INTRODUCTIONThe European Roma <strong>Rights</strong> Centre (ERRC), Chance for Children Foundati<strong>on</strong> (CFCF) and <str<strong>on</strong>g>the</str<strong>on</strong>g> HungarianHelsinki Committee (HHC) respectfully submit <str<strong>on</strong>g>written</str<strong>on</strong>g> <str<strong>on</strong>g>comments</str<strong>on</strong>g> c<strong>on</strong>cerning Hungary for c<strong>on</strong>siderati<strong>on</strong> by<str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>Human</strong> <strong>Rights</strong> Committee (HRC) at its 98th sessi<strong>on</strong>.The ERRC is an internati<strong>on</strong>al public interest law organisati<strong>on</strong> engaging in a range <str<strong>on</strong>g>of</str<strong>on</strong>g> activities aimed at combatinganti-Romani racism and human rights abuse <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma, in particular strategic litigati<strong>on</strong>, internati<strong>on</strong>aladvocacy, research and policy development and training <str<strong>on</strong>g>of</str<strong>on</strong>g> Romani activists. In order to accomplish<str<strong>on</strong>g>the</str<strong>on</strong>g>se objectives CFCF undertakes strategic litigati<strong>on</strong>, community acti<strong>on</strong>, legislative lobbying, training and variouso<str<strong>on</strong>g>the</str<strong>on</strong>g>r forms <str<strong>on</strong>g>of</str<strong>on</strong>g> advocacy.The HHC is a n<strong>on</strong>-pr<str<strong>on</strong>g>of</str<strong>on</strong>g>it organisati<strong>on</strong> founded in 1989 and registered as an associati<strong>on</strong> with prominent publicbenefit status in Hungary. It is a member <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> European Council <strong>on</strong> Refugees and Exiles (ECRE). The HHCm<strong>on</strong>itors <str<strong>on</strong>g>the</str<strong>on</strong>g> enforcement in Hungary <str<strong>on</strong>g>of</str<strong>on</strong>g> human rights enshrined in internati<strong>on</strong>al human rights instruments,provides legal defence to victims <str<strong>on</strong>g>of</str<strong>on</strong>g> human rights abuses by state authorities and informs <str<strong>on</strong>g>the</str<strong>on</strong>g> public aboutrights violati<strong>on</strong>s. The HHC strives to ensure that domestic legislati<strong>on</strong> guarantee <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>sistent implementati<strong>on</strong><str<strong>on</strong>g>of</str<strong>on</strong>g> human rights norms. The HHC promotes legal educati<strong>on</strong> and training in fields relevant to its activities, bothin Hungary and abroad. The HHC’s main areas <str<strong>on</strong>g>of</str<strong>on</strong>g> activities are centred <strong>on</strong> protecting <str<strong>on</strong>g>the</str<strong>on</strong>g> rights <str<strong>on</strong>g>of</str<strong>on</strong>g> asylumseekers and foreigners in need <str<strong>on</strong>g>of</str<strong>on</strong>g> internati<strong>on</strong>al protecti<strong>on</strong>, as well as m<strong>on</strong>itoring <str<strong>on</strong>g>the</str<strong>on</strong>g> human rights performance<str<strong>on</strong>g>of</str<strong>on</strong>g> law enforcement agencies and <str<strong>on</strong>g>the</str<strong>on</strong>g> judicial system. It particularly focuses <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> detenti<strong>on</strong> and<str<strong>on</strong>g>the</str<strong>on</strong>g> effective enforcement <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> right to defence and equality before <str<strong>on</strong>g>the</str<strong>on</strong>g> law.Regular m<strong>on</strong>itoring <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> human rights situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma in Hungary has been undertaken by <str<strong>on</strong>g>the</str<strong>on</strong>g> ERRC andits partner organisati<strong>on</strong>s. On <str<strong>on</strong>g>the</str<strong>on</strong>g> basis <str<strong>on</strong>g>of</str<strong>on</strong>g> this, it is evident that <str<strong>on</strong>g>the</str<strong>on</strong>g> measures adopted and undertaken by <str<strong>on</strong>g>the</str<strong>on</strong>g>Hungarian government to date have been insufficient to ensure <str<strong>on</strong>g>the</str<strong>on</strong>g> effective implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Internati<strong>on</strong>alCovenant <strong>on</strong> Civil and Political <strong>Rights</strong> (<str<strong>on</strong>g>the</str<strong>on</strong>g> Covenant) and indeed, <str<strong>on</strong>g>of</str<strong>on</strong>g>ten have effects specifically counterto <str<strong>on</strong>g>the</str<strong>on</strong>g> spirit and letter <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Covenant.The present document does not aim to address all issues <str<strong>on</strong>g>of</str<strong>on</strong>g> relevance to <str<strong>on</strong>g>the</str<strong>on</strong>g> implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Covenant or itsprovisi<strong>on</strong>s in Hungary. Nor is this document a comprehensive summary <str<strong>on</strong>g>of</str<strong>on</strong>g> all human rights issues facing Roma inHungary. With this submissi<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> submitting organisati<strong>on</strong>s aim to present <str<strong>on</strong>g>the</str<strong>on</strong>g> results <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir research in severalareas <str<strong>on</strong>g>of</str<strong>on</strong>g> relevance to <str<strong>on</strong>g>the</str<strong>on</strong>g> Covenant in order to complement <str<strong>on</strong>g>the</str<strong>on</strong>g> informati<strong>on</strong> provided in <str<strong>on</strong>g>the</str<strong>on</strong>g> State Report.EXECUTIVE SUMMARYThe submitting organisati<strong>on</strong>s are aware <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>tents <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarian government’s fifth periodic reportto <str<strong>on</strong>g>the</str<strong>on</strong>g> HRC, as well as o<str<strong>on</strong>g>the</str<strong>on</strong>g>r recent Hungarian government policy documents <str<strong>on</strong>g>of</str<strong>on</strong>g> relevance to Roma. To date,measures adopted and undertaken by <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarian government have been insufficient to ensure <str<strong>on</strong>g>the</str<strong>on</strong>g> effectiveimplementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> ICCPR, particularly with regard to Articles 2, 3, 6, 7, 10, 14, 20, 24, 26 and 27.As to Articles 2, 26 and 27, discriminati<strong>on</strong> pervades all aspects <str<strong>on</strong>g>of</str<strong>on</strong>g> life for Roma in Hungary, most egregiously in<str<strong>on</strong>g>the</str<strong>on</strong>g> fields <str<strong>on</strong>g>of</str<strong>on</strong>g> educati<strong>on</strong>, housing and access to public services. The Government has failed to prevent, prohibitand eradicate practices <str<strong>on</strong>g>of</str<strong>on</strong>g> racial segregati<strong>on</strong> in educati<strong>on</strong> and housing. Legal prohibiti<strong>on</strong>s and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r legal andadministrative measures against racial discriminati<strong>on</strong> have to date been ineffective in prohibiting and bringingto an end racial discriminati<strong>on</strong> against Roma in Hungary. Moreover, <str<strong>on</strong>g>the</str<strong>on</strong>g>re is no available statistical data c<strong>on</strong>cerningrace and ethnicity, which hinders <str<strong>on</strong>g>the</str<strong>on</strong>g> exposure and tackling <str<strong>on</strong>g>of</str<strong>on</strong>g> discriminati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>se grounds.As to Article 3, Romani women suffer multiple discriminati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> basis <str<strong>on</strong>g>of</str<strong>on</strong>g> sex and ethnicity. As victims<str<strong>on</strong>g>of</str<strong>on</strong>g> multiple discriminati<strong>on</strong>, Romani women experience barriers in accessing equal educati<strong>on</strong>, health care andadequate housing and face high unemployment levels and barriers in accessing justice through administrative or3


esearch in 2002 and 2004 established that <str<strong>on</strong>g>the</str<strong>on</strong>g> educati<strong>on</strong>al segregati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma pupils has increased in primaryeducati<strong>on</strong> since 1990. 3 Havas, Kemény and Liskó (2001) identified 126 Roma-dominated segregated primaryschools in Hungary that 40% <str<strong>on</strong>g>of</str<strong>on</strong>g> all Roma students attend. Havas and Liskó (2004) stated that between <str<strong>on</strong>g>the</str<strong>on</strong>g>1999–2000 and <str<strong>on</strong>g>the</str<strong>on</strong>g> 2003–2004 school year, <str<strong>on</strong>g>the</str<strong>on</strong>g> number <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma-dominated primary schools increased from126 to 178 while an additi<strong>on</strong>al 67 schools had over 40% Roma students and rising. Havas and Liskó find segregati<strong>on</strong>at <str<strong>on</strong>g>the</str<strong>on</strong>g> class level as well, if <str<strong>on</strong>g>the</str<strong>on</strong>g> difference between <str<strong>on</strong>g>the</str<strong>on</strong>g> share <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma children in <strong>on</strong>e class is 50% higherthan that <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma children in ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r class in <str<strong>on</strong>g>the</str<strong>on</strong>g> school.According to <str<strong>on</strong>g>the</str<strong>on</strong>g> same 2004 research, while in 1992 7.1% <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma children studied in a school attended mainly byRoma, by 2000 this had risen to 18.1%. In 2004, 20–25% <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma children attended a primary school in which <str<strong>on</strong>g>the</str<strong>on</strong>g>proporti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma was over 40%, and every sixth Roma child attended a school in which more than half <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>student populati<strong>on</strong> was Roma. Based <strong>on</strong> data coming in from 86% <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> schools examined and <strong>on</strong> representativedata in 2004, Havas and Liskó c<strong>on</strong>cluded that twice as many socially disadvantaged and jeopardised childrenattended primary schools in which Roma students represented more than 20% <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> student populati<strong>on</strong> thanwas <str<strong>on</strong>g>the</str<strong>on</strong>g> case in “average” primary schools. This reinforces <str<strong>on</strong>g>the</str<strong>on</strong>g>ir previous findings that ethnicity-based segregati<strong>on</strong>also includes social class-based segregati<strong>on</strong>. Romani children are also frequently placed in segregated classes ato<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise mixed schools, where <str<strong>on</strong>g>the</str<strong>on</strong>g>y are likely to study a remedial or “catch-up” curriculum.Roma are overrepresented in schools and classes for children with intellectual disabilities, and evidence suggests thatthis is largely due to flawed assessment procedures that are influenced by discriminati<strong>on</strong>. Available statistics show adepressing picture. The percentage <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma children in special schools rose from about 25% in 1974–1975 to 42%in 1992. 4 No <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial statistics are available after this date, but numerous sociological studies have dealt with <str<strong>on</strong>g>the</str<strong>on</strong>g> issue.A 1997 survey involving 309 special schools estimated <str<strong>on</strong>g>the</str<strong>on</strong>g> percentage <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma pupils to be over 40%, whereas a1998 survey in Borsod County showed over 90% <str<strong>on</strong>g>of</str<strong>on</strong>g> students attending schools with special curricula to be Roma.Most experts agree that a good number <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma children attending special schools are not even slightly mentallydisabled and are <strong>on</strong>ly relegated to such instituti<strong>on</strong>s due to <str<strong>on</strong>g>the</str<strong>on</strong>g> negligent failure to take into c<strong>on</strong>siderati<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir specificsocio-cultural characteristics and owing to – c<strong>on</strong>scious or unc<strong>on</strong>scious – discriminatory c<strong>on</strong>siderati<strong>on</strong>s. 5Roma NGOs charge that flaws in <str<strong>on</strong>g>the</str<strong>on</strong>g> assessment procedure have c<strong>on</strong>tributed to <str<strong>on</strong>g>the</str<strong>on</strong>g> placement <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma childrenin disproporti<strong>on</strong>ate numbers in special schools and classes. There have been allegati<strong>on</strong>s and anecdotalevidence suggesting that Roma parents are not provided with enough informati<strong>on</strong> by expert panels that wouldensure <str<strong>on</strong>g>the</str<strong>on</strong>g>ir informed c<strong>on</strong>sent for such placement. This is crucial, because parents must c<strong>on</strong>sent to or appealagainst <str<strong>on</strong>g>the</str<strong>on</strong>g> opini<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> expert panels in writing. 6The Government has implemented a funding scheme intended to integrate schools, <str<strong>on</strong>g>of</str<strong>on</strong>g>fering a subsidy ando<str<strong>on</strong>g>the</str<strong>on</strong>g>r support through Educatio Kht. While <str<strong>on</strong>g>the</str<strong>on</strong>g> number <str<strong>on</strong>g>of</str<strong>on</strong>g> schools using <str<strong>on</strong>g>the</str<strong>on</strong>g>se subsidies has been steadily increasing,research suggests that true integrati<strong>on</strong> remains a slow and uneven process. Regrettably, schools whosestudent body over 50% Roma have tended not to join this program.The lack <str<strong>on</strong>g>of</str<strong>on</strong>g> a mechanism to m<strong>on</strong>itor and oversee <str<strong>on</strong>g>the</str<strong>on</strong>g> implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> integrati<strong>on</strong> programmes is problematic,but no soluti<strong>on</strong> has been put forward.A number <str<strong>on</strong>g>of</str<strong>on</strong>g> individual complaint based remedies against discriminati<strong>on</strong> in educati<strong>on</strong> exist; while <strong>on</strong>ly a limitednumber <str<strong>on</strong>g>of</str<strong>on</strong>g> cases have been brought forward. Activists have successfully pursued charges <str<strong>on</strong>g>of</str<strong>on</strong>g> segregati<strong>on</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> courts.Ra<str<strong>on</strong>g>the</str<strong>on</strong>g>r than improving its own c<strong>on</strong>trol, <str<strong>on</strong>g>the</str<strong>on</strong>g> Government has suggested that NGOs should bring more cases <str<strong>on</strong>g>of</str<strong>on</strong>g>segregati<strong>on</strong> to <str<strong>on</strong>g>the</str<strong>on</strong>g> attenti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> authorities. But without funding for such activities and a general fear am<strong>on</strong>gRomani parents <str<strong>on</strong>g>of</str<strong>on</strong>g> victimisati<strong>on</strong>, NGOs and activists are hardly able to c<strong>on</strong>tribute to <str<strong>on</strong>g>the</str<strong>on</strong>g> fight against segregati<strong>on</strong>3 Havas, Gábor, István Kemény and Il<strong>on</strong>a Liskó. as envisaged. Civil society has been active in <str<strong>on</strong>g>the</str<strong>on</strong>g> educati<strong>on</strong>al sphere, but <str<strong>on</strong>g>the</str<strong>on</strong>g> central Government itself should asserta more active role in moving desegregati<strong>on</strong> forward, ra<str<strong>on</strong>g>the</str<strong>on</strong>g>r than relying <strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g>ten segregating local authoritiesfor implementati<strong>on</strong> without providing support or external m<strong>on</strong>itoring <str<strong>on</strong>g>of</str<strong>on</strong>g> progress.The Nati<strong>on</strong>al <str<strong>on</strong>g>Office</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> Public Educati<strong>on</strong> has <str<strong>on</strong>g>the</str<strong>on</strong>g> authority to sancti<strong>on</strong> schools for discriminati<strong>on</strong>, but <str<strong>on</strong>g>the</str<strong>on</strong>g> maximumpenalty that it can impose is low, and <str<strong>on</strong>g>the</str<strong>on</strong>g>re are examples where its inspectors have failed to note physical segregati<strong>on</strong>in schools under review. Leadership and funding from <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> Educati<strong>on</strong> and Culture is <str<strong>on</strong>g>the</str<strong>on</strong>g> key in <str<strong>on</strong>g>the</str<strong>on</strong>g>desegregati<strong>on</strong> process. It is noteworthy that <str<strong>on</strong>g>the</str<strong>on</strong>g> CFCF has taken to court <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry precisely because <str<strong>on</strong>g>of</str<strong>on</strong>g> its failureto take legal proceedings against segregating schools and local authorities. Since <str<strong>on</strong>g>the</str<strong>on</strong>g> adopti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Equal TreatmentAct (Act CXXV <str<strong>on</strong>g>of</str<strong>on</strong>g> 2003), <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry/<str<strong>on</strong>g>Office</str<strong>on</strong>g> has initiated <strong>on</strong>ly <strong>on</strong>e procedure <strong>on</strong> account <str<strong>on</strong>g>of</str<strong>on</strong>g> segregati<strong>on</strong>.Biased and insulting material about Roma remains in some Hungarian textbooks and <str<strong>on</strong>g>the</str<strong>on</strong>g>re are no courses forteachers focusing <strong>on</strong> tolerance or multicultural educati<strong>on</strong> available as part <str<strong>on</strong>g>of</str<strong>on</strong>g> standard teacher training.Since 1 September 1993 (<str<strong>on</strong>g>the</str<strong>on</strong>g> adopti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Act <strong>on</strong> Public Educati<strong>on</strong>), pre-school has been available forchildren aged from three until <str<strong>on</strong>g>the</str<strong>on</strong>g> age when <str<strong>on</strong>g>the</str<strong>on</strong>g>y start primary school. Following amendments effective as <str<strong>on</strong>g>of</str<strong>on</strong>g> 1September 2003, pre-schools “must not refuse <str<strong>on</strong>g>the</str<strong>on</strong>g> admittance” <str<strong>on</strong>g>of</str<strong>on</strong>g> disadvantaged children, and from 2005 mustnot refuse <str<strong>on</strong>g>the</str<strong>on</strong>g> admittance <str<strong>on</strong>g>of</str<strong>on</strong>g> “multiply disadvantaged” children – many <str<strong>on</strong>g>of</str<strong>on</strong>g> whom are Roma from <str<strong>on</strong>g>the</str<strong>on</strong>g> age <str<strong>on</strong>g>of</str<strong>on</strong>g>three; 7 o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise, preschool is compulsory for a minimum <str<strong>on</strong>g>of</str<strong>on</strong>g> four hours a day from <str<strong>on</strong>g>the</str<strong>on</strong>g> age <str<strong>on</strong>g>of</str<strong>on</strong>g> five. 8Due to a lack <str<strong>on</strong>g>of</str<strong>on</strong>g> pre-schools in small villages, almost 20% <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma children live in areas with no pre-schoolnearby, and <str<strong>on</strong>g>the</str<strong>on</strong>g> transportati<strong>on</strong> to villages where <str<strong>on</strong>g>the</str<strong>on</strong>g>re is a pre-school may not be provided. Overcrowding <str<strong>on</strong>g>of</str<strong>on</strong>g>Romani children is also a problem in areas where <str<strong>on</strong>g>the</str<strong>on</strong>g>re are pre-schools. Generally, administrative requirementsfor enrolment in school are not an obstacle for Roma families; however, cases have been reported where Romachildren were turned away from pre-schools due to <str<strong>on</strong>g>the</str<strong>on</strong>g>ir parents’ “social disadvantage” or unemployment. Privateschools are increasingly popular in Hungary; however, as most <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>se are too expensive for Roma familiesto afford, many functi<strong>on</strong> as segregated instituti<strong>on</strong>s. Although <str<strong>on</strong>g>the</str<strong>on</strong>g>re are no c<strong>on</strong>clusive data in this regard,educati<strong>on</strong> in public schools does not seem to impose a serious financial burden <strong>on</strong> low-income families, as <str<strong>on</strong>g>the</str<strong>on</strong>g>State and municipal support for socially disadvantaged children alleviate most costs.The physical separati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma communities is increasing, with a growing number <str<strong>on</strong>g>of</str<strong>on</strong>g> Romani children livingin homogenous settlements. Schools draw <str<strong>on</strong>g>the</str<strong>on</strong>g>ir pupils from a legally defined catchment area, although parentscan choose to send <str<strong>on</strong>g>the</str<strong>on</strong>g>ir children to ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r school outside <str<strong>on</strong>g>the</str<strong>on</strong>g> area. In practice, however, few Romani parentselect to send <str<strong>on</strong>g>the</str<strong>on</strong>g>ir children to o<str<strong>on</strong>g>the</str<strong>on</strong>g>r schools, while n<strong>on</strong>-Roma parents are more likely to withdraw <str<strong>on</strong>g>the</str<strong>on</strong>g>ir childrenfrom schools with a high proporti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma. Regrettably, regulati<strong>on</strong>s seeking to even out <str<strong>on</strong>g>the</str<strong>on</strong>g> proporti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g>socially deprived (including Roma) children am<strong>on</strong>g catchment areas have not been properly implemented at <str<strong>on</strong>g>the</str<strong>on</strong>g>local level and again, central oversight <str<strong>on</strong>g>of</str<strong>on</strong>g> implementati<strong>on</strong> is missing.Despite government programmes designed to tackle misdiagnosis and <str<strong>on</strong>g>the</str<strong>on</strong>g> internati<strong>on</strong>al c<strong>on</strong>demnati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> such practicein <str<strong>on</strong>g>the</str<strong>on</strong>g> D. H. and o<str<strong>on</strong>g>the</str<strong>on</strong>g>rs v. Czech Republic judgment <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> European Court <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Human</strong> <strong>Rights</strong>, it is still comm<strong>on</strong>to assign Roma children to classes based <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir intellectual abilities. The tests and methods used for <str<strong>on</strong>g>the</str<strong>on</strong>g> assessmentfor placing children in special schools or classes are still out <str<strong>on</strong>g>of</str<strong>on</strong>g> date and culturally biased. Assessments are sometimesc<strong>on</strong>ducted under inappropriate c<strong>on</strong>diti<strong>on</strong>s and without appropriate attenti<strong>on</strong> to language or cultural issues – <str<strong>on</strong>g>of</str<strong>on</strong>g>tenstemming from <str<strong>on</strong>g>the</str<strong>on</strong>g> prohibiti<strong>on</strong> to collect ethnic data. Although mechanisms exist for re-transfer <str<strong>on</strong>g>of</str<strong>on</strong>g> children intomainstream schools and classes, <str<strong>on</strong>g>the</str<strong>on</strong>g>re are no statistics maintained <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> actual number that take place.In smaller villages school–community relati<strong>on</strong>s are <str<strong>on</strong>g>of</str<strong>on</strong>g>ten informal, but where such day to day c<strong>on</strong>tacts do nottake place, <str<strong>on</strong>g>the</str<strong>on</strong>g>re is little evidence that more structured mechanisms engage Roma parents as needed. Research<strong>on</strong> discriminatory attitudes indicates that many teachers and school directors harbour negative percepti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g>Roma students, but that such attitudes are not overtly expressed, and ra<str<strong>on</strong>g>the</str<strong>on</strong>g>r come across in <str<strong>on</strong>g>the</str<strong>on</strong>g> form <str<strong>on</strong>g>of</str<strong>on</strong>g> low expectati<strong>on</strong>s.In addressing <str<strong>on</strong>g>the</str<strong>on</strong>g> more direct c<strong>on</strong>sequences <str<strong>on</strong>g>of</str<strong>on</strong>g> such prejudice, such as segregati<strong>on</strong> in special classesor <str<strong>on</strong>g>the</str<strong>on</strong>g> inclusi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> biased material in textbooks, <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> Educati<strong>on</strong> and Culture should also focus <strong>on</strong><str<strong>on</strong>g>the</str<strong>on</strong>g>se indirect forms <str<strong>on</strong>g>of</str<strong>on</strong>g> discriminati<strong>on</strong> and take steps to eliminate <str<strong>on</strong>g>the</str<strong>on</strong>g>m in <str<strong>on</strong>g>the</str<strong>on</strong>g> classroom.7 Art. 65 (2) Act <strong>on</strong> Public Educati<strong>on</strong>.8 Art. 24 (3) Act <strong>on</strong> Public Educati<strong>on</strong>.9 Kemény I. and B. Am<strong>on</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g> country’s ethnic and nati<strong>on</strong>al minorities, Roma al<strong>on</strong>e have no accredited teaching material in <str<strong>on</strong>g>the</str<strong>on</strong>g>irmo<str<strong>on</strong>g>the</str<strong>on</strong>g>r t<strong>on</strong>gue at all, nor accredited teacher training courses where minority language-speaking teachers can study.1 . 2 . D I S C R I M I N A T I O N A G A I N S T R O M A I N H O U S I N G1.2.1. Racial segregati<strong>on</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> field <str<strong>on</strong>g>of</str<strong>on</strong>g> housingAccording to <str<strong>on</strong>g>the</str<strong>on</strong>g> most recent European Uni<strong>on</strong> Agency for Fundamental <strong>Rights</strong> study <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> housing situati<strong>on</strong><str<strong>on</strong>g>of</str<strong>on</strong>g> Roma in Hungary, 72% <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma families lived in a situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> segregati<strong>on</strong> in 2003, <str<strong>on</strong>g>of</str<strong>on</strong>g> whom 42% lived <strong>on</strong><str<strong>on</strong>g>the</str<strong>on</strong>g> edges <str<strong>on</strong>g>of</str<strong>on</strong>g> towns, 2% lived far from towns, 6% lived in separate settlements and 22% had homes in <str<strong>on</strong>g>the</str<strong>on</strong>g> innerparts <str<strong>on</strong>g>of</str<strong>on</strong>g> towns in neighbourhoods mostly populated by Roma. 9Segregating forces in Hungary are extremely powerful. The failure <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> government to take effective measuresagainst private actors and local <str<strong>on</strong>g>of</str<strong>on</strong>g>ficials who force Roma from <str<strong>on</strong>g>the</str<strong>on</strong>g>ir homes or prevent Roma from settlingin certain communities c<strong>on</strong>stitutes a violati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> articles 7, 12, 17 and 26. In last decade, n<strong>on</strong>-Roma have obstructedRoma from moving into certain areas <strong>on</strong> a number <str<strong>on</strong>g>of</str<strong>on</strong>g> occasi<strong>on</strong>s with no adequate resp<strong>on</strong>se from government.Roma have been prevented from moving into housing by physical force (e.g. Roma families boughthouses which were subsequently damaged by locals such that <str<strong>on</strong>g>the</str<strong>on</strong>g> Roma could not or would not move in, orsometimes <str<strong>on</strong>g>the</str<strong>on</strong>g> families were prevented from moving into housing by <str<strong>on</strong>g>the</str<strong>on</strong>g> locals forming “human chains” – Aba-Belsőbáránd, etc.) as well as by local authorities as a result <str<strong>on</strong>g>of</str<strong>on</strong>g> petiti<strong>on</strong>s by inhabitants (Celldömölk-Alsóság<strong>on</strong>,Eger Felnémeti). 10 For instance <strong>on</strong> 28 April 2008, Molotov cocktails were thrown at a house <str<strong>on</strong>g>of</str<strong>on</strong>g> a Roma family(Balogh) who were about to move in. The fire destroyed all <str<strong>on</strong>g>the</str<strong>on</strong>g>ir bel<strong>on</strong>gings. The family had to look for a newhouse. The new vendor allegedly was verbally threatened by a member <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> local self-government and forcedto withdraw <str<strong>on</strong>g>the</str<strong>on</strong>g> purchase transacti<strong>on</strong>. No acti<strong>on</strong> was taken against <str<strong>on</strong>g>the</str<strong>on</strong>g> government <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial. However, she ignored<str<strong>on</strong>g>the</str<strong>on</strong>g> threat and sold her house to <str<strong>on</strong>g>the</str<strong>on</strong>g> family. On 18 April, this house was also set <strong>on</strong> fire with Molotovbombs. The local self-government, <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarian Guard and <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>alist Motor Bikers organised a dem<strong>on</strong>strati<strong>on</strong><strong>on</strong> 21 June in <str<strong>on</strong>g>the</str<strong>on</strong>g> village against <str<strong>on</strong>g>the</str<strong>on</strong>g> “gypsy –criminality”. 11With respect to <str<strong>on</strong>g>the</str<strong>on</strong>g> housing segregati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma, <str<strong>on</strong>g>the</str<strong>on</strong>g> ECRI in its 2009 report highlights that although <str<strong>on</strong>g>the</str<strong>on</strong>g>Hungarian authorities declared that housing desegregati<strong>on</strong> is <str<strong>on</strong>g>the</str<strong>on</strong>g>ir main aim and <str<strong>on</strong>g>the</str<strong>on</strong>g>y introduced social housingprograms to encourage Roma living in segregated settlements outside towns and villages to move into <str<strong>on</strong>g>the</str<strong>on</strong>g>refurbished social housing inside <str<strong>on</strong>g>the</str<strong>on</strong>g> town or village, still <str<strong>on</strong>g>the</str<strong>on</strong>g>re are reports <str<strong>on</strong>g>of</str<strong>on</strong>g> resistance from local authoritiesand individuals when a Roma family has sought to move into a new neighbourhood. 12II. ARTICLE 3 – EQUAL RIGHTS OF MEN AND WOMENDespite <str<strong>on</strong>g>the</str<strong>on</strong>g> various measures adopted by <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarian Government, gender inequality still exists in Hungary.The Nati<strong>on</strong>al Strategy <strong>on</strong> Equality Between Women and Men was adopted <strong>on</strong>ly in January 2009.According to <str<strong>on</strong>g>the</str<strong>on</strong>g> recent European Commissi<strong>on</strong> Annual Report <strong>on</strong> Equality between women and men, <str<strong>on</strong>g>the</str<strong>on</strong>g>employment rate for women is approx 52% in Hungary, which is under <str<strong>on</strong>g>the</str<strong>on</strong>g> European average. 13 While <str<strong>on</strong>g>the</str<strong>on</strong>g>reis not much <str<strong>on</strong>g>of</str<strong>on</strong>g> a difference c<strong>on</strong>cerning salary rates between men and women, and greater number <str<strong>on</strong>g>of</str<strong>on</strong>g> womenparticipate in educati<strong>on</strong> (at least at higher levels) than men, women spend <strong>on</strong> average 16 hours more per weekwith domestic or family work than men. Parenthood also has a l<strong>on</strong>g-term negative impact <strong>on</strong> female employment.The number <str<strong>on</strong>g>of</str<strong>on</strong>g> female members in <str<strong>on</strong>g>the</str<strong>on</strong>g> Parliament is less than 15%. Although <str<strong>on</strong>g>the</str<strong>on</strong>g>re is no ethnic dataavailable, due to <str<strong>on</strong>g>the</str<strong>on</strong>g> socially and ec<strong>on</strong>omically disadvantaged situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma, Romani women face multiplediscriminati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> basis <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir sex and ethnicity.10 Forray R. Policies adopted by <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarian state to improve <str<strong>on</strong>g>the</str<strong>on</strong>g> situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> women and Roma in <str<strong>on</strong>g>the</str<strong>on</strong>g> country have notyet resulted in substantive improvements in <str<strong>on</strong>g>the</str<strong>on</strong>g> situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> most Romani women since <str<strong>on</strong>g>the</str<strong>on</strong>g>y ei<str<strong>on</strong>g>the</str<strong>on</strong>g>r do not takeinto account <str<strong>on</strong>g>the</str<strong>on</strong>g> gender perspective or fail to include <str<strong>on</strong>g>the</str<strong>on</strong>g> ethnic perspective, failing to secure <str<strong>on</strong>g>the</str<strong>on</strong>g> advancement<str<strong>on</strong>g>of</str<strong>on</strong>g> Romani women every time.In 2005, Hungary joined in <str<strong>on</strong>g>the</str<strong>on</strong>g> Decade <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma Inclusi<strong>on</strong> (2005-2015). 14 Within this initiative in 2007, <str<strong>on</strong>g>the</str<strong>on</strong>g>Hungarian Parliament adopted a resoluti<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Decade <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Roma Integrati<strong>on</strong> Program Strategic Planspecifying goals and indicators in <str<strong>on</strong>g>the</str<strong>on</strong>g> areas <str<strong>on</strong>g>of</str<strong>on</strong>g> housing, health, employment and educati<strong>on</strong>. 15 Measures toachieve <str<strong>on</strong>g>the</str<strong>on</strong>g> creati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> equal opportunities for women are listed under cross-cutting <str<strong>on</strong>g>the</str<strong>on</strong>g>mes. Acti<strong>on</strong> Plans areadopted by <str<strong>on</strong>g>the</str<strong>on</strong>g> Government for <str<strong>on</strong>g>the</str<strong>on</strong>g> period <str<strong>on</strong>g>of</str<strong>on</strong>g> two years establishing <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>crete tasks and measures to betaken in <str<strong>on</strong>g>the</str<strong>on</strong>g> framework <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Strategy. In 2007, <str<strong>on</strong>g>the</str<strong>on</strong>g> Government adopted <str<strong>on</strong>g>the</str<strong>on</strong>g> first acti<strong>on</strong> plan for <str<strong>on</strong>g>the</str<strong>on</strong>g> year2008-2009. 16 No plan for <str<strong>on</strong>g>the</str<strong>on</strong>g> coming period has yet been adopted.The submitting organisati<strong>on</strong>s welcome that <str<strong>on</strong>g>the</str<strong>on</strong>g> l<strong>on</strong>g-term Strategic Plan specifically refers to Roma womenwhen defining required measures to be taken in <str<strong>on</strong>g>the</str<strong>on</strong>g> area <str<strong>on</strong>g>of</str<strong>on</strong>g> employment and in access to health care services.However, <str<strong>on</strong>g>the</str<strong>on</strong>g> submitting organisati<strong>on</strong>s remain c<strong>on</strong>cerned that in <str<strong>on</strong>g>the</str<strong>on</strong>g> key areas <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> plan including those relatingto anti-discriminati<strong>on</strong>, housing and educati<strong>on</strong> make no menti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> women. The StrategicPlan menti<strong>on</strong>s gender equality in <str<strong>on</strong>g>the</str<strong>on</strong>g> paragraph <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> establishment <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Strategic Plan (1.3.1), but it remainssilent <strong>on</strong> some important matters. Although it emphasizes, for example, <str<strong>on</strong>g>the</str<strong>on</strong>g> importance <str<strong>on</strong>g>of</str<strong>on</strong>g> data collecti<strong>on</strong>, itdoes not menti<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> need for disaggregated data by gender (1.3.6), and many times it also fails to include genderperspectives am<strong>on</strong>gst <str<strong>on</strong>g>the</str<strong>on</strong>g> indicators (except in <str<strong>on</strong>g>the</str<strong>on</strong>g> employment and health care secti<strong>on</strong>s).2 . 1 . E D U C A T I O NIn its Sixth Periodic Report submitted by Hungary to <str<strong>on</strong>g>the</str<strong>on</strong>g> Committee <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Eliminati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Discriminati<strong>on</strong> againstWomen (CEDAW), <str<strong>on</strong>g>the</str<strong>on</strong>g> Government noted that Romani women face a “substantial disadvantage in <str<strong>on</strong>g>the</str<strong>on</strong>g> schoolingsystem.” It went <strong>on</strong> to say that surveys have indicated that as many as 35 to 40% <str<strong>on</strong>g>of</str<strong>on</strong>g> Romani women have notcompleted primary school, compared to 30% <str<strong>on</strong>g>of</str<strong>on</strong>g> Romani men. 17 The failure <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Government to ensure thatRomani women complete mandatory primary educati<strong>on</strong> is a violati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> articles 2, 3 and 26 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Covenant.Romani women and girls face a lack <str<strong>on</strong>g>of</str<strong>on</strong>g> access to educati<strong>on</strong> due to multiple discriminati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> basis <str<strong>on</strong>g>of</str<strong>on</strong>g> sexand ethnicity. Am<strong>on</strong>gst <str<strong>on</strong>g>the</str<strong>on</strong>g> Romani women interviewed during ERRC research, 16.7% had not completedprimary educati<strong>on</strong>, 4.2% completed less than a year <str<strong>on</strong>g>of</str<strong>on</strong>g> educati<strong>on</strong> or had never attended school. The researchidentified key areas in which Romani women and girls were at a particular disadvantage in terms <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir educati<strong>on</strong>experience. These included verbal and physical abuse by classmates and teachers, an unwelcoming atmosphereat educati<strong>on</strong>al facilities, poverty, patriarchal expectati<strong>on</strong>s and stereotypes which remain prevalent am<strong>on</strong>glarge sectors <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Romani community and which are also held by school staff and a lack <str<strong>on</strong>g>of</str<strong>on</strong>g> positive models. 182 . 3 . discriminated against when applying for work. In some instances, <str<strong>on</strong>g>the</str<strong>on</strong>g> prospective employers reportedly identified<str<strong>on</strong>g>the</str<strong>on</strong>g> ethnicity <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> job applicant by <str<strong>on</strong>g>the</str<strong>on</strong>g>ir address or name, while in most cases <str<strong>on</strong>g>the</str<strong>on</strong>g> ethnicity was revealedduring <str<strong>on</strong>g>the</str<strong>on</strong>g> interview process. In some instances a higher educati<strong>on</strong>al level than that necessary to perform <str<strong>on</strong>g>the</str<strong>on</strong>g>job is required by <str<strong>on</strong>g>the</str<strong>on</strong>g> employer in order to avoid employing Romani women.2 . 4 . H E A L T HRomani women’s health situati<strong>on</strong> is significantly worse than that <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> general populati<strong>on</strong> as a result <str<strong>on</strong>g>of</str<strong>on</strong>g> directdiscriminati<strong>on</strong> and degrading treatment at <str<strong>on</strong>g>the</str<strong>on</strong>g> hands <str<strong>on</strong>g>of</str<strong>on</strong>g> doctors and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r hospital staff (including segregati<strong>on</strong>in maternity wards), lack <str<strong>on</strong>g>of</str<strong>on</strong>g> access to medical services and <str<strong>on</strong>g>the</str<strong>on</strong>g> disadvantaged positi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Romani womenwithin <str<strong>on</strong>g>the</str<strong>on</strong>g> family. Of <str<strong>on</strong>g>the</str<strong>on</strong>g> 78 Romani women who answered questi<strong>on</strong>s related to access to health care duringERRC research in 2007, 43 (49%) evaluated it as inadequate. The most comm<strong>on</strong> complaints included extorti<strong>on</strong>(44.44%), neglect and/or verbal abuse (25.64%) and segregati<strong>on</strong> in maternity wards (11.54%).Romani women victims <str<strong>on</strong>g>of</str<strong>on</strong>g> violence face multiple discriminati<strong>on</strong> when seeking justice or redress. There is a lack<str<strong>on</strong>g>of</str<strong>on</strong>g> trust between Romani women and <str<strong>on</strong>g>the</str<strong>on</strong>g> police and several Romani women reported being <str<strong>on</strong>g>the</str<strong>on</strong>g> targets <str<strong>on</strong>g>of</str<strong>on</strong>g> policesurveillance and harassment, which results in a lack <str<strong>on</strong>g>of</str<strong>on</strong>g> reporting <str<strong>on</strong>g>of</str<strong>on</strong>g> violent incidents by Romani women. 19This situati<strong>on</strong> is fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r exacerbated by <str<strong>on</strong>g>the</str<strong>on</strong>g> failure <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> police to provide adequate protecti<strong>on</strong> to Romaniwomen victims <str<strong>on</strong>g>of</str<strong>on</strong>g> violence.III. ARTICLE 6 – RIGHT TO LIFEArticle 6 (1) <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Covenant stipulates that, “Every human being has <str<strong>on</strong>g>the</str<strong>on</strong>g> inherent right to life. This right shallbe protected by law. No <strong>on</strong>e shall be arbitrarily deprived <str<strong>on</strong>g>of</str<strong>on</strong>g> his life.” In this respect <str<strong>on</strong>g>the</str<strong>on</strong>g> Committee’s GeneralComment No. 6 makes clear that “[s]tates have <str<strong>on</strong>g>the</str<strong>on</strong>g> supreme duty to prevent wars, acts <str<strong>on</strong>g>of</str<strong>on</strong>g> genocide and o<str<strong>on</strong>g>the</str<strong>on</strong>g>racts <str<strong>on</strong>g>of</str<strong>on</strong>g> mass violence causing arbitrary loss <str<strong>on</strong>g>of</str<strong>on</strong>g> life.” 20 Moreover <str<strong>on</strong>g>the</str<strong>on</strong>g> Committee highlights that “[t]he expressi<strong>on</strong>‘inherent right to life’ cannot properly be understood in a restrictive manner, and <str<strong>on</strong>g>the</str<strong>on</strong>g> protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this rightrequires that States adopt positive measures”. 21In <str<strong>on</strong>g>the</str<strong>on</strong>g> period January 2008 through June 2009, <str<strong>on</strong>g>the</str<strong>on</strong>g> ERRC registered around 30 attacks against Roma based <strong>on</strong>media reports. 22 In <str<strong>on</strong>g>the</str<strong>on</strong>g> course <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> attacks, <str<strong>on</strong>g>the</str<strong>on</strong>g> perpetrators reportedly used fire, bombing, shooting, stabbing,beatings or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r kinds <str<strong>on</strong>g>of</str<strong>on</strong>g> violent means. According to ERRC desk and field research as well as media reports,<str<strong>on</strong>g>the</str<strong>on</strong>g> attacks against Roma in Hungary in this period took at least nine lives 23 and have left many o<str<strong>on</strong>g>the</str<strong>on</strong>g>r peoplewith injuries. Many <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> assaults have targeted families and children, causing injury and death to Roma <str<strong>on</strong>g>of</str<strong>on</strong>g> allages. In <str<strong>on</strong>g>the</str<strong>on</strong>g> vast majority <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>se cases, <str<strong>on</strong>g>the</str<strong>on</strong>g> law enforcement resp<strong>on</strong>se has been inadequate or n<strong>on</strong>-existent.Despite <str<strong>on</strong>g>the</str<strong>on</strong>g> seriousness <str<strong>on</strong>g>of</str<strong>on</strong>g> this problem, <str<strong>on</strong>g>the</str<strong>on</strong>g> Government makes no reference to it in its report under <str<strong>on</strong>g>the</str<strong>on</strong>g> Covenant.Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>rmore, <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarian authorities have never made public coherent and readily-comprehensibledata <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> number <str<strong>on</strong>g>of</str<strong>on</strong>g> racially-motivated crimes occurring in Hungary. In relati<strong>on</strong> to this <str<strong>on</strong>g>the</str<strong>on</strong>g> ECRI in <str<strong>on</strong>g>the</str<strong>on</strong>g>irreport noted that introducti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> systematic and comprehensive m<strong>on</strong>itoring <str<strong>on</strong>g>of</str<strong>on</strong>g> all incidents that may c<strong>on</strong>stituteracist violence, including collecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> disaggregated data by ethnicity, is essential to combating racial violence. 24Some <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> cases involving violence against Hungarian Roma are as follows:QQOn 23 February 2009 <str<strong>on</strong>g>the</str<strong>on</strong>g> house <str<strong>on</strong>g>of</str<strong>on</strong>g> a Romani family in Tatarszentgyörgy was set <strong>on</strong> fire by Molotov cocktails.Then <str<strong>on</strong>g>the</str<strong>on</strong>g> perpetrator(s) shot and killed two family members, a fa<str<strong>on</strong>g>the</str<strong>on</strong>g>r (27) and s<strong>on</strong> (5), as <str<strong>on</strong>g>the</str<strong>on</strong>g>y fled19 Ibid.20 General Comment No. 06: The right to life (art. 6): 30/04/82. The <strong>on</strong>-duty police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer and a forensic expert at<str<strong>on</strong>g>the</str<strong>on</strong>g> crime scene both failed to recognise <str<strong>on</strong>g>the</str<strong>on</strong>g> victims’ gunshot wounds. The police also classified <str<strong>on</strong>g>the</str<strong>on</strong>g> attackand murders as <str<strong>on</strong>g>the</str<strong>on</strong>g> result <str<strong>on</strong>g>of</str<strong>on</strong>g> an accidental fire. No detail such as <str<strong>on</strong>g>the</str<strong>on</strong>g> identity <str<strong>on</strong>g>of</str<strong>on</strong>g><str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers, why <str<strong>on</strong>g>the</str<strong>on</strong>g>y were held resp<strong>on</strong>sible and what kind <str<strong>on</strong>g>of</str<strong>on</strong>g> punishment was imposed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>m, if any,has been made public.On 22 April 2009, as he was leaving to work <str<strong>on</strong>g>the</str<strong>on</strong>g> nightshift, 54-year-old Kóka Jenő was shot to deathin fr<strong>on</strong>t <str<strong>on</strong>g>of</str<strong>on</strong>g> his house. At <str<strong>on</strong>g>the</str<strong>on</strong>g> crime scene, a witness saw a black Land Rover bel<strong>on</strong>ging to <str<strong>on</strong>g>the</str<strong>on</strong>g> unknownperpetrator(s), and a tall man stepping out <str<strong>on</strong>g>of</str<strong>on</strong>g> it. According to <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial police website, murder investigati<strong>on</strong>sagainst unidentified suspect(s) have begun. They also reported similarities between this case andearlier attacks against Roma.On <str<strong>on</strong>g>the</str<strong>on</strong>g> night <str<strong>on</strong>g>of</str<strong>on</strong>g> 3 August 2009, 45-year-old Mária B. and her daughter were attacked by strangers in <str<strong>on</strong>g>the</str<strong>on</strong>g>irhome. The mo<str<strong>on</strong>g>the</str<strong>on</strong>g>r died after being shot while in her bed and her daughter survived but was badly injured.On <str<strong>on</strong>g>the</str<strong>on</strong>g> night <str<strong>on</strong>g>of</str<strong>on</strong>g> 18 November, a hand grenade was thrown at <str<strong>on</strong>g>the</str<strong>on</strong>g> house <str<strong>on</strong>g>of</str<strong>on</strong>g> a Romani family in Pécs. Twoadults were killed instantly. Two children (aged 3 and 5) were taken to hospital in a state <str<strong>on</strong>g>of</str<strong>on</strong>g> shock andwith minor injuries. The police eliminated a racist motive after investigating <str<strong>on</strong>g>the</str<strong>on</strong>g> crime scene. They assume(without any apparent evidence) a revenge motive or possible mafia c<strong>on</strong>flict.It is impossible to state c<strong>on</strong>clusively <str<strong>on</strong>g>the</str<strong>on</strong>g> factors that lead to violence. However, <str<strong>on</strong>g>the</str<strong>on</strong>g> ERRC has identified <str<strong>on</strong>g>the</str<strong>on</strong>g>following factors that it believes encourages violence against Roma.Anti-Roma statements <str<strong>on</strong>g>of</str<strong>on</strong>g> public authorities and politicians: During <str<strong>on</strong>g>the</str<strong>on</strong>g> period many instances <str<strong>on</strong>g>of</str<strong>on</strong>g> anti-Romastatements <str<strong>on</strong>g>of</str<strong>on</strong>g> public authorities or politicians were registered, as well as statements <str<strong>on</strong>g>of</str<strong>on</strong>g> a discriminatory nature.More detailed discussi<strong>on</strong> related to this follows below in <str<strong>on</strong>g>the</str<strong>on</strong>g> part related to advocacy <str<strong>on</strong>g>of</str<strong>on</strong>g> nati<strong>on</strong>al and racial hatred.Lack <str<strong>on</strong>g>of</str<strong>on</strong>g> effective investigati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> attacks against Roma leading to impunity: According to publiclyavailable informati<strong>on</strong>, in <str<strong>on</strong>g>the</str<strong>on</strong>g> past year <str<strong>on</strong>g>the</str<strong>on</strong>g> police have identified four perpetrators implicated in nine cases <str<strong>on</strong>g>of</str<strong>on</strong>g>violent attacks. 25 In <strong>on</strong>e case in Abádszalók, <str<strong>on</strong>g>the</str<strong>on</strong>g> attacked family was able to detain <str<strong>on</strong>g>the</str<strong>on</strong>g> perpetrator at <str<strong>on</strong>g>the</str<strong>on</strong>g> scene<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> crime <str<strong>on</strong>g>the</str<strong>on</strong>g>mselves. 26In October 2009, <str<strong>on</strong>g>the</str<strong>on</strong>g> ERRC sent <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial letters to <str<strong>on</strong>g>the</str<strong>on</strong>g> law enforcement authorities and <str<strong>on</strong>g>the</str<strong>on</strong>g> public prosecutorsrequesting informati<strong>on</strong> about <str<strong>on</strong>g>the</str<strong>on</strong>g> investigati<strong>on</strong> and prosecuti<strong>on</strong> status <str<strong>on</strong>g>of</str<strong>on</strong>g> 12 cases in which no informati<strong>on</strong>was publicly available. The ERRC has received <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial resp<strong>on</strong>ses in 10 cases. According to <str<strong>on</strong>g>the</str<strong>on</strong>g> informati<strong>on</strong>provided, <str<strong>on</strong>g>the</str<strong>on</strong>g> investigati<strong>on</strong>s have been closed in six cases, <str<strong>on</strong>g>the</str<strong>on</strong>g> investigati<strong>on</strong> is <strong>on</strong>going in three cases and in <strong>on</strong>ly<strong>on</strong>e case is <str<strong>on</strong>g>the</str<strong>on</strong>g>re an indictment against <str<strong>on</strong>g>the</str<strong>on</strong>g> perpetrator. Racial motivati<strong>on</strong> was not found in any <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> cases.The failure <str<strong>on</strong>g>of</str<strong>on</strong>g> law enforcement to c<strong>on</strong>duct effective investigati<strong>on</strong>s and launch prosecuti<strong>on</strong>s in <str<strong>on</strong>g>the</str<strong>on</strong>g> vast majority <str<strong>on</strong>g>of</str<strong>on</strong>g><str<strong>on</strong>g>the</str<strong>on</strong>g>se crimes <str<strong>on</strong>g>of</str<strong>on</strong>g> violence against Roma creates a general impressi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> impunity. This can give c<strong>on</strong>fidence to potentialfuture perpetrators as <str<strong>on</strong>g>the</str<strong>on</strong>g>y may rightly understand that <str<strong>on</strong>g>the</str<strong>on</strong>g>re are almost no c<strong>on</strong>sequences for people who commit violentcrimes against Roma. The Minister <str<strong>on</strong>g>of</str<strong>on</strong>g> Justice and Law Enforcement recently emphasised “We have not been ableto track down <str<strong>on</strong>g>the</str<strong>on</strong>g> perpetrators <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>se crimes even though we have a 95% detecti<strong>on</strong> rate in homicide cases overall.” 27Associati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> law enforcement <str<strong>on</strong>g>of</str<strong>on</strong>g>ficials with anti-Romani ideology: Law enforcement <str<strong>on</strong>g>of</str<strong>on</strong>g>ficials in Hungaryhave been increasingly associated with extremist groups with str<strong>on</strong>g anti-Romani platforms such as Jobbikand <str<strong>on</strong>g>the</str<strong>on</strong>g> Magyar Garda. The Magyar Garda website and campaign announcements publicly invite both policeand army <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers to join <str<strong>on</strong>g>the</str<strong>on</strong>g>ir ranks. In June 2009 it was reported that a law enforcement <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers’ trade uni<strong>on</strong> called Tettrekesz (“Ready for Acti<strong>on</strong>”)representing more than 5,000 active police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers had entered a collaborati<strong>on</strong> agreement with Jobbik. 28 Aninvestigati<strong>on</strong> by <str<strong>on</strong>g>the</str<strong>on</strong>g> public prosecutor is currently pending, however wide coverage <str<strong>on</strong>g>of</str<strong>on</strong>g> such acts in <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarianmedia c<strong>on</strong>tribute to <str<strong>on</strong>g>the</str<strong>on</strong>g> impressi<strong>on</strong> that <str<strong>on</strong>g>the</str<strong>on</strong>g> police are allied against Roma. At <str<strong>on</strong>g>the</str<strong>on</strong>g> same time, police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficialshave featured prominently <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> party lists <str<strong>on</strong>g>of</str<strong>on</strong>g> Jobbik, with Judit Szima, <str<strong>on</strong>g>the</str<strong>on</strong>g> Secretary General <str<strong>on</strong>g>of</str<strong>on</strong>g> Tettrekesz,ranking fourth <strong>on</strong> Jobbik’s list <str<strong>on</strong>g>of</str<strong>on</strong>g> candidates in <str<strong>on</strong>g>the</str<strong>on</strong>g> recent European Parliament electi<strong>on</strong>s.IV. ARTICLE 7– PROHIBITION OF TORTURENo systematic research <strong>on</strong> ill-treatment <str<strong>on</strong>g>of</str<strong>on</strong>g> members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Roma minority has been performed so far. However,a questi<strong>on</strong>naire-based survey, carried out by <str<strong>on</strong>g>the</str<strong>on</strong>g> HHC in 2003, 29 focusing <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> pre-trialdetainees in police jails and penitentiary instituti<strong>on</strong>s also examined how ethnicity influences <str<strong>on</strong>g>the</str<strong>on</strong>g> likelihood <str<strong>on</strong>g>of</str<strong>on</strong>g>ill-treatment. The research dem<strong>on</strong>strated that ill-treatment was comm<strong>on</strong> (affecting 17% <str<strong>on</strong>g>of</str<strong>on</strong>g> resp<strong>on</strong>dents), andthat in pre-trial detenti<strong>on</strong> Romani pris<strong>on</strong>ers were more likely to suffer ill-treatment than Roma pris<strong>on</strong>ers. Researchsuggests that violence applied during <str<strong>on</strong>g>the</str<strong>on</strong>g> apprehensi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a suspect (i.e. in a very stressful situati<strong>on</strong>) ismore driven by emoti<strong>on</strong>s, whereas unlawful force applied in order to extort a c<strong>on</strong>fessi<strong>on</strong> is motivated by morerati<strong>on</strong>al c<strong>on</strong>siderati<strong>on</strong>s. Therefore, biases, potential anti-Roma sentiments may play a more significant role inaggressive acts committed at <str<strong>on</strong>g>the</str<strong>on</strong>g> beginning <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> criminal procedure. Since <str<strong>on</strong>g>the</str<strong>on</strong>g>re is lack <str<strong>on</strong>g>of</str<strong>on</strong>g> data, <str<strong>on</strong>g>the</str<strong>on</strong>g>re is noreas<strong>on</strong> to believe that <str<strong>on</strong>g>the</str<strong>on</strong>g> situati<strong>on</strong> has changed.Two recent cases reinforce <str<strong>on</strong>g>the</str<strong>on</strong>g> clam that nothing changed. In late September 2008, <str<strong>on</strong>g>the</str<strong>on</strong>g> HHC was informedthat an inmate in <str<strong>on</strong>g>the</str<strong>on</strong>g> Borsod-Abaúj-Zemplén County penitentiary had been seriously ill-treated by more thanten pris<strong>on</strong> guards. The HHC’s pris<strong>on</strong> m<strong>on</strong>itor paid an ad hoc visit to <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>cerned pris<strong>on</strong> and interviewed <str<strong>on</strong>g>the</str<strong>on</strong>g>allegedly beaten inmate, G. F. The inmate told HHC that, following a minor c<strong>on</strong>flict with a guard, his cell wasemptied (i.e. all <str<strong>on</strong>g>the</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r inmates were sent out <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> cell and were placed in ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r <strong>on</strong>e temporarily) and <str<strong>on</strong>g>the</str<strong>on</strong>g>guards started beating him as a result <str<strong>on</strong>g>of</str<strong>on</strong>g> which he suffered serious injuries (broken nose, seriously wounded leftear and jaw, bruises all over his body). After <str<strong>on</strong>g>the</str<strong>on</strong>g> beating, he was taken to <str<strong>on</strong>g>the</str<strong>on</strong>g> medical department from where hewas transferred to a civilian hospital. The medical report issued by <str<strong>on</strong>g>the</str<strong>on</strong>g> hospital establishes that he had sufferedinjuries which required a healing time <str<strong>on</strong>g>of</str<strong>on</strong>g> 29 days. The pris<strong>on</strong> governor imposed 10 days solitary c<strong>on</strong>finement<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> inmate as a disciplinary sancti<strong>on</strong> (for <str<strong>on</strong>g>the</str<strong>on</strong>g> incident that served as <str<strong>on</strong>g>the</str<strong>on</strong>g> antecedent <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> beating) and at <str<strong>on</strong>g>the</str<strong>on</strong>g>same time reported <str<strong>on</strong>g>the</str<strong>on</strong>g> case to <str<strong>on</strong>g>the</str<strong>on</strong>g> prosecuti<strong>on</strong> (which is resp<strong>on</strong>sible for investigating ill-treatment by pris<strong>on</strong><str<strong>on</strong>g>of</str<strong>on</strong>g>ficials). The investigati<strong>on</strong> is pending.Ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r case <str<strong>on</strong>g>of</str<strong>on</strong>g> ill-treatment <str<strong>on</strong>g>of</str<strong>on</strong>g> pers<strong>on</strong>s bel<strong>on</strong>ging to <str<strong>on</strong>g>the</str<strong>on</strong>g> Roma minority took place in <str<strong>on</strong>g>the</str<strong>on</strong>g> city <str<strong>on</strong>g>of</str<strong>on</strong>g> Tiszaújváros.In June 2009, a brawl broke out between two Romani families in a town called Köröm. The police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers whoarrived started beating up <str<strong>on</strong>g>the</str<strong>on</strong>g> family members, used tear gas extensively and also entered apartments in <str<strong>on</strong>g>the</str<strong>on</strong>g>neighbourhood without a search warrant (homes <str<strong>on</strong>g>of</str<strong>on</strong>g> pers<strong>on</strong>s not even present at <str<strong>on</strong>g>the</str<strong>on</strong>g> brawl). Finally, <str<strong>on</strong>g>the</str<strong>on</strong>g> policetook 28 pers<strong>on</strong>s into short-term custody, am<strong>on</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g>m juveniles, a physically disabled pers<strong>on</strong> and civil guardstrying to help <str<strong>on</strong>g>the</str<strong>on</strong>g> police. In Tiszaújváros, <str<strong>on</strong>g>the</str<strong>on</strong>g> detainees were treated in a degrading and humiliating way: <str<strong>on</strong>g>the</str<strong>on</strong>g>yhad to wait for hours sitting <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> stairs <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> police headquarters, <str<strong>on</strong>g>the</str<strong>on</strong>g> police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers used str<strong>on</strong>g languagewith <str<strong>on</strong>g>the</str<strong>on</strong>g>m and shouted at <str<strong>on</strong>g>the</str<strong>on</strong>g>m, <str<strong>on</strong>g>the</str<strong>on</strong>g>y were allegedly urinated <strong>on</strong> and spat <strong>on</strong> by <str<strong>on</strong>g>the</str<strong>on</strong>g> police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers and werehumiliated when asking for permissi<strong>on</strong> to go to <str<strong>on</strong>g>the</str<strong>on</strong>g> toilet. Some <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> detainees were told that <str<strong>on</strong>g>the</str<strong>on</strong>g>y could goto <str<strong>on</strong>g>the</str<strong>on</strong>g> toilet and were escorted inside <str<strong>on</strong>g>the</str<strong>on</strong>g> police headquarters, where <str<strong>on</strong>g>the</str<strong>on</strong>g>y were beaten by <str<strong>on</strong>g>the</str<strong>on</strong>g> police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers.The aggrieved pers<strong>on</strong>s – several <str<strong>on</strong>g>of</str<strong>on</strong>g> whom have medical records <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir injuries – filed a complaint with <str<strong>on</strong>g>the</str<strong>on</strong>g>Parliamentary <str<strong>on</strong>g>Commissi<strong>on</strong>er</str<strong>on</strong>g> for <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>Rights</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Nati<strong>on</strong>al and Ethnic Minorities and reported <str<strong>on</strong>g>the</str<strong>on</strong>g> ill-treatmentto <str<strong>on</strong>g>the</str<strong>on</strong>g> prosecutor’s <str<strong>on</strong>g>of</str<strong>on</strong>g>fice. V. ARTICLE 10 – INHUMAN TREATMENT OF PERSONS DEPRIVED OFLIBERTYProblems c<strong>on</strong>cerning c<strong>on</strong>diti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> detenti<strong>on</strong> in penitentiary instituti<strong>on</strong>s in Hungary include e.g. severe overcrowding,<str<strong>on</strong>g>the</str<strong>on</strong>g> lack <str<strong>on</strong>g>of</str<strong>on</strong>g> separated toilets in cells in certain facilities, poor staffing level and detainees’ limited rightsto call <str<strong>on</strong>g>the</str<strong>on</strong>g>ir defence counsels. Situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> detainees held in special regime units for pris<strong>on</strong>ers serving lengthysentences (HSR unit) and <str<strong>on</strong>g>the</str<strong>on</strong>g> situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> so-called Grade 4 pris<strong>on</strong>ers is also problematic, as emphasized by<str<strong>on</strong>g>the</str<strong>on</strong>g> European Council <str<strong>on</strong>g>of</str<strong>on</strong>g> for <str<strong>on</strong>g>the</str<strong>on</strong>g> Preventi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Torture and Inhuman or Degrading Treatment or Punishmentin its reports <strong>on</strong> its visits to Hungary in 2003, 2005 and 2007. 30Roma make up a disproporti<strong>on</strong>ate number <str<strong>on</strong>g>of</str<strong>on</strong>g> people in detenti<strong>on</strong> in Hungary: research from 2003 found <str<strong>on</strong>g>the</str<strong>on</strong>g>percentage <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma in certain pre-trial detenti<strong>on</strong> facilities to be 24% and research from 2000-1 found that32.8% <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>victed pers<strong>on</strong>s resp<strong>on</strong>ding to a survey were Roma. 31VI. ARTICLE 14 – EQUALITY BEFORE THE COURTS AND THE RIGHT TOA FAIR AND PUBLIC HEARINGAs far as <str<strong>on</strong>g>the</str<strong>on</strong>g> treatment <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma by criminal courts is c<strong>on</strong>cerned, no recent data is available due to <str<strong>on</strong>g>the</str<strong>on</strong>g> failure <str<strong>on</strong>g>of</str<strong>on</strong>g><str<strong>on</strong>g>the</str<strong>on</strong>g> government to collect criminal justice data disaggregated by ethnicity. In 2001, <str<strong>on</strong>g>the</str<strong>on</strong>g> HHC analysed 1100 casefiles, and found unequal treatment <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma suspects. Adult Roma in this study were 15% more likely than n<strong>on</strong>-Roma to be impris<strong>on</strong>ed with regard to <str<strong>on</strong>g>the</str<strong>on</strong>g> criminal <str<strong>on</strong>g>of</str<strong>on</strong>g>fences examined (<str<strong>on</strong>g>the</str<strong>on</strong>g>ft and robbery). Moreover, receivinga fine instead <str<strong>on</strong>g>of</str<strong>on</strong>g> being impris<strong>on</strong>ed is 9% less likely in <str<strong>on</strong>g>the</str<strong>on</strong>g> case <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma. HHC suspects that comprehensive datamay show a worse picture, because many courts in areas with large Roma populati<strong>on</strong>s refused to provide data to<str<strong>on</strong>g>the</str<strong>on</strong>g> researchers. O<str<strong>on</strong>g>the</str<strong>on</strong>g>r research has shown that representatives <str<strong>on</strong>g>of</str<strong>on</strong>g> authorities in <str<strong>on</strong>g>the</str<strong>on</strong>g> areas where <str<strong>on</strong>g>the</str<strong>on</strong>g> proporti<strong>on</strong><str<strong>on</strong>g>of</str<strong>on</strong>g> Roma is higher are more biased against Roma. 32Individual cases dem<strong>on</strong>strate severe miscarriages <str<strong>on</strong>g>of</str<strong>on</strong>g> justice against Romani defendants. Examples include<str<strong>on</strong>g>the</str<strong>on</strong>g> following.On 4 March 1999, a man was robbed and murdered in <str<strong>on</strong>g>the</str<strong>on</strong>g> village <str<strong>on</strong>g>of</str<strong>on</strong>g> Újszentmargita, Hungary. Before <str<strong>on</strong>g>the</str<strong>on</strong>g> incident<str<strong>on</strong>g>the</str<strong>on</strong>g> victim had a few drinks in a bar toge<str<strong>on</strong>g>the</str<strong>on</strong>g>r with Ferenc Burka Jr. and his fa<str<strong>on</strong>g>the</str<strong>on</strong>g>r, Ferenc Burka, both Roma. Thenext day <str<strong>on</strong>g>the</str<strong>on</strong>g>y were arrested and an investigati<strong>on</strong> started against <str<strong>on</strong>g>the</str<strong>on</strong>g>m. Two witness testim<strong>on</strong>ies were c<strong>on</strong>sideredenough evidence for an indictment decisi<strong>on</strong>: <strong>on</strong>e from <str<strong>on</strong>g>the</str<strong>on</strong>g> bartender and ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r from a villager who saw <str<strong>on</strong>g>the</str<strong>on</strong>g>two Romani men walking in <str<strong>on</strong>g>the</str<strong>on</strong>g> directi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> victim’s house. The prosecutor’s investigati<strong>on</strong> was based <strong>on</strong>ly <strong>on</strong>circumstantial evidence. On 11 April 2000, <str<strong>on</strong>g>the</str<strong>on</strong>g> prosecutor pressed charges against <str<strong>on</strong>g>the</str<strong>on</strong>g>m and <str<strong>on</strong>g>the</str<strong>on</strong>g>y were sentencedto 15 and 13 years <str<strong>on</strong>g>of</str<strong>on</strong>g> impris<strong>on</strong>ment. They were kept in pre-trial detenti<strong>on</strong> for 6 years. After a l<strong>on</strong>g procedure, <str<strong>on</strong>g>the</str<strong>on</strong>g>Szeged Appellate Court ordered a retrial and <strong>on</strong> 20 July 2005, <str<strong>on</strong>g>the</str<strong>on</strong>g> court found <str<strong>on</strong>g>the</str<strong>on</strong>g>m not guilty and ordered <str<strong>on</strong>g>the</str<strong>on</strong>g>mreleased. The decisi<strong>on</strong> was upheld <strong>on</strong> appeal at <str<strong>on</strong>g>the</str<strong>on</strong>g> Debrecen Appellate Court <strong>on</strong> 25 April 2006. It turned out thatevidence suggesting that ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r pers<strong>on</strong> committed <str<strong>on</strong>g>the</str<strong>on</strong>g> murder was neglected by <str<strong>on</strong>g>the</str<strong>on</strong>g> authorities.Ernő Setét is a musician <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma origin. He was charged with beating three homeless pers<strong>on</strong>s toge<str<strong>on</strong>g>the</str<strong>on</strong>g>r withano<str<strong>on</strong>g>the</str<strong>on</strong>g>r perpetrator, and <str<strong>on</strong>g>the</str<strong>on</strong>g>n tearing <str<strong>on</strong>g>of</str<strong>on</strong>g>f <str<strong>on</strong>g>the</str<strong>on</strong>g> golden chain <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> victims. Setét became a suspect afterhe was arrested <strong>on</strong> 17 September by a police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer who thought Setét had matched <str<strong>on</strong>g>the</str<strong>on</strong>g> arrest warrant’sdescripti<strong>on</strong> based <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> statement <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> victims. The victims recognised Setét, who had a very firm alibi: heevening before, he gave a c<strong>on</strong>cert in Demecser (260 kilometres from Budapest) that ended late at night. Hewished to verify this alibi with witnesses present at <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>cert, <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong>s who travelled back to Budapest inhis car, <str<strong>on</strong>g>the</str<strong>on</strong>g> employee <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> gas stati<strong>on</strong> where he stopped to buy fuel, <str<strong>on</strong>g>the</str<strong>on</strong>g> cell informati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> his mobile ph<strong>on</strong>e,30 See: http://www.cpt.coe.int/EN/states/hun.htm.31 András Kádár: Presumpti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Guilt. The court <str<strong>on</strong>g>of</str<strong>on</strong>g> sec<strong>on</strong>d instance quashed <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong> and ordered a repeated trial.In <str<strong>on</strong>g>the</str<strong>on</strong>g> repeated procedure Setét was acquitted. Altoge<str<strong>on</strong>g>the</str<strong>on</strong>g>r he spent 16 m<strong>on</strong>ths in pre-trial detenti<strong>on</strong>.Two Roma bro<str<strong>on</strong>g>the</str<strong>on</strong>g>rs, Miklós and Zoltán Gán spent 15 m<strong>on</strong>ths in pre-trial detenti<strong>on</strong>, after <str<strong>on</strong>g>the</str<strong>on</strong>g>y became suspects<str<strong>on</strong>g>of</str<strong>on</strong>g> a murder. The Cs<strong>on</strong>grád County Court finally acquitted <str<strong>on</strong>g>the</str<strong>on</strong>g> bro<str<strong>on</strong>g>the</str<strong>on</strong>g>rs from <str<strong>on</strong>g>the</str<strong>on</strong>g> charges <strong>on</strong> 19 April 2003, andterminated <str<strong>on</strong>g>the</str<strong>on</strong>g>ir pre-trial detenti<strong>on</strong>. The bro<str<strong>on</strong>g>the</str<strong>on</strong>g>rs claimed damages 2 milli<strong>on</strong> HUF from <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarian statebecause <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir detenti<strong>on</strong>. When ruling <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> sum <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> damages, <str<strong>on</strong>g>the</str<strong>on</strong>g> first instance court stated that <str<strong>on</strong>g>the</str<strong>on</strong>g>bro<str<strong>on</strong>g>the</str<strong>on</strong>g>rs did not suffer moral damages severe enough to entitle <str<strong>on</strong>g>the</str<strong>on</strong>g>m to <str<strong>on</strong>g>the</str<strong>on</strong>g> amount claimed, since <str<strong>on</strong>g>the</str<strong>on</strong>g>ir pers<strong>on</strong>alityis “more primitive than <str<strong>on</strong>g>the</str<strong>on</strong>g> average”, and granted <str<strong>on</strong>g>the</str<strong>on</strong>g>m a sum <str<strong>on</strong>g>of</str<strong>on</strong>g> 1.2 milli<strong>on</strong> HUF. Finally, <str<strong>on</strong>g>the</str<strong>on</strong>g> Cs<strong>on</strong>grádCounty Court, acting as a sec<strong>on</strong>d instance court in <str<strong>on</strong>g>the</str<strong>on</strong>g> case, deleted <str<strong>on</strong>g>the</str<strong>on</strong>g> reference to <str<strong>on</strong>g>the</str<strong>on</strong>g> “primitive pers<strong>on</strong>ality”<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Gán bro<str<strong>on</strong>g>the</str<strong>on</strong>g>rs from <str<strong>on</strong>g>the</str<strong>on</strong>g> reas<strong>on</strong>ing <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> final decisi<strong>on</strong>. However, it did not alter <str<strong>on</strong>g>the</str<strong>on</strong>g> sum <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> damages.VII. ARTICLE 20 – ADVOCACY OF NATIONAL AND RACIAL HATREDArticle 20 (2) <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Covenant stipulates that, “Any advocacy <str<strong>on</strong>g>of</str<strong>on</strong>g> nati<strong>on</strong>al, racial or religious hatred that c<strong>on</strong>stitutesincitement to discriminati<strong>on</strong>, hostility or violence shall be prohibited by law.”Incitement to hatred is regulated under Article 269 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarian Penal Code; however <str<strong>on</strong>g>the</str<strong>on</strong>g> restrictive interpretati<strong>on</strong>applied by <str<strong>on</strong>g>the</str<strong>on</strong>g> courts creates an obstacle for its effective implementati<strong>on</strong>. In its decisi<strong>on</strong> No. 18/2004<str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>stituti<strong>on</strong>al Court stated that <str<strong>on</strong>g>the</str<strong>on</strong>g> legislator could limit freedom <str<strong>on</strong>g>of</str<strong>on</strong>g> speech through criminal sancti<strong>on</strong>s<strong>on</strong>ly in cases <str<strong>on</strong>g>of</str<strong>on</strong>g> most dangerous c<strong>on</strong>duct, if <str<strong>on</strong>g>the</str<strong>on</strong>g> behaviour is capable <str<strong>on</strong>g>of</str<strong>on</strong>g> whipping up such intense emoti<strong>on</strong>sin <str<strong>on</strong>g>the</str<strong>on</strong>g> majority <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> people that, up<strong>on</strong> giving rise to hatred, <str<strong>on</strong>g>the</str<strong>on</strong>g>y could result in <str<strong>on</strong>g>the</str<strong>on</strong>g> disturbance <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> publicpeace. The Court stressed that an abstract threat is insufficient to meet this threshold: <str<strong>on</strong>g>the</str<strong>on</strong>g> danger to <str<strong>on</strong>g>the</str<strong>on</strong>g> publicpeace must be “clear and present”. This means that <str<strong>on</strong>g>the</str<strong>on</strong>g> regulati<strong>on</strong> is applicable <strong>on</strong>ly for <str<strong>on</strong>g>the</str<strong>on</strong>g> most extreme forms<str<strong>on</strong>g>of</str<strong>on</strong>g> hate speech i.e. when <str<strong>on</strong>g>the</str<strong>on</strong>g> incitement liable to provoke immediate violent acts. 33 Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r attempts to amend<str<strong>on</strong>g>the</str<strong>on</strong>g> criminal and civil law have failed and were declared unc<strong>on</strong>stituti<strong>on</strong>al by <str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>stituti<strong>on</strong>al Court. The latestregulati<strong>on</strong> adopted by <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al Assembly in 2008 is still under review by <str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>stituti<strong>on</strong>al Court.While experts can differ as to whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarian law meets <str<strong>on</strong>g>the</str<strong>on</strong>g> requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Covenant, in practicefailure by <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarian authorities to take acti<strong>on</strong> against <str<strong>on</strong>g>the</str<strong>on</strong>g> disseminati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> racism and incitement to racialhatred c<strong>on</strong>stitutes a violati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> article 20. The ERRC has registered many instances <str<strong>on</strong>g>of</str<strong>on</strong>g> anti-Roma statementsby public authorities or politicians as well as statements <str<strong>on</strong>g>of</str<strong>on</strong>g> a discriminatory nature advocating hatred towardsRoma, with no significant Government resp<strong>on</strong>se. The reluctance <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarian authorities to take acti<strong>on</strong>against racist statements c<strong>on</strong>tributes to <str<strong>on</strong>g>the</str<strong>on</strong>g> streng<str<strong>on</strong>g>the</str<strong>on</strong>g>ning <str<strong>on</strong>g>of</str<strong>on</strong>g> a public culture in which racist statements and<str<strong>on</strong>g>the</str<strong>on</strong>g>refore violati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> fundamental rights and dignity <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma is tolerated.The ERRC compiled <str<strong>on</strong>g>the</str<strong>on</strong>g> following n<strong>on</strong>-exhaustive list <str<strong>on</strong>g>of</str<strong>on</strong>g> anti-Roma statements by public <str<strong>on</strong>g>of</str<strong>on</strong>g>ficials and politicians:QQQQIn January 2009, <str<strong>on</strong>g>the</str<strong>on</strong>g> Police Chief in <str<strong>on</strong>g>the</str<strong>on</strong>g> city <str<strong>on</strong>g>of</str<strong>on</strong>g> Miskolc, <strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> Hungary’s poorest regi<strong>on</strong>s, claimed thatRoma were resp<strong>on</strong>sible for all street robberies without <str<strong>on</strong>g>of</str<strong>on</strong>g>fering any evidence to support this claim. ThePolice Chief was removed from <str<strong>on</strong>g>of</str<strong>on</strong>g>fice, but after a day-l<strong>on</strong>g investigati<strong>on</strong> and significant public pressurein support <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Police Chief, <str<strong>on</strong>g>the</str<strong>on</strong>g> Minister <str<strong>on</strong>g>of</str<strong>on</strong>g> Justice and Law Enforcement accepted <str<strong>on</strong>g>the</str<strong>on</strong>g> moti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>Chief Police to reinstate him. No o<str<strong>on</strong>g>the</str<strong>on</strong>g>r disciplinary acti<strong>on</strong> was taken.Similarly, in April 2009, Dr Máté Szabó, Parliamentary <str<strong>on</strong>g>Commissi<strong>on</strong>er</str<strong>on</strong>g> for Civil <strong>Rights</strong>, stated in an interviewwith <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>on</strong>line news portal FigyelőNet that “criminality categorised <strong>on</strong> an ethnic basis” – “Gypsycrime” – exists, identifying it as a type <str<strong>on</strong>g>of</str<strong>on</strong>g> crime performed to earn a living. He also referred to Roma asbeing “a collectivist, almost tribal level social group,” comparing <str<strong>on</strong>g>the</str<strong>on</strong>g>m unfavourably to <str<strong>on</strong>g>the</str<strong>on</strong>g> individualistHungarian society. Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>rmore, Dr Szabó stated that <str<strong>on</strong>g>the</str<strong>on</strong>g> attenti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> majority society should bedrawn to <str<strong>on</strong>g>the</str<strong>on</strong>g> existence <str<strong>on</strong>g>of</str<strong>on</strong>g> this specific criminal pr<str<strong>on</strong>g>of</str<strong>on</strong>g>ile. The Parliamentary <str<strong>on</strong>g>Commissi<strong>on</strong>er</str<strong>on</strong>g> did not withdraw his statements and<str<strong>on</strong>g>the</str<strong>on</strong>g> Parliament took no acti<strong>on</strong> against him. 34In February 2009, <str<strong>on</strong>g>the</str<strong>on</strong>g> leader <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> main oppositi<strong>on</strong> party (Fidesz) Viktor Orban stated publicly that itis clear that <str<strong>on</strong>g>the</str<strong>on</strong>g> ratio <str<strong>on</strong>g>of</str<strong>on</strong>g> perpetrators <str<strong>on</strong>g>of</str<strong>on</strong>g> serious crimes <str<strong>on</strong>g>of</str<strong>on</strong>g> Gypsy origin is increasing day by day, c<strong>on</strong>siderablyand tangibly. Those that keep that fact silent […] will but aggravate <str<strong>on</strong>g>the</str<strong>on</strong>g> problem,” said Orban. 35When resp<strong>on</strong>ding to <str<strong>on</strong>g>the</str<strong>on</strong>g> reports that 40-50 Roma families are going to settle in his municipality, <str<strong>on</strong>g>the</str<strong>on</strong>g>Mayor <str<strong>on</strong>g>of</str<strong>on</strong>g> Kiskunlachaza József Répás stated, “Rumours about <str<strong>on</strong>g>the</str<strong>on</strong>g> local government’s intenti<strong>on</strong> to have40-50 Roma families settle in Kiskunlachaza are false. As Mayor [I] hereby emphasise that nei<str<strong>on</strong>g>the</str<strong>on</strong>g>r Romanor any o<str<strong>on</strong>g>the</str<strong>on</strong>g>r ethnic minority families are to settle in Kiskunlachaza, nor are <str<strong>on</strong>g>the</str<strong>on</strong>g>y encouraged or supportedto do so. Any<strong>on</strong>e stating o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise, lies!” 36 Again no acti<strong>on</strong> was taken at a political or legal level tochallenge <str<strong>on</strong>g>the</str<strong>on</strong>g>se racist remarks by a public <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial.Oszkar Molnar, <str<strong>on</strong>g>the</str<strong>on</strong>g> Mayor <str<strong>on</strong>g>of</str<strong>on</strong>g> Edeleny claimed at a local council meeting that Roma women living in tw<strong>on</strong>earby villages had deliberately harmed <str<strong>on</strong>g>the</str<strong>on</strong>g>ir unborn children in order to receive higher state benefits.Approximately 400 Roma women filed a defamati<strong>on</strong> suit against <str<strong>on</strong>g>the</str<strong>on</strong>g> mayor and demanded his resignati<strong>on</strong>and departure from politics. 37 There was no <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial reacti<strong>on</strong> to this racist statement.The submitting organisati<strong>on</strong>s are c<strong>on</strong>cerned about <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>on</strong>-going illegal operati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> extreme right wingparamilitary group, <str<strong>on</strong>g>the</str<strong>on</strong>g> Magyar Gárda (Hungarian Guard). The group was established in 2007 with its statedpurpose <str<strong>on</strong>g>of</str<strong>on</strong>g> protecting Hungarian culture and <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarian nati<strong>on</strong>. It is infamous for its explicit anti-Romaniactivities and propaganda. The Magyar Gárda was dissolved and its activities barred by <str<strong>on</strong>g>the</str<strong>on</strong>g> final and enforceablejudgement <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Supreme Court in December 2009. Despite this, <str<strong>on</strong>g>the</str<strong>on</strong>g> Magyar Garda c<strong>on</strong>tinues to operateopenly in Hungary. Hungarian law enforcement authorities have not yet undertaken sufficient efforts t<str<strong>on</strong>g>of</str<strong>on</strong>g>ully enforce <str<strong>on</strong>g>the</str<strong>on</strong>g> judgment. In many instances law enforcement authorities have failed to intervene and initiatecriminal procedure against individuals wearing <str<strong>on</strong>g>the</str<strong>on</strong>g> uniform <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> group and explicitly declaring <str<strong>on</strong>g>the</str<strong>on</strong>g>mselves tobe members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> dissolved Magyar Gárda.VIII. ARTICLE 24 – RIGHTS OF THE CHILD 38Article 24/1 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Covenant underlines that “[e]very child shall have, without any discriminati<strong>on</strong> […] <str<strong>on</strong>g>the</str<strong>on</strong>g> rightto such measures <str<strong>on</strong>g>of</str<strong>on</strong>g> protecti<strong>on</strong> as are required by his status as a minor, <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> part <str<strong>on</strong>g>of</str<strong>on</strong>g> his family, society and <str<strong>on</strong>g>the</str<strong>on</strong>g>State.” General Comment No. 17 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Committee noted that “<str<strong>on</strong>g>the</str<strong>on</strong>g> implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this provisi<strong>on</strong> entails<str<strong>on</strong>g>the</str<strong>on</strong>g> adopti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> special measures to protect children, in additi<strong>on</strong> to <str<strong>on</strong>g>the</str<strong>on</strong>g> measures that States are required to takeunder article 2 to ensure that every<strong>on</strong>e enjoys <str<strong>on</strong>g>the</str<strong>on</strong>g> rights provided for in <str<strong>on</strong>g>the</str<strong>on</strong>g> Covenant”. 39It is widely held to be true that <str<strong>on</strong>g>the</str<strong>on</strong>g> situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Romani children compared to n<strong>on</strong>-Romani children is especiallyvulnerable vis-à-vis <str<strong>on</strong>g>the</str<strong>on</strong>g> child protecti<strong>on</strong> system <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> country in which <str<strong>on</strong>g>the</str<strong>on</strong>g>y live. In 2007 <str<strong>on</strong>g>the</str<strong>on</strong>g> ERRC c<strong>on</strong>ducted an in-depth study <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Romani children in children’s homes, inadopti<strong>on</strong> and in instituti<strong>on</strong>s for <str<strong>on</strong>g>the</str<strong>on</strong>g> mentally disabled in Hungary. The results <str<strong>on</strong>g>of</str<strong>on</strong>g> this study indicate that <str<strong>on</strong>g>the</str<strong>on</strong>g>Romani children are overwhelmingly overrepresented in <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarian child protecti<strong>on</strong> system. Am<strong>on</strong>gst <str<strong>on</strong>g>the</str<strong>on</strong>g>sample <str<strong>on</strong>g>of</str<strong>on</strong>g> children in pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al care instituti<strong>on</strong>s interviewed by <str<strong>on</strong>g>the</str<strong>on</strong>g> ERRC, 40% were <str<strong>on</strong>g>of</str<strong>on</strong>g> Romani origin andan additi<strong>on</strong>al 18% were half-Romani; 58% in total. Although <str<strong>on</strong>g>the</str<strong>on</strong>g> Hungarian Child Protecti<strong>on</strong> Act bans <str<strong>on</strong>g>the</str<strong>on</strong>g> removal <str<strong>on</strong>g>of</str<strong>on</strong>g> children from <str<strong>on</strong>g>the</str<strong>on</strong>g>ir familiesfor purely material reas<strong>on</strong>s, Romani children appear to be removed more frequently from <str<strong>on</strong>g>the</str<strong>on</strong>g>ir families for materialreas<strong>on</strong>s than n<strong>on</strong>-Romani children. Preventative social care and community development programmes in Hungaryare extremely underdeveloped. Also <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>cern is that according to ERRC research, <str<strong>on</strong>g>the</str<strong>on</strong>g> temporary or short-termcare <str<strong>on</strong>g>of</str<strong>on</strong>g> children un<str<strong>on</strong>g>of</str<strong>on</strong>g>ficially becomes l<strong>on</strong>g-term care in almost all cases, meaning that a disproporti<strong>on</strong>ate number<str<strong>on</strong>g>of</str<strong>on</strong>g> Romani children in state care are relegated to life in an instituti<strong>on</strong>al setting. Because <str<strong>on</strong>g>the</str<strong>on</strong>g> legal framework <strong>on</strong> childprotecti<strong>on</strong> allows children to be placed in temporary and short-term care <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> basis <str<strong>on</strong>g>of</str<strong>on</strong>g> an administrative decisi<strong>on</strong>,many Romani children and parents are de facto l<strong>on</strong>g-term separated without any court involvement (which is requiredfor <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial l<strong>on</strong>g-term placement <str<strong>on</strong>g>of</str<strong>on</strong>g> children in pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al care in Hungary).The over-representati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Romani children in instituti<strong>on</strong>alised care is a c<strong>on</strong>siderable problem because childrengrowing up in an instituti<strong>on</strong>al setting will be without any substantial support network as adults. Alarmingly,workers in <str<strong>on</strong>g>the</str<strong>on</strong>g> children’s homes informed ERRC researchers that <str<strong>on</strong>g>the</str<strong>on</strong>g>re are indicati<strong>on</strong>s that many children growingup in homes will <str<strong>on</strong>g>the</str<strong>on</strong>g>mselves end up having <str<strong>on</strong>g>the</str<strong>on</strong>g>ir children removed due to <str<strong>on</strong>g>the</str<strong>on</strong>g>ir socio-ec<strong>on</strong>omic situati<strong>on</strong> asadults, creating a nasty cycle from which it is very difficult to emerge.IX. RECOMMENDATIONSThe Government <str<strong>on</strong>g>of</str<strong>on</strong>g> Hungary should:QQQQQQQQQQQQQQQQUndertake measures to ensure effective implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> existing anti-discriminati<strong>on</strong> law;C<strong>on</strong>duct systematic m<strong>on</strong>itoring <str<strong>on</strong>g>of</str<strong>on</strong>g> access <str<strong>on</strong>g>of</str<strong>on</strong>g> Roma to educati<strong>on</strong>, housing, employment, health care and socialservices and establish a mechanism for collecting and publishing data disaggregated by ethnicity in <str<strong>on</strong>g>the</str<strong>on</strong>g>se fields;In order to achieve systematic and effective implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> school desegregati<strong>on</strong> programmes, <str<strong>on</strong>g>the</str<strong>on</strong>g>government should ensure <str<strong>on</strong>g>the</str<strong>on</strong>g> enactment in nati<strong>on</strong>al legislati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> an enforceable statutory duty to desegregateeducati<strong>on</strong> requiring public authorities to take acti<strong>on</strong> to eliminate segregated educati<strong>on</strong> within afixed period <str<strong>on</strong>g>of</str<strong>on</strong>g> time;Recognise multiple discriminati<strong>on</strong> in current and future policies and take c<strong>on</strong>crete and effective steps toprevent and counter <str<strong>on</strong>g>the</str<strong>on</strong>g> effects <str<strong>on</strong>g>of</str<strong>on</strong>g> multiple discriminati<strong>on</strong> faced by Romani women;Ensure that all existing laws and policies – as well as future laws and policies – adequately account for genderequality and include provisi<strong>on</strong>s for preventing and addressing <str<strong>on</strong>g>the</str<strong>on</strong>g> multiple barriers female members<str<strong>on</strong>g>of</str<strong>on</strong>g> minority groups face in exercising <str<strong>on</strong>g>the</str<strong>on</strong>g>ir fundamental human rights.C<strong>on</strong>sistently, clearly and str<strong>on</strong>gly state that attacks against Roma and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r minorities are not acceptablein Hungary, each time an incident occurs;Investigate promptly and impartially incidents <str<strong>on</strong>g>of</str<strong>on</strong>g> violence against Roma and prosecute perpetrators <str<strong>on</strong>g>of</str<strong>on</strong>g>such crimes to <str<strong>on</strong>g>the</str<strong>on</strong>g> fullest extent <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> law, whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r <str<strong>on</strong>g>the</str<strong>on</strong>g>y are committed by law enforcement <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers orby private parties; make public guidelines to law-enforcement and judicial authorities <strong>on</strong> identifying andinvestigating racially-motivated crime; publish detailed statistics in a format readily available and understandableto a lay pers<strong>on</strong> – at minimum yearly – <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> ethnic identity <str<strong>on</strong>g>of</str<strong>on</strong>g> victims <str<strong>on</strong>g>of</str<strong>on</strong>g> crime and <str<strong>on</strong>g>the</str<strong>on</strong>g> number<str<strong>on</strong>g>of</str<strong>on</strong>g> racially-motivated crimes occurring and prosecuted;Adopt and implement a zero-tolerance policy for expressi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> racial animosity in <str<strong>on</strong>g>the</str<strong>on</strong>g> police force oro<str<strong>on</strong>g>the</str<strong>on</strong>g>r branches <str<strong>on</strong>g>of</str<strong>on</strong>g> law enforcement and public administrati<strong>on</strong>, with swift and public punishment, includingdismissal, <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>fenders;15
