9.4 <strong>The</strong> problems surround<strong>in</strong>g organ retention, the Alder Hey and Bristol <strong>in</strong>quiries and the potential<br />

and now actual effects on access to material reta<strong>in</strong>ed at post-mortem and <strong>in</strong>deed after surgical<br />

operations were aga<strong>in</strong> rehearsed, with special emphasis on the effects on research, tra<strong>in</strong><strong>in</strong>g<br />

and the ma<strong>in</strong>tenance of standards via exam<strong>in</strong>ations, EQA and, <strong>in</strong>deed, referral of material for<br />

diagnosis.<br />

9.5 <strong>The</strong> emergent MRC guidel<strong>in</strong>es were noted, which, <strong>in</strong> particular, state that the pr<strong>in</strong>ciple of<br />

abandonment after, say, surgical operation is not appropriate and that all tissue has to be <strong>in</strong>dividually<br />

gifted. It was also noted that these guidel<strong>in</strong>es have specific recommendations for histopathologists<br />

seek<strong>in</strong>g to do research on archival material where, even for simple <strong>in</strong>vestigations such<br />

as re-exam<strong>in</strong>ation of rout<strong>in</strong>ely sta<strong>in</strong>ed sections, <strong>in</strong>formed consent is needed.<br />

9.6 Although there have been several suggestions for the design of an appropriate consent form,<br />

it was clear that different forms were <strong>in</strong> use all over the country.<br />

Action po<strong>in</strong>ts<br />

(i) Initiatives to reduce the amount of bureaucracy <strong>in</strong>volved <strong>in</strong> the grant<strong>in</strong>g of animal licences<br />

and to <strong>in</strong>crease the security of researchers <strong>in</strong>volved <strong>in</strong> experiments on animals (Mart<strong>in</strong>/<br />

Wright).<br />

(ii) Although there was some feel<strong>in</strong>g that we <strong>are</strong> stuck with the MRC guidel<strong>in</strong>es, some members<br />

felt that the pr<strong>in</strong>ciple of abandonment aga<strong>in</strong>st gift<strong>in</strong>g should be tested and that the<br />

guidel<strong>in</strong>es, where they imp<strong>in</strong>ge upon simple archival histopathological research, should be<br />

challenged. In any case, it was felt that it would be impossible to implement these guidel<strong>in</strong>es<br />

without some sort of a grandfather clause that would become operative at some time after<br />

the acceptance of the guidel<strong>in</strong>es (Stamp/Quirke/PathSoc).<br />

(iii) It was felt very important that the potentially seriously damag<strong>in</strong>g effects on research or lack<br />

of access to archival tissues or to properly ordered and classified tissue and organ banks<br />

should be made forcibly and publicised (PathSoc).<br />

(iv) <strong>The</strong>re should be a movement towards the design and acceptance of a National Ethics and<br />

Consent Form as applied to the use of human tissues for teach<strong>in</strong>g and research (Stamp/<br />

Quirke).<br />

(v) Because of the extreme sp<strong>in</strong> put on the f<strong>in</strong>d<strong>in</strong>gs of the Alder Hey Inquiry et sec, it was felt<br />

essential that the profession should engage with Government (RCPath).<br />

(vi) Similarly, it was also felt that professional public relations advice should be sought to put<br />

over our view on the use of human tissues for research and education (PathSoc/RCPath).<br />

(vii) We should also make contact with Pharma UK to explore matters of jo<strong>in</strong>t concern and <strong>in</strong><br />

any campaign underl<strong>in</strong>e the potential effects on UK PLCs if research on human tissues is<br />

compromised (Quirke/Stamp/RCPath).<br />

(viii) A campaign of public education about the use of human tissues <strong>in</strong> research should be undertaken<br />

(PathSoc).<br />

(ix) Centres should consider sett<strong>in</strong>g up a Tissue Ethics Subcommittee, which already exists <strong>in</strong><br />

some places, to consider requests for the use of tissues <strong>in</strong> research (Profs).<br />

(x) <strong>The</strong> possibility of produc<strong>in</strong>g a brochure describ<strong>in</strong>g the value of the use of human tissues <strong>in</strong><br />

research, for use <strong>in</strong> hospitals before and while seek<strong>in</strong>g <strong>in</strong>formed consent, should be explored<br />

(PathSoc).
