PROPOSED CHANGE
The application is to permit a larger multi-purpose
building, including a museum, to be developed on the
land. Schedule 1 shows details of the property.
The land is currently zoned Resort Commercial
Establishment (RCE-654), in part, and Environmental
Protection Area (EPA-655), in part. A multi-purpose
building with a maximum floor area of 500 square metres
is permitted on the RCE-654 land. The applicant is
requesting the permitted floor area of the proposed multipurpose
building be increased to 1,400 square metres. The
applicant is also requesting a portion of the required
landscaping strip along Kalar Road to be reduced in width
from 15 metres to 5 metres to accommodate parking and
access for the multi-purpose building. In addition, the
applicant is requesting the holding (H) provisions that
apply to the land, which require that adequate sanitary,
stormwater and water services be available to service the
land, be lifted.

WRITTEN SUBMISSION
To provide input in writing, or request notice if the proposed Zoning By-law amendment is approved, please
submit a letter to the Director of Planning & Development, City Hall, 4310 Queen Street, Niagara Falls, Ontario,
L2E 6X5 on or before Tuesday, May 8, 2012.

Section 34 of the Planning Act
If you disagree with Council’s decision on the application, you can appeal it to the Ontario Municipal Board
(O.M.B.). However, if a person or public body does not make oral submissions at a public meeting or make
written submissions to the City of Niagara Falls before the by-law is passed, the person or public body is not
entitled to appeal the decision of the Niagara Falls City Council to the Ontario Municipal Board.
If a person or public body does not make oral submissions at a public meeting or make written submissions to
the City of Niagara Falls before the by-law is passed, the person or public body may not be added as a party to
the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are
reasonable grounds to do so.
