Landscaping represented the SF <strong>Bay</strong> <strong>Area</strong><br />

<strong>Chapter</strong> <strong>CLCA</strong> at the 2010 “Day At The<br />

Capitol” arranged by the Construction<br />

Industry Legislative Council (CILC). The<br />

event was preceded by <strong>CLCA</strong>’s Grass Roots<br />

Training Day, an annual event coordinated<br />

by <strong>CLCA</strong>’s Legislative Committee and staff.<br />

These events are held each year to help<br />

train members new to California’s political<br />

process on how to to meet with their<br />

respective Assembly Members and State<br />

Senators to seek support or opposition to<br />

bills currently being considered.<br />

The Grass Roots Training began Tuesday<br />

afternoon, April 20. Larry Rohlfes and Shari<br />

Collins, <strong>CLCA</strong> Director of Legislation,<br />

welcomed us and explained the goals of<br />

A Message from the President<br />

April’s Bountiful Harvest!<br />

It was such a joy for me to have witnessed Competition from unlicensed operators,<br />

To say April was a busy month for<br />

James Walker is a huge understatement<br />

considering what he accomplished for our<br />

chapter. Not only did James do a fabulous<br />

job hosting and organizing Membership<br />

Night on April 15th, but he also put<br />

together a great <strong>Chapter</strong> Project Design<br />

Competition that involved contractors,<br />

designers and Foothill College horticulture<br />

students. The students’ assignment was to<br />

design the upcoming <strong>Chapter</strong> Project using<br />

<strong>CLCA</strong> contractors and APLD designers as<br />

their mentors. As our Student Liaison,<br />

James has been planning for a long time to<br />

have contractors interact more with Foothill<br />

College students enrolled in the horticulture<br />

department. The competition was a great<br />

success. As I sat at the lunch barbeque on<br />

April 7, where they announced the top<br />

three winners of the competition, I was very<br />

proud of James. He really pulled it off with<br />

great help from Brandon Stewart, Foothill<br />

College student, and Dave Sauter, Foothill<br />

College professor. I had the pleasure of<br />

participating in the competition and heard<br />

nothing but overwhelmingly positive<br />

feedback from everyone involved. All the<br />

designs submitted were incredible and<br />

proudly displayed at Membership<br />

Night where the top three winners were<br />

announced to the attending members.<br />

Fantastic job James!<br />

As you just read, last April was an<br />

incredible and successful month for our<br />

chapter. I can't recall a more enjoyable and<br />

productive time in all the years I have been<br />

a board member. Although the seeds were<br />

planted long ago, April produced a great<br />

harvest for our chapter thanks to the<br />

exceptionally hard work of Frank, Kevin<br />

and James.<br />

I'm sure you have a strong passion<br />

regarding a certain facet in our industry.<br />

Please come to our next board meeting and<br />

share your ideas. Plant the seeds for our<br />

next bountiful harvest.<br />

Education Sustainable Brown Bag<br />

Lunch Style... with a SMaRT Twist.<br />

By Nate Crosby of Crosby Landscaping, <strong>CLCA</strong>-SFBA <strong>Chapter</strong> treasurer and education chairperson<br />

On Tuesday, May 4, we had another<br />

educational Brown Bag Lunch (BBL) at the<br />

SMaRT Transfer Station in Sunnyvale, CA.<br />

So, we had to let the 25 tour goers eat<br />

before this event, but, it was well worth the<br />

settled bellies. The SMaRT Transfer Station<br />

is where the trash from the residents and<br />

businesses located within the cities of<br />

Sunnyvale, Mountain View, and Palo Alto<br />

gets sorted and then sent out for recycling,<br />

reuse, or to the landfill.<br />

So what does this have to do with the<br />

<strong>CLCA</strong> and landscaping Well, quite a bit. In<br />

addition to processing regular trash,<br />

they also shred all yard waste and<br />

return it to the community for use<br />

in their gardens as mulch or<br />

compost. The facility even recycles<br />

PVC and HDPE materials. In spite<br />

of all the facility does in 2-3 hours<br />

of sorting to limit the amount going<br />

to the landfill, they still haul more<br />

than 60,000 tons or refuse a year to<br />

the Morgan Hill area to sit in the<br />

land of “away and forgotten.”<br />

<strong>Chapter</strong> members really enjoyed the<br />

tour. Jeff Sheehan of Confidence<br />

Landscaping mentioned that, “…seeing this<br />

makes the separation of waste materials<br />

that much more worthwhile… we need to<br />

do more…everyone needs to understand<br />

the impact each of us have with our<br />

‘throwaway’ mentality.” Rick Camin of<br />

Camin Landscaping stated, “This was an<br />

excellent <strong>CLCA</strong> chapter event. The SMaRT<br />

station is a very efficient operation.” Julie<br />

Orr of Julie Orr Designs enjoyed the tour so<br />

much that she even provided the photos.<br />

We had great attendance for this BBL.<br />

Deva Luna of EarthCare Landscaping<br />

invented the concept of having monthly<br />

BBL’s. Thank you Deva for all you do for<br />

the committee and sustainability!<br />

I’d like to thank another very special<br />

person on the <strong>CLCA</strong>-SFBA chapter’s<br />

education committee: Heidi Johnson of<br />

HKJohnson & Associates. She did a<br />

tour. Heidi is an amazing person and a real<br />

asset to the education committee. She has<br />

successfully planned out most, if not all, of<br />

the BBL’s for the past year. Thanks Heidi!<br />

Keep in mind that the education<br />

committee is continuing BBL’s, at noon, on<br />

the first Tuesday of each month. Subjects<br />

include networking and venues that<br />

educate all of us in some aspect of<br />

‘sustainability’ of our professional and<br />

personal lives. You can find updates to the<br />

Girvin Peters! Two months in a row now<br />

Girvin is the winner. The raffles are not<br />

rigged. Trust me. Girvin is just a lucky<br />

state budget cuts, the College of <strong>San</strong><br />

Beauséjour Restaurant Francais in Los<br />

Altos. We had 13 members in attendance<br />

and had a lively discussion about all sorts<br />

of things. Thank you Millie Crosby for<br />

signing up as our Holiday Party chair. We<br />

discussed some interesting new ideas for<br />

the holiday party and hopefully, I will<br />

have a report on the event next month.<br />

2010 Elections and responsible budget<br />

reform. After a break, <strong>CLCA</strong>’s Lobbyist<br />

Parke Terry provided a legislative<br />

overview and went over the <strong>CLCA</strong> Issue<br />

Papers we would discuss the next day with<br />

our legislators. We wrapped up the day<br />

with two California State Assembly<br />

Members, The Honorable Connie Conway<br />

(34th Assembly District) and The<br />

Honorable Bill Emmerson (63rd Assembly<br />

District).<br />

The CILC “Day At The Capitol”, held<br />

Wednesday, April 21, started early in the<br />

Sacramento Convention Center. Assembly<br />

Member Roger Niello (5th Assembly<br />

District) discussed 21st Century Sales & Use<br />

Tax while other issues were covered by<br />

Attorney Bill Porter and Sam Abdulaziz.<br />

Issues regarding licensing laws and the<br />

underground economy were covered by<br />

Steve <strong>San</strong>ds, Mike Brown and David Fogt<br />

from the Contractors State License Board.<br />

Our lunchtime Keynote Speaker, Ward<br />

Connerly, a political activist and former<br />

University of Califormia Regent, shared his<br />

views regarding ways that California can<br />

dig out of the hole we’re in. After lunch it<br />

was off to the Capitol.<br />

Catherine met with Peter Hartnett,<br />

Legislative Director in the office of<br />

Assembly Member Ira Ruskin (21st<br />

Assembly District) and I met with<br />

Assembly Member Jerry Hill (19th District).<br />

We were both scheduled to meet with<br />

Senator Leland Yee but schedules were very<br />

tight and the Senator’s previous meeting<br />

ran long so I had to leave the Senator’s<br />

office in order to keep my meeting with<br />

Assembly Member Hill. But it all worked<br />

out well and we were able to meet with<br />

them all. We were provided the opportunity<br />

to present our issue papers, state our case<br />

and found our positions were met with<br />

agreement across the board.<br />

We covered many issues from contract<br />

requirements that materials not be<br />

produced in sweatshops to a proposal to<br />

withhold 3% of all subcontractor payments<br />

to cover state income tax, to a bill that<br />

proposes repealing Mechanics Lien rights.<br />

Most important to us was a bill introduced<br />

by Senator Mark Leno (Senate District 3).<br />

SB1254 authorizes the Registrar of<br />

Contractors to issue a stop order to any<br />

licensed or unlicensed contractor who as an<br />

employer has failed to secure workers’<br />

compensation insurance coverage for his or<br />

her employees. As we left the Capital we<br />

felt gratified that our voice was heard and<br />

felt we received support for issues<br />

important to us. And, our legislators<br />

thanked us for taking the time to help them<br />

to understand why these issues are<br />

important.<br />

Earlier in the week, Catherine and I<br />

worked with other SF <strong>Bay</strong> <strong>Area</strong> <strong>CLCA</strong><br />

contractors to bring public awareness to the<br />

underground economy and how unlicensed<br />

operatorss adversely affect our<br />

communities. Focusing on tax evasion and<br />

how that equates to diminishing vital<br />

services -- public schools, police and fire<br />

protection, emergency medical response,<br />

etc. -- we staged a civil protest in South <strong>San</strong><br />

<strong>Francisco</strong> at the <strong>San</strong> Mateo County Superior<br />

Court Northern Branch.We were there<br />

because a case involving a convicted<br />

unlicensed operator who victimized a<br />

retired Hillsborough resident was<br />

scheduled for a restitution hearing that was<br />

being covered by ABC 7 On Your Side.<br />

Michael Finney’s coverage included footage<br />

of Michael Gladden, McClintock Landscape<br />

Corp., who works as an industry expert for<br />

the Contractors State License Board who<br />

was instrumental in securing an agreement<br />

for the defendant, Ediberto Heredia, to pay<br />

the homeowner, Gordon Curry, $114,800.00<br />

in restitution over the next three years.<br />

Yip, had just enough time to stop and talk<br />

to us on the courthouse steps and the 7 On<br />

Your Side piece included footage of our<br />

groups protest with my explanation that the<br />

underground economy in California is $140<br />

Billion Dollars of untaxed revenue which is<br />

estimated at $6.5 Billion Dollars in<br />

uncollected tax revenue. This news was<br />

broadcast on ABC’s six o’clock news and<br />

hopefully received plenty of notice. Now<br />

we’re energized. We’ve got some great signs<br />

made up and plans for similar events where<br />

news coverage may be possible.<br />

Now is an unbelievably good time to get<br />

involved. Your participation can make a<br />

huge difference to help level the playing<br />

field for legitimate licensed contractors.<br />

<strong>Chapter</strong> Seeking Awards Chair.<br />

After several years as SFBA <strong>Chapter</strong> Awards Chairperson, I will<br />

be stepping down next year. I encourage anyone who is interested<br />

in taking on this great event to talk to me at the banquet about<br />

joining the committee and seeing what a wonderful group of<br />

contractors and vendors we work with to produce this show every<br />

year. I will make myself available to guide you through this<br />

process and make it as simple as possible. This is truly a great<br />

experience!<br />

I would also like to hear from anyone who is interested in<br />

discussing their thoughts on how to make the awards program<br />

better. We would like to have a general discussion session<br />

sometime in late <strong>June</strong> or early July to “brainstorm” ideas to<br />

improve this program. I invite one and all to this free and open<br />

exchange of your ideas. That’s what makes our chapter one of the<br />

Slow the Flow: Connecting <strong>CLCA</strong><br />

Water Managers with the Community<br />

On Saturday, April 24th, 2010, The Foothill<br />

College Horticultural Department and the<br />

many motivated students put on a 1-day<br />

conference for their community. Over 180<br />

residents attended the seminars with many<br />

great and knowledgeable industry leading<br />

speakers including <strong>CLCA</strong> members Frank<br />

Niccoli, Peter Estournes, and Tom Bressan.<br />

Attendees used the day to learn more about<br />

subjects including irrigation, rainwater<br />

harvesting, sustainable landscaping, and<br />

lawn conversions.<br />

Gardener, Sean Garrone of Green Shelter<br />

Landscaping, and Peter Estournes of<br />

Gardenworks Inc. for ‘manning’ the <strong>CLCA</strong><br />

booth. It was great to see the <strong>CLCA</strong><br />

supporting this well attended Foothill<br />

College community outreach event. I felt<br />

very welcome in our booth, as we were<br />

nestled in next to the booths of some of our<br />

regular and associate <strong>CLCA</strong> members. The<br />

<strong>CLCA</strong> booth was fantastic! We had the right<br />

resources providing attendees with<br />

information on <strong>CLCA</strong>’s Water Management<br />

Certification program and a list of certified<br />

water managers, so that attendees could<br />

find a contractor best suited to their water<br />

management needs.<br />

I was pleasantly encouraged that<br />

attendees wanted to hire certified water<br />

managers. Despite the fact that local<br />

reservoirs are refilling, people are still<br />

concerned about water conservation.<br />

Horticultural Department staff and its<br />

students including: David Sauter, Dan<br />

Svenson, and Mike Diefenbach for making<br />

this a great day.<br />
