consult with the tenderers about sensitive information before making a decision
on any Freedom of Information request received.
10.4. If tenderers consider that none of the information supplied by them is sensitive,
they are requested to make a statement to that effect. Such information may be
released in response to a Freedom of Information request.
10.5. Similarly, the Department of the Environment, Community and Local
Government requires that all information provided pursuant to this invitation to
tender will be treated in strict confidence by tenderers.
11. DISPUTES.
11.1 Any irreconcilable dispute arising during the appointment as Consultant shall be
referred to the arbitration of a person to be mutually agreed upon and any such
reference shall be deemed to be a submission to arbitration within the meaning of
the Arbitration Act, 1954 or any statutory re-enactment for the time being in force.
11.2 Where, at any stage during the project, the work being undertaken by the
Consultant is found to be unsatisfactory, the project may be terminated by the
Department with seven days’ notice. In such circumstances, the Department’s
total liability will not exceed an amount calculated as the total cost based on the
number of days of the project completed as a proportion of the total number of
days agreed for the project.
12. DEADLINE FOR RECEIPT OF APPLICATIONS.
12.1 Eight (8) copies of the applicant’s written proposal should be sent by registered
post or recorded delivery by hand clearly marked “Review of the Producer
Responsibility Initiative” and addressed to Mr. Roger Harrington, Environment
Policy and Awareness Section, Department of the Environment, Community,
and Local Government, Newtown Road, Co. Wexford, Ireland to arrive not later
than 17.00 on Tuesday 15 th May 2012. Sole responsibility for meeting this
deadline rests with the applicant. Late or incomplete or faxed proposals will not
be considered. Late delivery of proposals by a third party will not be
entertained.
