leading to a particular loss to <strong>the</strong> employer or end user. It is less clear how this works in<br />
practice in respect of BAA’s arrangements at Terminal 5. BAA hold itself out as holding all<br />
of <strong>the</strong> risks, but quite what this means in practice is ano<strong>the</strong>r matter.<br />

A variety of industry or sector orientated st<strong>and</strong>ard <strong>forms</strong> have been developed. A more<br />
widely recognised selection of <strong>the</strong>m include:<br />

• ENAA (Engineering Advancement Association of Japan) Model Form<br />
International Contract for Power Plant Construction;<br />
• ECA Conditions of Contract (<strong>and</strong> Articles of Agreement) for specialist<br />
engineering <strong>and</strong> construction work; <strong>and</strong><br />
• The National Federation of Demolition Contractors Form of Direct<br />
Contract.<br />
IChemE’s contract suite<br />
In November 2007 <strong>the</strong> Institution of Chemical Engineers (“IChemE”) launched <strong>the</strong><br />
international <strong>forms</strong>, which now sit alongside <strong>the</strong> UK versions. The current IChemE <strong>forms</strong><br />

The IChemE chose as a result of <strong>the</strong> growing dem<strong>and</strong> in <strong>the</strong> <strong>forms</strong> of contract for global<br />
projects to launch international versions of its UK contracts. In effect, several additional<br />
clauses have been included in order to identify <strong>the</strong> applicable law <strong>and</strong> related matters.<br />
