COUNCIL TUESDAY 22 MAY 2012 COUNCIL DECISION: That the Town of Cambridge enter into negotiations with the owners of 81 Branksome Gardens, City Beach to:- (i) (ii) have the sand removed from the front yard of the property with a gentle gradient from the front boundary to the front of the existing dwelling; re-turf the front yard to the owners' satisfaction; at the expense of the Town of Cambridge. COUNCIL TUESDAY 22 MAY 2012 DV12.54 DRAFT POLICY 5.6 - PERCENT FOR PUBLIC ART - OUTCOMES OF ADVERTISING PURPOSE OF REPORT: To report to Council the outcomes of advertising the draft Percent for Public Art Policy and to present Policy 5.6 - Percent for Public Art (with modifications) for final adoption. SUMMARY: Draft Policy 5.6 Percent for Public Art Policy has been developed to formalise mechanisms for collecting public art contributions from developers for commercial, non-residential and mixed use developments with a construction value of $1 million or more. The draft policy was advertised in accordance with Scheme provisions and three written submissions were received. Submissions on the draft policy generally supported the intent of Council to collect public art contributions and provided comments on how Council funds should be spent. It is intended that more detailed consideration of public art expenditure could occur through the preparation of a Public Art Strategy. The draft policy, (as amended) and attached to this report, is submitted for final adoption. Other minor changes to the policy have been included to give the Town greater flexibility to approve suitable artworks and to include artistic landscaping as part of art works. In adopting this Policy, it is of note that for a consistent approach to public art over the Town, Council's own infrastructure and works projects should be also complemented by public art projects into the future as per Council's existing Art and Culture Policy No 2.1.29. BACKGROUND: In response to a number of conditions on recent development applications to provide public art contributions, Council on 28 February 2011 considered a report (Item DV12.9) on the draft Percent for Public Art Policy which aims to formalise development contributions for public art. Council decided: That the draft Policy 5.6: Percent for Public Art:- (i) be adopted for the purpose of advertising as specified in accordance with Clause 48 (3) of the Town Planning Scheme; (ii) be advertised as follows:- • an advertisement be placed in the local newspaper under the Cambridge noticeboard; • a notice be included on the Town’s website; and • a notice be sent to the Western Australian Planning Commission and local ratepayer groups.
