Introduction<br />

Croatia is situated at the crossroads <strong>of</strong> Central Europe, the Balkans and<br />

Mediterranean and has come to be recognized as a country with potential<br />

and economic <strong>opportunities</strong>. Croatia jo<strong>in</strong>ed NATO on April 1, 2009 and is<br />

due to become the 28th member State <strong>of</strong> the European Union on July 1,<br />

2013. It is also a member <strong>of</strong> the United Nations, the World Trade<br />

Organization and the Central European Free Trade Association (CEFTA).<br />

Even though Croatia is a small country with a population <strong>of</strong> 4.5 million, its<br />

CEFTA membership and impend<strong>in</strong>g accession to the European Union<br />

gives it free access to a large geographical area cover<strong>in</strong>g many high<br />

<strong>in</strong>come and densely populated European countries.<br />

Presently Croatia’s economy is dom<strong>in</strong>ated by the service sector though the<br />

contribution <strong>of</strong> <strong>in</strong>dustry and agriculture is also significant. The European<br />

Union and the Balkans are the ma<strong>in</strong> trade partners <strong>of</strong> Croatia. It presently<br />

has a total <strong>for</strong>eign trade <strong>of</strong> US$32.69 billion with exports <strong>of</strong> US$12.29<br />

billion and imports <strong>of</strong> US$20.40 billion.<br />

Croatia has positioned itself favourably <strong>for</strong> the future with its highly<br />

developed <strong>in</strong>frastructure, education and technical tra<strong>in</strong><strong>in</strong>g facilities. Its<br />

capabilities <strong>in</strong> basic sciences are well recognized. With these advantages<br />

Croatia is now endeavour<strong>in</strong>g to make advances <strong>in</strong> develop<strong>in</strong>g technology<br />

through <strong>in</strong>vestments <strong>in</strong> research and development and <strong>in</strong>novation. Foreign<br />

<strong>in</strong>vestment also constitutes a high policy priority with a view to develop<strong>in</strong>g<br />

the nation’s economy. Total <strong>for</strong>eign <strong>in</strong>vestments <strong>in</strong> Croatia are valued at<br />

US$32.50 billion.<br />

India established its diplomatic relations with Croatia <strong>in</strong> 1992 and its<br />

engagement has been gradually grow<strong>in</strong>g. Bilateral trade dur<strong>in</strong>g the year<br />

2011 was valued at US$198 million with India’s exports <strong>of</strong> US$167<br />

million and imports <strong>of</strong> US$31 million. A few <strong>Indian</strong> <strong>in</strong>vestments have also<br />

been made.<br />

This publication seeks to provide the <strong>Indian</strong> <strong>bus<strong>in</strong>ess</strong> and <strong>in</strong>vestor<br />

community with an overview <strong>of</strong> the technological capabilities <strong>in</strong> Croatia’s<br />

small and medium scale enterprises. Many <strong>of</strong> these Croatian companies<br />

have technologies that may be <strong>of</strong> <strong>in</strong>terest and relevance to India. The<br />

advantage <strong>of</strong> engag<strong>in</strong>g with these Croatian companies would be <strong>for</strong> <strong>Indian</strong><br />

<strong>bus<strong>in</strong>ess</strong> entities to have a presence <strong>in</strong> a country which is soon to be a<br />

member <strong>of</strong> the EU, have exist<strong>in</strong>g clients <strong>in</strong> the region and have free trade<br />

access to the Balkans and the European Union. Various <strong>for</strong>ms <strong>of</strong><br />

collaboration <strong>in</strong>clud<strong>in</strong>g technology transfer, technical collaboration,<br />

mergers and acquisitions can be considered <strong>for</strong> the mutual benefit <strong>of</strong> both<br />

the <strong>Indian</strong> and Croatian partners.<br />

While all ef<strong>for</strong>ts have been made to provide relevant <strong>in</strong><strong>for</strong>mation <strong>of</strong> the<br />

Invest<strong>in</strong>g <strong>in</strong> Croatia<br />

Direct <strong>for</strong>eign <strong>in</strong>vestment<br />

Due to the global economic crisis and <strong>in</strong>vestors’ aversions to risk, value <strong>of</strong><br />

direct <strong>for</strong>eign <strong>in</strong>vestment <strong>in</strong> Croatia decl<strong>in</strong>ed s<strong>in</strong>ce 2008. Dur<strong>in</strong>g the first<br />

three quarters <strong>of</strong> 2010, total <strong>for</strong>eign <strong>in</strong>vestment <strong>in</strong> the Republic <strong>of</strong> Croatia<br />

was EUR 1.2 billion, which is 30.8% less than <strong>in</strong> 2009 and more than 50%<br />

less compar<strong>in</strong>g to 2008. India and Croatia have signed a Bilateral<br />

Investment Promotion and Protection Agreement.<br />

Investment <strong>in</strong>centives<br />

Investment is regulated by the Investment Incentives Act (Official Gazette<br />

No. 138/06) that governs <strong>for</strong>eign and domestic <strong>in</strong>vestment <strong>in</strong> the Republic<br />

<strong>of</strong> Croatia.<br />

The <strong>in</strong>centive measures regulated by the Investment Promotion Act apply<br />

to projects cover<strong>in</strong>g:<br />

a) The manufactur<strong>in</strong>g sector activities;<br />

b) Technological development and <strong>in</strong>novation centres;<br />

c) Strategic <strong>bus<strong>in</strong>ess</strong> support services;<br />

The projects must at the same time ensure an environmentally friendly<br />

economic activity and achievement <strong>of</strong> one or more <strong>of</strong> the follow<strong>in</strong>g<br />

objectives:<br />

• Introduction <strong>of</strong> new equipment and state-<strong>of</strong>-the-art technologies;<br />

• Introduction <strong>of</strong> new production processes and new products;<br />

• Increase <strong>in</strong> employment and a higher level <strong>of</strong> tra<strong>in</strong><strong>in</strong>g <strong>of</strong><br />

employees;<br />

• Modernisation and improvement <strong>of</strong> per<strong>for</strong>mance;<br />

• Development <strong>of</strong> production processes <strong>in</strong>volv<strong>in</strong>g more value added<br />

products;<br />

• Increase <strong>in</strong> <strong>in</strong>ternational economic activities;<br />

• Increase <strong>in</strong> economic activities <strong>in</strong> the parts <strong>of</strong> the Republic <strong>of</strong><br />

Croatia where the economic growth and employment rate fall<br />

beh<strong>in</strong>d the national average and <strong>in</strong> compliance with a map <strong>of</strong><br />

government grants on the regional level;<br />

• Development <strong>in</strong> respect <strong>of</strong> the provision <strong>of</strong> new services;<br />

• Energy sav<strong>in</strong>g;<br />

• Enhancement <strong>of</strong> IT activities;<br />

• Cooperation with <strong>for</strong>eign f<strong>in</strong>ancial <strong>in</strong>stitutions;<br />

• Adjustment <strong>of</strong> the Croatian economy to the European standards.<br />

An <strong>in</strong>vestment or <strong>in</strong>itial <strong>in</strong>vestment means <strong>in</strong>vestment <strong>in</strong> fixed assets<br />

entered <strong>in</strong>to the property <strong>of</strong> the recipient <strong>of</strong> <strong>in</strong>centive measures amount<strong>in</strong>g<br />

to a m<strong>in</strong>imum HRK equivalent <strong>of</strong> EUR 300,000.00, and relates to the<br />

sett<strong>in</strong>g-up <strong>of</strong> a new company, the expansion <strong>of</strong> an exist<strong>in</strong>g company or the<br />

start<strong>in</strong>g-up <strong>of</strong> an activity <strong>in</strong>volv<strong>in</strong>g a fundamental change <strong>in</strong> the product or<br />

production process <strong>of</strong> an exist<strong>in</strong>g company. Replacement <strong>in</strong>vestments are<br />

excluded and are not a part <strong>of</strong> the amount <strong>of</strong> <strong>in</strong>itial <strong>in</strong>vestment. Pursuant to<br />

the Act, regional government grants may not be granted to companies <strong>in</strong><br />

difficulty and companies <strong>in</strong> the steel and synthetic fibres sectors.<br />

A recipient <strong>of</strong> <strong>in</strong>centive measures may be a company registered on the<br />

territory <strong>of</strong> the Republic <strong>of</strong> Croatia which uses <strong>in</strong>centive measures or to<br />

which aid <strong>for</strong> <strong>in</strong>itial <strong>in</strong>vestment is granted. A company that wants to<br />

benefit from a grant <strong>for</strong> <strong>in</strong>itial <strong>in</strong>vestment must submit a grant application<br />

to the M<strong>in</strong>istry <strong>of</strong> the Economy, Labour and Entrepreneurship be<strong>for</strong>e an<br />

<strong>in</strong>vestment project is launched.<br />

The <strong>in</strong>centive measures are:<br />

1. Tax concessions;<br />

2. Tariff concessions;<br />

3. Grant to cover eligible costs <strong>of</strong> creat<strong>in</strong>g new <strong>in</strong>vestment-related jobs;<br />

4. Grant to cover eligible costs <strong>of</strong> <strong>in</strong>vestment-related tra<strong>in</strong><strong>in</strong>g;<br />

5. Incentive measures <strong>for</strong> the establishment and development <strong>of</strong>:<br />

• Technological development and <strong>in</strong>novation centres, and;<br />

• Strategic <strong>bus<strong>in</strong>ess</strong> support services;<br />

6. Incentive measures <strong>for</strong> large <strong>in</strong>vestment projects – <strong>in</strong>vestment projects<br />

<strong>of</strong> significant economic <strong>in</strong>terest.<br />

The total amount <strong>of</strong> the tax concession to which the recipient <strong>of</strong> <strong>in</strong>centive<br />

measures is entitled with<strong>in</strong> the period <strong>of</strong> use <strong>of</strong> the concession must be<br />

expressed <strong>in</strong> an absolute amount result<strong>in</strong>g from the difference between the<br />

due amount <strong>of</strong> pr<strong>of</strong>it tax calculated pursuant to the Pr<strong>of</strong>it tax act and the<br />

amount calculated pursuant to the Investment promotion act, thereby<br />

tak<strong>in</strong>g <strong>in</strong>to account the maximum permitted amount <strong>of</strong> <strong>in</strong>centives.<br />

If the recipient <strong>of</strong> <strong>in</strong>centive measures fails to fulfil the criteria concern<strong>in</strong>g<br />

the creation <strong>of</strong> new jobs or reduces the number <strong>of</strong> jobs, he/she will be<br />

denied the right to use the tax concession <strong>for</strong> entire period <strong>for</strong> which it was<br />

granted and must return the funds derived from the use <strong>of</strong> the tax<br />

concession <strong>in</strong>creased by the statutory <strong>in</strong>terest on arrears. The recipient <strong>of</strong><br />

<strong>in</strong>centive measures must reta<strong>in</strong> eligibility status by keep<strong>in</strong>g the <strong>in</strong>vestment<br />

and related new jobs dur<strong>in</strong>g a m<strong>in</strong>imum period <strong>of</strong> 5 years, and this period<br />

will not be shorter than the period <strong>in</strong> which he makes use <strong>of</strong> the <strong>in</strong>centive<br />

measures.<br />

Tariff concessions<br />

The imported equipment that constitutes part <strong>of</strong> the <strong>in</strong>vestment is not<br />

subject to the payment <strong>of</strong> customs duties (<strong>in</strong> accordance with customs<br />

tariffs under sections 84, 85, 86, 87, 88, 89, and 90 <strong>of</strong> the Customs tariff<br />

act). However, tariff concessions <strong>for</strong> <strong>in</strong>vestments will cease to have effect<br />

on the day <strong>of</strong> accession <strong>of</strong> the Republic <strong>of</strong> Croatia to the European Union.<br />

Grant to cover eligible costs <strong>of</strong> creat<strong>in</strong>g new <strong>in</strong>vestmentrelated<br />

jobs<br />

An <strong>in</strong>vestor is entitled to a grant if he/she hires workers with<strong>in</strong> their own<br />

facilities. The amount <strong>of</strong> the grant is determ<strong>in</strong>ed on the basis <strong>of</strong> the<br />

unemployment rate <strong>in</strong> the area where funds are <strong>in</strong>vested and jobs created.<br />

Grants are def<strong>in</strong>ed on the basis <strong>of</strong> the follow<strong>in</strong>g criteria (<strong>in</strong> EUR):<br />

Grant to cover eligible costs <strong>of</strong> <strong>in</strong>vestment-related tra<strong>in</strong><strong>in</strong>g<br />

The recipient <strong>of</strong> <strong>in</strong>centive measures who ensures the creation <strong>of</strong> new<br />

<strong>in</strong>vestment-related jobs is awarded a grant <strong>for</strong> tra<strong>in</strong><strong>in</strong>g <strong>of</strong> employees <strong>in</strong> the<br />

new jobs. A grant may be awarded <strong>in</strong> the <strong>for</strong>m <strong>of</strong>:<br />

• Grants <strong>for</strong> general tra<strong>in</strong><strong>in</strong>g that <strong>in</strong>volves acquisition <strong>of</strong> general<br />

knowledge used <strong>in</strong> the present or future job provided by the<br />

recipient <strong>of</strong> <strong>in</strong>centive measures who uses government grant. Such<br />

tra<strong>in</strong><strong>in</strong>g is transferable to other enterprises or activities and thereby<br />

substantially improves the hir<strong>in</strong>g potential. Tra<strong>in</strong><strong>in</strong>g is considered<br />

general if it meets the follow<strong>in</strong>g criteria: it is jo<strong>in</strong>tly organised by<br />

different <strong>in</strong>dependent entrepreneurs or if employees <strong>of</strong> different<br />

entrepreneurs may make use <strong>of</strong> the tra<strong>in</strong><strong>in</strong>g; if it is recognised,<br />

certified or validated by state adm<strong>in</strong>istration bodies or other<br />

authorized bodies or <strong>in</strong>stitutions <strong>of</strong> the Republic <strong>of</strong> Croatia.<br />

• Grants <strong>for</strong> specific tra<strong>in</strong><strong>in</strong>g which is <strong>in</strong>tended <strong>for</strong> the acquisition <strong>of</strong><br />

theoretical knowledge and practical skills used <strong>in</strong> the present or<br />

future job provided by the recipient <strong>of</strong> <strong>in</strong>centive measures who uses<br />

government grant, is not transferable or is transferable to a limited<br />

degree to other enterprises or activities.<br />

The eligible tra<strong>in</strong><strong>in</strong>g costs are: tra<strong>in</strong>er’s costs; tra<strong>in</strong>er’s and tra<strong>in</strong>ees’ travel<br />

the total amount <strong>of</strong> all eligible costs. Only the hours, dur<strong>in</strong>g which the<br />

tra<strong>in</strong>ees actually participate <strong>in</strong> the tra<strong>in</strong><strong>in</strong>g, after deduction <strong>of</strong> any<br />

productive hours or <strong>of</strong> their equivalent, is taken <strong>in</strong>to account.<br />

Incentive measures <strong>for</strong> the establishment <strong>of</strong> technology and<br />

<strong>in</strong>novation centres with strategic <strong>bus<strong>in</strong>ess</strong> support services<br />

In the case <strong>of</strong> projects on the establishment and development <strong>of</strong> technology<br />

and <strong>in</strong>novation centres; the establishment and development <strong>of</strong> strategic<br />

<strong>bus<strong>in</strong>ess</strong> support services, <strong>in</strong>centive measures will be granted <strong>for</strong> the<br />

follow<strong>in</strong>g types <strong>of</strong> projects:<br />

1. Technological development and <strong>in</strong>novation centres – Development<br />

and <strong>in</strong>novation <strong>of</strong> high-tech products and production processes<br />

which enable the exploitation <strong>of</strong> the development and <strong>in</strong>novation<br />

activities concerned and improve the production provid<strong>in</strong>g <strong>for</strong> the<br />

enhancement <strong>of</strong> products, production series, production processes,<br />

and production technologies.<br />

2. Strategic <strong>bus<strong>in</strong>ess</strong> support services – these can be divided as<br />

follows:<br />

• Customer Contact Centres – all types <strong>of</strong> call-centres, multi-media<br />

contact centres and other types <strong>of</strong> customer contact centres focused<br />

on technical support and address<strong>in</strong>g customers’ problems.<br />

• Shared Services Centres - focused on outsourc<strong>in</strong>g and pool<strong>in</strong>g <strong>of</strong><br />

corporate activities <strong>of</strong> mult<strong>in</strong>ational companies <strong>in</strong> the areas such as:<br />

f<strong>in</strong>ances, account<strong>in</strong>g, market<strong>in</strong>g, development <strong>of</strong> human resources<br />

and IT.<br />

• Logistics and Distribution Centres – focused on the establishment<br />

and construction <strong>of</strong> high-tech logistics and distribution centres<br />

enabl<strong>in</strong>g <strong>in</strong>termodal transport <strong>of</strong> goods, warehous<strong>in</strong>g, packag<strong>in</strong>g<br />

and handl<strong>in</strong>g <strong>of</strong> goods <strong>in</strong> order to significantly improve logistics<br />

and distribution activities with<strong>in</strong> <strong>bus<strong>in</strong>ess</strong> processes and delivery <strong>of</strong><br />

goods to local and <strong>in</strong>ternational customers.<br />

• ICT Centres – engaged <strong>in</strong> the development and application <strong>of</strong> IT<br />

systems at a corporate level, management <strong>of</strong> IT systems, and<br />

development <strong>of</strong> telecommunications network operation centres.<br />

• S<strong>of</strong>tware Development Centres – development and application <strong>of</strong><br />

new s<strong>of</strong>tware solutions <strong>for</strong> local and <strong>in</strong>ternational customers.<br />

In addition to the <strong>in</strong>centive measures <strong>for</strong>eseen <strong>for</strong> the projects concern<strong>in</strong>g<br />

the establishment and development <strong>of</strong> technological development and<br />

<strong>in</strong>novation centres, an additional <strong>in</strong>crease <strong>in</strong> the grant to cover the creation<br />

<strong>of</strong> new <strong>in</strong>vestment-related jobs by 50% <strong>of</strong> the def<strong>in</strong>ed amount will be<br />

granted.<br />

In addition to the <strong>in</strong>centive measures <strong>for</strong>eseen <strong>for</strong> the projects concern<strong>in</strong>g<br />

the establishment and development <strong>of</strong> strategic <strong>bus<strong>in</strong>ess</strong> support services,<br />

an additional <strong>in</strong>crease <strong>in</strong> the grant to cover the creation <strong>of</strong> new <strong>in</strong>vestmentrelated<br />

jobs by 25% <strong>of</strong> the def<strong>in</strong>ed amount will be granted.<br />

For the projects concern<strong>in</strong>g the establishment and development <strong>of</strong><br />

technological development and <strong>in</strong>novation centres, a grant will be<br />

approved <strong>for</strong> fixed assets or <strong>for</strong> the purchase <strong>of</strong> equipment <strong>for</strong> the<br />

technological development and <strong>in</strong>novation centre not exceed<strong>in</strong>g 5% <strong>of</strong> the<br />

actual eligible equipment purchase costs, with the maximum amount not<br />

exceed<strong>in</strong>g a HRK equivalent <strong>of</strong> EUR 0.5 million, provided that the<br />

purchased equipment <strong>for</strong> the technological development and <strong>in</strong>novation<br />

centre is high-tech equipment. The grant will be provided from the state<br />

budget under the M<strong>in</strong>istry’s head<strong>in</strong>g.<br />

Incentive measures <strong>for</strong> large <strong>in</strong>vestment projects –<br />

<strong>in</strong>vestment projects <strong>of</strong> significant economic <strong>in</strong>terest<br />

In the case <strong>of</strong> large <strong>in</strong>vestment projects <strong>of</strong> significant economic <strong>in</strong>terest,<br />

the follow<strong>in</strong>g parameters are set accord<strong>in</strong>g to which projects are prioritised<br />

and will be taken <strong>in</strong>to account: the amount and significance <strong>of</strong> <strong>in</strong>vestment<br />

<strong>for</strong> overall economic development and employment; uni<strong>for</strong>m regional<br />

development; the development <strong>of</strong> areas where the registered<br />

unemployment rate exceeds the national average; the development <strong>of</strong> the<br />

branch <strong>of</strong> <strong>in</strong>dustry <strong>in</strong>to which the <strong>in</strong>vestment is made.<br />

A large <strong>in</strong>vestment project or an <strong>in</strong>vestment project <strong>of</strong> significant<br />

economic <strong>in</strong>terest is a project which <strong>in</strong>volves a large economic activity,<br />

such as the construction <strong>of</strong> a new factory or <strong>in</strong>dustrial plant, start<strong>in</strong>g up <strong>of</strong><br />

a new economic activity, as well as the development <strong>of</strong> new technologies,<br />

and <strong>in</strong>vestment projects with the value <strong>of</strong> <strong>in</strong>vestment <strong>in</strong> fixed assets <strong>of</strong> the<br />

recipient <strong>of</strong> <strong>in</strong>vestment measures <strong>of</strong> at least EUR 15 million <strong>in</strong> HRK<br />

equivalent, provided that a m<strong>in</strong>imum <strong>of</strong> 100 now <strong>in</strong>vestment-related jobs is<br />

created, start<strong>in</strong>g from the end <strong>of</strong> the first year <strong>of</strong> <strong>in</strong>vestment.<br />

For large <strong>in</strong>vestment projects <strong>in</strong> the regions (counties) <strong>of</strong> the Republic <strong>of</strong><br />

Croatia where the registered unemployment rate accord<strong>in</strong>g to the data <strong>of</strong><br />

the Croatian Bureau <strong>of</strong> Statistics <strong>for</strong> the preced<strong>in</strong>g year exceeds 20%, the<br />

recipient <strong>of</strong> <strong>in</strong>centive measures will be granted an <strong>in</strong>crease <strong>in</strong> the <strong>in</strong>centive<br />

measures provided <strong>for</strong> by this Act not exceed<strong>in</strong>g 5% <strong>of</strong> the actual eligible<br />

costs <strong>of</strong> <strong>in</strong>vestment <strong>in</strong>to fixed assets:<br />

• For the costs <strong>of</strong> construct<strong>in</strong>g a new factory or <strong>in</strong>dustrial plant;<br />

• For the costs <strong>of</strong> purchase <strong>of</strong> new mach<strong>in</strong>es or manufactur<strong>in</strong>g<br />

equipment <strong>in</strong> the total maximum HRK equivalent value <strong>of</strong> up to<br />

EUR 1 million, provided that the share <strong>of</strong> <strong>in</strong>vestment <strong>in</strong>to<br />

mach<strong>in</strong>ery or manufactur<strong>in</strong>g equipment accounts <strong>for</strong> at least 40% <strong>of</strong><br />

the total <strong>in</strong>vestment value and that at least 50% <strong>of</strong> the purchased<br />

mach<strong>in</strong>ery or manufactur<strong>in</strong>g equipment is high-tech mach<strong>in</strong>ery or<br />

equipment.<br />

• For large <strong>in</strong>vestment projects whose implementation implies the<br />

construction <strong>of</strong> new <strong>in</strong>vestment-related <strong>in</strong>frastructure facilities and<br />

<strong>in</strong>stallations or extension or enlargement <strong>of</strong> exist<strong>in</strong>g ones, a grant<br />

not exceed<strong>in</strong>g 5 % <strong>of</strong> the actual costs <strong>of</strong> the construction <strong>of</strong> new or<br />

extension or enlargement <strong>of</strong> the exist<strong>in</strong>g <strong>in</strong>frastructure facilities and<br />

<strong>in</strong>stallations will be awarded, subject to the maximum amount <strong>of</strong><br />

EUR 500,000 <strong>in</strong> HRK equivalent.<br />

Depend<strong>in</strong>g on the <strong>in</strong>vestment amount, the maximum grant <strong>for</strong> large<br />

<strong>in</strong>vestment projects will amount to:<br />

• For an <strong>in</strong>vestment not exceed<strong>in</strong>g a HRK equivalent <strong>of</strong> EUR 50<br />

million, the maximum overall grant will be 100 % <strong>of</strong> the eligible<br />

costs ceil<strong>in</strong>g determ<strong>in</strong>ed by the approved map <strong>of</strong> regional<br />

government grants;<br />

• For an <strong>in</strong>vestment <strong>in</strong> the amount from EUR 50 to 100 million <strong>in</strong><br />

HRK equivalent, the maximum overall grant will be 50 % <strong>of</strong> the<br />

eligible costs ceil<strong>in</strong>g determ<strong>in</strong>ed by the approved map <strong>of</strong> regional<br />

government grants;<br />

• For an <strong>in</strong>vestment exceed<strong>in</strong>g a HRK equivalent <strong>of</strong> EUR 100<br />

million, the maximum overall grant will be 34 % <strong>of</strong> the eligible<br />

costs ceil<strong>in</strong>g determ<strong>in</strong>ed by the approved map <strong>of</strong> regional<br />

government grants.<br />

Approval and supervision<br />

Legal persons, who <strong>in</strong>tend to use the <strong>in</strong>centive measures on the basis <strong>of</strong> the<br />

Investment Promotion Act can apply <strong>for</strong> <strong>in</strong>centive measures at the M<strong>in</strong>istry<br />

<strong>of</strong> Economy, Labour and Entrepreneurship prior to the commencement <strong>of</strong><br />

<strong>in</strong>vestment operations.<br />

On the basis <strong>of</strong> the submitted application, the M<strong>in</strong>istry will, <strong>in</strong> cooperation<br />

with the M<strong>in</strong>istry <strong>of</strong> F<strong>in</strong>ance and the m<strong>in</strong>istries with jurisdiction over the<br />

proposed <strong>in</strong>vestment, as well as with other authorities competent <strong>for</strong><br />

<strong>in</strong>vestment promotion activities establish whether the submitted<br />

application complies with the provisions <strong>of</strong> the Act and will <strong>in</strong><strong>for</strong>m the<br />

applicant there<strong>of</strong> and issue a Certificate on the eligibility status <strong>of</strong> the<br />

recipient <strong>of</strong> <strong>in</strong>centive measures not later than 60 days from the day <strong>of</strong> the<br />

receipt <strong>of</strong> the application.<br />

Dur<strong>in</strong>g the period <strong>in</strong> which <strong>in</strong>centive measures are used, the recipients <strong>of</strong><br />

<strong>in</strong>centive measures must submit written annual reports on the use <strong>of</strong> the<br />

<strong>in</strong>centive measures to the M<strong>in</strong>istry <strong>of</strong> Economy, Labour and<br />

Entrepreneurship and to the M<strong>in</strong>istry <strong>of</strong> F<strong>in</strong>ance, Tax Adm<strong>in</strong>istration. The<br />

annual reports must be submitted together with the pr<strong>of</strong>it tax declaration <strong>in</strong><br />

accordance with the deadl<strong>in</strong>es laid down by the Pr<strong>of</strong>it Tax Act.<br />

If the recipient <strong>of</strong> <strong>in</strong>centive measures, tax concessions and tariff<br />

concessions fails to submit the report with<strong>in</strong> the specified deadl<strong>in</strong>e, his<br />

right to use the approved <strong>in</strong>centive measures will be revoked and his status<br />

<strong>of</strong> the recipient <strong>of</strong> <strong>in</strong>centive measures will be withdrawn.<br />

The mandatory content <strong>of</strong> the application <strong>for</strong> obta<strong>in</strong><strong>in</strong>g the status <strong>of</strong> the<br />

recipient <strong>of</strong> <strong>in</strong>centive measures together with accompany<strong>in</strong>g standard<br />

<strong>for</strong>ms, the procedures <strong>of</strong> apply<strong>in</strong>g <strong>for</strong>, approv<strong>in</strong>g and us<strong>in</strong>g <strong>in</strong>centive<br />

measures, as well as the content <strong>of</strong> the report on the use <strong>of</strong> <strong>in</strong>centive<br />

measures is def<strong>in</strong>ed by the government <strong>of</strong> the Republic <strong>of</strong> Croatia by a<br />

regulation.<br />

The companies which use <strong>in</strong>centive measures, tax concessions and tariff<br />

concessions <strong>for</strong> <strong>in</strong>vestment reta<strong>in</strong> the right to use the approved <strong>in</strong>centive<br />

measures, tax concessions and tariff concessions until the expiry <strong>of</strong> the<br />

period <strong>for</strong> which these were approved.<br />
