8.6. The Department may publish the completed Report. The documents should
therefore include all necessary figures, charts, diagrams, etc. required to illustrate
and communicate the contents to the reader.
9. EXCLUSION CRITERIA.
9.1 Any tenderer may be excluded from participation in this Request for Tenders
who-
(a) is bankrupt or is being wound up, whose affairs are being administered by a
court of law, who has entered into an arrangement with creditors or who is in
any analogous situation arising from a similar procedure under national laws
and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an order for
compulsory winding–up or administration by a court of law or for an
arrangement with creditors or is the subject of any other similar proceedings
under national laws or regulations;
(c) has been convicted of an offence concerning his or her professional conduct
by a judgment which has the force of res judicata;
(d) has been guilty of grave professional misconduct proven by any means which
the steering group can justify;
(e) has not fulfilled obligations relating to the payment of social security
contributions in accordance with the legal provisions of the country in which
he or she is established or those of the Republic of Ireland;
(f) has not fulfilled obligations relating to the payment of taxes in accordance
with the legal provisions of the country in which he or she is established or
those of the Republic of Ireland;
(g) is guilty of serious misrepresentation in supplying the information required
under this Request for Tenders.
10. FREEDOM OF INFORMATION ACTS 1997 and 2003.
10.1. The Department of the Environment, Community and Local Government
proposes that the following information relating to this tender competition will be
made available on request: -
(a) award criteria
(b) reasons to unsuccessful candidates as to why their application was
rejected.
10.2. The Department of the Environment, Community and Local Government
undertakes to hold confidential any information provided by tenderers subject
to: -
(a) disclosure of the information specified at 7.1 (a) above as liable for release
to the public
(b) the Client’s obligations under law, including the Freedom of Information Acts
1997 and 2003.
10.3. Tenderers are asked to consider if any of the information supplied by them in
their tender should not be disclosed because of its sensitivity, other than that
referred to at 11.1 (a) above. If this is the case, they should, when providing the
