strong>g>the</str<strong>on</strong>g> SPL’s limited resources, <str<strong>on</strong>g>the</str<strong>on</strong>g> company provides some<br />

assistance to <str<strong>on</strong>g>the</str<strong>on</strong>g> police, including through transport, infrastructure, sustenance and financial

c<strong>on</strong>tributi<strong>on</strong>s. 24<br />

Amnesty Internati<strong>on</strong>al cannot c<strong>on</strong>firm if any <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers working <strong>on</strong> AML property<br />

were involved in <str<strong>on</strong>g>the</str<strong>on</strong>g> events that took place <strong>on</strong> 17 and 18 April. However, <str<strong>on</strong>g>the</str<strong>on</strong>g> role that AML<br />

played in relati<strong>on</strong> to some aspects <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> events in Bumbuna requires fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r investigati<strong>on</strong>.<br />

As noted above, AML paid compensati<strong>on</strong> to women traders for <str<strong>on</strong>g>the</str<strong>on</strong>g> damage d<strong>on</strong>e when <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

SLP ransacked <str<strong>on</strong>g>the</str<strong>on</strong>g> market place and fired into <str<strong>on</strong>g>the</str<strong>on</strong>g> ro<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> market. The fact that AML paid<br />

compensati<strong>on</strong> for acts carried out by <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP raises questi<strong>on</strong>s about <str<strong>on</strong>g>the</str<strong>on</strong>g> link between <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

two. Amnesty Internati<strong>on</strong>al c<strong>on</strong>tacted AML about <str<strong>on</strong>g>the</str<strong>on</strong>g> payment made to <str<strong>on</strong>g>the</str<strong>on</strong>g> market traders,<br />

and asked <strong>on</strong> what basis it was provided. According to AML, <str<strong>on</strong>g>the</str<strong>on</strong>g> amount paid to <str<strong>on</strong>g>the</str<strong>on</strong>g> market<br />

women was determined following <str<strong>on</strong>g>the</str<strong>on</strong>g> request <str<strong>on</strong>g>of</str<strong>on</strong>g> local government <str<strong>on</strong>g>of</str<strong>on</strong>g>ficials and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

community, including <str<strong>on</strong>g>the</str<strong>on</strong>g> paramount chief. The funds were given <strong>on</strong> compassi<strong>on</strong>ate<br />

grounds. 25<br />

The incident at <str<strong>on</strong>g>the</str<strong>on</strong>g> radio stati<strong>on</strong> also raises c<strong>on</strong>cerns regarding AML’s close relati<strong>on</strong>ship with<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> SLP and <str<strong>on</strong>g>the</str<strong>on</strong>g> events described in this report. Witnesses claim that <strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> vehicles<br />

used by <str<strong>on</strong>g>the</str<strong>on</strong>g> police to go to <str<strong>on</strong>g>the</str<strong>on</strong>g> local radio stati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> morning <str<strong>on</strong>g>of</str<strong>on</strong>g> 18 April was an AML<br />

vehicle and that an AML liais<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer was driving <str<strong>on</strong>g>the</str<strong>on</strong>g> vehicle. The journalist and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r eye<br />

witnesses described <str<strong>on</strong>g>the</str<strong>on</strong>g> vehicle as a “Hawk” vehicle, which according to <str<strong>on</strong>g>the</str<strong>on</strong>g> Hawk Group<br />

website is a UK-based c<strong>on</strong>structi<strong>on</strong> company working in Sierra Le<strong>on</strong>e. 26 According to <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

community, this company is sub-c<strong>on</strong>tracted to AML. Amnesty Internati<strong>on</strong>al also put this<br />

allegati<strong>on</strong> to AML who c<strong>on</strong>firmed that <str<strong>on</strong>g>the</str<strong>on</strong>g> vehicle is owned by Hawk and was being used by<br />

an AML police liais<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer (PLO). In a letter addressed to Amnesty Internati<strong>on</strong>al, 17<br />

September 2012, <str<strong>on</strong>g>the</str<strong>on</strong>g> company stated that <str<strong>on</strong>g>the</str<strong>on</strong>g> PLO <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer used <str<strong>on</strong>g>the</str<strong>on</strong>g> vehicle prior to <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

incident at <str<strong>on</strong>g>the</str<strong>on</strong>g> radio stati<strong>on</strong>. They stated that <str<strong>on</strong>g>the</str<strong>on</strong>g> PLO had left Bumbuna <str<strong>on</strong>g>the</str<strong>on</strong>g> day before <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

incident and <str<strong>on</strong>g>the</str<strong>on</strong>g> vehicle remained in Bumbuna. The company fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r stated to its knowledge<br />

no <strong>on</strong>e employed or c<strong>on</strong>tracted by AML was involved in <str<strong>on</strong>g>the</str<strong>on</strong>g> visit to <str<strong>on</strong>g>the</str<strong>on</strong>g> radio stati<strong>on</strong>. However,<br />

Amnesty Internati<strong>on</strong>al spoke to several eye witnesses, including <str<strong>on</strong>g>the</str<strong>on</strong>g> journalist himself, who<br />

said <str<strong>on</strong>g>the</str<strong>on</strong>g> vehicle was driven to <str<strong>on</strong>g>the</str<strong>on</strong>g> radio stati<strong>on</strong> by <str<strong>on</strong>g>the</str<strong>on</strong>g> PLO.<br />

The nature <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> agreement between AML and <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP over <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> security at <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

mine site in Bumbuna and associated support by AML to <str<strong>on</strong>g>the</str<strong>on</strong>g> police are not clear. Amnesty<br />

Internati<strong>on</strong>al asked AML to disclose <str<strong>on</strong>g>the</str<strong>on</strong>g> terms <str<strong>on</strong>g>of</str<strong>on</strong>g> any agreements with <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP, and<br />

requested figures for its financial c<strong>on</strong>tributi<strong>on</strong>s to <str<strong>on</strong>g>the</str<strong>on</strong>g> police. Amnesty Internati<strong>on</strong>al also<br />

asked AML to provide details <str<strong>on</strong>g>of</str<strong>on</strong>g> any risk assessment or measures put in place to ensure<br />

public security provided by <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP to AML was d<strong>on</strong>e in a manner c<strong>on</strong>sistent with <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

resp<strong>on</strong>sibility <str<strong>on</strong>g>of</str<strong>on</strong>g> companies to respect human rights. AML did not resp<strong>on</strong>d to <str<strong>on</strong>g>the</str<strong>on</strong>g>se questi<strong>on</strong>s<br />

but gave a general assurance that at no time have AML or its managers directed or sought to<br />

influence <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP. 27<br />

In <str<strong>on</strong>g>the</str<strong>on</strong>g> absence <str<strong>on</strong>g>of</str<strong>on</strong>g> a freedom <str<strong>on</strong>g>of</str<strong>on</strong>g> informati<strong>on</strong> law, many documents detailing government<br />

agreements with multinati<strong>on</strong>al corporati<strong>on</strong>s are not available to <str<strong>on</strong>g>the</str<strong>on</strong>g> public in Sierra Le<strong>on</strong>e.<br />

Amnesty Internati<strong>on</strong>al, <strong>Human</strong> <strong>Rights</strong> Watch and <str<strong>on</strong>g>the</str<strong>on</strong>g> Freedom <str<strong>on</strong>g>of</str<strong>on</strong>g> Informati<strong>on</strong> Coaliti<strong>on</strong> have<br />

called <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> government to ensure <str<strong>on</strong>g>the</str<strong>on</strong>g> passing <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Freedom <str<strong>on</strong>g>of</str<strong>on</strong>g> Informati<strong>on</strong> Bill currently<br />

pending in Parliament. 28<br />

securing <str<strong>on</strong>g>the</str<strong>on</strong>g> resources required to follow up <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>se recommendati<strong>on</strong>s.”

3. ACCOUNTABILITY AND JUSTICE<br />

“They gave 40 milli<strong>on</strong> Le<strong>on</strong>es for <str<strong>on</strong>g>the</str<strong>on</strong>g> women<br />

traders, but no <strong>on</strong>e listened to <str<strong>on</strong>g>the</str<strong>on</strong>g> rest <str<strong>on</strong>g>of</str<strong>on</strong>g> us. I<br />

used to be able to afford 10 bags <str<strong>on</strong>g>of</str<strong>on</strong>g> flours, but<br />

now I can <strong>on</strong>ly buy 2… and now I am struggling. I<br />

want my m<strong>on</strong>ey back. That is what I do – bake - I<br />

d<strong>on</strong>’t have a mo<str<strong>on</strong>g>the</str<strong>on</strong>g>r or fa<str<strong>on</strong>g>the</str<strong>on</strong>g>r. I am surviving from<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> skill I have. The [6] boys that work with me<br />

d<strong>on</strong>’t have relatives here. We are surviving from<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> bakery. Now <str<strong>on</strong>g>the</str<strong>on</strong>g>y have destroyed our work. If I<br />

had power I would retaliate by charging <str<strong>on</strong>g>the</str<strong>on</strong>g>m to<br />

court.”<br />

A baker whose business was ransacked by police in Bumbuna in April 2012<br />

On 16 July 2012 <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al <strong>Human</strong> <strong>Rights</strong> Commissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Sierra Le<strong>on</strong>e established a<br />

Public Inquiry into alleged gross violati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> human rights in Bumbuna in relati<strong>on</strong> to <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

events that took place <strong>on</strong> 16, 17 and 18 April 2012. 29 The Inquiry had finished its<br />

investigati<strong>on</strong> and was preparing its findings at <str<strong>on</strong>g>the</str<strong>on</strong>g> time <str<strong>on</strong>g>of</str<strong>on</strong>g> writing. The President also<br />

announced in June that a Cor<strong>on</strong>er’s Inquest would be undertaken. However, it is not clear<br />

whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r any criminal investigati<strong>on</strong> is being pursued into <str<strong>on</strong>g>the</str<strong>on</strong>g> events described in this report<br />

and <str<strong>on</strong>g>the</str<strong>on</strong>g> evidence <str<strong>on</strong>g>of</str<strong>on</strong>g> unlawful use <str<strong>on</strong>g>of</str<strong>on</strong>g> force and unlawful killing. While <str<strong>on</strong>g>the</str<strong>on</strong>g> Public Inquiry is an<br />

important step, it must complement and not be a substitute for criminal investigati<strong>on</strong>s and<br />

prosecuti<strong>on</strong>s. Amnesty Internati<strong>on</strong>al has written to <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP to request informati<strong>on</strong> about<br />

whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r any investigati<strong>on</strong> has been carried out to determine whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers acted in<br />

accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g>ir own rules and guidelines as well as internati<strong>on</strong>al law and standards.<br />

The SLP did not resp<strong>on</strong>d to <str<strong>on</strong>g>the</str<strong>on</strong>g>se questi<strong>on</strong>s.<br />

Victims <str<strong>on</strong>g>of</str<strong>on</strong>g> human rights violati<strong>on</strong>s have <str<strong>on</strong>g>the</str<strong>on</strong>g> right to an effective remedy. Prompt and<br />

thorough investigati<strong>on</strong>s are an important comp<strong>on</strong>ent <str<strong>on</strong>g>of</str<strong>on</strong>g> remedy; victims should be able to see<br />

that perpetrators are held to account. In additi<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> government should ensure that affected<br />

individuals have restituti<strong>on</strong>, which can include measures to compensate victims, provide<br />

rehabilitati<strong>on</strong>, ensure satisfacti<strong>on</strong> (for example, a public apology), as well as measure to<br />

guarantee that <str<strong>on</strong>g>the</str<strong>on</strong>g> violati<strong>on</strong>s will not be repeated. 30<br />

remedial acti<strong>on</strong>s, including compensati<strong>on</strong>, changes to law and policy and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r reparati<strong>on</strong><br />

measures for victims, as well as making orders or directi<strong>on</strong>s for <str<strong>on</strong>g>the</str<strong>on</strong>g> enforcement <str<strong>on</strong>g>of</str<strong>on</strong>g> a decisi<strong>on</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> has reached.

4. INTERNATIONAL OBLIGATIONS AND<br />

STANDARDS<br />

Sierra Le<strong>on</strong>e is a state party to <str<strong>on</strong>g>the</str<strong>on</strong>g> Internati<strong>on</strong>al Covenant <strong>on</strong> Civil and Political <strong>Rights</strong><br />

(ICCPR) to which it acceded in 1996. Sierra Le<strong>on</strong>e is also a state party to <str<strong>on</strong>g>the</str<strong>on</strong>g> African Charter<br />

<strong>on</strong> <strong>Human</strong> and Peoples’ <strong>Rights</strong> (African Charter), ratified in 1983. The ICCPR and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

African Charter guarantee, am<strong>on</strong>g o<str<strong>on</strong>g>the</str<strong>on</strong>g>rs, <str<strong>on</strong>g>the</str<strong>on</strong>g> right to life; right to freedom <str<strong>on</strong>g>of</str<strong>on</strong>g> expressi<strong>on</strong>,<br />

associati<strong>on</strong> and assembly; <str<strong>on</strong>g>the</str<strong>on</strong>g> right to be free from arbitrary detenti<strong>on</strong>; and <str<strong>on</strong>g>the</str<strong>on</strong>g> right to a fair<br />

trial. The C<strong>on</strong>stituti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Sierra Le<strong>on</strong>e also recognizes <str<strong>on</strong>g>the</str<strong>on</strong>g>se as fundamental human rights.<br />

Article 6(1) <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> ICCPR states: “Every human being has <str<strong>on</strong>g>the</str<strong>on</strong>g> inherent right to life. This right<br />

shall be protected by law. No <strong>on</strong>e shall be arbitrarily deprived <str<strong>on</strong>g>of</str<strong>on</strong>g> his life.” Article 4 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

African Charter provides: "<strong>Human</strong> beings are inviolable. Every human being shall be entitled<br />

to respect for his life and <str<strong>on</strong>g>the</str<strong>on</strong>g> integrity <str<strong>on</strong>g>of</str<strong>on</strong>g> his pers<strong>on</strong>. No <strong>on</strong>e may be arbitrarily deprived <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

this right."<br />

Amnesty Internati<strong>on</strong>al recognizes <str<strong>on</strong>g>the</str<strong>on</strong>g> right <str<strong>on</strong>g>of</str<strong>on</strong>g> police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers to defend <str<strong>on</strong>g>the</str<strong>on</strong>g>mselves and <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

duty to protect <str<strong>on</strong>g>the</str<strong>on</strong>g> safety <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> public. This role should, however, be carried out in a way<br />

that ensures full respect for <str<strong>on</strong>g>the</str<strong>on</strong>g> right to life, liberty and security <str<strong>on</strong>g>of</str<strong>on</strong>g> all pers<strong>on</strong>s, including<br />

those suspected <str<strong>on</strong>g>of</str<strong>on</strong>g> crime. The use <str<strong>on</strong>g>of</str<strong>on</strong>g> force by police and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r security forces must be<br />

c<strong>on</strong>sistent with <str<strong>on</strong>g>the</str<strong>on</strong>g> UN Basic Principles <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Use <str<strong>on</strong>g>of</str<strong>on</strong>g> Force and Firearms by Law<br />

Enforcement Officials (Basic Principles) and <str<strong>on</strong>g>the</str<strong>on</strong>g> UN Code <str<strong>on</strong>g>of</str<strong>on</strong>g> C<strong>on</strong>duct for Law Enforcement<br />

Officials.<br />

The use <str<strong>on</strong>g>of</str<strong>on</strong>g> force by <str<strong>on</strong>g>the</str<strong>on</strong>g> police must be an excepti<strong>on</strong>al measure. Article 3 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> UN Code <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

C<strong>on</strong>duct for Law Enforcement Officials states that <str<strong>on</strong>g>the</str<strong>on</strong>g>y “may use force <strong>on</strong>ly when strictly<br />

necessary and to <str<strong>on</strong>g>the</str<strong>on</strong>g> extent required for <str<strong>on</strong>g>the</str<strong>on</strong>g> performance <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir duty.” Police must apply<br />

n<strong>on</strong>-violent means before resorting to <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> force which should be used <strong>on</strong>ly if n<strong>on</strong>violent<br />

means have proven to be, or are likely not to be, effective (Basic Principle 4).<br />

Although Article 16 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>stituti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Sierra Le<strong>on</strong>e recognizes <str<strong>on</strong>g>the</str<strong>on</strong>g> right to life, it provides<br />

that deprivati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> life would not be unlawful where death is caused “as a result <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

force to such extent as is reas<strong>on</strong>ably justifiable in <str<strong>on</strong>g>the</str<strong>on</strong>g> circumstances <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> case, that is to<br />

say –<br />

a. for <str<strong>on</strong>g>the</str<strong>on</strong>g> defence <str<strong>on</strong>g>of</str<strong>on</strong>g> any pers<strong>on</strong> from unlawful violence or for <str<strong>on</strong>g>the</str<strong>on</strong>g> defence <str<strong>on</strong>g>of</str<strong>on</strong>g> property; or<br />

b. in order to effect a lawful arrest or to prevent <str<strong>on</strong>g>the</str<strong>on</strong>g> escape <str<strong>on</strong>g>of</str<strong>on</strong>g> a pers<strong>on</strong> lawfully detained; or<br />

c. for <str<strong>on</strong>g>the</str<strong>on</strong>g> purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> suppressing a riot, insurrecti<strong>on</strong> or mutiny; or<br />

d. in order to prevent <str<strong>on</strong>g>the</str<strong>on</strong>g> commissi<strong>on</strong> by that pers<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a criminal <str<strong>on</strong>g>of</str<strong>on</strong>g>fence …”<br />

The provisi<strong>on</strong>s in Sierra Le<strong>on</strong>e’s c<strong>on</strong>stituti<strong>on</strong> are inc<strong>on</strong>sistent with <str<strong>on</strong>g>the</str<strong>on</strong>g> necessity and<br />

proporti<strong>on</strong>ality requirement <str<strong>on</strong>g>of</str<strong>on</strong>g> internati<strong>on</strong>al standards <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> force and firearms. While<br />

internati<strong>on</strong>al standards allow for use <str<strong>on</strong>g>of</str<strong>on</strong>g> force “as is reas<strong>on</strong>ably necessary” including for <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

preventi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> crime or in effecting a lawful arrest, firearms may <strong>on</strong>ly be used as a last resort.<br />

The threshold for firearms to be used is high - ‘'imminent threat <str<strong>on</strong>g>of</str<strong>on</strong>g> death or serious injury” or<br />

“grave threat to life” (Basic Principle 9).<br />

Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r, <str<strong>on</strong>g>the</str<strong>on</strong>g> intenti<strong>on</strong>al lethal use <str<strong>on</strong>g>of</str<strong>on</strong>g> firearms is <strong>on</strong>ly permissible if strictly unavoidable in<br />

order to protect life (Basic Principle 9).<br />

The Sierra Le<strong>on</strong>e C<strong>on</strong>stituti<strong>on</strong> threshold for <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> lethal force (“reas<strong>on</strong>ably justifiable in<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> circumstances <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> case”) is impermissibly broad. It is open to a much wider<br />

interpretati<strong>on</strong> than <str<strong>on</strong>g>the</str<strong>on</strong>g> “grave threat to life” requirement in <str<strong>on</strong>g>the</str<strong>on</strong>g> UN Basic Principles. As a<br />

result, it lowers <str<strong>on</strong>g>the</str<strong>on</strong>g> threshold for <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> lethal force.<br />

Amnesty Internati<strong>on</strong>al welcomes <str<strong>on</strong>g>the</str<strong>on</strong>g> fact that, unlike <str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>stituti<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP internal<br />

“Guidance for opening fire for armed police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers” (Green Card “A”) clearly states that<br />

firearms must <strong>on</strong>ly be used as a last resort. However, <str<strong>on</strong>g>the</str<strong>on</strong>g> acti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP in Bumbuna do<br />

not reflect adherence to this or <str<strong>on</strong>g>the</str<strong>on</strong>g> guidance and in internati<strong>on</strong>al human rights law and<br />

standards.<br />

The use <str<strong>on</strong>g>of</str<strong>on</strong>g> firearms for “warning shots” and chemical irritants (reported as tear gas) in <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

marketplace <strong>on</strong> 17 April, as well as <str<strong>on</strong>g>the</str<strong>on</strong>g> subsequent live ammuniti<strong>on</strong> fired in <str<strong>on</strong>g>the</str<strong>on</strong>g> air and at<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> property <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> residents at various times through 17 and 18 April, was arbitrary or<br />

abusive. There is no evidence to indicate that <str<strong>on</strong>g>the</str<strong>on</strong>g>re was any violent activity in <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

marketplace, let al<strong>on</strong>e a grave threat to any pers<strong>on</strong>’s life. Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>rmore, even according to <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

SLP “Rules <str<strong>on</strong>g>of</str<strong>on</strong>g> Engagement,” firing warning shots with live ammuniti<strong>on</strong> is not permitted. 31<br />

Amnesty Internati<strong>on</strong>al has sought clarificati<strong>on</strong> from <str<strong>on</strong>g>the</str<strong>on</strong>g> police about <str<strong>on</strong>g>the</str<strong>on</strong>g> circumstances that<br />

required <str<strong>on</strong>g>the</str<strong>on</strong>g>m to use live ammuniti<strong>on</strong>. The SLP did not resp<strong>on</strong>d.<br />

Amnesty Internati<strong>on</strong>al is also disturbed by <str<strong>on</strong>g>the</str<strong>on</strong>g> arbitrary or abusive use <str<strong>on</strong>g>of</str<strong>on</strong>g> force, including live<br />

ammuniti<strong>on</strong>, against <str<strong>on</strong>g>the</str<strong>on</strong>g> protestors marching towards <str<strong>on</strong>g>the</str<strong>on</strong>g> police stati<strong>on</strong> <strong>on</strong> 18 April, which<br />

led to <str<strong>on</strong>g>the</str<strong>on</strong>g> death <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>on</strong>e woman and to gunshot injuries to several o<str<strong>on</strong>g>the</str<strong>on</strong>g>rs.<br />

Even if some protestors did in fact throw st<strong>on</strong>es at <str<strong>on</strong>g>the</str<strong>on</strong>g> police, <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> force, including<br />

lethal force, by <str<strong>on</strong>g>the</str<strong>on</strong>g> police must comply with human rights standards at all times. The UN<br />

Basic Principles state that in <str<strong>on</strong>g>the</str<strong>on</strong>g> case <str<strong>on</strong>g>of</str<strong>on</strong>g> violent assemblies, security forces must <strong>on</strong>ly use<br />

firearms when less dangerous means are not practicable, and <strong>on</strong>ly to <str<strong>on</strong>g>the</str<strong>on</strong>g> minimum extent<br />

necessary. The use <str<strong>on</strong>g>of</str<strong>on</strong>g> lethal and “less lethal” weap<strong>on</strong>s including tear gas should be carefully<br />

c<strong>on</strong>trolled to minimize <str<strong>on</strong>g>the</str<strong>on</strong>g> risk <str<strong>on</strong>g>of</str<strong>on</strong>g> endangering people, including those not involved in <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

incident. The SLP internal guidance itself does not envisage <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> live ammuniti<strong>on</strong><br />

against those throwing st<strong>on</strong>es or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r missiles. It provides that where <str<strong>on</strong>g>the</str<strong>on</strong>g>re is a risk <str<strong>on</strong>g>of</str<strong>on</strong>g> threat<br />

to life or serious injury to any pers<strong>on</strong> by such st<strong>on</strong>es/missiles, <str<strong>on</strong>g>the</str<strong>on</strong>g> police may use “bat<strong>on</strong><br />

rounds.” 32<br />

RIGHT TO REMEDY<br />

Under internati<strong>on</strong>al human rights law, Sierra Le<strong>on</strong>e has an obligati<strong>on</strong> to protect <str<strong>on</strong>g>the</str<strong>on</strong>g> rights to<br />

life, freedom <str<strong>on</strong>g>of</str<strong>on</strong>g> expressi<strong>on</strong>, peaceful assembly and associati<strong>on</strong>. Sierra Le<strong>on</strong>e must also<br />

ensure <str<strong>on</strong>g>the</str<strong>on</strong>g> right to an effective remedy guaranteed under <str<strong>on</strong>g>the</str<strong>on</strong>g> ICCPR. Article 2(3) states that<br />

governments must “ensure that any pers<strong>on</strong> whose rights or freedoms as herein recognized are<br />

violated shall have an effective remedy” and <str<strong>on</strong>g>the</str<strong>on</strong>g>se remedies “shall be enforced when<br />

granted”.

According to <str<strong>on</strong>g>the</str<strong>on</strong>g> UN Basic Principles and Guidelines <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Right to Remedy and Reparati<strong>on</strong><br />

for Victims <str<strong>on</strong>g>of</str<strong>on</strong>g> Violati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> Internati<strong>on</strong>al <strong>Human</strong> <strong>Rights</strong> Law and Serious Violati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Internati<strong>on</strong>al <strong>Human</strong>itarian Law, victims should be provided with full and effective reparati<strong>on</strong><br />

including compensati<strong>on</strong> for physical or mental harm, moral damage, costs required for legal<br />

or expert assistance, medicine and medical services, and psychological and social services,<br />

as well as “an <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial declarati<strong>on</strong> or a judicial decisi<strong>on</strong> restoring <str<strong>on</strong>g>the</str<strong>on</strong>g> dignity, <str<strong>on</strong>g>the</str<strong>on</strong>g> reputati<strong>on</strong><br />

and <str<strong>on</strong>g>the</str<strong>on</strong>g> rights <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> victim and <str<strong>on</strong>g>of</str<strong>on</strong>g> pers<strong>on</strong>s closely c<strong>on</strong>nected with <str<strong>on</strong>g>the</str<strong>on</strong>g> victim”, public apology<br />

and judicial and administrative sancti<strong>on</strong>s against <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong>s liable for <str<strong>on</strong>g>the</str<strong>on</strong>g> violati<strong>on</strong>s<br />

(paragraphs 18-22).<br />

HUMAN RIGHTS RESPONSIBILITIES OF COMPANIES<br />

Under internati<strong>on</strong>al law, governments are resp<strong>on</strong>sible for respecting, protecting and<br />

promoting human rights. When a government fails to protect people’s human rights against<br />

harm by n<strong>on</strong>-state actors, such as companies, this amounts to a violati<strong>on</strong> under internati<strong>on</strong>al<br />

law. However, <str<strong>on</strong>g>the</str<strong>on</strong>g> fact <str<strong>on</strong>g>of</str<strong>on</strong>g> government failure to protect rights does not absolve <str<strong>on</strong>g>the</str<strong>on</strong>g> n<strong>on</strong>-state<br />

actor from resp<strong>on</strong>sibility for <str<strong>on</strong>g>the</str<strong>on</strong>g>ir acti<strong>on</strong>s and <str<strong>on</strong>g>the</str<strong>on</strong>g> impact <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir acti<strong>on</strong>s <strong>on</strong> human rights.<br />

The UN Guiding Principles <strong>on</strong> Business and <strong>Human</strong> <strong>Rights</strong> (UN Guiding Principles) clarify<br />

that all companies must respect all human rights, and that “<str<strong>on</strong>g>the</str<strong>on</strong>g> resp<strong>on</strong>sibility to respect<br />

human rights is a global standard <str<strong>on</strong>g>of</str<strong>on</strong>g> expected c<strong>on</strong>duct for all business enterprises wherever<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>y operate. It exists independently <str<strong>on</strong>g>of</str<strong>on</strong>g> States’ abilities and/or willingness to fulfil <str<strong>on</strong>g>the</str<strong>on</strong>g>ir own<br />

human rights obligati<strong>on</strong>s, and does not diminish those obligati<strong>on</strong>s. And it exists over and<br />

above compliance with nati<strong>on</strong>al laws and regulati<strong>on</strong>s protecting human rights” (Principle 11).<br />

In order to meet <str<strong>on</strong>g>the</str<strong>on</strong>g>ir resp<strong>on</strong>sibility to respect human rights, businesses should carry out<br />

human rights due diligence. This encompasses steps a company must take to become aware<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g>, prevent and address adverse human rights impacts. 33<br />

The UN Guiding Principles fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r affirm that business enterprises should, “Seek to prevent<br />

or mitigate adverse human rights impacts that are directly linked to <str<strong>on</strong>g>the</str<strong>on</strong>g>ir operati<strong>on</strong>s, products<br />

or services by <str<strong>on</strong>g>the</str<strong>on</strong>g>ir business relati<strong>on</strong>ships, even if <str<strong>on</strong>g>the</str<strong>on</strong>g>y have not c<strong>on</strong>tributed to those<br />

impacts” (Principle 13). In <str<strong>on</strong>g>the</str<strong>on</strong>g> commentary to Principle 13, “business relati<strong>on</strong>ships” are<br />

defined as including relati<strong>on</strong>ships with o<str<strong>on</strong>g>the</str<strong>on</strong>g>r n<strong>on</strong>-state or state entities directly linked to its<br />

business operati<strong>on</strong>s, products or services. This would include relati<strong>on</strong>ships with security<br />

providers, whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r <str<strong>on</strong>g>the</str<strong>on</strong>g>se are private security companies or public security providers such as<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> police. The Guiding Principles also note that “Questi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> complicity may arise when a<br />

business enterprise c<strong>on</strong>tributes to, or is seen as c<strong>on</strong>tributing to, adverse human rights<br />

impacts caused by o<str<strong>on</strong>g>the</str<strong>on</strong>g>r parties” (Principle 17).<br />

Specific standards have also been developed with regard to <str<strong>on</strong>g>the</str<strong>on</strong>g> relati<strong>on</strong>ship between<br />

extractive industry companies and public and private security providers; <str<strong>on</strong>g>the</str<strong>on</strong>g>re are <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Voluntary Principles <strong>on</strong> Security and <strong>Human</strong> <strong>Rights</strong> (Voluntary Principles). 34 The Voluntary<br />

Principles provide guidance to companies <strong>on</strong> elements <str<strong>on</strong>g>of</str<strong>on</strong>g> due diligence in respect <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

corporate relati<strong>on</strong>ships with public security providers such as <str<strong>on</strong>g>the</str<strong>on</strong>g> police.<br />

The Voluntary Principles were developed by businesses, governments and NGOs (including<br />

Amnesty Internati<strong>on</strong>al) and provide detailed guidance to companies <strong>on</strong> maintaining <str<strong>on</strong>g>the</str<strong>on</strong>g> safety<br />

and security <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir operati<strong>on</strong>s in a framework that ensures respect for human rights. The<br />

Principles state that “companies should c<strong>on</strong>sult regularly with host governments and local<br />

communities about <str<strong>on</strong>g>the</str<strong>on</strong>g> impact <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir security arrangements <strong>on</strong> those communities.” The<br />

company should encourage <str<strong>on</strong>g>the</str<strong>on</strong>g> government to make all such arrangements available to <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

public, subject to any safety or security c<strong>on</strong>cerns, to ensure transparency. They must also<br />

“communicate <str<strong>on</strong>g>the</str<strong>on</strong>g>ir policies regarding ethical c<strong>on</strong>duct and human rights to public security<br />

providers, and express <str<strong>on</strong>g>the</str<strong>on</strong>g>ir desire that security be provided in a manner c<strong>on</strong>sistent with<br />

those policies by pers<strong>on</strong>nel with adequate and effective training.”

5. RECOMMENDATIONS<br />

TO THE PRESIDENT OF <str<strong>on</strong>g>SIERRA</str<strong>on</strong>g> <str<strong>on</strong>g>LEONE</str<strong>on</strong>g>:<br />

Publicly c<strong>on</strong>demn any use <str<strong>on</strong>g>of</str<strong>on</strong>g> arbitrary or abusive force by <str<strong>on</strong>g>the</str<strong>on</strong>g> SLP as well as <str<strong>on</strong>g>the</str<strong>on</strong>g> looting,<br />

harassment and intimidati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> community members in Bumbuna, and ensure that all those<br />

found resp<strong>on</strong>sible, including those with command resp<strong>on</strong>sibility, are held to account.<br />

TO THE POLICE COUNCIL:<br />

Ensure police independence and impartiality when operating to protect private<br />

companies. Police involved in guarding private actors must be under a clear and appropriate<br />

command structure, not subject to interference by companies, and aware <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir role and<br />

resp<strong>on</strong>sibilities in relati<strong>on</strong> to <str<strong>on</strong>g>the</str<strong>on</strong>g> wider public;<br />

Ensure that all security agreements between public security and private companies are<br />

established in an open and transparent manner, and in c<strong>on</strong>sultati<strong>on</strong> with potentially affected<br />

communities and civil society organizati<strong>on</strong>s, in order to help ensure accountability,<br />

independence and impartiality;<br />

Ensure that <str<strong>on</strong>g>the</str<strong>on</strong>g> public has clear informati<strong>on</strong> <strong>on</strong> how to make a complaint about police<br />

misc<strong>on</strong>duct (including at police stati<strong>on</strong>s, through radio and televisi<strong>on</strong> programmes and <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

internet).<br />

TO THE INSPECTOR GENERAL OF THE <str<strong>on</strong>g>SIERRA</str<strong>on</strong>g> <str<strong>on</strong>g>LEONE</str<strong>on</strong>g> POLICE:<br />

Suspend from active duty, pending a full investigati<strong>on</strong>, those suspected <str<strong>on</strong>g>of</str<strong>on</strong>g> ordering or<br />
