2. Your c<strong>on</strong>tract. A binding agreement will come into existence<br />

between us when we despatch our written c<strong>on</strong>firmati<strong>on</strong> to <strong>the</strong><br />

party leader or your travel agent. English Law will apply to our<br />

agreement <str<strong>on</strong>g>and</str<strong>on</strong>g> to any dispute or claim which arises between us<br />

out of it. Any such dispute or claim must be dealt with by <strong>the</strong><br />

Courts of Engl<str<strong>on</strong>g>and</str<strong>on</strong>g> <str<strong>on</strong>g>and</str<strong>on</strong>g> Wales.<br />

Many of <strong>the</strong> services which make up your arrangements are<br />

provided by independent suppliers. Those suppliers provide <strong>the</strong>se<br />

services in accordance with <strong>the</strong>ir own terms <str<strong>on</strong>g>and</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s. Some<br />

of <strong>the</strong>se terms <str<strong>on</strong>g>and</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s may limit or exclude <strong>the</strong> supplier’s<br />

liability to you, usually in accordance with applicable Internati<strong>on</strong>al<br />

C<strong>on</strong>venti<strong>on</strong>s as well as to any applicable law. Copies of <strong>the</strong>se<br />

terms <str<strong>on</strong>g>and</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s are available <strong>on</strong> request.<br />

3. The price of your arrangements. We reserve <strong>the</strong> right to<br />

amend or make correcti<strong>on</strong>s to <strong>the</strong> advertised prices prior to<br />

accepting your booking. However, <strong>on</strong>ce <strong>the</strong> actual price of your<br />

arrangements has been c<strong>on</strong>firmed, no amendment will be made<br />

to it unless our costs change as a result of an increase or decrease<br />

in transportati<strong>on</strong> costs, taxes or as a result of any changes in <strong>the</strong><br />

exchange rates which have been used to calculate <strong>the</strong> cost of your<br />

arrangements. If <strong>the</strong> amount of <strong>the</strong> increase in <strong>the</strong>se costs exceeds<br />

2% of <strong>the</strong> total cost of your arrangements (excluding amendment<br />

charges), we may make an additi<strong>on</strong>al charge. If this additi<strong>on</strong>al<br />

charge is greater than 10% of <strong>the</strong> cost of your arrangements<br />

(excluding amendment charges), you will be entitled to choose<br />

<strong>on</strong>e of opti<strong>on</strong>s (a), (b) <str<strong>on</strong>g>and</str<strong>on</strong>g> (c) as set out in clause 5 below. If you do<br />

not inform us of your choice within 14 <str<strong>on</strong>g>day</str<strong>on</strong>g>s from <strong>the</strong> issue date<br />

4. If You Change or Cancel Your Booking. If you need to make<br />

to c<strong>on</strong>firm, but this is not guaranteed. Where we can c<strong>on</strong>firm your<br />

change, an amendment fee (as detailed below) toge<strong>the</strong>r with any<br />

changes <strong>on</strong> flights are not allowed under our airline c<strong>on</strong>tracts, any<br />

flight tickets would need to be issued at <strong>the</strong> full cost of <strong>the</strong> flight.<br />

5. Changes <str<strong>on</strong>g>and</str<strong>on</strong>g> cancellati<strong>on</strong> by us. Brochures are planned many<br />

m<strong>on</strong>ths in advance <str<strong>on</strong>g>and</str<strong>on</strong>g> we hope that no changes will be necessary,<br />

but we reserve <strong>the</strong> right to make changes <str<strong>on</strong>g>and</str<strong>on</strong>g> correcti<strong>on</strong>s at any<br />

time. We also reserve <strong>the</strong> right to cancel c<strong>on</strong>firmed bookings for<br />

operati<strong>on</strong>al reas<strong>on</strong>s or if minimum passenger numbers are not<br />

met. However, bookings will not be cancelled by us within 56 <str<strong>on</strong>g>day</str<strong>on</strong>g>s<br />

of departure unless as a result of circumstances outside our<br />

c<strong>on</strong>trol/’force majeure’ as defined in clause 6 below.<br />

Most changes are minor but, occasi<strong>on</strong>ally, we may have to make a<br />

‘significant change’. Examples of ‘significant changes’ include <strong>the</strong><br />

following when made before departure: a change of destinati<strong>on</strong>,<br />

or to a lower grade of hotel for <strong>the</strong> whole or a major part of your<br />

holi<str<strong>on</strong>g>day</str<strong>on</strong>g>, a change of UK departure <str<strong>on</strong>g>and</str<strong>on</strong>g>/or arrival point to <strong>on</strong>e<br />

which is more inc<strong>on</strong>venient for you or a change in overall length of<br />

your holi<str<strong>on</strong>g>day</str<strong>on</strong>g> by 12 or more hours. For journeys wholly within <strong>the</strong><br />

UK, timings are subject to change at any time <str<strong>on</strong>g>and</str<strong>on</strong>g> we do not<br />

c<strong>on</strong>sider this or a substituti<strong>on</strong> between diesel <str<strong>on</strong>g>and</str<strong>on</strong>g> electric tracti<strong>on</strong><br />

in <strong>the</strong> case of advertised steam haulage journeys as a significant<br />

change.<br />

If we have to make a significant change or cancel, we will tell you<br />

as so<strong>on</strong> as possible before departure <str<strong>on</strong>g>and</str<strong>on</strong>g> we will offer you <strong>the</strong><br />

choice of <strong>the</strong> following opti<strong>on</strong>s:<br />

(a) (for significant changes) accepting <strong>the</strong> changed<br />

arrangements; or<br />

(b) purchasing alternative arrangements from us, of a similar<br />

st<str<strong>on</strong>g>and</str<strong>on</strong>g>ard to those originally booked if available with applicable<br />

adjustment in cost; or<br />

(c) cancelling or accepting <strong>the</strong> cancellati<strong>on</strong> in which case you will<br />

receive a full <str<strong>on</strong>g>and</str<strong>on</strong>g> quick refund of all m<strong>on</strong>ies you have paid to us.<br />

If we have to make a significant change or cancel 56 <str<strong>on</strong>g>day</str<strong>on</strong>g>s or less<br />

before departure, subject to <strong>the</strong> excepti<strong>on</strong>s below, we will pay you<br />

5% of <strong>the</strong> total holi<str<strong>on</strong>g>day</str<strong>on</strong>g> cost as compensati<strong>on</strong>. This does not apply<br />

in <strong>the</strong> event that we are forced to make a change or cancel as a<br />

result of unusual <str<strong>on</strong>g>and</str<strong>on</strong>g> unforeseeable circumstances bey<strong>on</strong>d our<br />

c<strong>on</strong>trol, <strong>the</strong> c<strong>on</strong>sequences of which we could not have avoided<br />

even with all due care.<br />

We regret we cannot pay any expenses, costs or losses incurred by<br />

you as a result of our change or cancellati<strong>on</strong>.<br />

Very rarely, we may be forced by ‘force majeure’ (see clause 6) to<br />

change or terminate your arrangements after departure. If this<br />

situati<strong>on</strong> does occur, we regret we may not be able to make any<br />

refunds or pay you compensati<strong>on</strong> or meet any costs or expenses<br />

you incur as a result.<br />

6. ‘Force Majeure’. In <strong>the</strong>se Booking C<strong>on</strong>diti<strong>on</strong>s, ‘force majeure‘<br />

means any event which we or <strong>the</strong> supplier of <strong>the</strong> service(s) in<br />

questi<strong>on</strong> could not, even with all due care, foresee or avoid. Such<br />

events may include war or threat of war, riot, civil strife, actual or<br />

threatened terrorist activity, industrial dispute, natural or nuclear<br />

disaster, adverse wea<strong>the</strong>r c<strong>on</strong>diti<strong>on</strong>s, fire <str<strong>on</strong>g>and</str<strong>on</strong>g> all similar events<br />

outside our c<strong>on</strong>trol. Except where o<strong>the</strong>rwise expressly stated in<br />

<strong>the</strong>se booking c<strong>on</strong>diti<strong>on</strong>s, we regret we cannot accept liability or<br />

pay any compensati<strong>on</strong> where <strong>the</strong> performance or prompt<br />

performance of our obligati<strong>on</strong>s under our agreement with you is<br />

prevented or affected by, or you o<strong>the</strong>rwise suffer any damage or<br />

loss (as more fully described in clause 7 below) as a result of,<br />

‘force majeure’.<br />

7. Our Liability to you. We promise that your holi<str<strong>on</strong>g>day</str<strong>on</strong>g><br />

arrangements will be made, performed or provided with<br />

reas<strong>on</strong>able skill <str<strong>on</strong>g>and</str<strong>on</strong>g> care. This means that we will accept<br />

resp<strong>on</strong>sibility if, for example, you suffer death or pers<strong>on</strong>al injury or<br />

your c<strong>on</strong>tracted arrangements are not provided as promised or<br />

prove deficient as a result of <strong>the</strong> failure of ourselves, our<br />

employees, agents or suppliers to use reas<strong>on</strong>able skill <str<strong>on</strong>g>and</str<strong>on</strong>g> care in<br />

making, performing or providing your arrangements. Fur<strong>the</strong>r, we<br />

will be resp<strong>on</strong>sible for what our employees, agents <str<strong>on</strong>g>and</str<strong>on</strong>g> suppliers<br />

do or do not do if <strong>the</strong>y were at <strong>the</strong> time acting within <strong>the</strong> course of<br />

<strong>the</strong>ir employment or carrying out work we had asked <strong>the</strong>m to do.<br />

We will not be resp<strong>on</strong>sible for any injury, illness, death, loss,<br />

damage, expense, cost or o<strong>the</strong>r claim of any descripti<strong>on</strong><br />

whatsoever which results from:<br />

<strong>the</strong> act(s) <str<strong>on</strong>g>and</str<strong>on</strong>g>/or omissi<strong>on</strong>(s) of <strong>the</strong> pers<strong>on</strong>(s) affected or<br />

any member(s) of <strong>the</strong>ir party; or<br />

<strong>the</strong> act(s) <str<strong>on</strong>g>and</str<strong>on</strong>g>/or omissi<strong>on</strong>(s) of a third party not c<strong>on</strong>nected<br />

with <strong>the</strong> provisi<strong>on</strong> of your arrangements <str<strong>on</strong>g>and</str<strong>on</strong>g> which were<br />

unforeseeable or unavoidable; or<br />

any service or facility not arranged by us as part of our<br />

c<strong>on</strong>tract with you; or ‘force majeure’ as defined above.<br />

Where any claim or part of a claim (including those involving death<br />

or pers<strong>on</strong>al injury) c<strong>on</strong>cerns or is based <strong>on</strong> any travel<br />

arrangements, <strong>the</strong> maximum amount of compensati<strong>on</strong> we will<br />

have to pay you will be limited. The most we will have to pay you<br />

for that claim or that part of a claim if we are found liable to you <strong>on</strong><br />

any basis is <strong>the</strong> most <strong>the</strong> carrier would have to pay under <strong>the</strong><br />

internati<strong>on</strong>al c<strong>on</strong>venti<strong>on</strong> or regulati<strong>on</strong> which applies to <strong>the</strong> travel<br />

arrangements in questi<strong>on</strong>. In any circumstances in which <strong>the</strong> carrier<br />

is liable to you by virtue of <strong>the</strong> Denied Boarding Regulati<strong>on</strong> 2004,<br />

any liability we may have to you under our c<strong>on</strong>tract with you,<br />

arising out of <strong>the</strong> same facts, is limited to <strong>the</strong> remedies provided<br />

under <strong>the</strong> Regulati<strong>on</strong> as if (for this purpose <strong>on</strong>ly) we were a carrier.<br />

When making any payment, we are entitled to deduct any m<strong>on</strong>ey<br />

which you have received or are entitled to receive from <strong>the</strong><br />

transport provider for <strong>the</strong> complaint or claim in questi<strong>on</strong>.<br />

We limit <strong>the</strong> maximum amount we may have to pay you, if we are<br />

found liable for any claims you may make against us, as follows:<br />

a) for loss of <str<strong>on</strong>g>and</str<strong>on</strong>g>/or damage to any luggage or pers<strong>on</strong>al<br />

possessi<strong>on</strong>s (including m<strong>on</strong>ey) £75 per pers<strong>on</strong> affected.<br />

b) For any o<strong>the</strong>r claim (providing your claim does not involve<br />

death or pers<strong>on</strong>al injury) – three times <strong>the</strong> price (excluding<br />

amendment charges) paid by or <strong>on</strong> behalf of <strong>the</strong> pers<strong>on</strong>(s)<br />

affected in total. This maximum amount will <strong>on</strong>ly be payable<br />

where everything has g<strong>on</strong>e wr<strong>on</strong>g <str<strong>on</strong>g>and</str<strong>on</strong>g> you have not received any<br />

benefit at all from your holi<str<strong>on</strong>g>day</str<strong>on</strong>g>.<br />

The services <str<strong>on</strong>g>and</str<strong>on</strong>g> facilities included in your holi<str<strong>on</strong>g>day</str<strong>on</strong>g> will be deemed<br />

to be provided with reas<strong>on</strong>able skill <str<strong>on</strong>g>and</str<strong>on</strong>g> care if <strong>the</strong>y comply with<br />

any local regulati<strong>on</strong>s which apply or, if <strong>the</strong>re are no applicable local<br />

regulati<strong>on</strong>s, if <strong>the</strong>y are reas<strong>on</strong>able when compared to <strong>the</strong> local<br />

st<str<strong>on</strong>g>and</str<strong>on</strong>g>ards in practice.<br />

We do not accept liability for (1) any damage, loss, expense or<br />

o<strong>the</strong>r sum(s) of any descripti<strong>on</strong> which, based <strong>on</strong> <strong>the</strong> informati<strong>on</strong><br />

you gave us at <strong>the</strong> time of booking, we could not have foreseen<br />

you would suffer or incur if we breached our c<strong>on</strong>tract with you;<br />

(2) any business losses.<br />

8. Complaints <str<strong>on</strong>g>and</str<strong>on</strong>g> problems. In <strong>the</strong> unlikely event that you have<br />

any reas<strong>on</strong> to complain or experience any problems with your<br />

holi<str<strong>on</strong>g>day</str<strong>on</strong>g> arrangements whilst away, you must immediately inform<br />

our representative <str<strong>on</strong>g>and</str<strong>on</strong>g> <strong>the</strong> supplier of <strong>the</strong> service(s) in questi<strong>on</strong> so<br />

that <strong>the</strong> complaint can be rectified immediately. Any verbal<br />

notificati<strong>on</strong> must be c<strong>on</strong>firmed in writing as so<strong>on</strong> as possible.<br />

However, if you remain dissatisfied, you must write to our head<br />

office within 28 <str<strong>on</strong>g>day</str<strong>on</strong>g>s of your return giving your booking reference<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> full details of your complaint. If asked, you must also transfer<br />

to us or our insurers any rights you have against whoever is<br />

resp<strong>on</strong>sible for your claim. We regret we cannot accept liability for<br />

any complaints or claims which do not involve death, pers<strong>on</strong>al<br />

injury or illness, if you fail to notify <strong>the</strong> complaint or claim in<br />

accordance with this clause.<br />

9. Special requests <str<strong>on</strong>g>and</str<strong>on</strong>g> medical problems. If you wish to make a<br />

special request, you must do so at <strong>the</strong> time of booking. We will try<br />

to pass any reas<strong>on</strong>able requests <strong>on</strong> to <strong>the</strong> relevant supplier but we<br />

cannot guarantee that requests will be met. The fact that a special<br />

request has been noted <strong>on</strong> your c<strong>on</strong>firmati<strong>on</strong> invoice or any o<strong>the</strong>r<br />

documentati<strong>on</strong> is not c<strong>on</strong>firmati<strong>on</strong> that <strong>the</strong> request will be met.<br />

Failure to meet any special request will not be a breach of c<strong>on</strong>tract<br />

<strong>on</strong> our part unless <strong>the</strong> request has been specifically c<strong>on</strong>firmed.<br />

10. Financial security. In respect of packages sold in<br />

<strong>the</strong> UK <strong>on</strong>ly, The Package Travel, Package Holi<str<strong>on</strong>g>day</str<strong>on</strong>g>s<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> Package Tours Regulati<strong>on</strong>s 1992 require us to<br />

provide security for <strong>the</strong> m<strong>on</strong>ies that you pay for <strong>the</strong><br />

package holi<str<strong>on</strong>g>day</str<strong>on</strong>g>s booked from this brochure/website<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> for your repatriati<strong>on</strong> in <strong>the</strong> event of our insolvency.<br />

We provide this security by way of a b<strong>on</strong>d held by <strong>the</strong> Civil<br />

Aviati<strong>on</strong> Authority under ATOL number 3141. In respect of all<br />

arrangements including flights you will receive a C<strong>on</strong>firmati<strong>on</strong><br />

invoice from us (or via our authorised agent through which you<br />

booked) c<strong>on</strong>firming your arrangements <str<strong>on</strong>g>and</str<strong>on</strong>g> your protecti<strong>on</strong> under<br />

our Air Travel Organiser’s Licence. This means that in respect of all<br />

arrangements including flights, in <strong>the</strong> unlikely event of our<br />

insolvency, <strong>the</strong> CAA will ensure that you are not left str<str<strong>on</strong>g>and</str<strong>on</strong>g>ed<br />

abroad or will arrange to refund any m<strong>on</strong>ey you have paid to us<br />

for an advance booking. For fur<strong>the</strong>r informati<strong>on</strong>, visit <strong>the</strong> ATOL<br />

website at www.atol.org.uk. The price of our flight-inclusive<br />

arrangements includes <strong>the</strong> amount of £1 per pers<strong>on</strong> as part of <strong>the</strong><br />

ATOL Protecti<strong>on</strong> C<strong>on</strong>tributi<strong>on</strong> (APC) we pay to <strong>the</strong> CAA. This<br />

charge is included in our advertised prices.<br />

NOTE: Not all holi<str<strong>on</strong>g>day</str<strong>on</strong>g> or travel services offered <str<strong>on</strong>g>and</str<strong>on</strong>g> sold by us<br />

will be protected by <strong>the</strong> ATOL Scheme. N<strong>on</strong>-flight-inclusive<br />

arrangements are protected by a special account set up by our<br />

bankers <str<strong>on</strong>g>and</str<strong>on</strong>g> held in trust <strong>on</strong> your behalf. N<strong>on</strong>-package<br />

arrangements or arrangements not booked or departing from <strong>the</strong><br />

UK are not protected by <strong>the</strong>se arrangements. Please ask us to<br />

c<strong>on</strong>firm what protecti<strong>on</strong> may apply to your booking.<br />

11. Accuracy of prices <str<strong>on</strong>g>and</str<strong>on</strong>g> o<strong>the</strong>r details. Important note: <strong>the</strong><br />

informati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> prices shown may have changed by <strong>the</strong> time you<br />

come to book your arrangements. Although we make every effort<br />

to ensure <strong>the</strong> accuracy of informati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> prices at <strong>the</strong> time of<br />

publishing, regrettably errors do occasi<strong>on</strong>ally occur. You must<br />
