PROPOSED CHANGE<br />

The <strong>application</strong> is to permit a larger multi-purpose<br />

building, including a museum, to be developed on the<br />

land. Schedule 1 shows details <strong>of</strong> the property.<br />

The land is currently zoned Resort Commercial<br />

Establishment (RCE-654), in part, and Environmental<br />

Protection Area (EPA-655), in part. A multi-purpose<br />

building with a maximum floor area <strong>of</strong> 500 square metres<br />

is permitted on the RCE-654 land. The applicant is<br />

requesting the permitted floor area <strong>of</strong> the proposed multipurpose<br />

building be increased to 1,400 square metres. The<br />

applicant is also requesting a portion <strong>of</strong> the required<br />

landscaping strip along Kalar Road to be reduced in width<br />

from 15 metres to 5 metres to accommodate parking and<br />

access for the multi-purpose building. In addition, the<br />

applicant is requesting the holding (H) provisions that<br />

apply to the land, which require that adequate sanitary,<br />

stormwater and water services be available to service the<br />

land, be lifted.<br />

Input on any proposed Zoning By-law Amendment is welcome and encouraged. You can provide input by:<br />

speaking at the <strong>public</strong> <strong>meeting</strong> or by making a written submission.<br />

WRITTEN SUBMISSION<br />

To provide input in writing, or request <strong>notice</strong> if the proposed Zoning By-law amendment is approved, please<br />

submit a letter to the Director <strong>of</strong> Planning & Development, City Hall, 4310 Queen Street, <strong>Niagara</strong> <strong>Falls</strong>, <strong>Ontario</strong>,<br />

L2E 6X5 on or before Tuesday, May 8, 2012.


LEGAL NOTICE<br />

Section 34 <strong>of</strong> the Planning Act<br />

If you disagree with Council’s decision on the <strong>application</strong>, you can appeal it to the <strong>Ontario</strong> Municipal Board<br />

(O.M.B.). However, if a person or <strong>public</strong> body does not make oral submissions at a <strong>public</strong> <strong>meeting</strong> or make<br />

written submissions to the City <strong>of</strong> <strong>Niagara</strong> <strong>Falls</strong> before the by-law is passed, the person or <strong>public</strong> body is not<br />

entitled to appeal the decision <strong>of</strong> the <strong>Niagara</strong> <strong>Falls</strong> City Council to the <strong>Ontario</strong> Municipal Board.<br />

If a person or <strong>public</strong> body does not make oral submissions at a <strong>public</strong> <strong>meeting</strong> or make written submissions to<br />

the City <strong>of</strong> <strong>Niagara</strong> <strong>Falls</strong> before the by-law is passed, the person or <strong>public</strong> body may not be added as a party to<br />

the hearing <strong>of</strong> an appeal before the <strong>Ontario</strong> Municipal Board unless, in the opinion <strong>of</strong> the Board, there are<br />

reasonable grounds to do so.<br />
