<str<strong>on</strong>g>Minutes</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>Pre</str<strong>on</strong>g>-<str<strong>on</strong>g>Bid</str<strong>on</strong>g> <str<strong>on</strong>g>meeting</str<strong>on</strong>g> <str<strong>on</strong>g>held</str<strong>on</strong>g> <strong>on</strong> 03.09.2012 in respect <str<strong>on</strong>g>of</str<strong>on</strong>g> the Global tender <str<strong>on</strong>g>of</str<strong>on</strong>g> “Designing,<br />

c<strong>on</strong>structi<strong>on</strong>, furnishing & equipping <str<strong>on</strong>g>of</str<strong>on</strong>g> a Vertical Shaft <strong>on</strong> Turnkey Basis at Balaghat<br />

Mine <str<strong>on</strong>g>of</str<strong>on</strong>g> MOIL <strong>Limited</strong>”.<br />

Based <strong>on</strong> the deliberati<strong>on</strong> and discussi<strong>on</strong>s, the following changes / modificati<strong>on</strong>s are being<br />

incorporated in the existing Tender document:<br />

1. Clause No. iv <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter I, and clause No. 2.1-iv Chapter II, should be read as “ Must have<br />

achieved a c<strong>on</strong>sistent yearly turnover <str<strong>on</strong>g>of</str<strong>on</strong>g> minimum Rupees seventy five crore or equivalent<br />

to foreign currency as <strong>on</strong> the last date <str<strong>on</strong>g>of</str<strong>on</strong>g> submissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> tender, in the last three years.”<br />

2. Clause no. 3.11 <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter II & Clause no. 2.25.7 <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter III should be read as “The prices<br />

and/ or rates quoted in INR shall be inclusive <str<strong>on</strong>g>of</str<strong>on</strong>g> all existing taxes, duties like Excise Duty, Sales<br />

Tax, Value added tax, additi<strong>on</strong>al tax, entry tax, Service tax, Educati<strong>on</strong>al Cess, WCT, fees, levies,<br />

etc. as levied in c<strong>on</strong>necti<strong>on</strong> with the C<strong>on</strong>tract work and shall be borne and paid by the<br />

C<strong>on</strong>tractor. All the taxes shall be indicated separately in the Price <str<strong>on</strong>g>Bid</str<strong>on</strong>g> with the taxati<strong>on</strong> rate<br />

c<strong>on</strong>sidered for bid purpose. Any statutory variati<strong>on</strong>s in the above or impositi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> new taxes,<br />

duties or aboliti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> any tax during executi<strong>on</strong> within c<strong>on</strong>tract period shall be reimbursed /<br />

adjusted at actual, against documentary evidence. However, such reimbursement shall not apply<br />

<strong>on</strong> any intermediate comp<strong>on</strong>ents/items including new materials. For calculating the variati<strong>on</strong>s<br />

in taxes, <strong>on</strong>ly variati<strong>on</strong> in rate <str<strong>on</strong>g>of</str<strong>on</strong>g> taxes shall be c<strong>on</strong>sidered taking the base date as last date<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> submissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> tender. The base rate and variati<strong>on</strong> in rate <str<strong>on</strong>g>of</str<strong>on</strong>g> taxes will be decided by the<br />

Company. If the taxati<strong>on</strong> rate indicated in the price bid by the successful tenderer is at<br />

variance with the base rate <str<strong>on</strong>g>of</str<strong>on</strong>g> taxes decided by the company, the taxati<strong>on</strong> rate indicated in<br />

the price bid shall not be c<strong>on</strong>sidered for calculating variati<strong>on</strong>s in taxes.”<br />

3. Clause no. 6.0 (c) <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter II should be read as “To facilitate financial evaluati<strong>on</strong> and<br />

comparis<strong>on</strong>, the Employer will c<strong>on</strong>vert all comp<strong>on</strong>ents <str<strong>on</strong>g>of</str<strong>on</strong>g> currencies quoted in the ‘Billing<br />

schedule’ submitted with the Price bid to Indian currency (INR) at the bill selling rate declared<br />

by the State Bank <str<strong>on</strong>g>of</str<strong>on</strong>g> India <strong>on</strong> the last date <str<strong>on</strong>g>of</str<strong>on</strong>g> submissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> tender. For imported P&M quoted<br />

in EURO or USD, the equivalent price <str<strong>on</strong>g>of</str<strong>on</strong>g> FOR destinati<strong>on</strong>, by c<strong>on</strong>verting the FOB price<br />

into INR at the applicable exchange rate and by multiplying it by appopriate factor, will be<br />

used. The appopriate factor for equipment imported from USA, Canada & Japan is 1.4305<br />

and imported from European & other countries is 1.4058. Year-wise break up <str<strong>on</strong>g>of</str<strong>on</strong>g> quoted price


(c<strong>on</strong>verted in to INR) will be discounted at 12% discount rate to arrive present value <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

Tender price. Lowest Tender price so arrived will be the L1.<br />

4. Clause no. 7.0 <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter II should be read as “The successful tenderer whose tender<br />

......................................... from the date <str<strong>on</strong>g>of</str<strong>on</strong>g> ‘Letter <str<strong>on</strong>g>of</str<strong>on</strong>g> Acceptance’. The successful tenderer will<br />

furnish the security deposit <str<strong>on</strong>g>of</str<strong>on</strong>g> requisite amount to the Employer within 45 days from the date <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

‘Letter <str<strong>on</strong>g>of</str<strong>on</strong>g> Acceptance’. In the event <str<strong>on</strong>g>of</str<strong>on</strong>g> his failure …………………………… and release their<br />

earnest m<strong>on</strong>ey.”<br />

5. Clause no. 2.1 <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter III should be read as<br />

SECURITY DEPOSIT<br />

“The successful tenderer shall submit the security deposit <str<strong>on</strong>g>of</str<strong>on</strong>g> 5 % <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>tract Value within<br />

45 days from the date <str<strong>on</strong>g>of</str<strong>on</strong>g> ‘Letter <str<strong>on</strong>g>of</str<strong>on</strong>g> acceptance’ issued by the company for accepting the tender<br />

failing which .................... ........................... ..................... ........................... ................. by the<br />

C<strong>on</strong>tractor, other than Force Majeure reas<strong>on</strong>s.”<br />

6. Clause No. 2.22 <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter III:<br />

ARBITRATION:<br />

This clause may be read as “DISPUTE RESOLUTION & ARBITRATION" and following<br />

may be added in this clause. “A Dispute Resoluti<strong>on</strong> Committee will be c<strong>on</strong>stituted headed<br />

by G.M. (Mines) for resoluti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> any dispute arising out <str<strong>on</strong>g>of</str<strong>on</strong>g> difference <str<strong>on</strong>g>of</str<strong>on</strong>g> opini<strong>on</strong> between<br />

the Engineer In-charge and the c<strong>on</strong>tractor. The decisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> dispute Resoluti<strong>on</strong> committee<br />

should not be at variance with the express provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this c<strong>on</strong>tract. In case an amicable<br />

soluti<strong>on</strong> could not be reached through Dispute Resoluti<strong>on</strong> committee, either <str<strong>on</strong>g>of</str<strong>on</strong>g> the party,<br />

subject to the provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the Integrity pact, can go for arbitrati<strong>on</strong> which is detailed as<br />

below”:<br />

Except where it is provided otherwise, any dispute or difference arising out <str<strong>on</strong>g>of</str<strong>on</strong>g> ...........................<br />

executed during Arbitrati<strong>on</strong> proceedings.<br />

7. Clause No. 2.25.2 (a) <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter III: should be read as<br />

For Design & Engineering:<br />

“80 % <str<strong>on</strong>g>of</str<strong>on</strong>g> the value <str<strong>on</strong>g>of</str<strong>on</strong>g> the above services shall be paid <strong>on</strong> progressive acceptance <str<strong>on</strong>g>of</str<strong>on</strong>g> design<br />

drawings and <strong>on</strong> submissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> corresp<strong>on</strong>ding pre-receipted invoices and duly certified by the<br />

Company, 10% <str<strong>on</strong>g>of</str<strong>on</strong>g> the value shall be paid after preliminary acceptance and remaining 10%<br />

shall be paid after issue <str<strong>on</strong>g>of</str<strong>on</strong>g> final acceptance certificate.”<br />

8. Clause No. 2.25.2 (c) <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter III: should be read as<br />

i) For imported deliverable P&M quoted in EURO or USD:


- Payment will be facilitated by letter <str<strong>on</strong>g>of</str<strong>on</strong>g> credit<br />

- On producti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> pro<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> dispatch al<strong>on</strong>g the bills, 80% <str<strong>on</strong>g>of</str<strong>on</strong>g> FOB price (Refer Price bid<br />

format 1.4.B) for the equipments will be released.<br />

- 10% <str<strong>on</strong>g>of</str<strong>on</strong>g> FOB price for the equipments will be released after issue <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>Pre</str<strong>on</strong>g>liminary<br />

acceptance certificate.<br />

Payment for the bills for the remaining 10% FOB price and for other expenses (Price bid format<br />

1.4.B) will be made after issue <str<strong>on</strong>g>of</str<strong>on</strong>g> Final Acceptance Certificate by the Company <strong>on</strong> the<br />

recommendati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Engineer in-charge. Subject to the provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> clause for taxes and<br />

duties, the maximum amount to be paid shall be limited to quoted agreed price.<br />

- Taxes, duties and levies as per statute will be reimbursed at actual <strong>on</strong> producti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

documentary pro<str<strong>on</strong>g>of</str<strong>on</strong>g>.<br />

For supply <str<strong>on</strong>g>of</str<strong>on</strong>g> winding engines, letter <str<strong>on</strong>g>of</str<strong>on</strong>g> credit shall be opened <strong>on</strong>ly after submissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Irrecoverable Bank guarantee <str<strong>on</strong>g>of</str<strong>on</strong>g> equivalent amount issued by a Nati<strong>on</strong>alised / Scheduled bank<br />

acceptable to MOIL, other than co-operative bank with its validity <str<strong>on</strong>g>of</str<strong>on</strong>g> 30 days bey<strong>on</strong>d the date <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

successful commissi<strong>on</strong>ing. Bank Guarantee will be extended by the C<strong>on</strong>tractor, if completi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

successful commissi<strong>on</strong>ing is delayed for any reas<strong>on</strong> whatsoever.<br />

ii) For deliverable P&M quoted in INR<br />

80% <str<strong>on</strong>g>of</str<strong>on</strong>g> the value <str<strong>on</strong>g>of</str<strong>on</strong>g> each complete equipment c<strong>on</strong>signment will be paid after delivery <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

C<strong>on</strong>signment at site subject to receipt <str<strong>on</strong>g>of</str<strong>on</strong>g> the following documents by the Company:<br />

- Irrecoverable Bank guarantee <str<strong>on</strong>g>of</str<strong>on</strong>g> equivalent amount issued by a Nati<strong>on</strong>alised / Scheduled bank<br />

acceptable to MOIL, other than co-operative bank with its validity <str<strong>on</strong>g>of</str<strong>on</strong>g> 30 days bey<strong>on</strong>d the date <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

successful commissi<strong>on</strong>ing. Bank Guarantee will be extended by the C<strong>on</strong>tractor, if completi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

successful commissi<strong>on</strong>ing is delayed for any reas<strong>on</strong> whatsoever. (Bank guarantee is to be<br />

furnished <strong>on</strong>ly for supply <str<strong>on</strong>g>of</str<strong>on</strong>g> winding engines)<br />

- C<strong>on</strong>tractor’s pre-receipted invoice.<br />

- Certificate for receipt <str<strong>on</strong>g>of</str<strong>on</strong>g> all materials (for which invoice has been made) at site in full and<br />

good c<strong>on</strong>diti<strong>on</strong>.<br />

- 2 copies <str<strong>on</strong>g>of</str<strong>on</strong>g> lorry receipt evidencing receipt <str<strong>on</strong>g>of</str<strong>on</strong>g> materials at site.<br />

- 2 copies <str<strong>on</strong>g>of</str<strong>on</strong>g> delivery challan & packing list.<br />

- Invoice in original + 1 copy.<br />

- Company’s Inspecti<strong>on</strong> Certificate (original + 1 copy)<br />

- <str<strong>on</strong>g>Pre</str<strong>on</strong>g> Despatch Clearance or its waival issued by the Employer.


- C<strong>on</strong>tractor’s certificate to the effect that c<strong>on</strong>tents in each case <str<strong>on</strong>g>of</str<strong>on</strong>g> complete equipment<br />

c<strong>on</strong>signment are not less than those entered in the invoice and the packing list and the quality <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

goods are guaranteed as new and are as per the relevant specificati<strong>on</strong>s.<br />

10% <str<strong>on</strong>g>of</str<strong>on</strong>g> the value <str<strong>on</strong>g>of</str<strong>on</strong>g> the above supply shall be paid after issue <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>Pre</str<strong>on</strong>g>liminary acceptance<br />

certificate.<br />

Balance 10% <str<strong>on</strong>g>of</str<strong>on</strong>g> the value <str<strong>on</strong>g>of</str<strong>on</strong>g> the above supply shall be paid after issue <str<strong>on</strong>g>of</str<strong>on</strong>g> Final Acceptance<br />

Certificate by the Company <strong>on</strong> the recommendati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Engineer in-charge.<br />

The Bank guarantee submitted during payment for supply <str<strong>on</strong>g>of</str<strong>on</strong>g> winding engines shall be returned<br />

30 days after issue <str<strong>on</strong>g>of</str<strong>on</strong>g> Commissi<strong>on</strong>ing Certificate by the Company.<br />

9. Clause No. 2.25.2 (g) <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter III: A New clause to be added as follows:<br />

“In lieu <str<strong>on</strong>g>of</str<strong>on</strong>g> proposed deducti<strong>on</strong>s as above the remaining payment may be released to the<br />

C<strong>on</strong>tractor <strong>on</strong> submissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> equivalent irrevocable Bank guarantee with appropriate<br />

validity at the discreti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the Company.”<br />

10. Clause No. 2.25.10 <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter III: should be read as<br />

Adjustment <str<strong>on</strong>g>of</str<strong>on</strong>g> excess/over payments:<br />

Excess/over payments as so<strong>on</strong> as they are discovered should be adjusted in the next running<br />

account bill <str<strong>on</strong>g>of</str<strong>on</strong>g> the c<strong>on</strong>tractor and in case the final bill has already been paid, the excess/over<br />

payment made shall be recovered from the Security Deposit <str<strong>on</strong>g>of</str<strong>on</strong>g> the c<strong>on</strong>tractor together with<br />

interest <str<strong>on</strong>g>of</str<strong>on</strong>g> 10% or such other percentages as Company may decide from time to time, from<br />

the date <str<strong>on</strong>g>of</str<strong>on</strong>g> such excess or over payment to the date <str<strong>on</strong>g>of</str<strong>on</strong>g> recovery. In case the amount recoverable is in<br />

excess <str<strong>on</strong>g>of</str<strong>on</strong>g> the Security Deposit, then such excess shall be recovered from any <str<strong>on</strong>g>of</str<strong>on</strong>g> the running bills<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>tractor in any <str<strong>on</strong>g>of</str<strong>on</strong>g> his other works in MOIL <strong>Limited</strong> or by serving a legal notice<br />

without further recourse to the c<strong>on</strong>tractor.<br />

11. Clause No. 1.6 (a) <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter IV: should be read as<br />

POWER SUPPLY: C<strong>on</strong>structi<strong>on</strong> power shall be made available by the Company at <strong>on</strong>e point at<br />

33KV <strong>on</strong> chargeable basis. .................................................. .............. .............. for the same shall be<br />

installed by the C<strong>on</strong>tractor. The current rate <str<strong>on</strong>g>of</str<strong>on</strong>g> Electricity for industrial feeder <str<strong>on</strong>g>of</str<strong>on</strong>g> 33 kV is<br />

Rs. 8.70 per kWH. The cost <str<strong>on</strong>g>of</str<strong>on</strong>g> the power supply shall be payable at the prevailing rate <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

electricity from time to time to the Company, every m<strong>on</strong>th and would be deducted from the<br />

running bills <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>tractor.<br />

12. Clause No. 1.6 (c) <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter IV: should be read as<br />

After completi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> sump c<strong>on</strong>structi<strong>on</strong> at different levels, the Company will supply required<br />

numbers <str<strong>on</strong>g>of</str<strong>on</strong>g> pumps free <str<strong>on</strong>g>of</str<strong>on</strong>g> cost to be installed at sumps <str<strong>on</strong>g>of</str<strong>on</strong>g> different levels. Installati<strong>on</strong> will be<br />

d<strong>on</strong>e by the c<strong>on</strong>tractor and maintenance will be d<strong>on</strong>e by the company.


13. Clause No. 1.6 (d) <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter IV: should be read as<br />

Explosives and det<strong>on</strong>ators<br />

Explosive and det<strong>on</strong>ators required for blasting will be made available by MOIL <strong>Limited</strong> <strong>on</strong><br />

chargeable basis. Explosives & det<strong>on</strong>ators (including n<strong>on</strong> electric det<strong>on</strong>ators) shall be issued <strong>on</strong><br />

day-to-day basis from the nearby dispensing magazine at the mine. Explosive van for<br />

transportati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> explosive from magazine to project site will be provided by MOIL and<br />

loading and unloading will be d<strong>on</strong>e by the c<strong>on</strong>tractor. Recovery towards cost <str<strong>on</strong>g>of</str<strong>on</strong>g> explosives and<br />

det<strong>on</strong>ators will be made from the Running bills as per the actual purchase price time to time. The<br />

blasting shall be d<strong>on</strong>e by the Company’s blasters, for which the C<strong>on</strong>tractor shall provide necessary<br />

assistance. The C<strong>on</strong>tractor will submit m<strong>on</strong>thly requirement <str<strong>on</strong>g>of</str<strong>on</strong>g> the explosives and det<strong>on</strong>ators to<br />

Engineer–in-Charge at the beginning <str<strong>on</strong>g>of</str<strong>on</strong>g> year. First such requirement will be given at the time <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

executi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>tract Agreement.<br />

Current cost price <str<strong>on</strong>g>of</str<strong>on</strong>g> different explosives for the reference is:<br />

Emulsi<strong>on</strong>/Slurry : Rs 54.93 per kg<br />

Electric delay det<strong>on</strong>ator: Rs 11.50 per number<br />

N<strong>on</strong>- Electric det<strong>on</strong>ators : Rs. 9.45/- per m.<br />

14. Clause No. 5.7.2 <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter V: Ore size should be read as<br />

Ore size + 300 mm to -500mm 10%<br />

- 300 mm to +150mm 30%<br />

- 150 mm to + 75mm 30%<br />

- 75 mm 30%<br />

15. Clause No. 2.3 <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter II: should be read as<br />

C<strong>on</strong>sortium: A c<strong>on</strong>sortium (<str<strong>on</strong>g>of</str<strong>on</strong>g> maximum four members) may also al<strong>on</strong>g with copy <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

satisfactory performance report issued by the customer, submit tenders. Either <str<strong>on</strong>g>of</str<strong>on</strong>g> the .........<br />

16. Clause No. 2.0 <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter IV: should be read as<br />

TIME SCHEDULE:<br />

The work <str<strong>on</strong>g>of</str<strong>on</strong>g> .......................................... and successful commissi<strong>on</strong>ing shall be completed<br />

within 42m<strong>on</strong>ths from the effective date <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>tract<br />

Maintenance <str<strong>on</strong>g>of</str<strong>on</strong>g> the complete .................................................. finished time for each activity.<br />

Time schedule shall be approved by the Company.<br />

START-UP & SUCCESSFUL COMMISSIONING<br />

Within 30 days from the date <str<strong>on</strong>g>of</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>Pre</str<strong>on</strong>g>liminary Acceptance Certificate, the C<strong>on</strong>tractor shall<br />

start-up and commissi<strong>on</strong>s the entire plant in an integrated manner under his sole resp<strong>on</strong>sibility<br />

and seek and obtain the statutory approvals from the c<strong>on</strong>cerned regulatory authorities like<br />

D.G.M.S. etc. Applicati<strong>on</strong> for DGMS approval will be made by the Company. The<br />

Company shall, for the purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> start-up and commissi<strong>on</strong>ing, associate his operating pers<strong>on</strong>nel<br />

20. Clause No. 1.1 (b) (vi) <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter IV: should be read as<br />

Skip loading (ore): Excavati<strong>on</strong> and c<strong>on</strong>structi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> skip loading stati<strong>on</strong>s (for ore-ROM) at 19L<br />

and 22L. The ore hoisting system is proposed to be operated in two stages. In the first stage,<br />

the ore will be hoisted from 19 th level and in 2nd stage it will be handled from 22 nd level in<br />

future. The ore hoisting arrangement should be capable <str<strong>on</strong>g>of</str<strong>on</strong>g> handling the ore in both the two<br />

stages in an efficient manner. Hoisting shall be operated from <strong>on</strong>e level at a time. Skip<br />

loading arrangement including c<strong>on</strong>structi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> receiving hopper shall be provided in both the<br />

levels. Complete automated system shall be provided for handling ore from the receiving<br />

hopper to loading the ore in to the skips. This shall include all the necessary equipments and<br />

accessories such as feeder, belt c<strong>on</strong>veyor, load cells measuring hopper, loading chutes,<br />

pneumatic / hydraulic system etc. Necessary excavati<strong>on</strong>s shall be d<strong>on</strong>e for accessing up to the<br />

skip loading points.<br />

21. Clause No. 1.1 (d) (ii) <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter IV: Sub heading should be read as “Surface Ore & waste<br />

rock handling”:<br />

22. Clause No. 1.1 (e) (i) <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter IV: should be read as


“Winder:<br />

Supply, installati<strong>on</strong>, trial run and commissi<strong>on</strong>ing <str<strong>on</strong>g>of</str<strong>on</strong>g> three (3) numbers electrical fricti<strong>on</strong> PLC<br />

c<strong>on</strong>trolled Koepe winders (with auto pilot and manual operati<strong>on</strong> mode) as per the approved<br />

specificati<strong>on</strong>s. Make <str<strong>on</strong>g>of</str<strong>on</strong>g> the winders shall be either <str<strong>on</strong>g>of</str<strong>on</strong>g> the following: i) ABB, Switzerland,<br />

ii) Siemens, Germany, iii) Siemag, Germany, iv) Davy Markham, UK, v) INCO, Czech<br />

Republic, vi) Hepburn Engg, Canada, vii) Winder c<strong>on</strong>trols (PTY) Ltd. Republic <str<strong>on</strong>g>of</str<strong>on</strong>g> South<br />

Africa, viii) NKMZ- Ukraine. The winders shall be completed in all respect such as<br />

mechanical, electrical, electr<strong>on</strong>ic equipments, switch gears, instrument panels, c<strong>on</strong>trol panels,<br />

winding ropes, etc. These winders should fully comply with the requirement <str<strong>on</strong>g>of</str<strong>on</strong>g> statutes &<br />

safety and should have all features like auto detecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> faults, c<strong>on</strong>trol system to m<strong>on</strong>itor<br />

speed and locati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> each c<strong>on</strong>veyance moving in a shaft, etc. The operators’ cabins and<br />

electrical c<strong>on</strong>trol panels’ rooms shall be air c<strong>on</strong>diti<strong>on</strong>ed.<br />

23. Clause No. 1.1 (b) (viii) Chapter IV, Clause 4.0 <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter V, Clause No. 5.12 <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter V<br />

ORE PASS:<br />

Two ore passes are to be c<strong>on</strong>structed:<br />

1. From 13 1 / 2 L to 19L with opening at 13 1 / 2 L, 15L, 16 1 / 2 L and 18L.<br />

2. From 18 L to 22L with opening at 18L, 19 1 / 2 L and 21L.<br />

Waste rock handling at surface:<br />

“ Suitable arrangements for c<strong>on</strong>veying <str<strong>on</strong>g>of</str<strong>on</strong>g> waste rock from the skip unloading chute to the stock<br />

piles at places earmarked by the Company shall be c<strong>on</strong>structed. A bunker <str<strong>on</strong>g>of</str<strong>on</strong>g> at least 100 t<strong>on</strong>s<br />

capacity with an effective discharge gate and proper supporting structure shall be c<strong>on</strong>structed<br />

at surface just below the unloading chute. The waste rock shall be directly stored in to the<br />

bunker from the unloading chute. The discharge point <str<strong>on</strong>g>of</str<strong>on</strong>g> the bunker shall be at such a height<br />

that rocks from the bunker can be directly loaded into the truck /dumper.<br />

25. Clause No. 2.31 <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter III: should be read as<br />

WARRANTY<br />

Warranty period for complete winding installati<strong>on</strong>s including shaft sinking and c<strong>on</strong>structi<strong>on</strong><br />

items, will be 12 m<strong>on</strong>ths from date <str<strong>on</strong>g>of</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> commissi<strong>on</strong>ing certificate or c<strong>on</strong>tinuous<br />

successful operati<strong>on</strong> without major break down (break down more than 24 hours), <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

complete installati<strong>on</strong>s for 6 m<strong>on</strong>ths, whichever is later.<br />

“As standard sinking procedure, no. <str<strong>on</strong>g>of</str<strong>on</strong>g> plumb lines shall be provided by the C<strong>on</strong>tractor and he<br />

shall set out these al<strong>on</strong>g the periphery <str<strong>on</strong>g>of</str<strong>on</strong>g> the shaft at required positi<strong>on</strong>s. All measurements for<br />

excavati<strong>on</strong> and c<strong>on</strong>crete lining shall be with reference to these lines. The finished shaft radius<br />

will have maximum tolerance <str<strong>on</strong>g>of</str<strong>on</strong>g> +20 mm at any place with reference to design shaft<br />

radius, the C<strong>on</strong>tractor shall maintain the shaft strictly vertical.”<br />

29. Clause No. 5.7 <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter V: should be read as<br />

The shaft is to be designed to have three hoisting arrangement. The cage–counter weight<br />

system for lowering & hoisting <str<strong>on</strong>g>of</str<strong>on</strong>g> men and materials, Twin skip system for ore hoisting and<br />

skip–counter weight system for hoisting <str<strong>on</strong>g>of</str<strong>on</strong>g> waste rock. The proposed shaft plan showing the<br />

each item is shown in the Drawing. No. CMPDI/HQ/UMD/201111. The shaft plan is<br />

tentative and it can be optimised by the bidder without reducing the cage size and<br />

capacity <str<strong>on</strong>g>of</str<strong>on</strong>g> the skips. However all such Design/drawings shall be approved by MOIL.<br />

30. Clause No. 5.16.1 (t) <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter V should be read as<br />

t) Specificati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Diesel Generator<br />

Suitable Diesel Generator set (11 KV out put) shall be supplied and installed by the C<strong>on</strong>tractor<br />

at the surface to supply power for emergency operati<strong>on</strong> (e.g. ventilati<strong>on</strong>, man winding,<br />

pumping, surface lighting, communicati<strong>on</strong>) in case <str<strong>on</strong>g>of</str<strong>on</strong>g> power failure. A suitable<br />

electrical……………………..<br />

31. Clause No. 2.26 – Escalati<strong>on</strong>, <str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter III (C<strong>on</strong>diti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>tract) should be read as<br />

Escalati<strong>on</strong> will be given during the scheduled completi<strong>on</strong> period. Escalati<strong>on</strong> shall also be<br />

c<strong>on</strong>sidered bey<strong>on</strong>d scheduled completi<strong>on</strong> period if delay is occurred due the fault <strong>on</strong> part<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the Company.<br />

However, no escalati<strong>on</strong> shall be c<strong>on</strong>sidered bey<strong>on</strong>d the scheduled completi<strong>on</strong> period if<br />

there is fault <strong>on</strong> the part <str<strong>on</strong>g>of</str<strong>on</strong>g> the c<strong>on</strong>tractor .<br />

The provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> escalati<strong>on</strong>s will be as under:<br />

(a) Escalati<strong>on</strong> for design & engineering cost:<br />

There shall be a ceiling <strong>on</strong> price variati<strong>on</strong> due to escalati<strong>on</strong> covered under clauses menti<strong>on</strong>ed<br />

hereinbefore, limited to 10% <str<strong>on</strong>g>of</str<strong>on</strong>g> the “total ordered price <str<strong>on</strong>g>of</str<strong>on</strong>g> the heads <strong>on</strong> which escalati<strong>on</strong> is<br />

allowed” <strong>on</strong>ly.


32. Black listed company from govt. organisati<strong>on</strong> can not participate in the bid.<br />

33. Soil bearing capacity and other parameters <str<strong>on</strong>g>of</str<strong>on</strong>g> soil at shaft site shall be provided by MOIL. Soil<br />

testing work under progress and the result <str<strong>on</strong>g>of</str<strong>on</strong>g> the same will be uploaded at our website in near<br />

future.<br />

34. Last date <str<strong>on</strong>g>of</str<strong>on</strong>g> submissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> bid extended upto 30.11.2012.<br />

35. Drawing showing Length <str<strong>on</strong>g>of</str<strong>on</strong>g> cross cut from inset to ore body is uploaded with tender document<br />
