A Message from the President
April’s Bountiful Harvest!
By Rick Camin, Camin Landscaping
It was such a joy for me to have witnessed Competition from unlicensed operators,
the recent accomplishments of three hard similar to the water issue that has
working chapter board members. The seeds challenged our industry for many decades,
of their accomplishments were planted long has been a thorn in the side for many
ago, but the fruits of their labors came this members. It is perhaps the most sensitive
past April as a benefit to be shared by all topic among members. I have personally
members. These selfless individuals all witnessed many heated debates over this
possess a unique passion toward a certain topic. Some members think fighting the
cause that I highly respect and admire. unlicensed operator cause should be
On April 24th, I helped with the CLCA CLCA's top priority while others feel that
booth at the “Slow the Flow” event at resources would be better spent elsewhere
Foothill College. This event was designed to because the fight against unlicensed
educate the public on water conservation. operators is futile. We are very proud and
Our own Frank Niccoli was one of the fortunate to have Kevin Burns representing
speakers. It was at this event that I thought our chapter for the past few years in
to myself how Frank really nailed it on how spearheading the fight against unlicensed
important water conservation is to our operators. Kevin has been instrumental in
industry and future. I can hear you say, “Of developing a closer relationship and
course it is, we have been in a drought for working with the Contractors State License
the past couple of years.” However, it was Board in the fight against unlicensed
Frank who recognized the importance of operatorss.
water conservation long before our last
On April 19th, Kevin and fellow CLCA
drought hit. I remember him telling us members Catherine Greer, Jim Link,
repeatedly at board meetings years ago that Michael and Kim Gladden, Bill Buchin and
when the drought finally does come, “Be Bob and Grace Kirtley picketed outside the
ready!” Not only did Frank issue a stern San Mateo Courthouse during a case heard
warning for all to hear, he contributed an inside the courthouse of an unlicensed
enormous amount of time preparing CLCA operator taking advantage of an elderly
members to “be ready” and positioned for man to the tune of $114,000. It just so
the drought. As director of the CLCA State happened a local news station was covering
Resource Management Committee, his the story and talked with Kevin. He spoke
dynamic committee developed and
on camera about the impact of unlicensed
and educating the public while increasing Kevin did a great job on camera. I was
sales within their own company. The “Slow proud of him and all the members who
the Flow” event, in my opinion, was a represented CLCA that day. Everyone on
celebration of Frank’s hard work and his the board knows how hard Kevin has been
selfless commitment to educate members working to protect our industry against
and the public on the importance of water unlicensed operators, so it was a thrill to
conservation. Kudos Frank!
watch Kevin speak on television and
deliver our message to a broad local
audience. Great job Kevin on your ten
seconds of fame!
To say April was a busy month for
James Walker is a huge understatement
considering what he accomplished for our
chapter. Not only did James do a fabulous
job hosting and organizing Membership
Night on April 15th, but he also put
together a great Chapter Project Design
Competition that involved contractors,
designers and Foothill College horticulture
students. The students’ assignment was to
design the upcoming Chapter Project using
CLCA contractors and APLD designers as
their mentors. As our Student Liaison,
James has been planning for a long time to
have contractors interact more with Foothill
College students enrolled in the horticulture
department. The competition was a great
success. As I sat at the lunch barbeque on
April 7, where they announced the top
three winners of the competition, I was very
proud of James. He really pulled it off with
great help from Brandon Stewart, Foothill
College student, and Dave Sauter, Foothill
College professor. I had the pleasure of
participating in the competition and heard
nothing but overwhelmingly positive
feedback from everyone involved. All the
designs submitted were incredible and
proudly displayed at Membership
Night where the top three winners were
announced to the attending members.
Fantastic job James!
As you just read, last April was an
incredible and successful month for our
chapter. I can't recall a more enjoyable and
productive time in all the years I have been
a board member. Although the seeds were
planted long ago, April produced a great
harvest for our chapter thanks to the
exceptionally hard work of Frank, Kevin
and James.
I'm sure you have a strong passion
regarding a certain facet in our industry.
Please come to our next board meeting and
share your ideas. Plant the seeds for our
next bountiful harvest.
Education Sustainable Brown Bag
Lunch Style... with a SMaRT Twist.
By Nate Crosby of Crosby Landscaping, CLCA-SFBA Chapter treasurer and education chairperson
On Tuesday, May 4, we had another
educational Brown Bag Lunch (BBL) at the
SMaRT Transfer Station in Sunnyvale, CA.
So, we had to let the 25 tour goers eat
before this event, but, it was well worth the
settled bellies. The SMaRT Transfer Station
is where the trash from the residents and
businesses located within the cities of
Sunnyvale, Mountain View, and Palo Alto
gets sorted and then sent out for recycling,
reuse, or to the landfill.
So what does this have to do with the
CLCA and landscaping Well, quite a bit. In
addition to processing regular trash,
they also shred all yard waste and
return it to the community for use
in their gardens as mulch or
compost. The facility even recycles
PVC and HDPE materials. In spite
of all the facility does in 2-3 hours
of sorting to limit the amount going
to the landfill, they still haul more
than 60,000 tons or refuse a year to
the Morgan Hill area to sit in the
land of “away and forgotten.”
Chapter members really enjoyed the
tour. Jeff Sheehan of Confidence
Landscaping mentioned that, “…seeing this
makes the separation of waste materials
that much more worthwhile… we need to
do more…everyone needs to understand
the impact each of us have with our
‘throwaway’ mentality.” Rick Camin of
Camin Landscaping stated, “This was an
excellent CLCA chapter event. The SMaRT
station is a very efficient operation.” Julie
Orr of Julie Orr Designs enjoyed the tour so
much that she even provided the photos.
We had great attendance for this BBL.
Deva Luna of EarthCare Landscaping
invented the concept of having monthly
BBL’s. Thank you Deva for all you do for
the committee and sustainability!
I’d like to thank another very special
person on the CLCA-SFBA chapter’s
education committee: Heidi Johnson of
HKJohnson & Associates. She did a
fantastic job selecting and setting up this
asset to the education committee. She has
successfully planned out most, if not all, of
the BBL’s for the past year. Thanks Heidi!
Keep in mind that the education
committee is continuing BBL’s, at noon, on
the first Tuesday of each month. Subjects
include networking and venues that
educate all of us in some aspect of
‘sustainability’ of our professional and
personal lives. You can find updates to the
CLCA-SFBA chapter website calendar or e-
vite invitations about the next sustainable
BBL. See you then!
views regarding ways that California can
dig out of the hole we’re in. After lunch it
was off to the Capitol.
Catherine met with Peter Hartnett,
Legislative Director in the office of
Assembly Member Ira Ruskin (21st
Assembly District) and I met with
Assembly Member Jerry Hill (19th District).
We were both scheduled to meet with
Senator Leland Yee but schedules were very
tight and the Senator’s previous meeting
ran long so I had to leave the Senator’s
office in order to keep my meeting with
Assembly Member Hill. But it all worked
out well and we were able to meet with
Above: Kevin Burns,
Catherine Greer and
Assembly Member
Jerry Hill.
At right: David Fogt
and Steve Sands
(CSLB) being
introduced by Sam
Abdulaziz.
them all. We were provided the opportunity
to present our issue papers, state our case
and found our positions were met with
agreement across the board.
We covered many issues from contract
requirements that materials not be
produced in sweatshops to a proposal to
withhold 3% of all subcontractor payments
to cover state income tax, to a bill that
Above: Catherine Greer and Senator
Leland Yee.
proposes repealing Mechanics Lien rights.
Most important to us was a bill introduced
by Senator Mark Leno (Senate District 3).
SB1254 authorizes the Registrar of
Contractors to issue a stop order to any
licensed or unlicensed contractor who as an
employer has failed to secure workers’
compensation insurance coverage for his or
her employees. As we left the Capital we
felt gratified that our voice was heard and
felt we received support for issues
important to us. And, our legislators
thanked us for taking the time to help them
to understand why these issues are
important.
Earlier in the week, Catherine and I
worked with other SF Bay Area CLCA
contractors to bring public awareness to the
underground economy and how unlicensed
operatorss adversely affect our
communities. Focusing on tax evasion and
how that equates to diminishing vital
services -- public schools, police and fire
protection, emergency medical response,
etc. -- we staged a civil protest in South San
Francisco at the San Mateo County Superior
Court Northern Branch.We were there
because a case involving a convicted
unlicensed operator who victimized a
retired Hillsborough resident was
scheduled for a restitution hearing that was
being covered by ABC 7 On Your Side.
Michael Finney’s coverage included footage
of Michael Gladden, McClintock Landscape
Corp., who works as an industry expert for
the Contractors State License Board who
was instrumental in securing an agreement
for the defendant, Ediberto Heredia, to pay
the homeowner, Gordon Curry, $114,800.00
in restitution over the next three years.
Great job Michael! Check out:
http://abclocal.go.com/kgo/storysection=
news/7_on_your_side&id=7394802.
The reporter shooting the footage, Randall
Yip, had just enough time to stop and talk
to us on the courthouse steps and the 7 On
Your Side piece included footage of our
groups protest with my explanation that the
underground economy in California is $140
Billion Dollars of untaxed revenue which is
estimated at $6.5 Billion Dollars in
uncollected tax revenue. This news was
broadcast on ABC’s six o’clock news and
hopefully received plenty of notice. Now
we’re energized. We’ve got some great signs
made up and plans for similar events where
news coverage may be possible.
Now is an unbelievably good time to get
involved. Your participation can make a
huge difference to help level the playing
field for legitimate licensed contractors.
Please give me a call (650) 343-0011 to find
out how you can be part of the solution. It
does require a bit of work but the payoff is
unbelievably gratifying. And more hands
make less work. We learn a lot from each
other as we work together and actually
have a lot of fun in the process. Get
involved. You’ll be glad you did.
Opportunity Knocks!
Chapter Seeking Awards Chair.
By Bob Kirtley, 2010 Awards Chairperson
After several years as SFBA Chapter Awards Chairperson, I will
be stepping down next year. I encourage anyone who is interested
in taking on this great event to talk to me at the banquet about
joining the committee and seeing what a wonderful group of
contractors and vendors we work with to produce this show every
year. I will make myself available to guide you through this
process and make it as simple as possible. This is truly a great
experience!
I would also like to hear from anyone who is interested in
discussing their thoughts on how to make the awards program
better. We would like to have a general discussion session
sometime in late June or early July to “brainstorm” ideas to
improve this program. I invite one and all to this free and open
exchange of your ideas. That’s what makes our chapter one of the
best in the state!! Watch for details.
Slow the Flow: Connecting CLCA
Water Managers with the Community
By Nate Crosby of Crosby Landscaping, CLCA-SFBA Chapter Treasurer and Education Chairperson
On Saturday, April 24th, 2010, The Foothill
College Horticultural Department and the
many motivated students put on a 1-day
conference for their community. Over 180
residents attended the seminars with many
great and knowledgeable industry leading
speakers including CLCA members Frank
Niccoli, Peter Estournes, and Tom Bressan.
Attendees used the day to learn more about
subjects including irrigation, rainwater
harvesting, sustainable landscaping, and
lawn conversions.
Thank you to Rick Camin of Camin
Landscaping, Frank Niccoli of the Village
Gardener, Sean Garrone of Green Shelter
Landscaping, and Peter Estournes of
Gardenworks Inc. for ‘manning’ the CLCA
booth. It was great to see the CLCA
supporting this well attended Foothill
College community outreach event. I felt
very welcome in our booth, as we were
nestled in next to the booths of some of our
regular and associate CLCA members. The
CLCA booth was fantastic! We had the right
resources providing attendees with
information on CLCA’s Water Management
Certification program and a list of certified
water managers, so that attendees could
find a contractor best suited to their water
management needs.
I was pleasantly encouraged that
attendees wanted to hire certified water
managers. Despite the fact that local
reservoirs are refilling, people are still
concerned about water conservation.
Thank you to the Foothill College
Horticultural Department staff and its
students including: David Sauter, Dan
Svenson, and Mike Diefenbach for making
this a great day.
Above: Frank Niccoli and Peter Estournes at the
Slow the Flow event, are happy to get the word
out to the public: CLCA Water Managers save
you water!
