CODE OF GENERAL ORDINANCES, 2011 - KENOSHA, WISCONSIN<br />

<strong>of</strong> a person or entity.<br />

C. Prohibited Acts. It is unlawful for any<br />

person(s) to: host or allow an event or gathering at<br />

any residence, premises or on any other private or<br />

public property where alcohol or alcoholic beverages<br />

are present when the person knows that an underage<br />

person will or does consume any alcohol or alcoholic<br />

beverage; or possess any alcohol or alcoholic<br />

beverage with the intent to consume it; and the<br />

person fails to take reasonable steps to prevent<br />

possession or consumption by the underage<br />

person(s).<br />

1. A person is responsible for violating this<br />

section if the person intentionally aids, advises, hires,<br />

counsels or conspires with or otherwise procures<br />

another to commit the prohibited act.<br />

2. A person who hosts an event or gathering<br />

does not have to be present at the event or gathering<br />

to be responsible.<br />

D. Exceptions.<br />

1. This <strong>chapter</strong> does not apply to conduct solely<br />

between an underage person and his or her parents<br />

while the parent is present and in control <strong>of</strong> the<br />

underage person.<br />

2. This <strong>chapter</strong> does not apply to legally<br />

protected religious observances.<br />

unlawful for any person to consume any fermented<br />

malt beverage or into<strong>xi</strong>cating liquor or to possess the<br />

same in other than a sealed container while upon any<br />

public walk, street, public park, other public place in<br />

the <strong>City</strong> or over which the <strong>City</strong> has any lease or<br />

jurisdiction, on any parking lot open to and available<br />

to the public, or within a parked vehicle located on<br />

any street within the <strong>City</strong> <strong>of</strong> <strong>Kenosha</strong>.<br />

However, the sale, service, giving away and<br />

consumption <strong>of</strong> fermented malt beverages, where<br />

authorized under <strong>City</strong> and State law, is permitted<br />

upon <strong>City</strong> streets and sidewalks where said areas are<br />

blocked <strong>of</strong>f and in use for a street party authorized<br />

under §5.04 B., Ordinances, or where said activity is<br />

associated with a community event and where a<br />

Special Class "B" Fermented Malt Beverage License<br />

has been granted and issued, and where a permit<br />

therefor is reviewed by the Committee on<br />

Licensing/Permits and approved by the Common<br />

Council. Any permit issued must particularly describe<br />

the area in which said activity will be permitted and<br />

temporary signs must be posted within the permit<br />

area informing the public <strong>of</strong> the terms and limitations<br />

<strong>of</strong> the permit.<br />

C. Into<strong>xi</strong>cants Permitted On <strong>City</strong> Sidewalks In<br />

An Outdoor Dining Area. The sale, service, giving<br />

away and consumption <strong>of</strong> into<strong>xi</strong>cants is permitted<br />

upon <strong>City</strong> sidewalks in an Outdoor Dining Area<br />

authorized and subject to a Permit under Section<br />

5.046 <strong>of</strong> the Code <strong>of</strong> General Ordinances.<br />

3. This <strong>chapter</strong> does not apply to situations<br />

where underage persons are lawfully in possession <strong>of</strong><br />

alcohol or alcoholic beverages during the course and<br />

scope <strong>of</strong> employment.<br />

E. Penalties. A person who violates any<br />

provision <strong>of</strong> this ordinance is subject to a forfeiture <strong>of</strong><br />

not less than $1,000 nor more than $5,000, together<br />

with the costs <strong>of</strong> prosecution. A person who is in<br />

default <strong>of</strong> payment is subject to imprisonment in the<br />

county jail until the forfeiture and costs are paid<br />

11.026 PROHIBITING THE DRINKING OF<br />

(b) bloodshot eyes;<br />

INTOXICANTS ON PUBLIC STREETS AND (c) dilated pupils;<br />

SIDEWALKS, OR WITHIN ANY PARKED MOTOR<br />

VEHICLE<br />

A. It shall be unlawful for any person to sell or<br />

serve or give to another person, or <strong>of</strong>fer to sell or<br />

serve or give to another person any fermented malt<br />

beverage or into<strong>xi</strong>cating liquor while upon any public<br />

street or sidewalk, or within a parked motor vehicle<br />

located on any street within the <strong>City</strong> <strong>of</strong> <strong>Kenosha</strong>.<br />

B. Unless otherwise properly licensed, It shall be<br />

D. Underage Persons Under the Influence<br />

Prohibited.<br />

1. No underage person as defined in Section<br />

125.02(20m), <strong>Wisconsin</strong> Statutes, shall be under the<br />

influence <strong>of</strong> alcohol in the <strong>City</strong> <strong>of</strong> <strong>Kenosha</strong>. Such<br />

prohibition is subject to the exceptions in Section<br />

125.07(4)(b), <strong>Wisconsin</strong> Statutes.<br />

2. For the purpose <strong>of</strong> this section "under the<br />

influence" shall mean any underage person who<br />

exhibits one or more <strong>of</strong> the following indicators:<br />

(a) odor <strong>of</strong> into<strong>xi</strong>cants on the breath;<br />

(d) unstable balance;<br />

(e) slurred speech;<br />

(f) failure <strong>of</strong> Standard Field Sobriety Test; and<br />

(g) admission to consumption <strong>of</strong> alcohol.<br />

11.027 SERVICE STATIONS<br />

A. Purpose. The purpose <strong>of</strong> this Ordinance is<br />

to reduce the number <strong>of</strong> service station robberies<br />

and thereby safeguard the health, safety and<br />

welfare <strong>of</strong> service station patrons and attendants
