NOTICE TO BUYERS
TERMS & CONDITIONS
Animals sell under the standard terms and conditions of the Canadian
Simmental Association.
INSURANCE
Bar 5 Simmental Farms recommends animals bought at the sale are
insured after purchase with your current insurance company.
“DNA” PARENT VERIFICATION
We DNA all of our animals so every bull and heifer has its Dam and Sire
DNA’d. We have collected hair on every Bar 5 bull and heifer through the
Test Station, for future DNA Marker or DNA recordation. We believe in two
responsibilities deeply.
1) Genetic Integrity & 2) Genetic Improvement.
SIGHT UNSEEN PURCHASE PROGRAM
If you are unable to attend the sale but are interested in a bull, give any of
the team a call and they will personally go over the bulls and your program
and recommend the bull that meets your needs.
TERMS & CONDITIONS
TERMS: The terms of the sale are cash, credit card or cheque payable
at par at sale location unless satisfactory credit arrangements have
been made previous to the sale. ALL CHEQUES SHALL BE MADE
PAYABLE TO TRANSCON LIVESTOCK. No sale will be considered
valid until and unless payment made out to TRANSCON LIVESTOCK
is received and cleared. The right of property shall not pass until after
settlement is made. Bar 5 Stock Farms reserve full power to resell
the animal to the best advantage either publicly or privately, without
further notice. Any loss arising from such resale together with keep
and all other expenses shall be payable by the defaulter.
ALL SETTLEMENTS MUST BE MADE WITH THE CLERKS OF THE
SALE BEFORE ANY CATTLE
WILL BE RELEASED.
BID: Every animal consigned to the sale will be sold by auction to
highest bidder.
DISPUTES: In case of disputes, bidding will be reopened between the
parties involved if no further bid is made, the buyer will be the person
from whom the auctioneer accepted the last bid. The Auctioneer`s
decision in such matters will be fi nal. The
Auctioneer shall have the right to refuse bids from anyone who has
a previous record of default in payment or who has not made proper
credit clearance prior to the sale.
PURCHASER’S RISK: Each animal becomes the risk of the purchaser
as soon as sold. Animals will be cared for at the purchaser`s risk for a
reasonable length of time.
ANNOUNCEMENTS: Announcements from the auction block will take
precedence over the printed matter in this catalogue. Buyers are
therefore cautioned to pay attention to such announcements.
CERTIFICATE OF REGISTRY: The proper Registration or Recordation
paper, as the case may be, will be duly transferred and furnished.
TRANSPORTATION: Bar 5 will arrange for trucking to your farm or a
central point; the following charges will apply unless the buyer wishes
to take care of shipping themselves: Local $50, Ottawa Valley $150,
Montreal $200, Maritimes $250, Manitoba $200, Saskatchewan &
Alberta $250, and U.S.A. $300 plus Export fees. Your purchase may
stay here free of charge until OCTOBER 31, then a fee of $5.00 per
day will apply.
BREEDERS GUARANTEE
BULLS: Should any bull fourteen (14) months of age or over, fail to
prove a breeder after being used on cows known to be breeders, the
matter shall be reported in writing to the seller within six (6) months
following date of purchase or six (6) months after the bull has reached
fourteen (14) months of age. The seller will have the right and
privilege of six (6) months to prove the bull a breeder. No guarantee
is given that semen collected from the bull will be suitable for artifi cial
insemination.
FEMALES: Cows represented as being “pregnancy tested, safe in calf”
have been examined and declared by a licensed veterinarian and will
be accompanied by a veterinarian’s certifi cate to the effect. They are
considered breeders without further guarantee. Cows with calves
at side shall be considered breeders also without further guarantee;
cows and heifers represented at “bred” are not guaranteed safe in
calf but they are open heifers selling as individual lots are guaranteed
to be breeders. No guarantee shall apply to sucking calves. In the
event a female is claimed to be a non-breeder, after having been
bred regularly to a bull known to be a breeder and after having been
treated by a licensed veterinarian, the matter must be reported in
writing to the seller within six (6) months of sale date. For heifers
under twelve (12) months of age and purchased as a single lot and
who fail to conceive to the services of a bull known to be a breeder,
the matter must be reported in writing to the seller before the heifer
reaches eighteen (18) months of age. The seller shall have six (6)
additional months in which to prove any such female a breeder and
may use any registered bull of the breed available to him. Any female
returned will be at the purchaser’s risk. No guarantee is given that a
pregnant female will deliver live calves nor that she will carry calves
full term nor that the calf carried will not be mummifi ed. The seller is
not responsible for damage caused by foreign bodies after the animal
has been sold or for sickness not apparent at sale time.
EXCEPTION OF GUARANTEE: In cases where the animal is subjected
to hormonal or surgical reproduction techniques after the sale, the
guarantee shall be null and void.
SETTLEMENT: TRANSPORTATION CHARGES ON ANIMALS
RETURNED TO THE SELLER ARE FOR ACCOUNT OF THE
PURCHASER. No incidental expenses such as feed, A.I. signing
fees, interest, veterinary charges, etc., will be charged by the either
party when making settlement. If the seller is successful in proving
the animal a breeder, the said animal will be reclaimed by the
purchaser at his expense. Should the seller fail to prove the animal
a breeder, then the buyer is guaranteed a satisfactory replacement,
F.O.B. ranch or location of origin or a refund of the actual purchase
price paid F.O.B. selling point. In no event shall the seller be
responsible for more than the purchase price.
HEALTH: All animals will have passed the required tests as
determined by Agriculture Canada at sale location. It is the buyer’s
responsibility to determine health requirements for importing any
animal into his province, state or country.
ACCIDENTS: Although every precaution will be taken to protect
the safety and comfort of buyers, neither the Owner’s, Sale’s
Management or Staff, assume any responsibility in this matter and
disclaims any liability legal or otherwise in the event of accident or
loss of property.
RIGHTS AND OBLIGATIONS: The above terms and conditions of the
sale shall constitute a contract between the buyer and the seller and
be equally binding to both. Resale of animals following purchase in
this sale shall constitute a separate transaction and the rights and
obligations of both parties connected thereto are not covered by the
terms and conditions of this sale.
