TERMS & CONDITIONS<br />
Animals sell under <strong>the</strong> standard terms and conditions of <strong>the</strong> Canadian<br />
Simmental Association.<br />
INSURANCE<br />
Bar 5 Simmental <strong>Farm</strong>s recommends animals bought at <strong>the</strong> sale are<br />
insured after purchase with your current insurance company.<br />
“DNA” PARENT VERIFICATION<br />
We DNA all of our animals so every bull and heifer has its Dam and Sire<br />
DNA’d. We have collected hair on every Bar 5 bull and heifer through <strong>the</strong><br />
Test Station, for future DNA Marker or DNA recordation. We believe in two<br />
responsibilities deeply.<br />
1) Genetic Integrity & 2) Genetic Improvement.<br />
SIGHT UNSEEN PURCHASE PROGRAM<br />
If you are unable to attend <strong>the</strong> sale but are interested in a bull, give any of<br />
<strong>the</strong> team a call and <strong>the</strong>y will personally go over <strong>the</strong> bulls and your program<br />
and recommend <strong>the</strong> bull that meets your needs.<br />
TERMS & CONDITIONS<br />
TERMS: The terms of <strong>the</strong> sale are cash, credit card or cheque payable<br />
at par at sale location unless satisfactory credit arrangements have<br />
been made previous to <strong>the</strong> sale. ALL CHEQUES SHALL BE MADE<br />
PAYABLE TO TRANSCON LIVESTOCK. No sale will be considered<br />
valid until and unless payment made out to TRANSCON LIVESTOCK<br />
is received and cleared. The right of property shall not pass until after<br />
settlement is made. Bar 5 Stock <strong>Farm</strong>s reserve full power to resell<br />
<strong>the</strong> animal to <strong>the</strong> best advantage ei<strong>the</strong>r publicly or privately, without<br />
fur<strong>the</strong>r notice. Any loss arising from such resale toge<strong>the</strong>r with keep<br />
and all o<strong>the</strong>r expenses shall be payable by <strong>the</strong> defaulter.<br />
ALL SETTLEMENTS MUST BE MADE WITH THE CLERKS OF THE<br />
SALE BEFORE ANY CATTLE<br />
WILL BE RELEASED.<br />
BID: Every animal consigned to <strong>the</strong> sale will be sold by auction to<br />
highest bidder.<br />
DISPUTES: In case of disputes, bidding will be reopened between <strong>the</strong><br />
parties involved if no fur<strong>the</strong>r bid is made, <strong>the</strong> buyer will be <strong>the</strong> person<br />
from whom <strong>the</strong> auctioneer accepted <strong>the</strong> last bid. The Auctioneer`s<br />
decision in such matters will be fi nal. The<br />
Auctioneer shall have <strong>the</strong> right to refuse bids from anyone who has<br />
a previous record of default in payment or who has not made proper<br />
credit clearance prior to <strong>the</strong> sale.<br />
PURCHASER’S RISK: Each animal becomes <strong>the</strong> risk of <strong>the</strong> purchaser<br />
as soon as sold. Animals will be cared for at <strong>the</strong> purchaser`s risk for a<br />
reasonable length of time.<br />
ANNOUNCEMENTS: Announcements from <strong>the</strong> auction block will take<br />
precedence over <strong>the</strong> printed matter in this catalogue. Buyers are<br />
<strong>the</strong>refore cautioned to pay attention to such announcements.<br />
CERTIFICATE OF REGISTRY: The proper Registration or Recordation<br />
paper, as <strong>the</strong> case may be, will be duly transferred and furnished.<br />
TRANSPORTATION: Bar 5 will arrange for trucking to your farm or a<br />
central point; <strong>the</strong> following charges will apply unless <strong>the</strong> buyer wishes<br />
to take care of shipping <strong>the</strong>mselves: Local $50, Ottawa Valley $150,<br />
Montreal $200, Maritimes $250, Manitoba $200, Saskatchewan &<br />
Alberta $250, and U.S.A. $300 plus Export fees. Your purchase may<br />
stay here free of charge until OCTOBER 31, <strong>the</strong>n a fee of $5.00 per<br />
day will apply.<br />
BREEDERS GUARANTEE<br />
BULLS: Should any bull fourteen (14) months of age or over, fail to<br />
prove a breeder after being used on cows known to be breeders, <strong>the</strong><br />
matter shall be reported in writing to <strong>the</strong> seller within six (6) months<br />
following date of purchase or six (6) months after <strong>the</strong> bull has reached<br />
fourteen (14) months of age. The seller will have <strong>the</strong> right and<br />
privilege of six (6) months to prove <strong>the</strong> bull a breeder. No guarantee<br />
is given that semen collected from <strong>the</strong> bull will be suitable for artifi cial<br />
insemination.<br />
FEMALES: Cows represented as being “pregnancy tested, safe in calf”<br />
have been examined and declared by a licensed veterinarian and will<br />
be accompanied by a veterinarian’s certifi cate to <strong>the</strong> effect. They are<br />
considered breeders without fur<strong>the</strong>r guarantee. Cows with calves<br />
at side shall be considered breeders also without fur<strong>the</strong>r guarantee;<br />
cows and heifers represented at “bred” are not guaranteed safe in<br />
calf but <strong>the</strong>y are open heifers selling as individual lots are guaranteed<br />
to be breeders. No guarantee shall apply to sucking calves. In <strong>the</strong><br />
event a female is claimed to be a non-breeder, after having been<br />
bred regularly to a bull known to be a breeder and after having been<br />
treated by a licensed veterinarian, <strong>the</strong> matter must be reported in<br />
writing to <strong>the</strong> seller within six (6) months of sale date. For heifers<br />
under twelve (12) months of age and purchased as a single lot and<br />
who fail to conceive to <strong>the</strong> services of a bull known to be a breeder,<br />
<strong>the</strong> matter must be reported in writing to <strong>the</strong> seller before <strong>the</strong> heifer<br />
reaches eighteen (18) months of age. The seller shall have six (6)<br />
additional months in which to prove any such female a breeder and<br />
may use any registered bull of <strong>the</strong> breed available to him. Any female<br />
returned will be at <strong>the</strong> purchaser’s risk. No guarantee is given that a<br />
pregnant female will deliver live calves nor that she will carry calves<br />
full term nor that <strong>the</strong> calf carried will not be mummifi ed. The seller is<br />
not responsible for damage caused by foreign bodies after <strong>the</strong> animal<br />
has been sold or for sickness not apparent at sale time.<br />
EXCEPTION OF GUARANTEE: In cases where <strong>the</strong> animal is subjected<br />
to hormonal or surgical reproduction techniques after <strong>the</strong> sale, <strong>the</strong><br />
guarantee shall be null and void.<br />
SETTLEMENT: TRANSPORTATION CHARGES ON ANIMALS<br />
RETURNED TO THE SELLER ARE FOR ACCOUNT OF THE<br />
PURCHASER. No incidental expenses such as feed, A.I. signing<br />
fees, interest, veterinary charges, etc., will be charged by <strong>the</strong> ei<strong>the</strong>r<br />
party when making settlement. If <strong>the</strong> seller is successful in proving<br />
<strong>the</strong> animal a breeder, <strong>the</strong> said animal will be reclaimed by <strong>the</strong><br />
purchaser at his expense. Should <strong>the</strong> seller fail to prove <strong>the</strong> animal<br />
a breeder, <strong>the</strong>n <strong>the</strong> buyer is guaranteed a satisfactory replacement,<br />
F.O.B. ranch or location of origin or a refund of <strong>the</strong> actual purchase<br />
price paid F.O.B. selling point. In no event shall <strong>the</strong> seller be<br />
responsible for more than <strong>the</strong> purchase price.<br />
HEALTH: All animals will have passed <strong>the</strong> required tests as<br />
determined by Agriculture Canada at sale location. It is <strong>the</strong> buyer’s<br />
responsibility to determine health requirements for importing any<br />
animal into his province, state or country.<br />
ACCIDENTS: Although every precaution will be taken to protect<br />
<strong>the</strong> safety and comfort of buyers, nei<strong>the</strong>r <strong>the</strong> Owner’s, Sale’s<br />
Management or Staff, assume any responsibility in this matter and<br />
disclaims any liability legal or o<strong>the</strong>rwise in <strong>the</strong> event of accident or<br />
loss of property.<br />
RIGHTS AND OBLIGATIONS: The above terms and conditions of <strong>the</strong><br />
sale shall constitute a contract between <strong>the</strong> buyer and <strong>the</strong> seller and<br />
be equally binding to both. Resale of animals following purchase in<br />
this sale shall constitute a separate transaction and <strong>the</strong> rights and<br />
obligations of both parties connected <strong>the</strong>reto are not covered by <strong>the</strong><br />
terms and conditions of this sale.<br />
