It has been observed in recent times that some members have not been wearing their bullet
proof vests when on duty. Members who have been issued with bullet proof vests are
reminded to wear them whilst on duty.
Commanding Officers are to conduct an immediate audit of personnel within their formations
to identify members who are not in receipt of bullet proof vest. Application must then be made
for those members who have been identified to be issued with vests. Supply of these vests by
Headquarters Stores will be done based on availability of stock.
FORCE ORDERS (CONT’D)
26 TH MAY, 2011 SERIAL NO. 3338
POST MORTEM AND DISPOSAL OF BODIES AT FUNERAL HOMES (CONT’D)
The delay in getting these bodies out of funeral homes has been incurring hundreds of
thousands of dollars in debt which is putting tremendous strain on the already stretched
budget of the JCF Finance Branch. The practice of the police allowing bodies to be stored for
excessively long periods is most inappropriate and reflects scant regard for prudent financial
management.
In some cases bodies are left in storage at morgues or funeral parlours for several months under
the pretext of awaiting identification.
All bodies, on being found, will be photographed by a trained scene of crime officer and again
at the post mortem examination, a scene of crime officer will photograph the body. The scene
of crime officer will ensure that a sample for DNA testing is taken by the pathologist from the
body and will take a full set of fingerprints (including palms).
The fingerprints and photograph will be referred to the Assistant Commissioner incharge
Criminal Investigation Branch who will take steps to identify the body, including publishing
the photograph (if appropriate) in the print media with the hope that someone will come
forward and identify it.
If after thirty (30) days, the body remains unidentified, the body can be released for burial and
appropriate arrangements made.
In every case under police investigation, a member of the Force and in cases of murder and or
fatal shooting by the police, the investigator must attend the post mortem examination to assist
the pathologist with a history of the incident and any special circumstances surrounding the
incident.
The investigating officer is also responsible for:-
I. Ensuring a scene of crime officer attends the post mortem examination
II. Recording a statement from person(s) identify the body of the deceased
III. Ensuring a statement(s) is recorded for the identification and/or continuity of the body
from the crime scene to the post mortem examination. (This is in keeping with the
judgement in R v Florence Bish).
IV. The Evidence (Amendment) Act requires that a comprehensive statement be recorded
from these persons. This is important, especially in circumstances where these
witnesses subsequently die or are otherwise not available to give evidence in the matter
if required, and the prosecution intends to rely on their statements.
V. Ensuring the process and actions taken are fully recorded.
Commanding Officers are to implement a system whereby investigating officers inform them
on a daily basis of the following:
I. Number of bodies at funeral homes
II. Number of days
III. Reason for post mortem not being held
On no account must bodies be sent to individuals and institutions which are not authorized by
the JCF and those that are so authorized will be properly licensed, registered and will have the
requisite storage facility to pick up and store bodies. Force Orders No. 3336 Part I Sub. No. 6
dated 2011-05-12 treating on the subject of Approved Funeral Homes should be read in
conjunction with these orders.
Divisional Officers will be held accountable for any exorbitant bills incurred for storage of dead
bodies without justification.
