<strong>NEW</strong> <strong>MEASURES</strong> <strong>APPLICABLE</strong> <strong>TO</strong> <strong>GUAR</strong> <strong>GUM</strong> <strong>FROM</strong> <strong>INDIA</strong><br />

INFORMATION AS REGARDS ANALYTICAL REPORTS<br />

The Commission Decision of 29 April 2008 imposing special conditions on guar gum<br />

originating from India requires that all consignments of guar gum or products containing guar<br />

gum at significant amounts originating in or consigned from India, which left India after 4<br />

May 2008 and imported into the Community intended for human or animal consumption,<br />

shall be accompanied by an original analytical report issued by a laboratory accredited<br />

according EN ISO/IEC 17025 for the analysis of PCP in food and feed or by a laboratory that<br />

is pursuing the necessary accreditation procedures and which has adequate quality control<br />

schemes in place accompanying the consignment demonstrates that the product does not<br />

contain more than 0.01 mg/kg pentachlorophenol (PCP). The analytical result must be<br />

reported with the expanded measurement uncertainty. The analytical report shall be<br />

endorsed by a representative of the competent authority from the country where the<br />

laboratory is located.<br />

As regards analytical reports endorsed by the competent authority of India, according the<br />

findings of the FVO, the Vimta Labs, Hyderabad, Andhra Pradesh is the only laboratory<br />

in India which fulfils the requirement of accreditation and/or having in place the<br />

appropriate quality control schemes.<br />

As regards the laboratories in the European Union, in order to reduce the administrative<br />

burden, it was agreed that a list of laboratories within the EU authorised to perform the PCP<br />

analysis would be established and put on the SANCO website. Analytical reports from these<br />

laboratories are considered to be endorsed automatically by the competent authority of the<br />

country where the laboratory is located.<br />

Based upon the information received from the competent authorities a list of<br />

laboratories from which the analytical reports are considered as automatically endorsed<br />

has been compiled and is available in Annex.<br />

Analytical reports from other laboratories in the EU need to be each<br />

individually endorsed by the competent authority of the country where the<br />

laboratory is located in order to be acceptable for authorisation of import<br />

of guar gum or products containing guar gum originating from India !
