Proposition 203 13 repealed the state statute that provided for bil<strong>in</strong>gual <strong>and</strong> English<br />

as a Second Language programs <strong>in</strong> the public schools 14 <strong>and</strong> replaced it with “English<br />

Language Education for Children <strong>in</strong> Public Schools.” 15 <strong>The</strong> result<strong>in</strong>g legislation requires<br />

that all public school <strong>in</strong>struction be conducted <strong>in</strong> English <strong>and</strong> that ELLs be placed <strong>in</strong> an<br />

<strong>in</strong>tensive one-year English immersion program. Parents may request a waiver for<br />

children who already know English, are ten years <strong>of</strong> age or older, or have special needs<br />

best suited to a different educational approach. Traditional foreign language programs<br />

are unaffected.<br />

Recent Developments<br />

S<strong>in</strong>ce the passage <strong>of</strong> Proposition 203 <strong>in</strong> November, 2000, the <strong>Arizona</strong> legislature,<br />

<strong>in</strong> consultation with the educational <strong>and</strong> bus<strong>in</strong>ess communities, has been engaged <strong>in</strong> rulemak<strong>in</strong>g<br />

that complies with two apparently conflict<strong>in</strong>g m<strong>and</strong>ates. Two additional<br />

developments emerg<strong>in</strong>g s<strong>in</strong>ce January 2002 are the reauthorization <strong>of</strong> the federal<br />

Elementary <strong>and</strong> Secondary Education Act (known as the No Child Left Beh<strong>in</strong>d Act <strong>of</strong><br />

2001 [NCLB]) 16 <strong>and</strong> <strong>Arizona</strong> LEARNS (<strong>Arizona</strong> Revised Statute 15-241), 17 which is<br />

<strong>Arizona</strong>’s state plan for participat<strong>in</strong>g <strong>in</strong> NCLB. To cont<strong>in</strong>ue to receive federal funds<br />

under NCLB, public schools must meet academic st<strong>and</strong>ards as prescribed by NCLB. <strong>The</strong><br />

objectives are to implement a s<strong>in</strong>gle, statewide accountability system that ensures that all<br />

districts <strong>and</strong> schools make Adequate Yearly Progress (AYP), <strong>and</strong> to hold accountable<br />

those that do not. Most notable <strong>of</strong> the statutory requirements are those <strong>in</strong>cluded <strong>in</strong> Title I<br />

(Improv<strong>in</strong>g the Academic Achievement <strong>of</strong> the Disadvantaged), which requires that: (1) In<br />

order to make adequate yearly progress, schools must test <strong>in</strong> each <strong>of</strong> a number <strong>of</strong><br />

categories at least 95 percent <strong>of</strong> their students, <strong>in</strong>clud<strong>in</strong>g low-<strong>in</strong>come students, students<br />

from major racial <strong>and</strong> ethnic groups, <strong>and</strong> students with limited English pr<strong>of</strong>iciency; 18 <strong>and</strong><br />

(2) Local school districts must notify parents <strong>of</strong> their right to request <strong>in</strong>formation on the<br />

pr<strong>of</strong>essional qualifications <strong>of</strong> their children’s teachers.<br />

<strong>Arizona</strong>’s <strong>in</strong>terpretation <strong>of</strong> the terms <strong>of</strong> NCLB through <strong>Arizona</strong> LEARNS appears<br />

to conflict with the Flores Consent Order. <strong>Arizona</strong> LEARNS requires that all students <strong>in</strong><br />

<strong>Arizona</strong>’s public schools be taught <strong>in</strong> English <strong>and</strong> that they “participate effectively” <strong>in</strong><br />
