CODE OF GENERAL ORDINANCES, 2011 - KENOSHA, WISCONSIN<br />

who is responsible for the operation <strong>of</strong>, or who is<br />

supervising the operation <strong>of</strong> an all-terrain vehicle,<br />

snowmobile or dirt bike.<br />

6. Public Property€ means any property<br />

owned or controlled by the <strong>City</strong> <strong>of</strong> <strong>Kenosha</strong>, or its<br />

subunits, excluding the portion <strong>of</strong> street right-<strong>of</strong>ways<br />

designated for motor vehicle traffic, excluding<br />

park land.<br />

7. Snowmobile€ means an engine driven<br />

vehicle that is manufactured solely for<br />

snowmobiling, that has an endless belt tread and<br />

sled-type runners or skis, to be used in contact with<br />

snow.<br />

Other words and phrases defined in Section<br />

340.01, <strong>Wisconsin</strong> Statutes, are incorporated herein<br />

by reference.<br />

B. Prohibition. No operator shall operate or<br />

cause the operation <strong>of</strong> an all-terrain vehicle,<br />

snowmobile or dirt bike upon public property<br />

without the written permission <strong>of</strong> the Director <strong>of</strong><br />

Public Works or designee, except for <strong>City</strong><br />

employees and agents <strong>of</strong> <strong>City</strong> performing work or<br />

services for or on behalf <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Kenosha</strong>.<br />

11.145 REGULATION OF THE SALE,<br />

POSSESSION, TRANSFER AND USE OF TOXIC<br />

GLUES<br />

A. Definition. To<strong>xi</strong>c glue shall mean any<br />

glue, adhesive cement, mucilage, plastic cement or<br />

any similar substance containing one or more <strong>of</strong> the<br />

following volatile substances:<br />

Acetone, benzene, butyl alcohol,<br />

cyclohexanone, ethyl acetate, ethyl alcohol,<br />

ethylene dichloride hexane, isopropyl alcohol,<br />

methyl alcohol, methyl cellosolve, acetate methyl,<br />

ethyl ketone, isobutyl ketone, pentachlorophenol,<br />

petroleum ether, trichlorethylene, tricresyl phospat,<br />

toluene, toluol, or any other chemical capable <strong>of</strong><br />

producing into<strong>xi</strong>cation when inhaled.<br />

B. Inhalation <strong>of</strong> Vapors or Fumes from<br />

To<strong>xi</strong>c Glues Prohibited. No person shall inhale<br />

or otherwise introduce into his respiratory tract any<br />

to<strong>xi</strong>c glue or any vapors or fumes which may be<br />

released from any to<strong>xi</strong>c glue with the intent <strong>of</strong><br />

becoming into<strong>xi</strong>cated, elated, excited, stupefied,<br />

irrational, paralyzed, or <strong>of</strong> changing, distorting or<br />

disturbing his eyesight, thinking process, judgment,<br />

balance or muscular coordination.<br />

C. Limitations on Sales, Transfer, and<br />

Possession <strong>of</strong> To<strong>xi</strong>c Glue. No person shall, for<br />

the purpose <strong>of</strong> violating or aiding another to violate<br />

any provision <strong>of</strong> this Section, possess, buy, sell,<br />

transfer possession or receive possession <strong>of</strong> any<br />

to<strong>xi</strong>c glue.<br />

No person shall sell or transfer possession <strong>of</strong><br />

any to<strong>xi</strong>c glue to any person under 18 years <strong>of</strong> age;<br />

provided, however, that one tube or container <strong>of</strong><br />

to<strong>xi</strong>c glue may be sold or transferred to a child<br />

under 18 years <strong>of</strong> age immediately in conjunction<br />

with the sale or transfer <strong>of</strong> a model kit, if the kit<br />

requires appro<strong>xi</strong>mately such quantity <strong>of</strong> the glue for<br />

assembly <strong>of</strong> the model, and provided, further, that<br />

nothing herein contained shall be applicable to the<br />

transfer <strong>of</strong> a tube or other container <strong>of</strong> such glue<br />

from a parent to his child or from a legal guardian<br />

to his ward.<br />

D. Penalties. Any person, firm or corporation<br />

violating any part <strong>of</strong> this Ordinance shall upon<br />

conviction there<strong>of</strong> be punished by a fine <strong>of</strong> not less<br />

than $10 or more than $100, together with the<br />

costs and disbursements <strong>of</strong> the prosecution, and in<br />

default there<strong>of</strong> shall be imprisoned in the County<br />

Jail for a period <strong>of</strong> time not to exceed thirty (30)<br />

days. Each day that each violation continues shall<br />

be considered a separate <strong>of</strong>fense.<br />

E. Validity. Should any section, paragraph,<br />

sentence, clause or phrase <strong>of</strong> this Ordinance be<br />

declared unconstitutional or invalid or be repealed,<br />

it shall not affect the validity <strong>of</strong> the Ordinance as a<br />

whole or any part there<strong>of</strong> other than the part so<br />

declared to be invalid or repealed.<br />

All Ordinances, or parts <strong>of</strong> Ordinances,<br />

contravening the provisions <strong>of</strong> this Ordinance are<br />

hereby repealed.<br />

11.146 POSSESSION OF MARIJUANA<br />

A. Intent. It is the intent <strong>of</strong> the Common<br />

Council <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Kenosha</strong> to effectively control<br />

and regulate the possession and use <strong>of</strong> small<br />

amounts <strong>of</strong> marijuana (1 ounce or 28 grams or less<br />

<strong>of</strong> marijuana). It is intended that this Ordinance will<br />

promote, encourage and expedite law enforcement<br />

and prosecution for such violations. Possession <strong>of</strong><br />

amounts <strong>of</strong> marijuana exceeding 1 ounce or 28<br />

grams and/or subsequent violations for such<br />

<strong>of</strong>fenses will continue to be referred to the District<br />

Attorney’s <strong>of</strong>fice for State criminal prosecution.<br />

B. It shall be unlawful for any person to use or<br />

carry, or for any person, firm, party or corporation<br />

to possess marijuana as that substance is defined<br />

in Section 961.01(14), <strong>Wisconsin</strong> Statutes (2006),<br />

except as otherwise authorized by Chapter 961 <strong>of</strong><br />

the <strong>Wisconsin</strong> Statutes (2006).<br />
