Instructions for implement<strong>at</strong>ion of H.P. Land Records Manual.<br />

Madam/Sir,<br />

As per provisions of Section 34 of the H.P. Land Revenue Act, 1954, the<br />

Financial <strong>Commissioner</strong> is empowered to prescribe the intervals to amend an edition of recordof-rights<br />

i.e. the Jamabandi. In para 8.77 of the H.P. Land Records Manual, a period of 5 years<br />

has been prescribed for this purpose.<br />

It has been experienced th<strong>at</strong> in some revenue est<strong>at</strong>es particularly in rural areas,<br />

transactions of land are few and there appears hardly any need to revise the record in such<br />

est<strong>at</strong>es after five years. In other revenue est<strong>at</strong>es which are normally comprised in urban and<br />

semi urban areas, numerous transactions take place within a short period and resultantly<br />

numerous mut<strong>at</strong>ions are <strong>at</strong>tested and a large number of changes occur in Jamabandi which are<br />

required to be entered in remarks column of the same.<br />

Hence, the issue regarding re-fix<strong>at</strong>ion of intervals to amend Jamabandi was<br />

under active consider<strong>at</strong>ion of the Government and after consult<strong>at</strong>ion with all the Deputy<br />

<strong>Commissioner</strong>s in Video Conferences held in recent past, it has been decided to amend the


aforesaid schedule of 5 years prescribed in Para 8.77 of the H.P. Land Records Manual, for<br />

upd<strong>at</strong>ion of Jamabandi, as follows:<br />

a period of one month. Revision in the list may be made as and when felt necessary. A copy of<br />

the order shall be supplied to the Government for inform<strong>at</strong>ion.<br />

<strong>The</strong>se instructions may be implemented in letter and spirit, henceforth to<br />

amend/upd<strong>at</strong>e periodical record-of-rights i.e. jamabandi.<br />

Instructions to write “Himachal Pradesh Sarkar” in ownership column of<br />

Jamabandi in place of “name of department” of government land transferred to<br />

th<strong>at</strong> department.<br />

Madam/Sir,<br />

It has come to the notice th<strong>at</strong> in certain cases rel<strong>at</strong>ing to Government land under<br />

possession of a particular Government Department, the name of such department is indic<strong>at</strong>ed in<br />

the column of ownership of the Jamabandi. This is not an appropri<strong>at</strong>e practice. In fact all<br />

government owned lands which are in the names of departments are required to be shown in<br />

the ownership of the St<strong>at</strong>e Government with the name of the department being reflected in the<br />

column of possession. This applies also in cases where the ownership column reflects entries<br />

such as “Rajyapal Himachal Pradesh”.<br />

It is clarified th<strong>at</strong> in all such cases, necessary corrections may be made in<br />

relevant jamabandis and the words “Himachal Pradesh Sarkar” may be written in place of<br />

“name of department or Rajyapal Himachal Pradesh” in ownership column of Jamabandi. <strong>The</strong><br />

name of Department may be given in the column of possession only where relevant. <strong>The</strong>se<br />

instructions may be adhered to in future transactions. In the case of existing entries requiring<br />

correction this may be done by way of “fard badar”.<br />

Withdrawal of all previous instructions regarding mand<strong>at</strong>ory stay of<br />

Tehsildars/Naib-Tehsildars in field.<br />

Madam/Sir,<br />

I am directed to say th<strong>at</strong> with the passage of time and introduction of<br />

inform<strong>at</strong>ion technology in the Revenue Department, most of land record has been<br />

computerized. Mut<strong>at</strong>ions are now being mainly <strong>at</strong>tested <strong>at</strong> Tehsil/Sub-Tehsil level.<br />

Partition proceedings are now to be heard <strong>at</strong> Tehsil/Sub-tehsil levels. <strong>The</strong>se facts<br />

alongwith the fact th<strong>at</strong> most of the villages are now connected by road means th<strong>at</strong> it is<br />

no longer appropri<strong>at</strong>e to bind Tehsildars/Naib Tehsildars to stay in the field for a period<br />

of <strong>at</strong> least 12 days and eight nights in a month. <strong>The</strong>y are now required to devote more<br />

time in office to provide better services to the general public.<br />

<strong>The</strong>refore, all previous instructions regarding mand<strong>at</strong>ory touring of<br />

Revenue Officers issued by this department in this behalf from time to time are hereby<br />

withdrawn with immedi<strong>at</strong>e effect. Revenue Officers may undertake tours within their


jurisdiction as per the actual requirement of their official duties with approval of the<br />

competent authority. All reports and st<strong>at</strong>ements connected with monitoring of the<br />

mand<strong>at</strong>ory touring may also be discontinued with immedi<strong>at</strong>e effect.<br />
