Response to public consultation<br />

Composition <strong>of</strong> selection commissions/panels <strong>for</strong> senior judicial <strong>of</strong>fices<br />

135. We intend to bring <strong>for</strong>ward regulations that set out <strong>the</strong> following composition <strong>for</strong><br />

selection commissions/panels which would be subject to agreement with <strong>the</strong> Lord<br />

Chief <strong>Justice</strong> or <strong>the</strong> President <strong>of</strong> <strong>the</strong> UK Supreme Court (depending upon nature <strong>of</strong><br />

judicial <strong>of</strong>fice) <strong>and</strong> Parliament’s affirmative resolution procedure. In relation to <strong>the</strong> UK<br />

Supreme Court, <strong>the</strong> regulations will also be subject to consultation with <strong>the</strong> devolved<br />

administrations as specified in <strong>the</strong> Act.<br />

Selection Commission <strong>for</strong> President <strong>of</strong> UK Supreme Court<br />

Chair – lay representative from one <strong>of</strong> <strong>the</strong> three territorial judicial selection<br />

bodies;<br />

Representative from <strong>the</strong> JAC;<br />

Representative from <strong>the</strong> JAB (Scotl<strong>and</strong>);<br />

Representative from <strong>the</strong> NIJAC;<br />

Deputy President <strong>of</strong> <strong>the</strong> UKSC (unless applying, <strong>the</strong>n it would be <strong>the</strong> most senior<br />

ordinary judge <strong>of</strong> <strong>the</strong> Supreme Court);<br />

Senior UK Judge nominated by <strong>the</strong> outgoing President, <strong>and</strong><br />

Lord Chancellor.<br />

Of <strong>the</strong> four members from <strong>the</strong> territorial appointments bodies one <strong>of</strong> <strong>the</strong>m must be a<br />

judicial <strong>of</strong>fice holder <strong>and</strong> at least two, including <strong>the</strong> chair, must be lay members.<br />

Chair - President <strong>of</strong> <strong>the</strong> UKSC;<br />

Chair <strong>of</strong> <strong>the</strong> JAC;<br />

Chair <strong>of</strong> <strong>the</strong> JAB;<br />

Chair <strong>of</strong> <strong>the</strong> NIJAC, <strong>and</strong><br />

Senior UK Judge (non-UK Supreme Court <strong>of</strong>fice holder).<br />

Selection Panel <strong>for</strong> Lord Chief <strong>Justice</strong><br />

Chair – Chair <strong>of</strong> JAC;<br />

Lord Chancellor;<br />

Most senior English <strong>and</strong> Welsh Supreme Court judge or <strong>the</strong>ir nominee;<br />

Lay JAC member, <strong>and</strong><br />

Lord Chief <strong>Justice</strong> Judicial nominee.<br />
