Welcome<br />

It is my pleasure to welcome you and introduce the 2009-2010<br />

edition of the “Azerbaijan Export Catalogue” (AEC). This is<br />

the second edition of this kind and a unique project which<br />

aims to introduce Azerbaijan’s export potential to the world.<br />

At present, Azerbaijan’s economic growth is one of the highest<br />

in the world; thus, the potential of local companies is growing.<br />

Our country was among the least affected by the global<br />

financial crisis due to the timely policy measures by the government.<br />

Moreover, the development of entrepreneurship<br />

remains one of main priorities of economic reforms. As a<br />

result Azerbaijan’s business sector is getting stronger and has<br />

become a driving force for country’s development.<br />

As a result of these positive trends many Azerbaijani companies now produce high quality products and<br />

services that could compete regionally and internationally. However, these products and services sometimes<br />

are not promoted and marketed properly. The AEC's mission is to provide the necessary marketing<br />

support to promote local companies' exports.<br />

Since AEC is based on the detailed study of country’s export potential and selection of companies to represent<br />

Azerbaijani business sector, we are confident that it will serve as a useful source of information for<br />

foreign companies interested in establishing successful business relations with Azerbaijani companies.<br />

Thus AEC provides information on various companies operating in Azerbaijan that have potential and commitment<br />

to export their products and services, to compete internationally. And it is you, who will judge the<br />

quality of our work.<br />

AZERBAIJAN COUNTRY PROFILE<br />

Oil-rich Azerbaijan gained independence from the Soviet Union in 1991 amid political turmoil and<br />

against a backdrop of violence in the Nagorno-Karabakh region. Azerbaijan has been known for its hydrocarbon<br />

reserves since ancient times. By the beginning of the 20th century Azerbaijan was supplying almost<br />

half of the world's oil. In 1994, Azerbaijan signed an oil contract worth $7.4bn with a Western consortium of<br />

11 trans-national oil companies from eight countries on development of the "Azeri", "Chiraq" and "Gunashli"<br />

oil fields in the Azerbaijani Sector of the Caspian Sea. Since then, around 18,4 billion US Dollars has been<br />

invested in the development of the country's oil and gas reserves. Azerbaijan hydrocarbon reserves are delivered<br />

to the rest of the world through a network of pipelines, amongst which are the essential components of<br />

the South-West energy corridor – the Baku-Tbilisi-Ceyhan oil pipeline and Baku-Tbilisi-Erzerum gas pipeline<br />

forming a very strong partnership of the three countries of South Asia – Azerbaijan, Turkey and Georgia.<br />

Azerbaijan is a member to a number of international organizations of global significance and impact such as:<br />

ADB, BSEC, CE, CIS, EAPC, EBRD, ECO, FAO, GCTU, GUAM, IAEA, IBRD, ICAO, ICRM, IDA, IDB, IFAD, IFC,<br />

IFRCS, ILO, IMF, IMO, Interpol, IOC, IOM, IPU, ISO, ITSO, ITU, ITUC, MIGA, NAM (observer), OAS (observer),<br />

OIC, OPCW, OSCE, PFP, SECI (observer), UN, UNCTAD, UNESCO, UNIDO, UNWTO, UPU, WCO, WFTU,<br />

WHO, WIPO, WMO, WTO (observer).<br />

Azerbaijan became a member of the Council of Europe in 2001. The Partnership and Cooperation Agreement<br />

concluded between the European Union and Azerbaijan entered into force in June 1999. The European<br />

Neighborhood Policy (ENP) Action Plan for Azerbaijan was adopted on 14 November, 2006 and offers Azerbaijan<br />

the prospect of increasingly close relationships with the EU, involving a significant degree of economic integration<br />

and deepening political cooperation.<br />

ECONOMIC OUTLOOK AND FORECAST<br />

Economic Outlook<br />

According to the official statistics, in 2003-2009 domestic economy grew by 2.6 times, having reached<br />

6.1% GDP growth in the year of global economic crisis – 2009. During 2009 GDP growth made 9.3%<br />

(10.8% growth vs. 2008). 85% of GDP has been generated by private sector. Population income has<br />

increased at 8.0%. Banks issued loans of USD 8.4bn or 17.4% more than in 2008 The country’s FOREX<br />

reserves in the State Oil Fund and the Central Bank have reached the amount of USD19 bn in 2009 and will<br />

continue growing steadily in 2010 to reach USD50 billion through proper asset management and income generation<br />

to finance social development projects<br />

The 2009 World Bank/IFC "Doing Business" report ranks Azerbaijan the world’s top reformer country, while<br />

according to the World Economic Forum qualifies Azerbaijan for the 51st place by competitiveness rating in the<br />

world and for the 1st place among the CIS countries.<br />

Forecast<br />

The social economic strategy for 2011-2013 proposed by the Ministry of Economic Development envisages 6.8%<br />

GDP growth with 4.9%-increase of the non-oil sector. During next three years, the government will continue allocation<br />

of cheap loans for agricultural development, especially for construction of grain elevators, wheat warehouses<br />

and cold storages. More than USD 20 billion FDI is expected to inflow into the economy over the next 15 years<br />

upon the launch of the Second Phase of development of one of the largest gas fields in the Caspian Sea -<br />

Shahdeniz gas field.<br />

Independent international monitors (Emerging European Monitor) estimate that Azerbaijan posted real GDP growth<br />

of 5.0% over the first eight months of the year, by that having performed as the only Caucasus country to avoid recession.<br />

Sustained expansion of industrial output volumes helped to lift headline growth, while the stabilization of oil<br />

prices through Q209-Q309 has also improved the investment outlook over the medium term. EEM estimates that the<br />

Azeri economy to grow by 3.8% by the end of 2009 and accelerating back to 9.0% growth in 2010. The country’s<br />

leadership has pledged to continue all social and infrastructure projects and secure macroeconomic stability in 2010.<br />

Draft State Budget 2010: Infrastructure and social protection are key to the nation’s development<br />

The State Budget continues applying conservative policy of the previous years and estimates the price of USD45 per<br />

one barrel of oil. 2010 budget revenues are set at approx USD 14.3bn and expenditures-USD15.1bn respectively. The<br />

Budget envisages extensive allocations around USD5bn for social, infrastructural, and investment projects. In 2010,<br />

the government will progressively sponsor construction of highways, water, gas and power lines, power plants and<br />

water dams in order to strengthen the domestic economy and address regional development agenda.<br />

Infrastructure<br />

In 2010, the largest state-sponsored infrastructural projects aim to solve the problems of water supply and energy<br />

security in the Baku City and the regions of Azerbaijan. Such projects are construction of the Oguz-Gabala-Baku water<br />

channel, Takhtakorpu Water Reservoir, Samur-Absheron water channel, and Shamkirchay water reservoir. Given the<br />

domestic energy resources supply-demand balance, the government plans to implement more alternative energy production<br />

projects. Particular attention will be given to utilization of mountainous rivers potential through construction of<br />

2-3 megawatt power stations. Significant attention and budget allocations are envisaged for utilization of solar and<br />

wind energy.<br />

Social protection<br />

The Draft 2010 budget social spending will make USD 4.65bn or 34.4% of total expenditures in the following distribution:<br />

USD3.9bn for science, education, healthcare, social protection, culture, physical culture and youth;<br />

USD1.3bn for raise of effectiveness of the national social protection system, improvement of living conditions of people<br />

and living standards of the low-income families, financing of basic part of labor pensions and other social measures<br />

and the remaining amount to be channeled to address social aids and other social measures, and aid to<br />

refugees and IDPs.


Taxation<br />

According to the Tax Code of the Azerbaijan Republic the taxes shall not be of discriminatory nature and shall not<br />

be established based on the political, ideological, ethnic, confessional or other existing differences between taxpayers.<br />

Trade Liberalization<br />

Azerbaijan has an observer status at the WTO. Import of alcohol, alcoholic drinks, and tobacco as well as food products<br />

of animal origin are subject to licensing. Imports of large communication equipment must be authorized by the<br />

Ministry of Communications. Apart from the commodities that are subject to export restriction, exports are not subject<br />

to licensing.<br />

Main Features of Customs Regulations<br />

Import Tariffs<br />

Today, imports are subjects to ad valorem duties at uniform rates at 0.5%, 3%, 5% and 15% of declared customs value.<br />

Some goods are granted duty free entry.<br />

Tariff Exemptions<br />

According to Article 34 of the law on “Customs Tariff”, a duty free import regime applies to the following: medical equipment<br />

and medicines, humanitarian goods and some products for military use, property contributed by foreign investors<br />

to the equity capital of joint ventures and goods for official use by diplomatic missions and international organizations.<br />

Moreover, customs duties are not applied on goods imported under bilateral free trade treaties.<br />

Special provisions for imports by companies working in the oil sector are an integral part of the Product Sharing<br />

Agreements between the Government and respected oil companies. Goods, tools, equipment, supplies and services<br />

used under the Product Sharing Agreements are duty free as well as exempt from VAT. This regime is also extended<br />

to foreign firms registered in Azerbaijan and providing services to the contractor parties as well as respected foreign<br />

sub-contractors.<br />

There are no other duty free-exemptions from custom duties for imports used as factors of productions for export<br />

products. This is one of serious obstacles for exports by the non-oil sector, since many components need to be<br />

imported.<br />

Import Quotas. Prohibitions<br />

There are import quotas on ethyl alcohol, alcohol beverages and tobacco products.<br />

Exports tariffs<br />

Domestic export tariffs are applied for the “non-precious metals and products thereof” (especially, Group 72 (ferrous<br />

metals) and Croup 76 (aluminium and articles thereof). In these groups tariffs are applied to about 75 product<br />

items (51 of them from Group 72; 9 – Group 76; 15 – Groups 78, 79 and 80). Exports tariffs are estimated<br />

as 5 USD per tone for ferrous metals, 15 USD per ton for aluminium and articles thereof, lead and articles<br />

thereof, zinc and articles thereof, tin and articles thereof.<br />

Export Restrictions<br />

Export of works of arts, weapons, explosives, radioactive materials and wastes, narcotics, and psychotic<br />

drugs are prohibited. In addition, exports of strategic commodities produced in Azerbaijan are restricted;<br />

such commodities include: petroleum products, cotton, electric power and non/ferrous metals.<br />

Export subsidies<br />

Azerbaijan does not maintain any agro export subsidies. In Azerbaijan farmers are exempt from VAT<br />

while imported agro-products are not. GATT requires equal taxation of domestic and imported goods.<br />

While GATT requires equal application of taxation, Azerbaijan applies higher excise tax rates on<br />

imports than domestic goods for a number of products.<br />

Conclusion:<br />

Given the country’s steadily growing positive economic performance during the last decade due<br />

to rich hydrocarbon reserves and stable political environment, quite effective anti-economic crisis<br />

strategy in 2008-2009, Azerbaijan, in 2010, and for the years to come, will remain as a very highmargin,<br />

attractive destination for doing business.<br />

The National Confederation of Entrepreneurs (Employers’)<br />

Organizations of Azerbaijan Republic was established on March 5, 1999<br />

and officially registered on April 9, 1999. The Confederation is republicwide<br />

public union of international standing which protects interests of<br />

businessmen and supports entrepreneurship development. More than<br />

4000 entrepreneurial entities including well-established companies,<br />

banks and company groups as well as about 50 economic and social<br />

oriented Association and Unions, NGOs are currently members of<br />

The confederation’s activity is based on The Constitution of Republic of Azerbaijan, law of Azerbaijan Republic “On<br />

non-governmental organizations”, other normative legal acts and the statue of the confederation.<br />

The National Confederation of Entrepreneurs (Employers) Organizations of Azerbaijan Republic (AEC) being a<br />

social union of employers in Azerbaijan Republic, is non-governmental, non-commercial, non - profitable, , selfgoverning<br />

organization carrying public efficient objectives, promoting favorable business environment in<br />

Azerbaijan, coordinating activities of juridical and physical entities dealing with entrepreneurial activities<br />

The Confederation operates in accordance with its statutes, broadens its activity and cooperation with<br />

The Confederation properly fulfils its responsibilities as a social partner representing employers in tripartite


General Collective Agreement signed between Cabinet of<br />

Ministers, Trade Unions Confederation and AEC in socialeconomic<br />

policy development and labour regulations in<br />

Azerbaijan since 2001. Main objectives of the confederations are<br />

to contribute into promoting successful integration into the world<br />

economy, to facilitate solution of existing problems of the country,<br />

to foster creation of new jobs and to increase professionalism of<br />

the population and support entrepreneurship development. AEC<br />

is a member of International Organization of Employers, World<br />

Association of NGOs, International Industrialist and<br />

Entrepreneurs’ Congress and other international organizations.<br />

The Confederation closely cooperates with embassies of USA,<br />

Great Britain, Germany, France, Iran, Turkey, Egypt, Korea,<br />

Greece, Hungary, India, Latvia, Romania, Russia, Italy and Israel<br />

TUSIAB played a great role in improving modern life standards in Azerbaijan, supporting the formation<br />

of the structure of Azerbaijan's economy to meet modern standards, in joining in the ranks of developed<br />

countries that solved the majority of economic and social problems.<br />

Turkey and Turkish businessmen sharing historical roots with Azerbaijan made an investment in Azerbaijan<br />

during very risky periods, which in turn provided an impetus for the development of the economy and<br />

integration to the world economy. Businessmen willing to invest into Azerbaijan were given information<br />
