Introduction 

Croatia is situated at the crossroads of Central Europe, the Balkans and 

Mediterranean and has come to be recognized as a country with potential 

and economic opportunities. Croatia joined NATO on April 1, 2009 and is 

due to become the 28th member State of the European Union on July 1, 

2013. It is also a member of the United Nations, the World Trade 

Organization and the Central European Free Trade Association (CEFTA). 

Even though Croatia is a small country with a population of 4.5 million, its 

CEFTA membership and impending accession to the European Union 

gives it free access to a large geographical area covering many high 

income and densely populated European countries. 

Presently Croatia’s economy is dominated by the service sector though the 

contribution of industry and agriculture is also significant. The European 

Union and the Balkans are the main trade partners of Croatia. It presently 

has a total foreign trade of US$32.69 billion with exports of US$12.29 

billion and imports of US$20.40 billion. 

Croatia has positioned itself favourably for the future with its highly 

developed infrastructure, education and technical training facilities. Its 

capabilities in basic sciences are well recognized. With these advantages 

Croatia is now endeavouring to make advances in developing technology 

through investments in research and development and innovation. Foreign 

investment also constitutes a high policy priority with a view to developing 

the nation’s economy. Total foreign investments in Croatia are valued at 

US$32.50 billion. 

India established its diplomatic relations with Croatia in 1992 and its 

engagement has been gradually growing. Bilateral trade during the year 

2011 was valued at US$198 million with India’s exports of US$167 

million and imports of US$31 million. A few Indian investments have also 

been made.

This publication seeks to provide the Indian business and investor 

community with an overview of the technological capabilities in Croatia’s 

small and medium scale enterprises. Many of these Croatian companies 

have technologies that may be of interest and relevance to India. The 

advantage of engaging with these Croatian companies would be for Indian 

business entities to have a presence in a country which is soon to be a 

member of the EU, have existing clients in the region and have free trade 

access to the Balkans and the European Union. Various forms of 

collaboration including technology transfer, technical collaboration, 

mergers and acquisitions can be considered for the mutual benefit of both 

the Indian and Croatian partners.

Investing in Croatia 

Direct foreign investment 

Due to the global economic crisis and investors’ aversions to risk, value of 

direct foreign investment in Croatia declined since 2008. During the first 

three quarters of 2010, total foreign investment in the Republic of Croatia 

was EUR 1.2 billion, which is 30.8% less than in 2009 and more than 50% 

less comparing to 2008. India and Croatia have signed a Bilateral 

Investment Promotion and Protection Agreement.

Investment incentives 

Investment is regulated by the Investment Incentives Act (Official Gazette 

No. 138/06) that governs foreign and domestic investment in the Republic 

of Croatia.

The incentive measures regulated by the Investment Promotion Act apply 

to projects covering: 

a) The manufacturing sector activities; 

b) Technological development and innovation centres; 

c) Strategic business support services; 

The projects must at the same time ensure an environmentally friendly 

economic activity and achievement of one or more of the following 

objectives: 

• Introduction of new equipment and state-of-the-art technologies; 

• Introduction of new production processes and new products; 

• Increase in employment and a higher level of training of 

employees; 

• Modernisation and improvement of performance; 

• Development of production processes involving more value added 

products; 

• Increase in international economic activities; 

• Increase in economic activities in the parts of the Republic of 

Croatia where the economic growth and employment rate fall 

behind the national average and in compliance with a map of 

government grants on the regional level; 

• Development in respect of the provision of new services; 

• Energy saving; 

• Enhancement of IT activities; 

• Cooperation with foreign financial institutions; 

• Adjustment of the Croatian economy to the European standards. 

An investment or initial investment means investment in fixed assets 

entered into the property of the recipient of incentive measures amounting 

to a minimum HRK equivalent of EUR 300,000.00, and relates to the 

setting-up of a new company, the expansion of an existing company or the 

starting-up of an activity involving a fundamental change in the product or 

production process of an existing company. Replacement investments are 

excluded and are not a part of the amount of initial investment. Pursuant to

the Act, regional government grants may not be granted to companies in 

difficulty and companies in the steel and synthetic fibres sectors. 

A recipient of incentive measures may be a company registered on the 

territory of the Republic of Croatia which uses incentive measures or to 

which aid for initial investment is granted. A company that wants to 

benefit from a grant for initial investment must submit a grant application 

to the Ministry of the Economy, Labour and Entrepreneurship before an 

investment project is launched. 

The incentive measures are: 

1. Tax concessions; 

2. Tariff concessions; 

3. Grant to cover eligible costs of creating new investment-related jobs; 

4. Grant to cover eligible costs of investment-related training; 

5. Incentive measures for the establishment and development of: 

• Technological development and innovation centres, and; 

• Strategic business support services; 

6. Incentive measures for large investment projects – investment projects 

of significant economic interest. 

The total amount of the tax concession to which the recipient of incentive 

measures is entitled within the period of use of the concession must be 

expressed in an absolute amount resulting from the difference between the 

due amount of profit tax calculated pursuant to the Profit tax act and the 

amount calculated pursuant to the Investment promotion act, thereby 

taking into account the maximum permitted amount of incentives.

If the recipient of incentive measures fails to fulfil the criteria concerning 

the creation of new jobs or reduces the number of jobs, he/she will be 

denied the right to use the tax concession for entire period for which it was 

granted and must return the funds derived from the use of the tax 

concession increased by the statutory interest on arrears. The recipient of 

incentive measures must retain eligibility status by keeping the investment 

and related new jobs during a minimum period of 5 years, and this period 

will not be shorter than the period in which he makes use of the incentive 

measures. 

Tariff concessions 

The imported equipment that constitutes part of the investment is not 

subject to the payment of customs duties (in accordance with customs 

tariffs under sections 84, 85, 86, 87, 88, 89, and 90 of the Customs tariff 

act). However, tariff concessions for investments will cease to have effect 

on the day of accession of the Republic of Croatia to the European Union. 

Grant to cover eligible costs of creating new investmentrelated 

jobs 

An investor is entitled to a grant if he/she hires workers within their own 

facilities. The amount of the grant is determined on the basis of the 

unemployment rate in the area where funds are invested and jobs created. 

Grants are defined on the basis of the following criteria (in EUR):

Grant to cover eligible costs of investment-related training 

The recipient of incentive measures who ensures the creation of new 

investment-related jobs is awarded a grant for training of employees in the 

new jobs. A grant may be awarded in the form of:

• Grants for general training that involves acquisition of general 

knowledge used in the present or future job provided by the 

recipient of incentive measures who uses government grant. Such 

training is transferable to other enterprises or activities and thereby 

substantially improves the hiring potential. Training is considered 

general if it meets the following criteria: it is jointly organised by 

different independent entrepreneurs or if employees of different 

entrepreneurs may make use of the training; if it is recognised, 

certified or validated by state administration bodies or other 

authorized bodies or institutions of the Republic of Croatia. 

• Grants for specific training which is intended for the acquisition of 

theoretical knowledge and practical skills used in the present or 

future job provided by the recipient of incentive measures who uses 

government grant, is not transferable or is transferable to a limited 

degree to other enterprises or activities.

The eligible training costs are: trainer’s costs; trainer’s and trainees’ travel 

costs; other current costs; costs of depreciation of devices and equipment, 

to the extent that they are used for the training project; costs of consulting 

services related to the training project; trainees’ participation costs up to 

the total amount of all eligible costs. Only the hours, during which the 

trainees actually participate in the training, after deduction of any 

productive hours or of their equivalent, is taken into account.

Incentive measures for the establishment of technology and 

innovation centres with strategic business support services 

In the case of projects on the establishment and development of technology 

and innovation centres; the establishment and development of strategic 

business support services, incentive measures will be granted for the 

following types of projects: 

1. Technological development and innovation centres – Development 

and innovation of high-tech products and production processes 

which enable the exploitation of the development and innovation 

activities concerned and improve the production providing for the 

enhancement of products, production series, production processes, 

and production technologies. 

2. Strategic business support services – these can be divided as 

follows: 

• Customer Contact Centres – all types of call-centres, multi-media 

contact centres and other types of customer contact centres focused 

on technical support and addressing customers’ problems. 

• Shared Services Centres - focused on outsourcing and pooling of 

corporate activities of multinational companies in the areas such as: 

finances, accounting, marketing, development of human resources 

and IT. 

• Logistics and Distribution Centres – focused on the establishment 

and construction of high-tech logistics and distribution centres 

enabling intermodal transport of goods, warehousing, packaging 

and handling of goods in order to significantly improve logistics 

and distribution activities within business processes and delivery of 

goods to local and international customers.

• ICT Centres – engaged in the development and application of IT 

systems at a corporate level, management of IT systems, and 

development of telecommunications network operation centres. 

• Software Development Centres – development and application of 

new software solutions for local and international customers. 

In addition to the incentive measures foreseen for the projects concerning 

the establishment and development of technological development and 

innovation centres, an additional increase in the grant to cover the creation 

of new investment-related jobs by 50% of the defined amount will be 

granted. 

In addition to the incentive measures foreseen for the projects concerning 

the establishment and development of strategic business support services, 

an additional increase in the grant to cover the creation of new investmentrelated 

jobs by 25% of the defined amount will be granted. 

For the projects concerning the establishment and development of 

technological development and innovation centres, a grant will be 

approved for fixed assets or for the purchase of equipment for the 

technological development and innovation centre not exceeding 5% of the 

actual eligible equipment purchase costs, with the maximum amount not 

exceeding a HRK equivalent of EUR 0.5 million, provided that the 

purchased equipment for the technological development and innovation 

centre is high-tech equipment. The grant will be provided from the state 

budget under the Ministry’s heading. 

Incentive measures for large investment projects – 

investment projects of significant economic interest 

In the case of large investment projects of significant economic interest, 

the following parameters are set according to which projects are prioritised 

and will be taken into account: the amount and significance of investment 

for overall economic development and employment; uniform regional

development; the development of areas where the registered 

unemployment rate exceeds the national average; the development of the 

branch of industry into which the investment is made. 

A large investment project or an investment project of significant 

economic interest is a project which involves a large economic activity, 

such as the construction of a new factory or industrial plant, starting up of 

a new economic activity, as well as the development of new technologies, 

and investment projects with the value of investment in fixed assets of the 

recipient of investment measures of at least EUR 15 million in HRK 

equivalent, provided that a minimum of 100 now investment-related jobs is 

created, starting from the end of the first year of investment. 

For large investment projects in the regions (counties) of the Republic of 

Croatia where the registered unemployment rate according to the data of 

the Croatian Bureau of Statistics for the preceding year exceeds 20%, the 

recipient of incentive measures will be granted an increase in the incentive 

measures provided for by this Act not exceeding 5% of the actual eligible 

costs of investment into fixed assets: 

• For the costs of constructing a new factory or industrial plant; 

• For the costs of purchase of new machines or manufacturing 

equipment in the total maximum HRK equivalent value of up to 

EUR 1 million, provided that the share of investment into 

machinery or manufacturing equipment accounts for at least 40% of 

the total investment value and that at least 50% of the purchased 

machinery or manufacturing equipment is high-tech machinery or 

equipment. 

• For large investment projects whose implementation implies the 

construction of new investment-related infrastructure facilities and 

installations or extension or enlargement of existing ones, a grant

not exceeding 5 % of the actual costs of the construction of new or 

extension or enlargement of the existing infrastructure facilities and 

installations will be awarded, subject to the maximum amount of 

EUR 500,000 in HRK equivalent. 

Depending on the investment amount, the maximum grant for large 

investment projects will amount to: 

• For an investment not exceeding a HRK equivalent of EUR 50 

million, the maximum overall grant will be 100 % of the eligible 

costs ceiling determined by the approved map of regional 

government grants; 

• For an investment in the amount from EUR 50 to 100 million in 

HRK equivalent, the maximum overall grant will be 50 % of the 

eligible costs ceiling determined by the approved map of regional 

government grants; 

• For an investment exceeding a HRK equivalent of EUR 100 

million, the maximum overall grant will be 34 % of the eligible 

costs ceiling determined by the approved map of regional 

government grants. 

Approval and supervision 

Legal persons, who intend to use the incentive measures on the basis of the 

Investment Promotion Act can apply for incentive measures at the Ministry 

of Economy, Labour and Entrepreneurship prior to the commencement of 

investment operations. 

On the basis of the submitted application, the Ministry will, in cooperation 

with the Ministry of Finance and the ministries with jurisdiction over the 

proposed investment, as well as with other authorities competent for 

investment promotion activities establish whether the submitted 

application complies with the provisions of the Act and will inform the

applicant thereof and issue a Certificate on the eligibility status of the 

recipient of incentive measures not later than 60 days from the day of the 

receipt of the application. 

During the period in which incentive measures are used, the recipients of 

incentive measures must submit written annual reports on the use of the 

incentive measures to the Ministry of Economy, Labour and 

Entrepreneurship and to the Ministry of Finance, Tax Administration. The 

annual reports must be submitted together with the profit tax declaration in 

accordance with the deadlines laid down by the Profit Tax Act. 

If the recipient of incentive measures, tax concessions and tariff 

concessions fails to submit the report within the specified deadline, his 

right to use the approved incentive measures will be revoked and his status 

of the recipient of incentive measures will be withdrawn. 

The mandatory content of the application for obtaining the status of the 

recipient of incentive measures together with accompanying standard 

forms, the procedures of applying for, approving and using incentive 

measures, as well as the content of the report on the use of incentive 

measures is defined by the government of the Republic of Croatia by a 

regulation. 

The companies which use incentive measures, tax concessions and tariff 

concessions for investment retain the right to use the approved incentive 

measures, tax concessions and tariff concessions until the expiry of the 

period for which these were approved.

for nanotechnology biosensors, a

With its patent, Texo plans to produce Carbon from the extraction of high 

quality input raw materials such as oil and steel from waste material such 

as old tires, steel and rubber compounds of any kind. The production 

process will function energetically by itself after the initial start-up phase; 

the production process will not require an enormous amount of energy and 

the gas by-product from production will be converted by a generator 

system to electrical energy which will be utilized to operate and power the 

production ovens.
