12.1 TARIFF REGULATIONS AT ZURI<strong>CH</strong> AIRPORT<br />

l. General terms and conditions<br />

Art. 1 Principle<br />

The airport operator, Flughafen Zürich AG, levies charges for the use of the airport in accordance with ll. The individual<br />

charges. All charges are indicated in Swiss Francs (<strong>CH</strong>F).<br />

Art. 2 Party liable<br />

Unless otherwise provided, the charges shall be paid, in case of:<br />

a. scheduled or non-scheduled commercial flights by the company that actually carries out the flight („operating carrier”);<br />

b. non-commercial flights by the aircraft operator.<br />

An aircraft operator is defined as the person who has the actual and permanent power of control over the aircraft and who<br />

uses it or permits it to be used at its expense.<br />

Several operators of the same aircraft shall be jointly and severally liable for the charges; in the event that the operator is not<br />

also the owner of the aircraft, both the operator and owner shall be jointly and severally liable for the charges.<br />

Art. 3 Exemptions<br />

The following parties are exempt from the charges set forth in A to F of ll. The individual charges:<br />

a. the Swiss Confederation for flights of officials of the Federal Office for Civil Aviation and the Aircraft Accident<br />

Investigation Bureau during the course of their duties;<br />

b. Swiss state aircraft;<br />

c. foreign state aircraft, provided the aircraft is carrying the Head of State on an official state visit;<br />

d. recognised Swiss air rescue organisations for flights carrying sick or injured persons or rescue equipment, provided<br />

that the costs thus incurred cannot be otherwise charged.<br />

Art. 4 Due date; currency<br />

The date on which fuel charges are due for payment shall be in accordance with the agreements with companies<br />

commissioned with fuelling the aircraft.<br />

All other charges are payable in Swiss Francs (<strong>CH</strong>F) prior to take-off at the latest. However, the airport operator is entitled to<br />

demand payment at any time after the aircraft has landed.<br />

The airport operator, may allow regular airport users to pay the charges at a later date, those users being namely:<br />

a. a commercial airline operator, that has its head office or a branch office responsible for operations in Zurich in<br />

Switzerland or has designated, in respect of aerodrome charges, a domicile in Switzerland for enforcement within the<br />

meaning of Art. 50, paragraph 2 of the Federal Debt Collection and Bankruptcy Act, and has designated a party in<br />

Switzerland who is authorised to accept service of documents;<br />

b. a non-commercial airline operator, that has its domicile in Switzerland or that has a domicile in Switzerland for<br />

enforcement within the meaning of Art. 50, paragraph 2 of the Federal Debt Collection and Bankruptcy Act, and has<br />

designated a party in Switzerland who is authorised to accept service of documents.<br />

Furthermore, the airport operator may make the payment of the charges at a later date dependant upon the provision of<br />

security through a bank, that also has its head office in Switzerland.<br />

If the payment of charges at a later date is permitted, the payment shall be remitted within 10 days of the date of the invoice,<br />

unless otherwise agreed .<br />

Art. 5 Payment<br />

• The airport operator reserves the right to demand securities such as bank guarantees, cash securities or advance<br />

payment before performance.<br />

• An interest of 5% on arrears out of aerodrome charges and special payments out of aerodrome charges shall be paid<br />

by the party in arrears.<br />

• If a debtor does not pay the charges (aerodrome charges, approach charges), the airport operator may deny take-off<br />

until the debtor has paid all outstanding charges including interest.<br />

• The debtor has to bear all costs and damages (including consequential damages) arising out of such take-off ban.<br />

Art. 6 Aircraft documentation<br />

Every year before April 1st, aircraft operators are required to provide a list of each aircraft operated under their responsibility<br />

containing the following details:<br />

• Aircraft registration;<br />

• Manufacturer, type and model;<br />

• Maximum certified take-off mass (MTOM) in kilos (as defined in Art. 9);<br />

• Engine type (incl. ICAO key).<br />

The list has to be backed by copies of the relevant pages of the Airplane Flight Manual (AFM), Basic Section for Weight<br />

Limitations, and noise certificates. In addition, the operator is required to immediately report all changes occurring in its fleet,<br />

including changes to the MTOM and engine type, equally backed by the AFM basic section and noise certificates. If reported<br />

at least five days in advance, the changes come into effect on the first day of the following month. Otherwise the changes<br />

come into effect on the first day of the subsequent month.<br />

Art. 7 Value added tax<br />

The charge rates listed in ll. The individual charges do not include value added tax.<br />

Art. 8 Swiss airport<br />

The Euro Airport Bâle-Mulhouse shall be considered to be a Swiss airport in connection with the applicability of the domestic<br />

rates stated in Art. 11 and 28.<br />

ll. The individual charges<br />

A. Landing charge<br />

Art. 9 Principle<br />

For each aircraft, a landing charge has to be paid to the airport operator Flughafen Zürich AG. The charge shall also be<br />

payable for touch and go landings and missed approaches.<br />

The landing charge is based on the MTOM of the aircraft, as defined in the AFM, Basic Section for Weight Limitations as<br />

certified by the state of registration. Other MTOMs, e.g. flexible MTOMs or MTOMs reflected in AFM supplements, are not<br />

accepted. Fractions of a ton are rounded to the next full ton.<br />

In case of a landing of an aircraft for which no data has been declared, the highest known weight of the concerned aircraft<br />

type at Zurich Airport will be charged.<br />

Art. 10 Charge rates<br />

The landing charge amounts to the following rates, based on the MTOM as specified in Art. 9:<br />

up to 5 tons <strong>CH</strong>F 60.00 flat charge<br />

from 6 to 10 tons <strong>CH</strong>F 130.00 flat charge<br />

Art. 11 Charge reduction<br />

The landing charges computed in accordance with Art. 9 and 10 are reduced:<br />

a. by 50%, if the aircraft, directly prior to the landing which is the subject of the charge, took off from another Swiss<br />

airport;<br />

b. by 66 2/3%, if the landing follows a technical check flight or transfer flight without a payload, or if it follows an<br />

instruction, training or check flight for pilots accompanied or supervised by a flight instructor or inspecting pilot.<br />

B. Noise surcharge on landing charge<br />

<strong>CH</strong>F 9.55 per ton above 50 ton<br />

Art. 12 Principle<br />

In addition to the landing charge a noise surcharge is levied. It is based on the noise class to which the aircraft has been<br />

assigned.<br />

The noise classification at Zurich Airport is based on the energetic noise levels of an aircraft type measured at points in<br />

residential areas located in the vicinity of the airport.<br />

For each movement (landing or take-off) between 2100 (2000) and 0500 (0400), an additional night flight noise surcharge<br />

shall be paid based on the noise class of the aircraft type and adjusted according to the actual time of the night operation.<br />

Official actual airborne or touchdown times will be used to determine the charge. Off- and on-block times are not considered.<br />

Art. 13 a) Noise classification for jet aircraft<br />

Every jet aircraft type shall be assigned to a noise class between I and V. The classification is based on the difference<br />

between the measured noise level of the aircraft type and the overall mean noise level measured for all aircraft. The class<br />

assignment is published in the Aeronautical Information Publication (<strong>AIP</strong>) <strong>GEN</strong> <strong>4.1</strong> - Appendix A (Noise classification of jet<br />

aircraft).<br />

Aircraft that have been equipped with low-noise engines after their initial classification and new aircraft shall be assigned to<br />

noise class V until confirmed measurement data is available.<br />

Art. 13 b) Noise classification for propeller-driven aircraft<br />

The assignment of propeller-driven aircraft with a MTOM not exceeding 5.7 tons into one to the noise classes A to D<br />

corresponds to the classification established by the Federal Office for Civil Aviation. The decisive factor in this regard is the<br />

difference between mandatory noise level limits in accordance with Annex 16 of the Convention on International Civil Aviation<br />

and the measured noise level of the aircraft or aircraft type corrected by the performance correction factor.<br />

The class assignment of the aircraft type is published in the <strong>AIP</strong> Switzerland <strong>GEN</strong> <strong>4.1</strong> - Appendix B (Noise classification for<br />

propeller-driven aircraft without special sound-proofing). The classification of foreign aircraft shall be determined in<br />

accordance with the classification of the particular type. The classification of Swiss aircraft shall be entered in the Swiss<br />

Aircraft Register or shall be made public in another appropriate manner.<br />

In the event, that a party liable to pay noise charges lays claim to another classification, the party shall provide proof to the<br />

airport operator by appropriate documentation within 60 days from the day the claim is made.<br />

Art. 14 a) Surcharge rates for jet aircraft<br />

The noise surcharge for jet aircraft shall be as follows:<br />

Art. 14 b) Surcharge rates for propeller-driven aircraft<br />

The noise surcharge for aircraft with a MTOM not exceeding 5.7 tons shall be as follows:<br />

Aircraft with a MTOM exceeding 5.7 tons are not subject to a noise surcharge.<br />

For all propeller-driven aircraft (irrespective of their weight) the night flight noise surcharge of jet class V aircraft applies.<br />

Art. 15 Reimbursement<br />

If the proof required in Art. 13b, paragraph 3 is provided in a timely manner, the airport operator shall reimburse the excess<br />

surcharge paid during the 60-day period.<br />

C. Emission-related landing charges<br />

Art. 16 Principle<br />

An emission related landing surcharge is applied to all aircraft equipped with a combustion engine and that are subject to a<br />

weight-based landing charge. The emission charge is based on the absolute emission characteristic of the engine as<br />

described in the FOCA Directive "Aircraft Engine Emission Charges in Switzerland" (Reference 33-05-27).<br />

Art. 17 Aircraft with turbofan, turbojet or turboprop engines with emission data available to the FOCA<br />

Aircraft, equipped with turbofan, turbojet or turboprop engines that are:<br />

• regulated under the ICAO Annex 16, Volume II, or<br />

• not regulated, but have detailed emission data for the LTO cycle available to the FOCA,<br />

are subject to the emission calculation as specified in ECAC Recommendation 27/4. Specifically, the following emission<br />

Art. 20 Principle<br />

A parking charge is levied for aircraft parking between landing and take-off. The parking charge is calculated on basis of the<br />

MTOM and length of the parking period.<br />

The time of landing is defined as the point of time at which the aircraft touches down on the runway; the time of take-off is<br />

defined as the point of time at which the aircraft lifts off the runway. The parking period commences on the seventh minute<br />

following the time of landing and ends at the point of time the aircraft leaves the apron. In the event that the aircraft departs<br />

from a hangar or is moved to a hangar, the parking period shall commence at the moment the aircraft enters the apron and<br />

ends once the aircraft leaves the apron.<br />

In case the parking charge is calculated by number of days, the first day shall be deemed to be the period between the time<br />

of landing and 0930 (0830) on the following day; the hour of reference for additional days shall always be 0930 (0830).<br />

Partial tons, days and hours are calculated as full tons, days and hours for invoicing purposes.<br />

Art. 21 Charge-free parking period<br />

The period during which the aircraft may park without charge shall be:<br />

a. the first four hours of parking for aircraft used in non-commercial traffic;<br />

b. the first five hours of parking for aircraft used in scheduled or non-scheduled commercial traffic.<br />

Art. 22 Charge rates for non-commercial traffic<br />

The parking charge for non-commercial traffic shall be, for an aircraft with a MTOM of<br />

a. up to 2 tons <strong>CH</strong>F 8.-- per day<br />

b. over 2 tons <strong>CH</strong>F 4.-- per ton and day.<br />

Art. 23 Charge rates for scheduled and non-scheduled commercial traffic<br />

The parking charge for scheduled and non-scheduled commercial traffic shall be:<br />

a. provided there is no overnight parking: for the 6th and 7th hour <strong>CH</strong>F 2.-- per ton and hour; hours<br />

1-5 being without charge;<br />

b. provided there is overnight parking (change of<br />

date occurs during the parking period):<br />

c. provided there are several nights of overnight<br />

parking:<br />

E. Passenger related charges<br />

Art. 24 Principle<br />

Subject to Art. 27, charges shall be payable for each passenger who is transported in an aircraft which takes off from Zurich<br />

Airport.<br />

Art. 25 Passengers exempted from charges<br />

No charge shall be levied in the case of:<br />

in case of take-off before 0930<br />

(0830):<br />

in case of take-off after 0930<br />

(0830):<br />

up to and including the second<br />

last overnight stay in accordance<br />

with sub-paragraph b.<br />

<strong>CH</strong>F 2.-- per ton;<br />

flight from that airport (dead heading).<br />

Art. 26 Charge rates for flights departing from Zurich Airport and handled through the General Aviation Centre (GAC)<br />

or the Business Aviation Centre (BAC)<br />

The charges per passenger departing on such flights shall be:<br />

Art. 27 Charge rates for flights departing from Zurich Airport and not covered in Art. 26<br />

The charges per passenger departing on such flights shall be:<br />

*Transfer passengers are passengers who interrupt their travel by air at Zurich airport and proceed by aircraft with a different<br />

flight number on the same day of arrival. The airport of departure and the destination must not be the same.<br />

Art. 28 PRM charge<br />

Passenger-related charge for assistance on airports following REGULATION (EC) No 1107/2006 OF THE EUROPEAN<br />

PARLIAMENT AND THE COUNCIL of July 5 2006 concerning the rights of disabled persons and persons with reduced<br />

mobility (PRM) when travelling by air.<br />

No charge shall be levied in the case of:<br />

a) children under the age of two;<br />

b) passengers in direct transit;<br />

c) dead head crew (DHC);<br />

d) passengers on non-commercial flights.<br />

The charge rate per departing passenger (local and transfer passenger) amounts to <strong>CH</strong>F 0.90.<br />

F. Cargo charge<br />

Art. 29 Principle and amount<br />

A charge of <strong>CH</strong>F --.06 per kg of cargo shall be payable on all import cargo unloaded from an aircraft or from a motor-vehicle<br />

used in substitution for air cargo traffic.<br />

A charge of <strong>CH</strong>F --.02 per kg of cargo shall be payable on all transfer cargo unloaded from an aircraft or from a motor-vehicle<br />

used in substitution for air cargo traffic.<br />

The charge is calculated on basis of gross weight.<br />

Art. 30 Party liable<br />

The cargo charge is to be paid by the air transport carrier that actually effected carriage of the goods (operating carrier).<br />

G. Fuel charge<br />

Art. 31 Principle; Party liable<br />

A charge is to be paid for the supply of fuel and lubricant to aircraft on basis of the amount supplied.<br />

The charge shall be paid by the company authorised by the airport operator to supply such products.<br />

Art. 32 Charge rates<br />

1. Approach air navigation services<br />

1.1 Principles<br />

Main following principles apply:<br />

• A single unit rate is set per charging zone<br />

• One charge is billed for each approach<br />

• Charges take the Maximum Take Off Mass (MTOM) of aircraft into account<br />

• Charges have to be paid by the aircraft operator. If the aircraft operator is unknown, the aircraft owner is debtor of the<br />

charge<br />

• In case of non payment of the charges by the debtor, air navigation services may be denied<br />

Two charging zones are defined:<br />

• The category I gathers the aerodromes of Geneva and Zurich<br />

• The category II gathers the aerodromes of Lugano, Bern-Belp, Grenchen, Les Eplatures, Sion, St. Gallen-Altenrhein<br />

and Buochs<br />

Detailed principles applied are set by the Federal Ordinance on air navigation services which is available in the Swiss official<br />

1.2 Category I: Zurich and Geneva<br />

Valid charges per approach (VAT excl.) are available in annex 1.<br />

For information, they are calculated with following formula:<br />

Unit rate x ((MTOM/50) 0.65 ) and following unit rate: <strong>CH</strong>F 372.10<br />

A lump charge per MTOM in tons is granted to aircraft until 4.999 tons. The formula mentioned above is thus not applied for<br />

these flights.<br />

VFR training flights<br />

A lump charge per MTOM is billed for VFR training flights until 29.999 tons landing in Geneva. Beyond this MTOM, in Geneva,<br />

normal charges apply. In Zurich, normal charges apply for all training flights.<br />

Definition of a VFR Training flight:<br />

• Training flights must be attended or supervised by a flight instructor or inspector;<br />

• Training flights are not commercial flights within the meaning of the aviation law and are not to be used for the purpose<br />

of carriage of passengers or goods;<br />

• Training flights within the aerodrome circuit are treated as training flights provided that the airport offers reduced<br />

landing charges for these flights.<br />

Gliders<br />

For powered gliders the ordinary approach charges are levied.<br />

For instruction and training flights with towing aircraft and powered gliders the rate and the definition of "VFR training flights"<br />

are applicable.<br />

Exempted flights<br />

Following flights are exempted from approach charges:<br />

a. Flights operated exclusively for the transport, on official mission, of following passengers:<br />

• Reigning monarch and his immediate family<br />

• Heads of State, heads of Government, and Government Ministers<br />

In all cases, the exemption must be substantiated by the appropriate status indicator or remark on the flight plan.<br />

b. Search and Rescue flights as defined in the corresponding Federal Ordinance.<br />

c. Flights performed exclusively for the purpose of checking or testing equipment used or intended to be used as ground<br />

aids to air navigation, excluding positioning flights by the aircraft concerned.<br />

1.3 Category II: Lugano, Bern-Belp, Grenchen, Les Eplatures, Sion, St. Gallen-Altenrhein and<br />

Buochs<br />

Valid charges per approach (VAT excl.) are available in annex 2.<br />

2. En route air navigation services<br />

2.1 Principles<br />

Main following principles apply:<br />

• The Swiss FIR constitutes a single charging zone<br />

• A single unit rate is set for the Swiss charging zone<br />

• Charges take the distance flown and the Maximum Take Off Mass (MTOM) of aircraft into account<br />

• Charges have to be paid by the aircraft operator. If the aircraft operator is unknown, the aircraft owner is debtor of the<br />

charge<br />

• In case of non payment of the charges by the debtor, air navigation services may be denied<br />

As signatory of the Multilateral Agreement of 12th February 1981 relating to air navigation route charges, Switzerland is<br />

2.2 En route charges<br />

The Swiss unit rate is set up in Swiss francs and is recalculated monthly in euro by applying the average monthly exchange<br />

rate between the EURO and the national currency for the month preceding the month during which the flight takes place.<br />

The Swiss tariff is available on following web site:<br />

It is composed of a national unit rate to finance national air navigation services and of a regional administrative unit rate to<br />

finance the central billing and collection of charges at Eurocontrol level.<br />

The exchange rate applied shall be that published in the Official Journal of the European Communities (Information and<br />

Notices). Where not indicated in the Official Journal, the exchange rate shall be calculated by reference on the one hand to<br />

the rate of exchange between the EURO and the dollar of the United States of America and, on the other hand, to the rate of<br />

exchange between the national currency concerned and the dollar of the United States of America as published by the<br />

International Monetary Fund in its "International Financial Statistics".<br />

The data for the calculation of the charges are derived from the flight plan. Flight plans should be completed therefore in strict<br />

accordance with the ICAO instructions.<br />

With regard to the conditions of payment of route charges the interest rate on late payment of route charges is published on<br />

Exempted flights<br />

Following flights are exempted from en route charges:<br />

• Flights performed by aircraft of which the maximum takeoff mass authorized is less than two metric tons<br />

• Mixed VFR/IFR flights in the charging zones where they are performed exclusively under VFR and where a charge is<br />

not levied for VFR flights<br />

• Flights performed exclusively for the transport, on official mission, of the reigning Monarch and his immediate family,<br />

Heads of State, heads of Government, and Government Ministers; in all cases, the exemption must be substantiated<br />

by the appropriate status indicator or remark on the flight plan<br />

• Search and rescue flights authorized according to the related Federal Ordinance<br />

• Flights performed exclusively for the purpose of checking or testing equipment used or intended to be used as ground<br />
